ZEIGER and BETTY L. II='OC n wvrw wruor nwrr °CC!( 451 faCf 742 NOW, THEREFORE, THIS DEED -OF DEDICATION WITNESSETH: That -for and in consideration of the premises and the benefits that will accrue by reason of this.*dedication, the Grantors do hereby subdivide, grant, and dedicate in fee simple, all of that portion of land designated as Section 6, Leon B. Zeiger Subdivisi n, in Back Creek Magisterial Distri t, located just North of Route 616, Frederick County, Virginia, and more particularly described by the aforesaid plat attached her and made a part hereof and by this reference incorporated as a part of this deed as if set apart for the streets known as Zeiger Drive and Theodore Drive, and to create a public right of possession of the same, and being a portion of the same land conveyed to Leon B. Zeiger by deed dated December 19, 1972, from Alma B. Shade, widow, of record in the aforesaid Clerk's Office in Deed Book 402, at Page 388. All of the lots as shown on the plat attached hereto shall be subject to the following restrictions, which are covenan s - real running with the land, and shall be binding on all subsequen owners of the said lots, and each deed shall contain these restrictions or incorporate them by reference: 1. All the parcel or parcels of real estate hereby subdivided by this deed may be used for residential purposes only, and only one (1) single family dwelling may be erected per lot. 2. No commercial buildings shall be erected upon the lots nor shall the property be used for commercial purposes. 3. There shall be a building setback line of 35 feet from the front property line along the streets on each of the said lots, and no dwelling house or any part thereof shall be built in front of said property line, the minimum side yard for each main structure shall be 15 feet with the width of both 1 Each main structure shall side yards a minimum of 35 feet. • _2_. 743 MILK, 45 L .ace 7,13 'have a rear yard with a minimum depth of 35 feet. 4. There shall be no fences erected in the front of said lots or along the sides from the rear of dwelling house to the front property lines, however, fences may be erected in the rear of said lots, except not higher than three (3) feet, and there shall be no solid fences made of chicken wire or other farm -type fences. 8. Any residence_ constructed upon the property hereby conveyed must contain not.less than 960 square feet of floor space and at a cost of not less than $20,000.00. The party of the third part and fourth part join in this Deed of Dedication for the sole and exclusive purpose of indicating their consent to the subdivision of the subject land and by this instrument do not release or in -any wise affect that certain Deed of Trust dated December 19, 1972, of record in the 1 aforesaid Clerk's Office in Deed Book 402, at page.391, wherein the subject land was conveyed to Benjamin M. I have contacted Mr. Herbert Sluder and he has indicated that he will stamp the plat stating that lots will be approved on an individual basis. Other requirements that this office is seeking are that you submit the appropriate road profiles to the Virginia Department of Highways and Transportation for approval and you submit the appropriate bond to cover the cost of construction. Additionally, four (one original and three copies) plats signed by the owner need to be submitted to this office. Mr. Rosenberger informed me that the money is there and available, but that he cannot release the money until Mr...Zeiger's attorney Ben Butler, Esquire, gives the go ahead. At this point in time I believe it best that you as the County's attorney and Ben Butler as Mr. Zeiger's attorney work out whatever details are necessary as far as releasing the money. At that point I will be glad to resume my efforts and take care of whatever administrative details are necessary as far as receiving the money, having it deposited, and having a contract executed in order that the road in that subdivision might be built. Inclement weather including below freezing temperatures which caused the material to be graded.to be completely unworkable. 2. The construction plans for this project are incorrect which will necessitate the following: a. Complete redesign of the finished grades on the proposed street which could cause a change in storm sewer design thereby creating the need for drainage easements. b. Resubmittal of the revised plans to the Va. Dept. of Highways and Transportation for •reapproval. C. A new cost estimate made by this company if the quanitities of materials, labor, and/or equipment should increase due to plan revision.
