Crisman's 1954 Subdivision", containing 31.38 acres, more or less, lying just north of the corporate limits of the City of Winchester, in Stonewall agis- aerial District of Frederick County, Virginia, the chain of title to which appears below, and do hereby request that the proper officials designated by the County of Frederick, Virginia, and the Board of Supervisors of Frederick County, Virginia' approve said plat, so that the same may be recorded in the Jffice of the Clerk of I11III The chain of title and description of the property being subdivided are as follows: That certain, parcel of land, situate just north of the cor- -orate limits of the City of I"dinchester, in Stonewall 1,11agisterial District of Frederick County, Virginia, containing 31.38 acres, more or less, being a part of the land designated as Tracts 1 and 3 in that certain deed from Ira L. Swiger and yaude Swiger, his .,vife, to Helen Z. Crisman, dated Tay 25, 1936, of record in the II Office of the Clerk of the Circuit Court of Frederick County, Virginia, in Deed Book 171, at Page 426, and being a part of the land designated as Parcels 1 and 3, in that certain deed from Helen Z. Crisman and Fred A. Crisman, her husband, to ;'Helen Z. Crisman and Fred A. Crisman, her husband, bearing date October 7, 1948, of record in the aforesaid Clerk's Office in Deed Book 207, at Page 194. Said l parcel of land is more particularly described as follows, to -wit: "Beginning at (1) the Northwest corner of Lot No. 19 of F. A. ICrisman's Addition No. 1 and in the East line of the Cumberland Valley Railroad right-of-:vay,• thence with the East line of the railroad N 49 deg:. 45 min. E 1515.6 feet to (2) the point of intersection of the South side of Lee Street with the East line of the railroad; thence with the South line of Lee Street S 62 deg. 45 min. E 263.7 feet to (3) the intersection of the South side of Lee Street with the East I side of Pennsylvania Avenue; thence with the East side of Pennsylvania Avenue S 49 deg. 45 min,. 71 7.8 feet to (4) thence S 27 deg. 15 min. W 900.7 feet to the point of beginning." All of the lots on the plat attached shall be conveyed sub- ject to the following restrictions listed below. These restrictions are made covenants real, running with the land, and shall be binding upon all subsequent owners and enforceable by the grantors and all subsequent owners of all lots in th subdivision known as "F. A. Crisman's 1954 Subdivision". Each deed from the under, ^mers and proprietors shall contain an incorporation therein of these res- signed o, tractions by reference to this instrument. 1. Except for the lot of Thomas N. Lupton, the lots of Gilbel, F. Dove, and Lot No. 641 none of said lots shall, at any time, be subdivided, con- veyed or sold except as a whole. 2. No dwelling shall be erected on any of said lots to cost {t less than $7,600.00, based on the Revised Kidlesale Price Index for Building Materials (1947-49-100) as of January, 1954, published by the U. S. Department of 399 jin accordance with the change in said Index between January, 1954, and the month I ;immediately preceding the date of completion of such dwelling. 3. %4o dwelling or building, including porches and verandas, shall be constructed or maintained on any of said lots closer than twenty (20) feet to the curb line of the street in front of the lot nor shall any dwelling or build- ing, including porches and verandas, be constructed or maintained on any of said lots closer than ten (10) feet to the curb line of any of the streets on the side I�f each lot. For the purposes of this restriction the portion of the lot having ,the shortest measurement on any of said streets shall be considered the front of said lot and the portion of the lot having the longest measurement on any of said Istreets shall be considered as the side of said lot. j 4. 1Vo hogs or cows shall be kept on any of the lots in said isubdivision, nor shall any nuisance be maintained or kept on any of said lots. NOW, ThEREFORE, THIS DEhD JF CORRECTION, WITNESSETh: That in consideration of the premises the parties of the firs] part hereto covenant and agree that any errors of descriptions shown on the said former plats, or made in any former deeds, insofar as they are inconsistent with the descriptions shown on the plat being hereby dedicated, are hereby amended, and, to this end, the parties of the first part do hereby grant, bargain, sell and conv to the parties of the second part all right, title and interest they may have in and to any property erroneously described in said former plats and deeds, and in- consistent with the descriptions shown on the plat being hereby dedicated, it bein the intention of the parties to this deed to confirm title and establish the boundaries of the property of the present owners of the land as it is shown on the plat attached hereto. In further consideration of the premises, the parties of the first part do hereby remove and rescind all former restrictive covenants placed on the said property, and do hereby consent and agree that all of the property shown on the attached plat shall be subject to the four restrictive covenants hereinabov� enumerated. The County of Frederick, Virginia, joins in this instrument as evidenced of its agreement that the aforementioned plats may be vacated by the undersigned owners and proprietors and as evidence of its further agreement that it has no right, title or interest in and to the streets and proposed streets sho on the aforementioned plats being vacated by this instrument, and to this end the County of Frederick, Virginia, by joining in this �strument, does hereby grant and convey to the parties of the second part any right, title or interest it may have acquired in any of the aforementioned deeds of dedication and plats being vacated by this instrument. Please submit information including the anticipated flow, the pipe material, slope and capacity, to show that the proposed sanitary sewer has sufficient design capacity for the development. 2. The plan proposes multiple lateral connections only 20 feet apart on the existing sanitary sewer, this will degrade the condition of the existing sewer. Therefore, the section of the sanitary sewer where these multiple connections are proposed should be completely replaced with sanitary wyes installed to serve the proposed development. 1. Please submit a water system report that shows that the proposed system will meet the requirements for minimum pressures in the main. 2. What is the length of the dead end main from the closest City water main loop? 3. Please add valves on the proposed main at each branch of the main. PROVIDING QUALITY SERVICES TO OUR CITIZENS IN A COST-EFFECTIVE, EFFICIENT AND COURTEOUS MANNER, WHILE ANTICIPATING THE FUTURE NEEDS OF OUR COMMUNITY 4. Please include a drainage area map for the on -site storm sewer system. Please include inlet calculations for the on -site storm sewer system. 4. Please obtain a letter from the County accepting the drainage as proposed. Specifically, that the County accepts this project with out providing on -site detention. 1. Section 165-37(9) permits adjoining properties to utilize this method and the requirement for signature of all appropriate property owners can mean one person or several persons. Comments made regarding the final plats may not be accurate if changes are made to the SDP which affect the final plats. The proposed final plats were received for review on August 9, 2002. Regarding the SDP, I offer the following comments: 1. Provide a graphic scale on Sheets 2 and 3. 2. Add the number of proposed units in the project information block on Sheet 1. 3. Add information pertaining to the total area of the subdivision, area in lots, and area in open space. 4. The driveway serving the Frederick County portion of the development does not have a street name. Approved street names are obtained through Marcus Lemasters, Director of the GIS Department, at (540)665-5651. 5. Provide a section of driveway, curb/gutter, and sidewalk detail. Also, label the proposed sidewalks on the plan view. 6. Provide the boundary information around the perimeter for the proposed lots. 7. Proposed Unit 6 does not appear to meet the side setback requirement of 20' from the parking area on the right side of the unit. 8. Provide a hedge planting detail. 9. Provide an Ownership Certification/approval block. 10. The Board of Supervisors granted a waiver to develop this property. Provide this information on the cover sheet. 11. Provide a lighting detail including a statement pertaining to glare reduction on adjoining properties. 12. Provide a dumpster pad and gate detail block. 13. Several issues concerning drainage and erosion and sediment control will be addressed on the Subdivision Design Plan. Parks and Recreation: Plan appears to meet the recreational unit requirements for this development; however, a summary of required, provided and usable open space is needed. Planning and Zoning: Public Meeting Requirement The Subdivision Ordinance requires that land divisions in the RP (Residential Performance) Zoning District, without an approved master development plan, be presented to the Board of Supervisors for final approval (§144-12-B). The Master Development Plan (MDP) requirement may be waived, and has been waived for this project as permitted by § 165-134A. On May 8, 2002, a letter from staff was provided to the applicant which granted a waiver to the MDP requirements This project contains land zoned RP and does not have an approved MDP; therefore, Board review and action is necessary. Staff Review The subject subdivision request involves a concept to subdivide the subject property along the zoning district lines and to develop six (6) townhouse units. The subject property recently obtained approval (#01-99) to rezone a 0.60 acre portion of the property from RP (Residential Performance) to B2 (Business General). The site plan for the B2 portion of the property has been approved and all proffers associated with the rezoning have been satisfied. The applicant has submitted the required subdivision application and the required fee for the subdivision design plan. Exhibit "A" illustrates the subject property being bisected by the corporate limits of Winchester and Frederick County. Six (6) townhouse units are proposed in the Frederick County portion and eight townhouse units are proposed in the City of Winchester portion of the property. The illustrated Category "A" buffer is required to separate the zoning districts in the Frederick County portion of the property. Subdivision #12-02, Kim & Marietta Walls Page 3 June 28, 2002 STAFF CONCLUSIONS FOR 06-19-02 PLANNING COMMISSION MEETING: The applicant has not satisfied all review agency comments associated with this subdivision proposal. At the time of this staff report, the applicant has not provided a recommendation for approval from the Virginia Department of Transportation (VDOT). The applicant has provided a VDOT review letter dated March 13, 2002. The letter does not provide plan approval recommendation but addresses plan detail revisions and a comment pertaining to trip generation data. The applicant is seeking approval of the conceptual layout while the subdivision design plan is currently being circulated for technical review. Staff is seeking administrative approval authority, therefore a recommendation from the Planning Commission to the Board of Supervisors regarding the subdivision request is desired. Should the Planning Commission forward a favorable recommendation, it would be appropriate prior to administrative approval, to require the applicant to: Provide language in the subdivision plan and final plats for the townhouse development pertaining to the establishment and maintenance of the required 50' common shared buffer and screening easement. PLANNING COMMISSION SUMMARY & ACTION OF 06/19/02 MEETING: The applicant's representative agreed to show the buffer and screening easement on all the plats and to provide language for the buffer and screening easement to the Planning Staff for the approval of the subdivision design plan. The applicant's representative noted that once commercial development has occurred, an inter -parcel access connection will provide through movement out to Rt. 11. Questions from the Commission centered on buffering and screening issues, the removal of trees, the water and sewer provider, and whether the City's street requirements could be met. There were no public comments. The Commission unanimously recommended approval of the subdivision request and granted administrative approval authority to the staff for the subdivision design plans. (Note: Commissioner Light and Commissioner Triplett were absent from the meeting.)
