THIS SUPPLEMENTARY DECLARATION OF COVENANTS AND
-
RESTRICTIONS (the "Supplementary Declaration"), made and dated this day of
, 2006, by and between JASBO, INC., a Virginia Corporation, party of the
first part, hereinafter called "Declarant"; and the COUNTY OF FREDERICK,
VIRGINIA, party of the second part, the "County".
RECITALS:
A. The Declarant is the owner in fee simple of those two certain tracts or parcels
of real estate, containing 23.0865 acres, more or less, and 19.4610 acres, more or less, lying
and being situate in Shawnee Magisterial District, Frederick County, Virginia (collectively,
the "Property"), and being more particularly described on that certain "Final Subdivision
Plat, Canter Estates, Section Five - Phase II", drawn by Jason G. Bly, L.S., dated December
7, 2005 (the "Final Subdivision Plat"), a copy of which is attached hereto and incorporated
herein by reference as if set out in full. The Property is a portion of the lands acquired by the
Declarant by that certain deed dated May 6, 1999, of record in the Clerk's Office of the
Circuit Court of Frederick County, Virginia as Instrument No. 990005146 (Deed Book 935,
at Page 1531), and by Final Plat For Boundary Line Adjustment dated December 6, 2001,
drawn by Darren S. Foltz, L.S., of record in the aforesaid Clerk's Office as Instrument No.
010017308. Tax Map No. 76-A-22 and 76-A-23
B. A portion of the Property, as shown on the attached Final Subdivision Plat,
has been subdivided into Lots for the construction of single family homes thereon (Lots 386 -
454, inclusive, Open Space A. Open Space B and Open Space C) and the Final Subdivision
Plat shows accurately the metes and bounds of the subdivided land, together with the
dimensions of each Lot thereof, the location of view shed preservation areas, storm
sewer/drainage easements, sanitary sewer easements, water line easements, gas line
easements, building restriction lines, utility easements, emergency access easements, drainage
easements, buried cable easements, emergency access easements and other easements, as well
as areas designated as open space, all of which shall constitute a portion of that development
known as Canter Estates, Section Five -Phase II, upon the terms and conditions set forth

Sections Two and Four, by that certain Deed of Dedication dated September 25, 2001, of
record in the aforesaid Clerk's Office as Instrument No. 010012795 (the "Existing Deed of

Dedication"). Under the terms of Article II of the Existing Deed of Dedication, it is
provided, inter alia, that additional Sections of Canter Estates may be added in the futujre
upon the filing of record of a Supplementary Declaration of Covenants and Restrictions, in
order to extend the scheme of the covenants and restrictions of the Existing Deed of
Dedication to. the additional lands to be included in Canter Estates, as more fully described in
the Existing Deed of Dedication, subject to the amendments allowed to such covenants and
restrictions as set forth hereinafter.
D. The Declarant now desires to subdivide a portion of the Property into lots to
be known as Canter Estates, Section Five - Phase II. The subdivision of said real estat� as it
now appears on the attached Final Subdivision Plat, is with the free consent and in
accordance with the desires of the undersigned Declarant. The Declarant further desires to
subdivide the Property in accordance with the provisions of Title 15.2, Chapter 22, Article 6
of the Code of Virginia (1950, as amended), as are applicable and in force and effect as of the
date of execution of this Supplementary Declaration.
NOW THEREFORE THIS SUPPLEMENTARY DECLARATION WITNE ETH:

That for and in consideration of the premises and the benefits which will accrue by
reason of this Supplementary Declaration, the Declarant does hereby subdivide all of that
certain tract or parcel of land into residential lots designated as Lots 386 - 454, inclusive,
Open Space A, Open Space B and Open Space C, of Canter Estates, Section Five - Phase II,
lying and being situate in Shawnee Magisterial District, Frederick County, Virginia, and
being more particularly described by the "Final Subdivision Plat, Canter Estates, Section Five
-Phase II", drawn by Jason G. Bly, L.S., dated December 7, 2005, which Final Subdivision
Plat is attached hereto and incorporated herein by reference as if set out in full.
For and in consideration as aforesaid, the Declarant does further dedicate all of the
streets in Canter Estates, Section Five Phase II, to the County of Frederick, Virginia (the
"County") for public use, which streets dedicated hereby are more particularly described by
the Final Subdivision Plat attached hereto and made a portion hereof.
All of the Lots shown on the Final Subdivision Plat attached hereto shall be subject to
the restrictions, covenants and conditions as set forth in the Deed of Dedication of Canter
Estates, Section Two and Four, dated September 25, 2001, of record in the aforesaid C�erk's
Office as Instrument No. 0 100 12795, which are incorporated herein by reference as if set out
in full, which shall constitute covenants real running with the land, and shall be binding upon

all parties having any right, title and interest in and to the aforesaid lots or any part thereof,
their heirs, successors and assigns, and shall inure to the benefit of each owner thereof,
subject, however, to the amendments to Article VII(14), as more fully set forth hereinafter.
ARTICLE VII
USE. RESTRICTIONS AND COVENANTS
Restriction No. 14 under Article VII is hereby deleted in its entirety, and in the place
and stead thereof, the following Restriction 14. is hereby imposed:
14. One-story houses shall have a not less than 1,500 square feet of living
space. Two-story houses shall have a not less than 900 square feet of
finished living space on the first floor above ground and a total living
space of not less than 1,800 square feet of finished living space.
Split -foyer style houses and salt box style houses shall not be allowed.
All other allowed house configurations, including, such as, but not
limited to, Cape Cod, shall have not less that 1,600 square feet of
usable, finished living space. Living space shall be computed using
outside foundation measures and shall be exclusive of carports,
garages and basements. Roof pitch shall be at least 5/12".
The foundation of all houses shall have a brick veneer or finished
masonry other than poured molded concrete or parget block from the
house plate to the ground surface, which brick veneer shall be on the
side of the house facing the street and on the two sides of the house
facing the side lines. No brick veneer is required on the side of the
house facing the rear property line; however, such foundation shall
have parget block or poured molded concrete block. The front steps of
each dwelling house shall be made of concrete or masonry materials
only.
Roof overhangs shall have a minimum of twelve inches (12" on all
sides of any residence constructed upon the Lots.
The Lots as shown on the attached Final Subdivision Plat shall be subject to those
view shed preservation areas, storm sewer/drainage easements, sanitary sewer easements,
water line easements, gas line easements, building restriction lines, utility easements,
emergency access easements, drainage easements, buried cable easements, emergency access
easements and other easements, as well as areas designated as open space, as more fully set
forth on the attached Final Subdivision Plat.
The dedication and subdivision of a portion of the Property as shown on the attached
Final Subdivision Plat is with the free consent and in accordance with the desire of the
Iundersigned Declarant and is in conformity with the provisions of Title 15.2, Chapter 22,
Article 6 of the Code of Virginia (1950, as amended), as are applicable, together with the

Dear Mark:
The purpose of this letter is to request your approval of the Final Subdivision Plats for
Canter Estates Section Five — Phase H. As you know, Frederick County Public Works
and your department recently completed an inspection of this project and determined that
all associated infrastructure improvements and site work have been complete as identified
on the Canter Estates Section V Bond Estimate prepared October 11, 2005, Revised
October 13, 2005. The following information is included for your review and approval:
➢ Five sets of the Final Subdivision Plats for Canter Estates Section Five — Phase I1
dated December 7, 2005 containing approved signatures from FCSA and VDOT.
These plats were previously reviewed by your department and were determined to
be in a form acceptable for approval.
➢ The required Residential Subdivision Record Plat application fee of $6,900.00 for
the 69 lots to be recorded.
➢ The Supplementary Declaration of Covenants and Restrictions and Deed of
Dedication.
➢ A copy of the Bond Estimate for Canter Estates Section V identifying all
applicable infrastructure and site improvements and your memorandum dated
May 18, 2006 verifying the completion of all required improvements.
Please review the information in this packet and advise me when your department has
signed the plats. We will make arrangements to have the approved plats recorded and
provide you with a copy of the recorded documents for your files.

Dear Mark:

The purpose of this letter is to request the reduction of Letter of Credit #9531282369 —
Note #6 that is held in favor of the .Treasurer of Frederick County in the amount of
$102,125.00. The Canter Estates developer has completed all improvements identified in
the Canter Estates Bond Estimate dated October 13, 2005 and requests that the current
Letter of Credit be reduced to $45,000.00 for maintenance of the public street systems
that will be ultimately accepted in the VDOT secondary road system.
Please provide me with a letter of concurrence for this request so we can obtain a new
Letter of Credit to fulfill this obligation. The original Letter of Credit is scheduled for
renewal on May 21, 2006; therefore, your letter advising that $45,000..00 is adequate for
public street maintenance will allow us to coordinate this reduction with the lender.
