TRANSPORTAT!0N FOR THE 21 ST CENTURY
NFORMATION AND DATA NEEDED FOR SUBDIVISION STREETS PRIOR TO ACCEPTANCE INTO
STATE SECONDARY SYSTEM
Subdivision streets may be considered eligible for acceptance
into the State Secondary System when built according to. plans
approved by the Department of Highways and Transportation,
properly maintained since completion and rendering a public
service. (Public service is generally defined as serving three
(3) occupied dwellings.)
The following is to be furnished to the County Subdivision
Administrator at least three (3) days prior to the adoption
of the resolution by the Board of Supervisors requesting
the addition.
One (1) copy of plans showing:
Roadway geometrics.
Drainage and drainage easements.
Date and place of recordation, Deed Book -number,
and page number.
Three (3) copies of final plat.
Maintenance fee - check payable to "Treasurer of Virginia".
Maintenace fee is required based on the length
of the streets being taken into the system from
the date of acceptance to June 30, (the end of
the fiscal year) . No maintenance fee is required
if the addition is effective July 1st.
Less than 1/4 mile - at the rate -of $300.00 per
year @ $25.00 per month. 1/4 mile to 1/2 mile -
at the rate of $600.00 per year @ $50.00 per month.
Over 1/2 mile - at the ratge of $1,200.00 per mile
per year prorated monthly.
Bond to guarantee workmanship and materials for one
year from date of acceptance.
Less than 1/4 mile - $3,750.00
1/4 mile to 1/2 mile - $7,500.00
Over 1/2 mile - at the rate of $15 , 000.00 per mile
Signed permits covering all utilities, publicly -or privately
owned. to occupy or cross the right of way and quitclaim-
ing any prior rights are in hand to be processed after
route numbers are assigned.
Additions will be made effective only on the first of
the month. All data is to be in the hands of the Depart -
ment of Highways and Transportation by the 20th
of the proceeding month.

THIS DEED OF DEDICATION made and dated this day of
1988, by and between Bedford Village Limited
Partnership, d Virginia limited partnership, party of the first
part, hereinafter called Declarant, and County of Frederick,
Virginia, party of the second part.
WHEREAS, Declarant is the owner in fee simple of the
real estate shown on the attached plat drawn by H. Bruce Edens,
C.L.S., dated October 30, 1987, revised November 13, 1987, known
as Bedford Village Subdivision. This is the same real estate
conveyed to Declarant by deed from Northern Counties Development
Corporation, a Virginia corporation, said deed dated
1988 and recorded in the Office of the Clerk of the Circuit
Court of Frederick County, Virginia, in Deed Book at Page
; and
WHEREAS, said real estate, as shown on the aforesaid
attached plat, has been subdivided into lots, and the attached
plat shows accurately the metes and bounds of the subdivided
land, together with the dimensions of each lot thereof (and also
shows those certain easements reserved for installation and
maintenance of water and sewer facilities for said lots), and
further shows certain public streets which shall constitute a
portion of that development known as Bedford Village
Subdivision; and
WHEREAS, Declarant now desires to subdivide the same
into lots to be known as Bedford Village Subdivision. The
subdivision of said real estate, as it now appears on the
aforesaid attached plat, is with the free consent and in
accordance with the desires of the undersigned Declarant, and
the parties hereto further desire to subdivide the aforesaid
real estate in accordance with the provisions of "The Virginia
Land Subdivision Act" as are applicable and in force and effect
as of the date of execution of this Deed of Dedication.
NOW THEREFORE, THIS DEED OF DEDICATION WITNESSETH:
That for and in consideration of the premises and the benefits"
which will accrue by reason of this dedication, Declarant does
hereby subdivide, grant and dedicate in fee simple all of that
certain tract or parcel of land designated as Bedford Village
Subdivision, lying and being situate in Shawnee Magisterial
District, Frederick County, Virginia, and being more
particularly described on the aforesaid plat of H. Bruce Edens,
C.L.S., dated October 30, 1987, attached hereto and by reference
made a part hereof.
All of the lots shown on the plat attached hereto shall
be subject to the following restrictions and covenants and
articles, which are covenants running with the land, and shall
be binding upon all parties having any right, title and interest
in and to the aforesaid lots, or any part thereof, their heirs,
successors and assigns, and shall inure to the benefit of each
owner thereof.
ARTICLE I. DEFINITIONS
Section 1. "Lot" shall mean and refer to any of the
lots designated upon the plat of Bedford Village Subdivision.
Section 2. "Owner" shall mean and refer to the record
owner, whether one or more persons or entities, of a fee simple
title to any Lot which is a part of Bedford Village Subdivision,
including contract sellers, but excluding those having such
interest merely as security for the performance of an obligation
Section 3. "Declarant" shall mean and refer to Bedford)
Village Limited Partnership, its successors and assigns.
ARTICLE II. ARCHITECTURAL REVIEW AND CONTROL
Section 1. Purpose. No building or other site improve
went (structural or otherwise), shall be erected, placed or

altered on any Lot until the construction plans and specifica-
tions and a plan showing the location of the structure have beer
approved by the Architectural Review Committee, as hereinafter
defined, as to the quality of workmanship, materials,
color, harmony of external design with the existing structures
and as to location. Notwithstanding anything contained herein
to the contrary, Declarant shall, at all times, be exempt from
the architectural review and control imposed by this article.
Section 2. Architectural Review Committee. Declarant
shall appoint an Architectural Review Committee which shall
consist of three (3) members who shall serve a one (1) year
term. Declarant shall appoint successors for all such members
until such time as Declarant has sold and conveyed more than
seventy-five percent (75%) of the lots in this subdivision.
Thereafter, the appointment of successors shall be made by the
Owners of a majority of the Lots in the subdivision. Each lot
owner shall be entitled to cast one vote, for each Lot owned,
for each vacancy.
Section 3. Architectural Review Procedures. The
committee shall review and act upon all lot owners' requests and
submissions. The committee, in its discretion, shall establish
architectural, landscaping and site design guidelines for the
individual lots in the subdivision. Requests for action by the
committee, together with any fee established by the committee,
shall be submitted in writing, with supporting design exhibits.
Section 4. Additional Review Procedures. Each Owner,
by acceptance of title or possession of a Lot, covenants and
agrees that each building and/or structure shall be placed on
the premises only in accordance with approved plans and specifi-
cations. No alteration in the exterior appearance of a building
or structure shall be made without the approval of the Architec-'

tural Review Committee.
ARTICLE III. RESTRICTIVE COVENANTS APPLICABLE TO ALL LOTS
All Lots shall be subject to the following restrictive
covenants, which shall be covenants real running with the land:
1. All Lots shall be used for single family
residential purposes only.
2. No profession or home occupation shall be conducted
in or on any part of a Lot; provided, however, that Declarant
reserves the right to use one or more of said Lots for business
purposes in connection with the development, sales and operation
of said subdivision.
3. No signs or advertising of any nature shall be
erected or maintained on any Lot, except for sale or rental
signs for said Lot not to exceed five (5) square feet in area,
or signs used by a builder to advertise the property during
construction and sale.
4. No exterior antennas, satellite dishes or similar
device shall be permitted on any Lot.
5. No boats, mobile homes, motor homes, campers,
buses, trailers of any type, tractors, trucks or other motor
vehicles (other than automobiles, motorcycles, pickup trucks and
3/4 ton [or less] vans) shall be permitted on any Lot except
during the course of construction. No motor vehicle or material
portion thereof which does not have a current license and
current Virginia inspection sticker shall be permitted on any
Lot.
6. No animals of any kind (including livestock,
poultry or birds) shall be permitted on any Lot, except that
dogs, cats and other usual household pets may be kept, provided
they are not kept, bred or maintained for commercial purposes or
in unusual numbers, and further provided that no household pets

shall be permitted to run at large in said subdivision.
7. No noxious or offensive activities shall be carried
on upon any Lot, nor shall anything be done thereon which may be
or may become an annoyance or nuisance to the neighborhood.
8. In the event that a dwelling is destroyed, the
Owner of the dwelling, within thirty (30) days from said
destruction, shall clear away the remaining portion of the
dwelling unit and maintain the Lot in a neat and orderly
condition. No structure, other than a single family residence,
shall be constructed in the place of the original unit.
9. Each owner shall keep all Lots owned by him and all
improvements therein or thereon in good order and repair and
free of debris, including, but not limited to, the seeding,
watering and mowing of all lawns, the pruning and cutting of all
trees and shrubbery, and the painting (or other appropriate
external care) of all buildings and other improvements, all in a
manner and with such frequency as is consistent with good
property management.
10. No Lot shall be used or maintained as a dumping
ground for rubbish. Trash, garbage or other waste shall be in
sanitary containers. All incinerators or other equipment for
the storage or disposal of such material shall be kept in a
clean and sanitary condition in the rear. No refuse or any
container for same shall be placed or stored in front of any
Lot, except on the date of garbage pickup.
11. No trees shall be planted nor other digging
undertaken without first securing the approval of the local
power company and without first being advised as to the location
of all underground electrical and telephone wires.
12. No exterior clothesline, or hanging device, shall
be permitted on any Lot.

13. If, in the construction of any dwelling by
Declarant, there occurs an encroachment, then such encroachment
shall be deemed a perpetual easement for the benefit of the
dominant Lot.
14. No Lot upon which a single family residence has
been constructed shall be further subdivided or separated into
smaller lots by any owner and no portion less than all of such
Lot, nor any easement or other interest therein, shall be
conveyed or transferred by an Owner, provided that this shall
not prohibit deeds of correction, deeds to resolve boundary
disputes and similar corrective instruments.
15. All of the covenants and restrictions herein shall
be binding and remain in full force and effect for a period of
fifteen (15) years from the date of this instrument and shall be
renewed automatically for additional successive ten (10) year
periods, unless the Owners of a majority of Lots in Bedford
Village Subdivision shall, at least six (6) months prior to any
such renewal date, execute and record an agreement amending said
covenants and restrictions.
16. Declarant herein reserves and shall have the right
alone to waive any one or more of the restrictive covenants and
conditions contained herein as to any Lot transferred by it,
except that it cannot change the use of any Lot from residential
to commercial. This waiver shall not affect the binding effect
of the covenants and conditions upon any other Lot. Declarant
further reserves the right alone to impose additional
restrictive covenants and restrictions as to any Lot or Lots
owned by it at the time of the imposition and such imposition
shall not affect the binding effect of these provisions upon any
other Lots.
17. The invalidation of any one of the covenants or

restrictions contained herein by judgment or court order shall
in no wise affect any of the other provisions which shall remain
in full force and effect. The failure of the lot owners or
Declarant herein to enforce any covenants or restrictions shall
not be deemed to be a waiver of the right to do so thereafter as
to a default occurring prior or subsequent thereto.
18. The principal dwelling on each lot shall meet the
total net usable/livable space (outside foundation), exclusive
of porches, carports, garages and basements, of one thousand
four hundred (1,400) square feet.
19. The roof line of any dwelling shall have a minimum
pitch of five (5) feet of rise for every twelve (12) feet of runt
(5/12 pitch).
ARTICLE IV. EASEMENTS
Section 1. Sewer Easement. The property dedicated
hereby is subject to that certain easement or right of way
designated "Sanitary Sewer Easement" on the aforesaid attached
plat. Declarant does hereby grant and convey unto the Frederick
County Sanitation Authority a perpetual right of way or easement
over the aforesaid right of way for the installation and
maintenance of sewer lines and any related facility designated
on the aforesaid plat as "Sanitary Sewer Easement."
Section 2. Surface Drainage Easement. The property
dedicated hereby is subject to those certain easements or rights
of way designated "Drainage Easement" on the aforesaid attached
plat for the purpose of surface water drainage easements. No
structures of any kind which substantially impede or obstruct
the flow or ponding of surface drainage water may be placed
within said surface water drainage easements designated on the
aforesaid attached plat. Said surface water drainage easements
may not be altered or modified without the prior consent of the

County of Frederick, Virginia, and Declarant does hereby grant
and convey unto the County of Frederick, Virginia, a perpetual
right of way or.easement over the aforesaid designated surface
drainage easements for the purpose of so providing surface
drainage.
Section 3. Reservations. Declarant reserves unto
itself, its successors or assigns, the right to erect, maintain,
operate and replace underground and above ground telephone and
electric light conduits, related equipment and other facility,
sewer, gas, water and television lines and related equipment,
and other utility equipment where such utility lines and
equipment are now located and along the ten (10) foot strip
along the front and rear of each Lot and a ten (10) foot strip
centered on the side line of each adjoining Lot, and a ten (10)
foot strip along the boundary of all non -adjoining Lots.
ARTICLE V. GENERAL PROVISIONS
Section 1. Enforcement. Any Owner shall have the
right to enforce, by proceeding at law or in equity, all.
restrictions, conditions, covenants, reservations, liens and
charges now or hereafter imposed by the provisions of this Deed
of Dedication. Failure by any Owner to enforce any covenant or
restriction herein contained shall in no event be deemed a
waiver of the right to do so thereafter. In the event that any
such Owner or Owners should be successful in any legal
proceeding to enforce the covenants or restrictions against a
Lot Owner found to be in violation thereof, then, in such event,
the Owner who prevails shall also be entitled to recover his
reasonable attorney's fees incurred in prosecuting such legal
action.
Section 2. Severability. Invalidation of any one of
these covenants or restrictions by judgment or court order shall

force and effect.

THIS DEED OF DEDICATION made and dated this
day of
1988, by and between Bedford Village Limited
Partnership, a Virginia limited partnership, party of the first
part, hereinafter called Declarant, and County of Frederick,
Virginia, party of the second part.
WHEREAS, Declarant is the owner in fee simple of the
real estate shown on the attached plat drawn by H. Bruce Edens,
C.L.S;-, dated October 30, 1987, revised November 13, 1987, known
as Bedford Village Subdivision. This is the same real estate
conveyed to Declarant by deed from Northern Counties Development
Corporation, a Virginia corporation, said deed dated ,
1988 and recorded in the Office of the Clerk of the Circuit
Court of Frederick County, Virginia, in Deed Book at Page
; and
WHEREAS, said real estate, as shown on the aforesaid
attached plat, has been subdivided into lots, and the attached
plat shows accurately the metes and bounds of the subdivided
land, together with the dimensions of each lot thereof (and also
shows those certain easements reserved for installation and
maintenance of water and sewer facilities for said lots), and
further shows certain public streets which shall constitute a
portion of that development known as Bedford Village
Subdivision; and
WHEREAS, Declarant now desires to subdivide the same
into lots to be known as Bedford Village Subdivision. The
subdivision of said real estate, as it now appears on the
aforesaid; attached plat, is with the free consent and in
accordance with the desires of the undersigned Declarant, and
the parties hereto further desire to subdivide the aforesaid
real estate in accordance with the provisions of "The Virginia
Land Subdivision Act" as are applicable and in force and effect
as of the date of execution of this Deed of Dedication.
NOW THEREFORE, THIS DEED OF DEDICATION WITNESSETH:
That for and in consideration of the premises and the benefits
which will accrue by reason of this dedication, Declarant does
hereby subdivide, grant and dedicate in fee simple all of that
certain tract or parcel of land designated as Bedford Village
Subdivision, lying and being situate in Shawnee Magisterial
District, Frederick County, Virginia, and being more
particularly described on the aforesaid plat of H. Bruce Edens,
C.L.S., dated October 30, 1987, attached hereto and by reference.
made a part hereof.
All of the lots shown on the plat attached hereto shall
be subject to the following restrictions and covenants and
articles, which are covenants running with the land, and shall
be binding upon all parties having any right, title and interest
in and to the aforesaid lots, or any part thereof, their heirs,
successors and assigns, and shall inure to the benefit of each
owner thereof.
ARTICLE I. DEFINITIONS
Section 1. "Lot" shall mean and refer to any of the
lots designated upon the plat of Bedford Village Subdivision.
Section 2. "Owner" shall mean and refer to the record
owner, whether one or more persons or entities, of a fee simple

title to`.any Lot which is a part of Bedford Village Subdivision,
including contract sellers, but excluding those having such
interest merely as security for the performance of an obligation]
;Section 3. "Declarant" shall mean and refer to Bedford)
Village Limited Partnership, its successors and assigns.
ARTICLE II. ARCHITECTURAL REVIEW AND CONTROL
Section 1. Purpose. No building or other site improve{
ment (structural or otherwise), shall be erected, placed or

altered on any Lot until the construction plans and specifica-
tions and a plan showing the location of the structure have beer
approved by the Architectural Review Committee, as hereinafter
defined, as to the quality of workmanship, materials,
color, harmony of external design with the existing structures
and as to location. Notwithstanding anything contained herein
to the contrary, Declarant shall, at all times, be exempt from
the architectural review and control imposed by this article.
Section 2. Architectural Review Committee. Declarant
shall appoint an Architectural Review Committee which shall
consist of three (3) members who shall serve a one (1) year
term. Declarant shall appoint successors for all such members
until such time as Declarant has sold and conveyed more than
seventy-five percent (75%) of the lots in this subdivision.
Thereafter, the appointment of successors shall be made by the
Owners of a majority of the Lots in the subdivision. Each lot
owner shall be entitled to cast one vote, for each Lot owned,
for each vacancy.
Section 3. Architectural Review Procedures. The
committee shall review and act upon all lot owners' requests and
submissions. The committee, in its discretion, shall establish
architectural, landscaping and site design guidelines for the
individual lots in the subdivision. Requests for action by the
committee, together with any fee established by the committee,
shall be submitted in writing, with supporting design exhibits.
Section 4. Additional Review Procedures. Each Owner,
by acceptance of title or possession of a Lot, covenants and
agrees that each building and/or structure shall be placed on
the premises only in accordance with approved plans and specifi-
cations. No alteration in the exterior appearance of a building
or structure shall be made without the approval of the Architec-

tural Review Committee.
ARTICLE III. RESTRICTIVE COVENANTS APPLICABLE TO ALL LOTS
All Lots shall be subject to the following restrictive
covenants, which shall be covenants real running with the land:
1. All Lots shall be used for single family
residential purposes only.
2. No profession or home occupation shall be conducted
in or on any part of a Lot; provided, however, that Declarant
reserves the right to use one or more of said Lots for business
purposes in connection with the development, sales and operation
of said subdivision.
3. No signs or advertising of any nature shall be
erected or maintained on any Lot, except for sale or rental
signs for said Lot not to exceed five (5) square feet in area,
or signs used by a builder to advertise the property during
construction and sale.
4. No exterior antennas, satellite dishes or similar
device shall be permitted on any Lot.
5. No boats, mobile homes, motor homes, campers,
buses, trailers of any type, tractors, trucks or other motor
vehicles (other than automobiles, motorcycles, pickup trucks and
3/4 ton [or less] vans) shall be permitted on any Lot except
during the course of construction. No motor vehicle or material
portion thereof which does not have a current license and
current Virginia inspection sticker shall be permitted on any
Lot.
6. No animals of any kind (including livestock,
poultry or birds) shall be permitted on any Lot, except that
dogs, cats and other usual household pets may be kept, provided
they are not kept, bred or maintained for commercial purposes or
in unusual numbers, and further provided that no household pets

shall be permitted to run at large in said subdivision.
7. No noxious or offensive activities shall be carried
on upon any Lot, nor shall anything be done thereon which may be
or may become an annoyance or nuisance to the neighborhood.
8. In the event that a dwelling is destroyed, the
Owner of the dwelling, within thirty (30) days from said
destruction, shall clear away the remaining portion of the
dwelling unit and maintain the Lot in a neat and orderly
condition. No structure, other than a single family residence,
shall be constructed in the place of the original unit.
9. Each Owner shall keep all Lots owned by him and all
improvements therein or thereon in good order and repair and
free of debris, including, but not limited to, the seeding,
watering and mowing of all lawns, the pruning and cutting of all
trees and shrubbery, and the painting (or other appropriate
external care) of all buildings and other improvements, all in a
manner and with such frequency as is consistent with good
property management.
10. No Lot shall be used or maintained as a dumping
ground for rubbish. Trash, garbage or other waste shall be in
sanitary containers. All incinerators or other equipment for
the storage or disposal of such material shall be kept in a
clean and sanitary condition in the rear. No refuse or any
container for same shall be placed or stored in front of any
Lot, except on the date of garbage pickup.
11. No trees shall be planted nor other digging
undertaken without first securing the approval of the local
power company and without first being advised as to the location
of all underground electrical and telephone wires.
12. No exterior clothesline, or hanging device, shall
be permitted on any Lot.

Declarant, -there occurs an encroachment, then such encroachment
shall be deemed a perpetual easement for the benefit of the
dominant Lot.
14. No Lot upon which a single family residence has
been constructed shall be further subdivided or separated into
smaller lots by any Owner and no portion less than all of such
Lot, nor any easement or other interest therein, shall be
conveyed or transferred by an Owner, provided that this shall
not prohibit deeds of correction, deeds to resolve boundary
disputes and similar corrective instruments.
15. All of the covenants and restrictions herein shall
be binding and remain in full force and effect for a period of
fifteen (15) years from the date of this instrument and shall be
renewed automatically for additional successive ten (10) year
periods, unless the Owners of a majority of Lots in Bedford
Village Subdivision shall, at least six (6) months prior to any
such renewal date, execute and record an agreement amending said
covenants and restrictions.
16. Declarant herein reserves and shall have the right
alone to waive any one or more of the restrictive covenants and
conditions contained herein as to any Lot transferred by it,
except that it cannot change the use of any Lot from residential
to commercial. This waiver shall not affect the binding effect
of the covenants and conditions upon any other Lot. Declarant
further reserves the right alone to impose additional
restrictive covenants and restrictions as to any Lot or Lots
owned byit at the time of the imposition and such imposition
shall not affect the binding effect of these provisions upon any
other Lots.
17. The invalidation of any one of the covenants or

restrictions contained herein by judgment or court order shall
in no wise affect any of the other provisions which shall remain
in full force and effect. The failure of the lot owners or
Declarant herein to enforce any covenants or restrictions shall
not be deemed to be a waiver of the right to do so thereafter as
to a`default occurring prior or subsequent thereto.
18. The principal dwelling on each lot shall meet the
total net usable/livable space (outside foundation), exclusive
of porches, carports, garages and basements, of one thousand
four hundred (1,400) square feet.
19. The roof line of any dwelling shall have a minimum
pitch of five (5) feet of rise for every twelve (12) feet of run
(5/12 pitch).
ARTICLE IV. EASEMENTS
Section 1. Sewer Easement. The property dedicated
hereby is subject to that certain easement or right of way
designated "Sanitary Sewer Easement" on the aforesaid attached
plat. Declarant does hereby grant and convey unto the Frederick
County,Sanitation Authority a perpetual right of way or easement
over the aforesaid right of way for the installation and
maintenance of sewer lines and any related facility designated
on the aforesaid plat as "Sanitary Sewer Easement."
.li Section 2. Surface Drainage Easement. The property
dedicated hereby is subject to those certain easements or rights)
of way designated "Drainage Easement" on the aforesaid attached
plat for the purpose of surface water drainage easements. No
structures of any kind which substantially impede or obstruct
the flowor ponding of surface drainage water may be placed
within said surface water drainage easements designated on the
aforesaid attached plat. Said surface water drainage easements
may not be altered or modified without the.prior consent of the

County'of Frederick, Virginia, and Declarant does hereby grant
and convey unto the County of Frederick, Virginia, a perpetual
right of way or easement over the aforesaid designated surface
drainage easements for the purpose of so providing surface
drainage.
Section 3. Reservations. Declarant reserves unto

As discussed by telephone today the 12" C.M.P. under the private entrance to
Lot #18 in the referenced development does not meet our minimum size
requirements. In order for Bedford Drive to be considered eligible for
addition into the State's Secondary Road System this culvert will need to be
replaced with a minimum 15" or equivalent size pipe.

As requested, a review of the above referenced subdivision site plans have been
made. Attached you will find one (1) set of the plans with changes marked in
red. We are listing below our comments:
1. The cul-de-sac must be designed with a minimum of 40' radius (45'
desirable) as noted.
2. The drainage appears -satisfactory, however, a drainage ditch with sod or
soil stabilization mat Standard DC-3 should be provided within the 20'
drainage easement. Since 10' of the easement falls on each side of the
property line between this subdivision and the Apple Ridge Subdivision, the
ccnstn-' icn of the ditch should be worked out between the two (2)
developers.
3. A 20' drainage easement to be provided across the beck of Lot No. 10 to
assure flaw within the drainage hollow if development occurs upstream.
All drainage is to be carried within the right-of-way in ditch lines along the
streets to a pipe for a drainage easement.
Please be sure the developer understands the minimum requirements for a private
entrance. In the past we have had problems with the -developer cxmstructing
private entrances according to the minimum requirements. Any mailboxes should
be placed behind the proposed ditch line.
Attached is a cxapy of the minimum requirements for subdivision streets prior to
acceptance into the Secondary System. This is the responsibility of the
developer.
