Dear John:
I have had an opportunity to review the preliminary subdivision plat for the Butler Manufacturing
property, revised 01-05-01. Please address the following comment:
1) Provide for an additional five -feet of right-of-way dedication along Woodbine Road. § 144-17.E
provides for expansion of existing right-of-ways.
2) Clarify the ownership of the Sanitary Sewage Treatment Plant.
3) Clarify Lot 2's road frontage on Woodbine Road.
Please address the above comments. Once all agency comments are addressed, please re -submit for a
final review. Following my final review, if all agency comments are addressed, I will request the
submittal of five copies of the completed, signed plat for approval.

Health Department: Before the Health Department proceeds, a written statement must be
submitted explaining exactly what the applicant is proposing. Approval cannot be given until
the owner is granted approval from the Office of Water Programs on both commercial
properties. According to the plat, there is no easement granted to parcel one to allow a force
main access to the existing system. A conference with the Environmental Supervisor I and
Environment 1 District Manager, must occur before approval can be determined. This mound
system currently will process 600 gallons per day. The owner must be clear on how much
sewage and water usage will be processed from Lot 2.
Planning and Zoning:
Public Meeting Requirement
The Subdivision Ordinance requires that land divisions in the M1 (Light Industrial) Zoning
District, without an approved master development plan, be presented to the Board of
Supervisors for fmal approval. This project is zoned M1 and does not contain an approved
MDP; therefore, Board review and action is necessary.
Staff Review
This parcel presently contains two buildings currently utilized for manufacturing. The
immediately surrounding properties are dominated by agricultural and residential uses.
The proposed division would establish two lots: Lot 1: 21.0483 acres and Lot 2: 12.8969
acres. As state road frontage is limited, the submitted plats indicate that an easement would
be utilized for a shared entrance accessing the properties. Staff encourages this shared
entrance as no new entrances would need to be created on Woodbine Road.
STAFF CONCLUSIONS FOR 01-03-01 PLANNING COMMISSION MEETING: Staff
recommends approval of this subdivision application contingent upon the applicant's satisfying all
review agency comments.
PLANNING COMMISSION SUMMARY & ACTION OF 01/03/01 MEETING: There were
no citizen comments. The Planning Commission believed the proposed division satisfied the
requirements of the Subdivision Ordinance and no issues were raised. The Commission unanimously
recommended approval contingent upon the applicant satisfying all of the review agency comments.
(Note: Mr. Wilson was absent from the meeting.)

This letter is to confirm that your application for Butler Manufacturing was presented to the Board
of Supervisors on January 24, 2001. During this meeting, the Board granted the Planning
Department administrative approval authority for this project, once all agency comments are
satisfactorily addressed. The Board also requested that a number of additional items be addressed
on the final plat. The board -identified items are as follows:
1. Identification and delineation of all railroad spur easements.
2. Identification and delineation of existing health systems. It was mentioned during the public
meeting that the existing health system would convey with proposed Lot 1; the lot
boundaries should be modified to accomplish such. The plat should also address how
proposed Lot 2 will be provided with appropriate health system requirements.
3. Clarify how access will be provided for Lot 2. A note of explanation on the plat may be
appropriate.

during the Board of Supervisors review. A number of items remain to be addressed before the
County can approve the subdivision.
1. VDOT's review letter requested a final plat for their signature (Hence, VDOT needs to sign
plat).
2. Provide note regarding how Lot 2 will be served with a health system (Board comment).
3. Lot 2 road access. Previous plat contained an easement. Why has the easement been
removed from the plat the Board reviewed?
4. The final plat will be approved by the Subdivision Administrator.

Please issue a refund check in the amount of $660.00 made payable to Butler Manufacturing
Company. This amount represents an overpayment for a minor non-residential subdivision. The
applicant (Butler Manufacturing Company) has requested that we accept their check and refund the
difference because their company is so large that it would take a considerable amount of time to get
a new check cut and they are anxious to proceed with their subdivision. They have requested that
we send the refund to their representative, Painter -Lewis P.L.C., Attention: Monica Butts, 302
South Braddock Street, Suite 200, Winchester, Virginia, 22601.
Butler Manufacturing Company had submitted Check Number 000 185 1, dated 11/30/2000 in the
amount of $980.00, made payable to Frederick County Treasurer. The check should have been in
the amount of $320.00 ($250.00 base fee plus two lots at $35.00 per lot). The check will be
deposited under GF1303-07 (Finance) and ZASP (Treasurer), if this request is approved by the Finance
Department.
