These covenants are to run with the land and
shall be binding on all parties and all persons claiming under
them for a period of twenty-five years from the date these
covenants are recorded, after which time said covenants shall
be automically extended for successive periods of 10 years
unless an instrument signed by a majority of the then owners of
the lots has been recorded, agreeing to change said covenants
in whole or in part.
Enforcement shall be by proceedings at law or in
equity against any person or persons violating or attempting to
violate any covenant either to restrain violation or to recover
damages.
Invalidation of any one of these covenants by
judgment or court order shall in no wise affect any of the other
provisions which shall remain in full force and effect.

single family dwelling, and a private garage for not more than
three (3),cars. No structure of a temporary character, trailer,
basement, tent, shack, garage, barn or other buildings shall
be used on any lot at any time as a residence either temporarily
or permanently.
(2) No building shall be erected on any lot
nearer than fifty (50) feet to the front lot line excluding
porches, stoops, verandas and bay windows, nor nearer than ten
(10) feet to a side property line thereof but may be erected as
near to the rear property line as the owners of the lot desire.
(3) No dwelling shall be permitted on any lot
at a cost of less than Twelve Thousand Dollars ($12,000.00)
based upon cost levels prevailing on the datethese covenants
are recorded.
(4) No residence shall be erected on any lot
having a foundation area of less than 1000 square feet-
(5) No Noxious or offensive activity shall be
carried on upon any lot nor shall anything be done thereon which
may be or become an annoyance or nuisance to the neighborhood.
No poultry or livestock shall be housed, kept or maintained on
said lot.
(6) Each and every lot shall be kept mown and
free from weeds and debris at all times to comply with city and
county ordinances.
(7) In order to provide for amply off street
parking each lot of land shall have a driveway of at least ten
(10) feet in width leading from the front property line and
extending at least forty (40) feet onto the said lot.

THIS DEED made and dated this day of July,
1973, by and between Charles E. Cooper and Betty T. Cooper,
his wife, of the one part, hereinafter called the Grantors, and
Lynn W. Clem and Doris M. Clem, his wife, of the other part,
hereinafter called the Grantees.
WITNESSETH: That for and in consideration of
the sum of Ten ($10.00) Dollars, and other valuable considera-
tion, receipt whereof is hereby acknowledged, the Grantors do
hereby grant and convey with general warranty and English
covenants of title, unto the Grantees, as tenants by the
entirety, with the right of survivorship, as at common law,
all that certain tract or parcel of land lying and being
situate in Stonewall Magisterial District, Frederick County,
Virginia, on the South side of Virginia State Highway No. 663
and designated on the plat attached hereto and as a part
hereof as Lot No. 3 containing 0.59 acres, to which plat
reference is made for a more particular description. This is
a portion of the same property conveyed to Charles E. Cooper,
et ux, by Deed from G. Grover Teets, Jr., et als, dated
December 21, 1970, of record in the Clerk's Office of the
Circuit Court of Frederick County, Virginia, in Deed Book 372,
page 378.
This conveyance is made subject to the rights
of way and easements of record, if any, affecting said realty,
and also to the following restrictions which are constituted
covenants real running with the land:
(1) No lot shall be used except for
residential purposes. No building shall be erected, altered,
placed or permitted to remain on any lot other than one detached
