Strawsnyder TRANSPORTATION FOR THE 21 ST CENTURY RESOLUTION BY THE FREDERICK COUNTY BOARD OF SUPERVISORS At the regular meeting of the Board of Supervisors of Frederick County, Virginia, held August 14, 1991, it was duly moved and seconded that the following resolution be adopted. BE IT RESOLVED, that the Virginia Department of Transportation is hereby requested to add the following road to the Secondary System of Frederick County, pursuant to Section 33.1 - 229 of the Code of Virginia, 1950, as amended: WINDY HILL LANE (60' ROW) Windy Hill Subdivision From: Intersection with Route 522 To: 744.351 or 0.14 Mile West of Intersection with 522 (cul-de-sac) Length: 744.351 or 0.14 Mile The total length of this addition is 744.35 feet or 0.14 mile and as described in Deed Book 517, Page 323 and certified on December 27, 1979. BE IT FURTHER RESOLVED that since the developer has no remaining financial interest in the subdivision, the County of Frederick has recently had the right of way reconstructed to current VDOT standards and specifications and VDOT has provided the necessary inspection services to insure compliance, that all maintenance fees and surety bond requirements be waived. BE IT FURTHER RESOLVED that the Board of Supervisors does guarantee to the Commonwealth of Virginia an unrestricted right of way of 60' as described in the above referenced Deed Book and Page numbers, with the necessary easements for cuts, fills and drainage. This group was not willing to pay the necessary moneys to bring this road up to State standards. It is my feelings that Frederick County should take the leadership to get this road taken into the State System. The more tarffic and the more time passes, the worse the road gets. The lots proposed meet the requirements for the B-2 zoning district and they should meet all requirements for the subdivision regulations. Before a final plat is drawn, I would like to forward a revised preliminary plat to the Highway Department. The revised plat should have the topographic information that is currently available for this land, and it should show the intersection of the northern sixty (60) foot right-of-way with Route 522. The revised plat should also show which lots are to be served by septic tanks (I presume they are the 5.8 and 6.7 acre tracts) and which will be served by the City sewer line (I presume the two (2) three•;(3) acre lots and the 4.7 acre lot will have City sewer).
