Enclosed you will find a copy of a plat of land that joins
'P le Orch-ard Estates (previously D. K. Russell's land there across
"`"'ifi5 Ueti ute 661) which, you will note, is dated
_- January 27, 1969. This plat, B. M. K. Subdivision, we seem to
have overlooked .putting on record. I blame the attorney and he says
it's my fault but placing the blame will not correct the situation,
i't'was simply a human error. Therefore, we are attempting to correct
it by pointing out to you,, as supervisor, that this subdivision was
approved back in 1969 by the. then Board of Supervisors, the highway
and health departments and all parties concerned, and hope that you will
give us your approval after you have studied the facts.
The land was percolated 'back in 1969 by Perry Engineering Company
and we have the report which was very satisfactory.
The 50' reserved strip is a private road going back to Ole Orchard
Estates and Mr. King of the highway department says that since it's
an already installed road, it would not come under the new specifications
for a larger road.
We have these two tracts sold for houses. Lots No. 2 & 3 are sold
as one lot and only Line house will be built on it. Lot No.,..,1, of course,
will have one house on it,
Mr. Bass will have the original plat of this subdivision along with
the restrictions at the next meeting. I would hope that you will see
favorably to making it possible for us to put this on record at your
earliest.

public view on any lot except one sign of not more than five squat
feet, advertising the property for sale or rent, or signs used by
a builder to advertise the property during the constructions and
sales period.
9. COMERCIAL VEHICLES: No lot shall be used for manu-
facturing purposes or for the sale, parking, or storage of new or
second hand automobiles or other motion vehicles.
10. GARLAGE PND RLFUS ; DISPOSAL. lNo lot shall be used or
Maintained as a dumping ground for rubbish. Trash, garbage or
other waste shall not be kept except in sanitary containers. All
incinerators or other equipment for the storage or disposal of
such material shall be kept in a clean and sanitary condition.
11. WATER SUPPLY: No individual water supply system s
be permitted on any lot unless such system is located, constructed
and equipped in accordance with the requirements, standards and
recommendations of the Frederick County Health Department. Approv
of such system as installed shall be obtained from such authority.
12. SEWAGE ;DISPOSAL: No individual sewage disposal
system shall be permitted on any lot unless such system is desi
located and constructed in accordance with the requirements,

ment, Approval of such system as installed shall be obtained from
such authority.
13. OFF-STREET PARKING: Every lot shall be provided with

time be subdivided, conveyed or sold except as a whole, unless the

provide services within the said Subdivision, with right `of i.ngres
and egress, the party of the first part and the party of the secoh
part reserving the right to determine when the same shall be

lines and shall not interfere with any existing or proposed

second part further re3erve the right to grant easements or rights
