Zeiger Subdivision Dear John: As you can see from the attached photocopy of the letter I received from Thomas M. Dickinson, Jr., Esquire, Counsel for Leon B. Zeiger, his client, has agreed to reimburse the County for the full amount the County was -caused to pay be- cause the bond posted for roadway construction in his sub- division was not adequate. In view of the circumstances, it is my recommendation that the Board accept this offer of settlement and agree to rein- state Section 5 of that subdivision. In the letter that I received from James White, of the county, dated September 29, 1980, he simply stated that the Board of Supervisors denied our request to reinstate Section 5 for the payment of $4,000.00. Please confirm whether or not we will have Section 5 reinstated upon payment of the $6,791.15. White, County Administrator John R. Riley, Director, Planning and Development REQUEST OF LEON B. ZEIGER SUBDIVISION In reference to a letter from Thomas M. Dickinson, Jr., Attorney, I have researched the history of the vacation of Section 5 of the Zeiger Subdivision. The sequence of events is as follows: On June 8, 1977, the Board approved execution of.the bond on Section 6 of the Zeiger- Subdivision because necessary work had not been completed. The amount of the posted bond was $18,662.55. On July 20, 1977, the Board approved an ordinance to vacate Section 5 of the Zeiger Subdivision. This was not done upon the request of the agent. On September 14, 1977, the Board authorized a supplemental appro- priation of $7,000 to complete the work on Section 6 of the Zeiger Subdivision. The Board also authorized the Commonwealth Attorney to start legal action to recover the $7,000 and legal fees. I am of the opinion that the vacation of the plat of Section 5 was not done in accordance with Section 15.1-481 of the.Code of Virginia and is, therefore, an illegal action. I would, therefore,. recommend that the Board meet in executive session to consider the following points: (1) The legality of the vacation of Section 5. (2) The recovery of the supplemental appropriation in the amount of $7,000. Please be advised that I have not consulted with the Commonwealth Attorney at this time; but, will do so as soon as possible. Zeiger Subdivision, Sec- tion 5. You, or one of the Zeiger's, should contact the Health Department. The Highway Department requires plan and profile, con- tours and drainage computations for final review. Zoning_ require- ments may be met by the lots, but a street name is required to complete subdivision requirements. As to the design of the tract, it is recommended that lot 23 be redesigned to do away with the "tail" and that the intersection with Route 616 be revised. If it is not possible to design a less dangerous intersection, then access should be pro- vided at Section 4 and the un-named street should as1-de-sac in the vacinity of Lots 32 and 23.
