VACATION OF PLAT
THIS VACATION OF PLAT dated the 28th day of October,
1977, of record in the Clerk's Office of the Circuit Court of
Frederick County, Virginia in Deed Book 482, at page 710, by
and between IRVIN F. BARB and MARGARETTE J. BARB, his wife, and
JAMES E. BARB and MARGARET L. BARB, his wife, parties of the
first part; NORMAN deV. MORRISON, Acting Trustee, party of the
second part; A. GARLAND WILLIAMS and VIRGINIA R. WILLIAMS, his
wife, parties of the third part; and CAROLINE W. LOY, party of
the fourth part.
WHEREAS, IRVIN F. BARB and JAMES E. BARB are the owners
of certain tracts of real estate located in Back Creek
Magisterial District, Frederick County, Virginia, being a portion
of the land conveyed to Irvin F. Barb and James E. Barb by Deed
dated May 3, 1976, from Caroline W. Loy, Widow, of record in the
Clerk's Office of the Circuit Court of Frederick County,
Virginia, in Deed Book No. 457, at page 710 and further being
a portion of the land conveyed to Irvin F. Barb and James E.
Barb by Deed dated May 3, 1976, from Carl E. Frye and Anna L.
Frye, his wife, of record in the aforesaid Clerk's Office in
Deed Book 457, at page 713; and
WHEREAS, a portion of the aforesaid tracts of land have
been subdivided as shown on Plat of Survey made by Greenway
Engineering and Surveying, Inc., dated October 28, 1977,
designated as "Final Plat Brookneill Subdivision Section IV"
located in Back Creek Magisterial District, Frederick County,
Virginia, which plat and Owner's Certificate dated October 28,
1977, are recorded in the aforesaid Clerk's Office in Deed Book
482, beginning at page 702; and

WHEREAS, no lots located within the said Brookneill
Subdivision Section IV have been sold; and
WHEREAS, the Director of Planning and Development of
Frederick County, Virginia, has indicated that the provisions
of the subdivision ordinance of Frederick County, Virginia are
not applicable to the said "Brookneill Subdivision Section IV";
and
WHEREAS, it is the desire of the parties hereto to
vacate "Brookneill Subdivision Section IV" as shown on the
Final Plat of Brookneill Subdivision Section IV, Back Creek
Magisterial District, Frederick County, Virginia, made by
Greenway Engineering and Surveying Company, Inc., dated
October 28, 1977, of record in the aforesaid Clerk's Office in
Deed Book 482, beginning at page 702;
NOW, THEREFORE, THIS AGREEMENT WITNESSETH:
That for and in consideration of the premises and of
the benefits accruing, or to be accrued, to the parties hereto,
Irvin F. Barb and Margarette J. Barb, his wife, and James E.
Barb and Margaret L. Barb, his wife, being the owners and
subdividers of "Brookneill Subdivision Section IV located in
Back Creek Magisterial District, Frederick County, Virginia, as
shown on the plat made by Greenway Engineering and Surveying
Co., Inc. on October 28, 1977, of record in the aforesaid Clerk'!
Office in Deed Book 482, at page 710, and Norman deV. Morrison,
Acting Trustee, agree to vacate the plat of "Brookneill
Subdivision Section IV", as shown on the aforesaid Plat dated
October 28, 1977, and the same is hereby vacated.

creditor and holders of the obligation secured by a Deed of
Trust'dated May 3, 1976, from Irvin F. Barb and Margarette J.

the purpose of indicating their approval to the said Vacation.
CAROLINE W. LOY, a lien creditor and holder of the
obligation secured by a Deed of Trust dated May 3, 1976, from
Irvin F. Barb and Margarette J. Barb, his wife, and James E.
Barb and Margaret L. Barb, his wife, to Norman deV. Morrison,
Acting Trustee, of Clarke County, Virginia, of record in the
aforesaid Clerk's Office in Deed Book 457, at page 729, unite
herein and execute this instrument for the purpose indicating
their approval to the said Vacation.

The Board of Supervisors has taken final action to amend the
subdivision regulations of Frederick County to exempt lots larger
than five (5) acres from County review. Accordingly, I am returning
the plan and profile sheets and the plats for Section 4 of Brookneil
without further action.
Before you re-record this Section, you should be aware of the
staff comments that I received. Laura Circle will connect to Forest
Ridge Road in Stonebrook and should be named Forest Ridge Road as well,
and drainage easements should be shown on the final plats.
