At the request of Dave Holliday (Shiho, Inc.), I contacted Robert Watkins, Director of
Frederick County Planning and Zoning Department, regarding the first take -down plat for
Carriebrooke (former Tom Perry property). The purpose of the discussion was to inquire
whether or not administrative approval would be required on the plat. Mr. Watkins stated
that subdivision law requires that the creation of any new lot (property) lines in any areas
which are zoned anything except A-1 or A-2 requires the submission of a Master
Development Plan to the County Planning Commission for approval (note that a portion of
the referenced property is zoned B-2). After MDP approval, the "Developer" can
"subdivide" the property without having to go before the County Board of Supervisors;
however, the "Developer" can request a waiver for the MDP requirement. This waiver
request must be approved by both the County Planning Commission and the County Board of
Supervisors.
Mr. Watkins will be leaving his office this afternoon at 4:00 pm and will not be returning
until Monday morning, March 27. He will be available at that time for consultation if
necessary.
