We strive to provide an efficient public service; promoting quality land use planning and implementation, while also responding to the development community's requests for timely plan reviews and bond reductions as a project proceeds. In an effort to be proactive and more responsive to developer's bond reduction requests, staff is conducting site inspections of the larger residential developments and issuing letters of outstanding improvements as a courtesy to the developer. Our site inspection letters should only pertain to the portion of the development that is bonded. If the bond had been previously released, it was because the developer had met his/her improvement responsibilities for that portion of the development. In further reviewing your concerns, we realize that you should not have received the site inspection letter; your bonds had been previously released and/or your company was not the developer of the project's particular section. Please disregard the September 26, 2006 letter addressed to JASBO; you are not held responsible for the identified issues. We regret having issued the letter in error, but appreciate your bringing it to our attention. We will continue to strive to provide improved customer service, and more importantly, improved communications. Box 888 Winchester, VA 22604 RE: Canter Estates - Revised White Oak Road Efficiency Buffer Dear Mr. Petry: As you know, Boyer Landscapes, Inc., has prepared a revised landscape plan for the road efficiency buffer that is required along the White Oak Road extension through Canter Estates. The revised plan submitted by Mr. Lew Boyer provides a typical section which indicates a white pine landscape screen supplemented with forsythia, red -twig dogwood, and butterfly bush. Furthermore, Mr. Boyer staked the earth berm to indicate where the various species of plant materials would be located for our inspection. Please be advised that this landscape plan is acceptable to the Frederick County Planning Department for Section Two and Section Four of Canter Estates: It should be noted that a portion of the berm on the west side of White Oak Road extended from Macedonia Church Road to the limits of the residential lots along Welsh Court did not contain stakes to indicate the required plantings. As you know, Sheet 2 of 9 of the approved Canter Estates - Section One Subdivision Design Plan, requires these plantings as well. These plantings will need to be provided prior to the release of the performance bond for this project. Our department will not require you to modify the approved Subdivision Design Plans for this project to reflect the landscape plan revisions; therefore, it is important to keep this letter as evidence of our department's position regarding this matter. Additional Sections: Additional sections of Canter Estates will be added in the future and those sections, as they are added, will become part of Canter Estates subdivision, subject to the same provisions as set forth herein, provided however that Declarant may amend the land use restrictions, set back requirements, building sizes and any other provisions so long as the same scheme established in Canter Estates, Section One, that being single family residential lots, is maintained. Section 2. Supplementary Declaration: The addition(s) authorized under this Article shall be made by filing of record a Supplementary Declaration of Covenants and Restrictions with respect to the additional property which shall extend the scheme of the covenants and restrictions of this Declaration (amended as herein permitted) to such property. Section 3: Nature of Supplementary Declaration. Such Supplementary Declaration may contain such complimentary additions and modifications of the covenants and restrictions contained in this Declaration as may be necessary to reflect the different character, if any, of the added properties, and as are not inconsistent with the scheme of this Declaration. HARRISON 6 JOHNSTON ATTORNEYS AT LAW WINCHESTER, VIRGINIA -3- BK957PG1547 ARTICLE II USE, RESTRICTIONS AND COVENANTS The single family Lots in Canter Estates, Section One shall be subject to the following restrictions, which are constituted covenants real to run with the land: 1. All Lots shall be used for single-family residential purposes only. No detached garage or carport shall be permitted on any Lot. Any utility or other out building on any Lot shall be of the same material and construction as the main structure on such Lot. 2. No signs or advertising of any nature shall be erected or maintained on any Lot except "For Sale" signs for said Lot which signs shall not exceed five (5) square feet in area, or signs used by the DECLARANT to advertise the property during construction and sale. No "For Rent" signs shall be allowed on any Lot. 3. No power boats, mobile homes, motor homes, campers, commercial buses, trailers of any type, tractors, trucks (other than automobiles, motorcycles, pickup trucks of 3/4 ton (or less) or vans) shall be permitted on any Lot except during the course of construction, provided, however that motor homes and campers are allowed for any consecutive period of less than 48 hours during a consecutive 30 day period, on any lot. No motor vehicle or material portion thereof, which does not have a current Virginia inspection sticker shall be permitted on any Lot. No commercial or business vehicle, of any type, unless excepted herein as to size, shall be allowed to park on any lot in said subdivision at any time, after the construction of a dwelling house has been completed. 4. No animals of any kind (including livestock, poultry or birds) shall be permitted on any Lot, except that dogs, cats and other usual household pets may be kept, provided that they are not kept, bred or maintained for commercial or charitable purposes or in unusual numbers. 5. No fence or hedge shall be constructed or planted in the front nor along the side of any residence. Rear fencing and hedges shall not exceed six feet (6') in height. On corner lots no fence or hedge shall be constructed or planted in the front nor along the sides of any dwelling unit nor within twenty-five (25) feet of any public street. 6. No noxious or offensive activities shall be carried on upon any Lot nor shall anything be done thereon which may be, or may become, an annoyance or nuisance to the neighborhood. 7. In the event that a dwelling is completely destroyed, the owner of the dwelling, within thirty (30) days from said destruction, shall clear the lot and maintain the Lot in a neat and orderly condition prior to rebuilding. 8. In the event a dwelling unit is damaged, or has materially deteriorated, the owner of the unit shall immediately repair the damage or deterioration. 9. No Lot shall be used or maintained as a dumping ground for refuse. Trash, garbage or other waste (refuse) shall be in sanitary containers and screened. No refuse or any container for same shall be placed or stored in front of any house, except on the date of refuse pickup. 10. No exterior clothes lines, or hanging device, shall be permitted on any Lot, except for an umbrella -type with a diameter not to exceed seven (7) feet; provided, however, that the same may only be used in the rear of any building constructed on said Lot and the clothes line is stored within a utility building or the equivalent when the clothes line is not in use. 11. Every owner shall provide his Lot with off-street parking space of at least 450 square feet, which may include all area in any driveway located on the Lot itself, to be used by the inhabitants of the dwelling house located on said Lot. It is the intent of this restriction that parking space for at least (2) vehicles be provided. All driveways are to be constructed of concrete and shall be installed per the specifications utilized by the Virginia Department of Highways. -5- HARRISON 6 JOHNSTON ATTORNEYS AT LAW WINCHESTER, NIRGINIA BK957PG1549 12. All Lots are subject to such ten foot (10') Slope and Drainage Easement along all rights of way, and a ten foot (10') Utility and Drainage Easement along all property lines, except the front property lines shall be subject to such easements in the width of twenty-five feet (25'). 13. There shall be no planting, structures, fences, shrubbery or other obstruction to obstruct vision planted or maintained on any corner Lot which rises more than three feet (3') above ground level within twenty-five feet (251 of the intersection of any street lines. 14. One-story houses shall have 1,450 square feet of living space. Two-story houses shall have 900 square feet of finished living space on the first floor above ground and a total living space of 1,600 square feet of finished living space. All other house configurations, such as, but not limited to, Cape Cod, split foyer and any other Multi -level and/or Tri-level shall have 1,600 square feet of usable, finished living space. Living space shall be computed using outside foundation measures and shall be exclusive of carports, garages and basements. Roof pitch shall be at least 5/12". No saltbox type houses are allowed. The foundation of all houses shall have a brick veneer or finished masonry other than poured molded concrete or parget block from the house plate to the ground surface, which brick veneer shall be on the side of the house facing the street and on the two sides of the house facing the side lines. No brick veneer is required on the side of the house facing the rear property line. 15. All Lots are required to observe any setback lines, and/or side lines and/or rear yard lines as shown on the plat attached hereto in addition to those applicable requirements of any COUNTY Ordinance. 16. No building, structure, addition or exterior alteration (including basketball backboards, rims and nets) or improvements of any character, shall be constructed on any Lot or dwelling located thereon, unless the "plan" of construction, including quality of workmanship, design, colors and materials including siding specifications shall have been approved in writing by the DECLARANT, or its designee, as being in harmony with the whole single family section and especially the adjoining single family residential properties. All of the covenants and restrictions herein shall be binding and remain in full force and effect for a period of fifteen (15) years from the date of this instrument and shall be renewed automatically for additional successive ten (10) year periods, unless changed in accordance with Article X, Section 3, infra. 18. The invalidation of any one of the covenants or restrictions contained herein by judgment or Court Order shall in no wise affect any of the other provisions which shall remain in full force and effect. The failure of the Association Lot Owners or the DECLARANT herein to enforce any covenants or restrictions shall not be deemed to be a waiver of the right to do so thereafter as to a default occurring prior or subsequent thereto. ARTICLE III EASEMENTS & RESERVATIONS Section 1. Public Utility and Drainage Easements: The property described hereby is, and shall be, subject to those certain easements or rights of way designated, or to be designated, as temporary ingress -egress easements, Drainage Easements, Gas Easements and Utility Easements on any plat relating to Canter Estates, Section One that have been recorded or will be recorded (including the plat attached hereto). The DECLARANT does hereby grant and convey unto the COUNTY, or other agency having jurisdiction thereof, a perpetual right of way or easement for the maintenance and repair of the aforesaid easements and any related facility designated on the aforesaid plat as Water Easements, Sanitary Sewer Easements, Gas Easements and Utility Easements. Section 2. Reservations: (a) The DECLARANT reserves unto itself, its successors or assigns, the right SA HARRISON & JOHNSTON ATTORNEYS AT LAW WINCHESTER, MRGINIA 1 BK957PG 155 ! to erect, maintain, operate and replace underground telephone and electrical conduits, related equipment, and other facilities, sewer, gas, water and television lines and related equipment, and other utility equipment where such utility lines and equipment are located within the easements reserved herein or as set forth on the Final Subdivision Plat of Canter Estates. (b) The DECLARANT further reserves unto itself, its successors or assigns, for a period of five (5) years from the date hereof, a blanket easement and right on, over and under the ground within said Subdivision to maintain and correct drainage of surface water problems in order to maintain reasonable standards of health, safety and appearance. Such right expressly includes the right to cut any trees, bushes or shrubbery, make any grading of the soil or to take any other similar action reasonably necessary, following which the DECLARANT shall restore the affected property to its original condition as near as practical. The DECLARANT shall give reasonable notice of intent to take such action to all affected owners, unless in the opinion of the DECLARANT an emergency exists which precludes such notice. Reservation by DECLARANT of such blanket easement and rights contained herein shall not, in any way, obligate DECLARANT to undertake any maintenance, repair or corrective action whatsoever and shall not impose any liability or responsibility upon DECLARANT therefore. ARTICLE IV GENERAL RESERVATION The DECLARANT herein reserves unto itself, for a period of five (5) years, the right to amend this Deed of Dedication, provided that the single family residential nature of the subdivision shall not be changed. in HARRISON & JOHNSTON ATTORNEYS AT LAW WINCHESTER, VIRGINIA BK957PG1552 ARTICLE V GENERAL PROVISIONS Section 1. Enforcement: The Declarant, its successors or assigns, or any Owner, shall have the right to enforce, by any proceeding at law or in equity, all restrictions, conditions, covenants, reservations, liens and charges, now or hereafter, imposed by the provisions of this Declaration. Failure by the Association, its successors or assigns, or by any Owner to enforce any covenant or restriction herein contained shall in no event be deemed a waiver of the right to do so thereafter. All costs which the Declarant, its successors or assigns, or any Owner shall incur in the successful enforcement of the restrictions, conditions, covenants, reservations, liens, and charges, now or hereafter imposed, shall be borne by the party against which action is taken and which costs shall include reasonable attorney's fees, costs, and damages. Section 2. Severability: Invalidation of any one of these covenants or restrictions by judgment or court order shall in no way affect any other provision which shall remain in full force and effect. Section 3. Amendment: The covenants and restrictions of this Declaration shall run with the land and bind the land, and shall inure to the benefit of and be enforceable by the Declarant, or the Owner of any Lot subject to this Declaration, their respective legal representatives, heirs, successors and assigns, for a term of fifteen (15) years from the date of this Declaration is recorded, after which time, said covenants shall be automatically extended for successive periods of ten (10) years. The originally proposed entrance onto Macedonia Church Road appears to have been removed. Access to this subdivision will need to be resolved, and the master development plan will need to be revised to reflect any changes to the proposed road system. As I discussed with Mark Smith on February 10, 1999, this subdivision must be approved with a permanent entrance(access onto a state maintained road. As a minimum, a road design scheme must be approved and bonded 2. Continue the Road Efficiency Buffer along proposed White Oak Road so that no gaps in, the buffer and screening exist. The submitted design has two gaps in the buffer and screening. This may be accomplished by constructing the buffer and screening on the west side of the drain outlets. 3. A 1-foot strip of grass should be placed between the curb/gutter and the sidewalk. Attached is the "Standard Typical Section for Residential Streets" chart that was included with the approved Master Development Plan; note the 1-foot minimum distance between the curb and sidewalk. As this road system has deviated from the original submission in October 1998, the approval letters from the review agencies may be invalid. Access points onto existing Route 642 (Macedonia Church Road) numbered 1, 2 and 3 are too close to each other such that they create unsafe maneuvering conditions for vehicles entering and leaving residential areas. Caspian Drive should be ended at a cul-de-sac in the vicinity shown. Also in this area either a posted speed limit or a safe driving speed should be provided for existing Route 642 (Macedonia Church Road) and the right-of-way along Route 642 should be 25' from center line for a total of 501 . 3. The printed size of proposed culverts 1-2 and 2-3 should be confirmed. If 24"x38" they would be laid in vertical installation. See VDOT Standard PC-1 Road & Bridge Standards 107.06, copy attached. Since there is no vertical size 24"x38", the culvert must be intended to be horizontal and 38"x24" would be the size. Culvert 1-2 discharges into an existing VDOT culvert of lesser size and capacity with no diversion or interceptor. The size of the culvert on the south side of Route 642 as well as the destination of discharged water should be provided. If the downstream stormwater management pond is the receiver, is the pond capacity calculated to meet the need for this additional volume? Refer also to comment on Subdivision Check List Page 7 of 8 for additional drainage concerns. 4. Access to this Section I of Canter Estate should be located at Welsh Court extended similar to sketched alignment. Evenly spaced access along proposed White Oak Road could be achieved for Land Bay 8. This is safer than the proposed access by way of Caspian Drive to Route 642. 5. Proposed White Oak Road should be constructed with this project to appropriate cul- de-sac to provide access between existing Route 642 (Macedonia Church Road) and Welsh Court Extended. 6. Outlet locations for Culverts 7-8 and 9-10 should address needs on the stormsewer system along White Oak Road. Sheet 3 of 7 7. UD-4 and CD's should be provided generally as shown on plan sheet. Sheet 4 of 7 8. See Comment #3. Sheet 6 of 7 9. Standard detail drawings should include VDOT CG-9D residential entrances, CG-12, ES-1 as needed, UD-4, DI-3C, and UD as appropriate. 10. Erosion and Sediment Control Narrative: Provide design calculations verifying that the stormwater management pond located in the Mosby Station subdivision will accommodate the additional storm flows from Canter Estates. Also, provide stonnwater management facilities (permanent or temporary) to mitigate the additional stormwater originating from Barb Court and Welsh Court. The dead end of Caspian Drive should also be evaluated to determine if on -site mitigation is required in this area. 2. Design Computations: Revise the runoff coefficient listed in the tabulated compactions to reflect the values shown on sheet 7 of 7 ( i.e. 0.04 should be changed to 0.45). If the revisions result in design flows which exceed the capacity of the existing 19 x 30 RCP, consider either on -site mitigation or upgrading the existing culvert. Also, an analysis of a closed conduit system may indicate a smaller pipe size requirement at the Route 642 road crossing. Sheet 1 of 7 3. Under General Note number 13 add a requirement for a wash rack in conjunction with the construction entrance. Sheet 4 of 7 5. Check the proposed design elevations associated with drop inlet number 2 along the storm sewer profile. It appears that the top of the prosed 24" x 38" RCP will extend above the top of the DI-7. 6. The storm sewer profiles for Welsh and Barb Courts indicate a grass lined ditch at each outfall with a slope of 0.5%. We recommend that the slope be increased to at least 1 % to minimize the creation of a marshy condition. Sheet 5 of 7 7. Check the grading (contour 726) surrounding storm structure A. We suggest revising the proposed grades to avoid ponding stormwater outside of the drop inlet. It appears that correcting the closure of the 726 contour will resolve the problem. 8. Add a note to this sheet indicating that detailed site plans will be required for lots 4, 5, 18, 19, 33 and 34. Also, because of the subsurface conditions which underlie the site, basements are not recommended unless they are accompanied by a detailed water proofing and dewatering design. Sheet 7 of 7 9. Provide a design detail for the proposed sediment trap located near the outlet of the Welsh Court outfall. We suggest that the design of this sediment trap be incorporated in the temporary or permanent stormwater management facility referenced in comment number 1. Should -conditions in the field exist such that additional measures are warranted, such measures shall be completed to the satisfaction of the Department prior to inclusion into the Secondary Road System. • Attached is a copy of the minimum requirements and information needed prior to acceptance of subdivision streets into the Secondary System. This is the responsibility of the developer. • All drainage is to be carried within the right-of-way in ditch lines or gutters along the street to a pipe or drainage easement. • . The permit is issued by this office and will require a minimum processing ,fee, surety bond coverage, and the salary & expenses of a State assigned Inspector. • If mailboxes are to be placed along the roadway fronting lots, a minimum of 4' shall be between the edge of pavement and the front of mailbox as shown or Standard RFD-1 603.01. Private entrances will be installed in accordance with CG-9B as shown on plans. This is the developer's responsibility. • Any entrances constructed from the referenced street(s) shall meet VDOT minimum standards. This is the developer's responsibility. • Any signs to be installed will be in accordance with attachments. • I suggest any utilities and/or storm sewer placed within the proposed right-of-way be backfilled completely with C.R. Type 21-B Stone. This will greatly reduce the possibility of any pavement settlement. • A copy of any/all plats of dedication for drainage easements or additional right-of- way adjacent to Route 756 required for implementation of this proposed project should be provided to VDOT prior to issuance of any land use permit. Dedication should be made to the Commonwealth of Virginia. • A copy of any/all plats of dedication to public use (the County of Frederick) for drainage easements or additional right-of-way on the interior road system required for implementation of this proposed project should be provided for VDOT review prior to issuance of any land use permit.
