Pedersen, M.D., Director, Lord Fairfax Health District Dear Mr. Riley: Regarding your request for comments from the Frederick County Health Department concerning the above noted property, I have reviewed the files and have been unable to locate any record of soil profiles, drainfield locations, etc., concerning this property. William H. Hatfield, M.D., Director, Frederick County Health Depart- ment, conditionally approved the plat for Section Five, Zeiger Subdivision in January of 1976. However, neither Dr. Hatfield nor anyone else connected with the evaluation and/or approval of this property for subdivision pur- poses in 1976 is presently employed with this office. Therefore, based on the above information, this office would have no comment at this time concerning adequacy of the soils for subdivision purposes (sewage disposal). I presume the Board of Supervisors can reinstate the plat, and the health department would reevaluate them on an individual lot basis, which is always the case, at the time a sewage permit is requested. Another possible option would be to have current health department approval before rein- statement of the plat for Section Five. Enclosed is a copy of a letter from Mr. Joe Curley, Sanitarian, to Mr. Thomas M. Dickinson, Attorney, dated October 3, 1979 which outlines the conditions to be met before further health department involvement in the matter. Riley, Director Frederick County Planning and Development 9 Court Square Winchester, VA 22601 Dear John: I have reviewed my files on the Zeiger Subdivision, Section 5, and find I did not receive revised plans in accordance with our recommendations or a copy of the plans, and letter to Mr. David Zeiger, dated March 10, 1976. The only plans I have is a copy of the set marked in red by our Design Section. I have discussed this with our Design Section and we agree that as this review was almost five years ago, that we should again review the plans due to some changes in our subdivision requirements. It does not appear there will be any substantial changes. We will need two copies of the plan and profile which should be revised in accordance with previous recommendations, for review. Riley, Director, Planning and Development SUBJECT: REQUEST,OFLEON B. ZEIGER SUBDIVISIONS In reference to a letter from Thomas M. Dickinson, Jr., Attorney, I have researched the history of the vacation of Section 5 of the Zeiger Subdivision. The sequence of events is as follows: On June 8, 1977, the Board approved execution of the bond on Section 6 of the Zeiger Subdivision because necessary work had not been completed. The amount of the posted bond was $18,662.55. On July 20, 1977, the Board approved an ordinance to vacate Section 5 of the Zeiger Subdivision. This was not done upon the request of the agent. On September 14, 1977, the Board authorized a supplemental appro- priation of $7,000 to complete the work on Section 6 of the Zeiger Subdivision. The Board also authorized the Commonwealth Attorney to start legal action to recover the $7,000 and legal fees. I am of the opinion that the vacation of the plat of Section 5 was not done in accordance with Section 15.1-481 of the Code of Virginia and is, therefore, an illegal action. I would, therefore, recommend that the Board meet in executive session to consider the following points: (1) The legality of the vacation of Section 5. (2) The recovery of the supplemental appropriation in the amount of $7,000.
