Dear Steve:
This letter is to confirm that the final plats for the Costello Drive (Garber Trust) Subdivision were
administratively approved on. August 27, 1999. The Subdivision Design Plans were approved on the
same date, Please ensure that this office receives copies of the final plats once they have been recorded.
The approval of lots 3 through 9 completes this subdivision. Lots 1 and 2, and the dedication of Costello
Drive, had previously been accomplished with the initial subdivision of the Garber Estate in 1995,
1'rederick County currently holds a bond in the amount of $600,000.00 for the completion of the
improvements associated with the Costello Drive Subdivision, This is primarily for the completion of
Costello Drive.

This letter is to confirm that the final plats for the Costello Drive (Garber Trust) Subdivision were
administratively approved on. August 27, 1999. The Subdivision Design Plans were approved on the
same date. Please ensure that this office receives copies of the final plats once they have been recorded.
The approval of lots 3 through 9 completes this subdivision. Lots 1 and 2, and the dedication of Costello
Drive, had previously been accomplished with the initial subdivision of the Garber Estate in 1995.
Frederick County currently holds a bond in the amount of $600,000.00 for the completion of the
improvements associated with the Costello Drive Subdivision. This is primarily for the completion of
Costello Drive.

Upon review of the revised subdivision plan dated July 28, 1999, we offer the
following comments:
1. Provide a detail and supporting calculations for the proposed level spreader and
stilling basin at the outfall of the proposed stormwater detention basin.
2. The attached final plat of the subdivision needs to include all the drainage
easements located within the subdivision. In addition, the outfall culvert for the
proposed stormwater pond shall be placed in a drainage easement. There is an
existing drainage easement that can be vacated and moved to accommodate the
proposed pipe.
Once these comments have been addressed, submit two (2) copies of the subdivision
plan for further review. If you have any questions, do not hesitate to contact me.

for Costello Drive", made by G. W. Clifford & Associates, Inc., dated May 28, 1999, and as approved
by Frederick County, Virginia.
A statement signed by the Subdivision Administrator or his representative that: "The drawing is for the
explicit purpose of providing for the completion or maintenance of a required facility or function
pursuant to the requirements of Chapter 144, Frederick County Code, Subdivision Ordinance and
pursuant to the agreement of the Subdivider, Developer, or his agent to comply with said Ordinance
as a condition of the approval of the subdivision to the satisfaction of the Subdivision Administrator."
We hereby engage with drawers, endorsers and bona fide holders that all drafts drawn in compliance

documents. This Irrevocable Letter of Credit shall remain in full force and effect for a minimum of one

months from the present or future expiration dates, unless sixty (60) days prior to such date or dates,
the above name Bank or financial institution issuing the instrument, notifies the County in writing by
certified mail, that they elect not to renew the instrument for such additional period. During the last
thirty (30) days while this Letter of Credit is in force and effect after notice of termination has been
given, the County may draw up to the full amount of the sum when accompanied by a document
stating that Alma G. Biggs, Patricia G. Biggs and Joan M. Garber, Trustees of the Nora Garber Trust
have failed to provide an acceptable substitute Irrevocable Letter of Credit or deposit in escrow, and a
document stating that "The drawing will be held by the County for the sole purpose of providing for
the completion and/or maintenance of the subdivision requirements to the satisfaction of the
Subdivision Administrator or his authorized representative."
This Credit shall be terminated upon the Subdivision Administrator or his authorized representative
giving written release to Alma G. Biggs, Patricia G. Biggs, and Joan M. Garber, Trustees of the Nora
Garber Trust stating that they have satisfactorily performed and fulfilled the obligations and
requirements of the subject subdivision.

Dear Steve:
I have had the opportunity to review the above referenced subdivision design plan. The following
comments should be addressed accordingly prior to re -submission of the subdivision plan. In addition,
any changes should be reflected on the final plats prepared for this subdivision. I have also provided a
marked copy of the subdivision design plan for your use.
1) Please revise the title, original P.I.N., page numbering, and vicinity map as marked.
2) Please provide the current names of owners, zoning, and use of all adjoining properties, and deed
book and page number references for each adjoining parcel. This includes parcels located across
the Route 522 right-of-way.
3) Please provide a table that depicts the area of each lot and parcel, the total area of the
subdivision, and the total area in lots. This should be included in the project summary/general
notes summary.
4) Please provide the name of a contact person for the Garber Trust. In addition, please provide a
space that includes the signature of the owner or principles certifying ownership of the property.
5) Please ensure that the shared private driveways are covered by some form of joint access
easement. Also, please provide a temporary turnaround easement on proposed lot #9 and note
the existing temporary turnaround easement.
6) Please ensure that the minimum 150' entrance spacing requirement is met. It would appear as
though the entrance to proposed lot #3 should be adjusted slightly to accommodate this
requirement, as should the entrances to the east of the plan. In reconfiguring the entrances, I
would encourage you to consider aligning an entrance directly across from the existing rear
driveway to the Costco facility.

7) Please revise the plan and details as they pertain to the required sidewalk. A grass utility strip
should be provided between the edge of the road and the sidewalk. In addition, the sidewalk
should be extended over the frontage of existing lot #2 to a handicap ramp/curb cut as marked
on lot #1. It should also extend to the eastern limits of the property being subdivided upon
removal of the temporary cul-de-sac. A note to that effect should be included on the plan and
an appropriate guarantee should be provided for its completion.
8) Please provide a note on the plan ensuring that all utilities serving this subdivision are to be
located underground.
9) Please label the individual setback lines shown on the subdivision plan as they apply to the
proposed lots.
10) Please show the required buffers and screening with design details. The approved Garber Master
Development Plan depicts an "A" category buffer adjacent to the vacant B3-zoned land to the
southeast of your subdivision.
11) Please remove the site plan approval block and provide a subdivision approval block for the
Subdivision Administrator.
In order to approve the final subdivision plan, the above comments must be addressed and I will need
all approved review agency comment sheets. Approval of the subdivision plan will then enable us to
approve the final plats. Please forward the revised final plats for my review. Once again, you should
ensure that the information contained on the final plats accurately reflects the final subdivision plan. I
will also need the necessary guarantee bonds sufficient to cover all improvements, and information
pertaining to the establishment of property owners association prior to approving the final plats.

A VDOT review has been completed on the preliminary plan dated June 3, 1999 for the
referenced project. Our comments are as follows and as shown in red on the plan
sheets.
Sheet 2 of 10
1. Costello Drive should be shown as a private road.
2. The station identifications at P.C.'s and P.T.'s should be placed out of congested
areas. (They cannot be read as presently displayed.)
3. An earlier, approved plan dated April 23, 1996 as designed by Greenway
Engineering (copy attached) had the storm sewer located at/near back of curb on
the south side of Costello Drive. The storm sewer should be located as approved.

4. These potential conflicts between utilities and storm sewer should be cleared as part
of this site plan review. A minimum 18" clearance should be maintained between
storm sewer and 8" water main.

5. The typical section pavement structure should match the existing road, especially as
to removal of unsuitable material. The unsuitable material areas should be
backfilled with OGB. The OGB in the existing road has as much as 36" of OGB in
place. This plan typical section should address that issue.

RE: Subdivision Application - Garber Trust
Dear Steve:
This office recently received the above referenced subdivision application. The application is missing the
required application fee and, therefore, can not be accepted at this time. Upon receipt of an application
fee of $1,430.00 we will be able to accept the application and initiate our review.
Your letter oftransmittal that accompanied the subdivision application noted that the Garber Trust does
not believe they should pay the subdivision review fee. It is their belief that they submitted a review fee
at the time Price Club was developed and should not have to pay again. In review of the original
subdivision, it is evident that the applicant paid a review fee of $390.00 for a four -lot subdivision. This
qualified as a minor subdivision. This most recent subdivision application is a seven -lot subdivision of
one of the lots created by the Price Club subdivision. Therefore, this non residential subdivision should
be accompanied by an application fee in the amount of $1,430.00 ($800.00 plus $90 x 7 lots). In
addition, this subdivision contains road plans for the extension of Costello Drive.
