Darlington and Ruby S. Darlington, his wife. WITNESSETH: WHEREAS, the said J. P. Darlington and Ruby S. Darlington are the owners, in fee simple, of real property hereinafter described and situate in Stonewall Magisterial District, Frederick County, Virginia, and desire to subdivide the same as a subdivision known as "Carrollton" as shown on the plats and survey dated March 12, 1976, prepared by J. R. Nicely, Certified Land Surveyor, which survey and plats of all lots are attached hereto and made a part hereof and is to be recorded herewith. NOW, THEREFORE, for and in consideration of the premises the said owners do hereby subdivide all that certain tract of land lying and being situate in Stonewall Magisterial District, Frederick County, Virginia, more particularly described by the aforesaid survey and plats; and being a portion of the same property conveyed to J. P. Darlington by Deed of H. George White, Jr., et ux, dated August 18, 1975, of record in the Clerk's Office of the Circuit Court of Frederick County, Virginia, in Deed Book 448, Page 107. The lots or tracts of land in this Subdivision are subject to certain restrictions which are to constitute cove- nants to run with the land and shall be binding on all parties and persons claiming under them, and for the benefit of and limitations upon all future owners in said Subdivision and are more particularly set forth as follows: 187 LAAOiRT. No building shall be erected on said lots within 75 feet ofthe front property line or 15 feet of the side property lines. 2. Nothing but a single private dwelling or residence 'designed for the occupancy of one family shall be erected on any of the lots in the Subdivision and the exterior of any such dwelling shall not be constructed of concrete unless the same is stuccoed. 3. No dwelling to be erected or maintained on said -lots to have a. ground floor space of less than 800 square.feet for a one story building or less than 600 square feet for the first floor and 400 square feet for the second floor of a dwelling of more than one story exclusive of any portion thereof used for a garage or an outside porch. 4. No lot shall be re -subdivided into building lots other than those shown on the recorded plat, except that*a lot may be re -subdivided to form a portion of adjoining lots. S. All lots shall be kept clean at all times and free from junk, rubbish, garbage and other noxious matter. 6. No sign of any kind shall be displayed to the public view on any lot except one professional sign of not more. than one square foot - one sign of not more than five square feet advertising the property for sale or rent or signs used by a builder to advertise the property during the construction and sales period. 7.
