The erosion appears to be a result of the heavy rains we have experienced recently. As I am sure you are aware we originally recommended standard EC-3 soil stabilization mat be placed in this ditch line. However, your contractor was allowed to use sod instead of the EC-3 if the sod could be permanently established. It appears vegetation within this ditch line cannot be established for the sod has washed out on at least two (2) occasions. From the new man -hole a 24" pipe will be extended in a southeasterly direction which will extend just beyond an existing man -hole just south of Lot 89 and will clear lot 90 which has a unit with a basement. The area will then be back -filled to cover the pipe and to create a terraced effect resulting in two basically level areas in which playground equipment may be placed. The pipe will be covered for the entire length that it is extended. The fill area will be accomplished by the importing of material from another area and no material will be disturbed within the project area with the slopes remaining as they are. That this work will be accomplished sometime in the fall when the children have returned to school and are not present at the site. 3. That in the event that the material is taken from a site where an erosion control permit is necessitated that the fees for applying for the same will be waived. Regardless of the fees being waived a soil and erosion plan will be developed in accordance with the regular processes and whatever steps are necessitated will be observed to comply with the permit that is issued. 4. That in return for the above the County will waive two units of playground equipment in the Brookland Heights Subdivision, meaning that three units will be installed rather than five. In addition a credit will be given on one playground unit at the Huntington Meadows project. 5. That the above referenced project will be undertaken by G. W. Clifford & Associates, Inc., Oakcrest Builders and Bowman and Glaize at their expense. The preliminary estimate for accomplishing this work was $48,000.00 and possibly will remain somewhere around that figure although the project was somewhat modified as a result of our meeting. 6. That Harrington Smith, Supervisor, with the assistance of Wayne Miller, will clear the way with the Property Owners Association of Brookland Heights and make it possible for the project to go forward this fall. 7. That of the three units remaining to be placed in Brookland Heights the same will be spotted by the appropriate authorities and Jim Petry notified as to the appropriate locations in order that the same may be installed in the very near future. I believe that the above encompasses the agreements reached. I would say, in passing, that this agreement is the result of the governmental body working with G. W. Clifford & Associates, Inc., Oakcrest Builders, Inc., and Bowman and Glaize in order to achieve something that is reasonable and which we believe will enhance the Brookland Heights project. It is always difficult to get so many people together to agree on anything and these matter can drag on for an extended period of time unless there are reasonable good faith efforts to resolve them. I am again submitting the plans and I apologize for not being more descriptive the first time on our reasons for design Tplating to the items you mentioned in -your letter. First, with regard to the inlet and 18" pipe across Valley Mill Road, please be advised that we have designed the curb and gutter system to handle the run-off from the front of the Townhouse Project by carrying the flow to the project entrance and then south along the western side of the Project entrance, in the curb and gutter systems, -.to a 20' throat drop inlet that carries the drainage to Abrams Creek. We believe this will be more satisfactory and will eliminate a storm water discharge onto lands across the road. It will also eliminate having to explain to the people across the road why we're increasing the pipe size over what exists. A calculation is attached for a spread of storm water on the entrance road which clearly shows it to be within allowable tolerance under State regulations. We have designed a typical four lane roadway, category IV would involve 4 10' lanes plus T gutter pans on either side. The County and, as far as we know, the Highway Department, does not have a thoroughfare plan for Frederick County, which calls for larger streets than that described above. It is unclear whether Valley Mill Road will be a major thoroughfare or some other road, such as Greenwood Road, would be called on. to handle very large traffic volumes. We take no exception with Valley Mill Road being widened to an ultimate 4 lane section, however, the provision for 211' lanes on our side of the project presents significant problems to development. We are proposing a dedication of an additional amount of land adequate for a 25' right-of-way from the center line of Valley Mill Road. Our previous submission and preliminaries, which have been approved by you and the County, established a geometric design which established the front of the townhouse units to be as shown on this plan. Building permits have been issued and these townhouse units are under construction. In order to comply with all the ordinance requirements, we can only have a 2' raised divider between the parking lane and your roadway. We suggest a typical design for 20' of roadway on our side plus a 2' gutter pan which allows for a 4' raised divider. We request your approval of this proposal at this time. With regard to the western most entrance of this project on Valley Mill Road, please be advised that we do not own the land on which you show the extended radius curb return on your check prints. We can not build public improvements on lands we do not own. We believe the plan . .lop shown originally, is a safe and serviceable plan and meets the minimum requirements of your department.
