Re: Vacation of Plat of C. Irvine Cather Lots,
Martinsburg Pike.
Dear Mr. Renalds:
The above referenced plat of the Cather Lots was a subdivision of
three lots, two of which are still owned by my client, C. Irvine Cather, Sr.,
and the third lot is owned by David A. Fahnestock and Dorothy M. Fahciestock,
his wife, and is encumbered by a lien in favor of the Commercial and Savings
Bank.
Since it appears that the best access to the proposed Amoco Foam
Products Plant will be across one of these lots, and since the lots now
lie in an Industrial Zone, Mr. Cather wishes to have Lots l and. 2, the
unsold lots, vacated. The Fabnestocks and the Bank have agreed to execute
a Deed vacating these lots, and it is my understanding that the lots may
be vacated by such a Deed with the approval of the Board of Supervisors
pursuant to Virginia Code Section 15.1-482(a).
It is my understanding that the County approval may be acbtained by
merely presenting the executed Deed to the Board and securing the Board's
approval by resolution, without public notice, and that you could execute
the Deed on behalf of the County after such Board approval. Therefore, I
request that you place this matter on the agenda for the next Board of
Supervisors Meeting scheduled for Wednesday, October 10, 1979. At that
time, I will appear with Mr. Cather to present the Deed and to request the
approval of the Board of Supervisors.
As soon as the Deed has been prepared, I will deliver a copy to
your office so that your staff may exam-dne the Deed in advance. If you
should have any questions prior to the Board Meeting, please give me a
call. Thank you for your cooperation and assistance in this natter.
