Extended was approved by the Frederick County Planning Commission
at their meeting of May 1, 1991.
The same subdivision was administratively approved by the Frederick
County Subdivision Administrator on May 9, 1991.
This property is located at the intersection of Brooke Road and
Fort Collier Road in the Stonewall Magisterial District and is
identified as parcel 81 on tax map 54.

This is to acknowledge receipt of your revised plans dated December 2, 1991 to
the above referenced locations. The plans appear satisfactory and are
approved. Please advise the developer accordingly.
I offer the following comments:
A preconstruction conference be held by the engineer and/or developer with
the attendance of the contractor, various County agencies and VDOT shall be
conducted prior to initiation of work.
• Materials used and method of construction shall apply to current observed
VDOT Road and Bridge Specifications applicable during construction of this
development.
• Our review and comments are general in nature. Should conditions in the
field exist such that additional measures are warranted, such measures shall
be completed to the satisfaction of the Department prior to inclusion into
the Secondary Road.System.
• Attached is a copy of the minimum requirements and information needed prior
to acceptance of subdivision streets into the Secondary System. This is the
responsibility of the developer.
All drainage is to be carried within the right-of-way in ditch lines or
gutters along the street to a pipe or drainage easement.
The contractor shall notify VDOT when work is to begin or cease for any
undetermined length of time. VDOT will also require (forty-eight) 48 hours
notice for inspections.
• If mailboxes are to be placed along the roadway fronting lots, a minimum of
four (41) feet shall be between the edge of pavement and the front of
mailbox as shown on the attached sketch.

• Any entrances constructed from the referenced street(s) shall meet VDOT
minimum standards. This is the developer's responsibility
Any signs to be installed will be in accordance with attachments.
• I suggest any utilities and/or storm sewer placed within the proposed
right-of-way be backfilled completely with C.R. Type 21-A Stone. This will
greatly reduce the possibility of any pavement settlement.
I would appreciate at your convenience two (2) additional sets of the plans
for our files.
At this time I would again like to request the developer to consider sealing
the roadway shoulders on those streets within the development which at this
time are not scheduled to receive a surface. A prime & sealed surface at an
approved application rate would greatly reduce the damage now being done to
the shoulders by truck traffic. We would appreciate you advising us of their
position on this issue at your earliest convenience.
As requested I have also enclosed the signed subdivision plats of the Park
Center Drive and Brooke Road cul-de-sac rights -of -way and the 82.136 acre
Hershey parcel.

W I T N E S S E T H:
WHEREAS, Owner is the fee simple owner of the property
containing 1.739 acres of land shown on the plat prepared by
Greenway Engineering and Surveying Co., Inc., entitled "Plat
Showing Brooke Road Extended, Fort Collier Industrial Park,
Stonewall District, Frederick County, Virginia" dated June 22,
1989 (hereinafter "Plat"), attached hereto as Exhibit A, made a
part hereof and incorporated herein by reference and being a part
of the property conveyed to Owner by a certain Deed recorded in
Deed Book 705, at Page 433, among the land records of Frederick
County, Virginia ("Property"); and
WHEREAS, it is the desire and intent of the Owner to
::onvey certain property to the County and to dedicate same for
3ublic street purposes as shown on the Plat and as hereinafter
Drovided.

NOW, THEREFORE, THIS DEED WITNESSETH, that for and in
consideration of the premises and the sum of One Dollar ($1.00),
cash in hand paid, the receipt and sufficiency of which are hereby
acknowledged, Owner does hereby convey in fee simple with general
warranty to the County, its successors and assigns, that parcel of
land containing 1.739 acres of land as shown on the Plat, attached
hereto and made a part hereof, and does hereby dedicate same for
public street purposes.
This conveyance and dedication is made with the Owner's
free consent and in accordance with its desires, and in accordance
with the statutes of Virginia governing the platting of the land;
the plat having been duly approved by the proper authorities of
Frederick County, Virginia, as evidenced by their endorsement
thereon.

Dear Mr. McIlvaine:
The Deed of Dedication for Brooke Road that you forwarded to me
with your correspondence of January 31, appears to be satisfactory
for the dedication of the road in order to make it eligible to go
into the state secondary system at a later date.
Greenway' Engineering had previously submitted a subdivision
application for this street but it laid idle for quite some time.
I met with Bruce Edens this morning and I believe this is on track
and we will bring it to a satisfactory conclusion soon. Bruce will
provide the necessary plats signed by the Sanitation Authority and
VDOT. This application was submitted under our old fee schedule
and the fee was then $250.00 plus the engineering cost of the
County Engineer. The engineering cost was $742.20 so the total fee
you owe Frederick county is $992.20. I am enclosing a copy of the
invoice from our engineer that shows the amount the County was
charged for their services for your project.
The County also requires bonding on streets/roads until they are
taken into the state system. I will accept a letter of credit or
other bond in the amount of $5,000.00 for this street.
To summarize what is required to bring this project to the final
approval stage I offer the following:
1. Greenway Engineering needs to provide the County with the
plats that have been signed by the Sanitation Authority and VDOT.
2. Your office needs to provide the County with the
subdivision fee in the amount of $992.20 and the bonding for the
street in the amount of $5,000.00.
3. The deed of dedication needs to be executed and recorded.
Once the above items have been completed we will expedite the
approval of the Brooke Road extension.
While I was at Greenway talking to Bruce Edens we also discussed
the division for Park Center Drive, the additional extension of

Brooke Road to the intersection with Park Center and the division
of the 20 acre tract southeast of the railroad and along Park

COMMENTS
Roadway
1. The profile plans show a 100' section of vertical curve with
a point of vertical intersection at station 42 + 00. However,
the roadway profile is a continuous -1.0% grade from station 39 +
00 to station 47 + 00. The vertical curve section is not needed
for vertical alignment since the grade does not change.
2. The plan view shows a cul-de-sac at the termination of the
extension. However, the end of construction line ends prior to
the cul-de-sac. We recommend that the temporary cul-de-sac be
included as part of the project and built to VDOT standards.
Utilities
1. The plans should show the connection of the existing 12" D.I.
water line to the proposed 12" PVC line that services the areas
opened up by the Brooke Road Extension. This needs to be approved
by the Frederick County Sanitation Authority.
2. The plans show a proposed water line tee intersection at
approximately station 45 + 22. The exact station needs to be
identified on the plans. Also, the plans show a 12" x 12" x 8"
tee at the junction with a 10" valve. The valve and tee branch
(size not shown) should both be the same size and the branch line
should be capped. Again, this needs to be approved by the
Sanitation Authority.
3. We also suggest that the stub out service line sizes be
confirmed with the Sanitation Authority and Fire Marshall for
adequacy of fire protection to the lots being served.
Drainage
1. Twin 30" R.C. storm drains are located at station 48 + 65.
The finished grade at the inlet is approximately 3' above the
invert elevation of 673.31. The outlet invert is approximately
1.5' below the ditch line. Recommend elevations of ditches/
drains be adjusted for better alignment. Pleas le

proper relief.
2. The discharge from existing culverts at station 35 + 50 is
substantial. The ditch catching this discharge is' --shown with
berming placed on fill to contain the flow. First of all, it is
not good practice to provide ditching of drainage on unprotected
fill. The volumes of water could present an erosion problem on
the outside ditch banks.
3. After reviewing the Clark, Frederick, Winchester Detention
Facility Plans. it appears that they are directing ditch flow
from Fort Collier Road around to the south side ditch of Brooke
Road. The proposed ditch berming will preclude this from
happening. Within the 20 foot drainage easement, it may be
possible to extend the ditch further down by extending the cut
slope length which would in turn reduce the distance needed for
the berming. Also, in speaking with Bob Childress of VDOT, they
may be willing to allow a 2 to 1 slope in lieu of the 4" to 1"
slope to assist in getting the ditch lower.

This is to acknowledge receipt of your revised plans dated August 14, 1989 to
the above referenced location. The plans appear satisfactory and are
approved. Please advise the developer and contractor accordingly.
I offer the following comments:
- A preconstruction conference held by the engineer and/or developer with the
attendance of the contractor, various County agencies and VDOT shall be
conducted prior to initiation of work.
- Materials used and method of construction shall apply to current observed
VDOT Road and Bridge Specifications applicable during construction of this
development. ,
- Our review and comments are general in nature; should conditions in the
field exit such that additional measures are warranted, such measures shall
.be completed to the satisfaction of the Department prior to inclusion into
the Secondary System.
- Attached is a copy of the mininImn requirements and data for subdivision
streets prior to acceptance into the Secondary System. This is the
responsibility of the developer.
- All drainage is to be carried within the right-of-way in ditch lines along
the street to a pipe or drainage easement.
- The contractor shall notify VDOT when work is to begin or cease for any
undetermined length of time. VDOT will also require 48 hours notice for
inspections.
- A land use permit shall be obtained before any work is performed on the
State's right-of-way.
- Any entrances constructed from the referenced street(s) shall meet VDOT
minim m standards prior to this street being eligible for into

Upon review of the above referenced developments construction plans dated
July 11, 1989, please find our recommendations on the attached plans marked
in red and dp follows:
1) The typical section is to be revised to show 8' fill and
6' cut shoulders with a 4' ditch width.
2) In addition to the special design ditch on the right,
a 3' flat bottom ditch will be required on the left
side of the roadway as noted.
3) A 50' radius cul-de-sac will be required on a permanent
right-of-way at the end of the proposed street.
4) The proposed 12" water line on the roadway shoulder
is to be relocated to within 5' to the right-of-way line.
Please revise and resubmit four copies for final approval. Should any
changes be deemed necessary, please design them to meet or exceed the above
recommendations.
