In general the rights -of -way have held up satisfactorily. However, the following list of deficienies can be attributed to defective workmanship and/or performance of materials and will need to be corrected prior to your Guarantee Bond expiration date of April 1, 1994. ABBEY ROAD - ROUTE 1237 Utility trench settlement in pavement fronting lots -- 13, 24, 25 and 26 Pavement deterioation eastern cul-de-sac. General Note: Re-establish ditchlines and shoulders as necessary. For your reference, all pavement settlement and failed areas have been marked with white paint. I apologize for the delay in performing this inspection, however, due to inclement weather and snow cover, this delay was unavoidable. Please schedule repairs for completion on/or before April 1, 1994 (the expiration date of your one year Performance Bond). If scheduling and completion of repairs cannot be accomplished by April 1, 1994, please have the Bond extended for a period necessary to accomplish repairs.. Upon review of your information the subdivision plats and as -built plans appear to be in order. However, no land use quitclaim permit applications were included. The copies of the utility easements -and installation acceptance letters are not what we are looking for. These documents are between the individual utility companies and the developer. What we require is a permit between VDOT and the utility company. Once construction has been accepted, we will then provide Frederick County with a legal description of the streets so they may proceed with the passage of a resolution. At that point we can then discuss a practicable addition date so the required maintenance fee and surety bond amounts can be determined. MAGISTERIAL DISTRICT: Shawnee ADJACENT LAND USE & ZONING: RP Zoning & residential land use. PROPOSED USE & IMPROVEMENTS: units. REVIEW EVALUATIONS: 26 Single Family Detached Cluster VA. Dept. of Transportation: Preliminary review indicated adequate sight distance for a secondary road connection. See attached letter dated August 22, 1988. Sanitation Authority: Approves the City of Winchester providing water and sewer services to the 26 lots in the referenced subdivision. City of Winchester: See attached letter dated December 13, 1989. Fire Marshal: Move fire hydrant from west to east on Lot 4. Everything else will be satisfactory. It would be a great benefit to the community if the fire department had access across this property to subdivisions behind it. Inspections Department: Shall comply to Use Group "R" (Residential), Section 309.0 of the BOCA Building Code. Planning & Zoning: The proposed Single Family Detached Cluster housing is a permitted use in the RP zone. With the 26 units proposed on 8.99 acres the overall density is 2.9 units per acre which is well below the maximum allowed. The ordinance also requires a minimum area of 10,000 square feet per dwelling unit, which should be easily met with the 26 units proposed on this site. Cluster housing requires 25% open space dedication or in this case, 2.25 acres. The applicants are requesting a 10% C reduction in open space through the use of 2 bonus points for installing underground utilities as provided for in the ordinance. This would result in 15% open space being required or 1.34 acres, the plan indicates that 1.35 acres are provided. ADDITIONS/CHANGES 1) The possibility of a connection to the end of Village Road in Heritage Hills Subdivision should be examined. The staff has contacted the VDOT's Edinburg office regarding the possibility of a connection. VDOT indicated no objection, but stated that turning lanes may be necessary if the through road were included. 2) The plan needs to show the zoning and use of all adjoining property. 3) A 50' full landscaped buffer is required along Route 657 rather than the 40' shown on the plan, a profile should also be provided. C 4) Information on environmental features needs to be provided on the plan. 5) The plan should indicate the applicant and owners name. The Windsor Hill Estates Homeowners Association (hereinafter called The Association) shall be operated subject to the following conditions: (a) Every person or entity who is a record owner of a fee or undivided fee interest in any lot shown on the attached plats shall be a member of The Association. The foregoing is not intended to include persons or entities who hold an interest merely as security for the performance of an obligation. Membership shall be appurtenant to and may not be separated form ownership of any lot. If a member has less than a full interest in a lot, his vote shall be reduced accordingly. The total number of votes shall equal the total number of lots in said Subdivision. (c) The members of The Association shall hold their annual meeting on the fourth Monday in April of (2ach year or on such other date as is set forth in the By-laws of The Association. The members shall elect the Board of Directors of The Association at that meeting, which Board shall initially consist of three (3) members, all of whom must be lot owners. The number of Directors on the Board may be changed by the membership at their annual meeting. At this meeting The Association shall elect by a majority vote a Chairman and a Treasurer. Paved ditch needs to be installed over the existing 6" gas main at Station 3+13.88, Abbey Road. We recommend a standard concrete paved ditch in accordance with our Standard PG-2A specifications. 4. Drainage easement at the end of Abbey Road (east end) needs to be dressed up at right-of-way line. 5. The shoulder around the Abbey Road cul-de-sac (west end) needs to be reconstructed to provide a minimum 4' width. Also, it appears the ditch line can be raised at approximate Station 0+50 to eliminate the severe "drop off" at this location. 6. The water meter needs to be reset to conform to the back slope and the right-of-way dressed up in front of Lot 92. 7. A standard VDOT stop sign is needed at the intersection of Windsor Lane and Route 657. Also, the erosion at the outlet end of the culvert under this intersection needs to be corrected as well as positive drainage obtained at the inlet end. 8. VDOT has apparently looked into the sight distance for the connection with Senseny Road. Horizontal sight distance should be verified by means of a profile at the intersection of Senseny Road and Windsor Lane. Please provide this with the final Subdivision Plan and Profiles. 2. Show traffic projection count (VPD) on the plan to be used for County's future traffic study programs. Use 7 to 10 VPD per each single family lot. 3. It would seem appropriate to connect the existing Village Road through this project to Senseny Road. I understand that this was voted down during previous Commission meetings and therefore this is not a requirement. 4. A reservation strip should be set aside for future right-of-way dedication along Senseny Road to accommodate probable widening and possible realignment of Senseny Road. This would not impact the subdivision since it is in common area. DRAINAGE AND GRADING ISSUES 1.
