The abandonment will result in the construction of cul-de-sacs on Macedonia Church Road at its future intersection with Warrior Drive. Phased Construction As part of the development of the Wakeland Manor residential project, the developer (Centex Homes) is responsible for constructing a two-lane section of Warrior Drive across the limits of the project. The developer has agreed to construct Warrior Drive from its current terminus at Tasker Road, north across the Wakeland Manor project. The constructed portion of Warrior Drive will be terminated approximately 300 feet south of the Opequon Creek. Transportation planning is the process of defining problems and opportunities, identifying potential courses of action, evaluating the alternatives, gathering public input, and recommending a set of specific projects. Transportation pmgramming entails deciding when chosen projects from plans should be funded, or programmed, within budgetary constraints. Our goals for public participation during planning and programming are to: • Identify improvements to the transportation system that will help citizens meet their mobility needs • Identify specific elements of a community that may be impacted by a planned transportation improvement • Prioritize proposed improvements and recommend which should be pro- grammed and moved forward in the project development process The primary objectives of this public involvement process are to: • Educate citizens about the planning and programming processes • Explain where in those processes the public can participate • Explain how the public's input will be used Take a Look Around Consider the roads and streets around your home, neighborhood, city and state. Two important products of the transportation plan- ning process at VDOT are the Statewide Transportation Plan and the State Highway Plan, which along with Small Urban Area Studies and Corridor and Feasibility Studies, help guide transportation improvements needed for the fu- ture. The Statewide Transportation Plan The Statewide Transportation Plan represents the Commonwealth's commitment to uniting all modes of transportation in Virginia- highways, rail and public transportation, ports and aviation- into a coordinated planning effort spearheaded by the Virginia Secretary of Transportation. The plan sets forth transportation policies, strategies, and programs to guide Virginia's transportation agencies (VDOT, DRPT, Virginia Depart- ment of Aviation, and Virginia Port Authority) for the future. The Statewide Transportation Plan public involvement process includes stakeholder and citizen meetings, special interest group meetings, surveys, brochures, videos, an e-mail address, a toll -free number and a web site. ®r, The State Highway Plan The State Highway Plan, a long-range plan updated every five years, outlines recommended improvements to the interstate and primary road systems. Several components are combined in developing the plan, including MPO plans from urbanized areas, small urban area transportation studies, corridor studies and VDOT staff field recommendations. Analysis used in the development of the State Highway Plan serves as a foundation for identifying highway needs in the Statewide Transportation Plan. There are several opportunities during the development of the State Highway Plan for citizens to get involved. VDOT holds annual public information meetings in each of VDOT's nine construction districts to seek public input on identifying State Highway Plan goals and objectives and transportation issues, or to receive comments on draft highway rec- ommendations on the interstate and primary road systems. Additionally, VDOT's web site lets the public review recommendations and provide feedback on the State Highway Plan throughout its development. In ad- dition, the draft and final versions of the State Highway Plan will be made available on the web site, at VDOT district offices and at local li- braries for citizens to review and respond. Public Involvement Guide Page 5 Small Urban Area Transportation Studies VDOT conducts small urban area transportation studies in urban areas with populations the U.S. Census Bureau has deternvned to be between 2,500 and 49,999. Long-range transportation plans are developed in part- nership with local elected officials to address transportation issues and identify travel needs in these areas for the next 20 years. Recommenda- tions (i.e. projects) from small urban area transportation studies are incor- porated into the State Highway Plan. Public information meetings are held for each small urban area transporta- tion study to give citizens a chance to comment on the recommendations. Small urban area transportation studies are available on VDOT's web site, where citizens are encouraged to comment on the plan. All comments will be considered by VDOT and localities during plan development and prior to plan adoption. Corridor and Feasibility Studies Corridor studies are conducted for significant transportation projects, such as major highway or transit improvements. These studies seek to identify the mix of transportation improvements that would be most ef- fective in moving people and goods in specific travel corridors and balanc- ing those improvements with available fimding and community concerns. Feasibility studies are performed on a proposed strategy to determine the degree to which: • the design or location is economically, justified • an alternative is considered preferable from an environmental or so- cial perspective • eventual construction and operation can be financed and managed Recommendations from corridor and feasibility studies can be incorpo- rated into the State Highway Plan. More information about most of the corridor and feasibility studies is available through VDOT's and DRPT's web sites. At least one public meeting is held in the study area to allow citizens to comment on the pro- posed alternatives. Public Involvement Planning versus Programming Early public involvement in planning helps us determine solutions needed to address transportation issues. Public involvement for programming helps us decide where to concentrate the state and federal funding VDOT and DRPT receive. Public Involvement Guide Page 6 Commonwealth Transportation Board (CTB) The CTB guides the work of VDOT, much like a board of directors. The board is comprised of 17 members who are appointed by the governor and confirmed by the General Assembly. The CTB is a policy board, meaning that it declares the policies and regulations used by VDOT and DRPT. It meets on the third Thursday of most months to discuss the location of routes, the approval of construction contracts, the creation of traffic regulations, the naming of highways, and the allocation of the Transportation Trust Fund. This public participation is paramount in today's tight financial environment where VDOT must make decisions with limited resources. By participating at the programming stage, citizens can help determine where those resources are focused. Statewide Transportation Improvement Program (STIP) The Statewide Transportation Improvement Program is a federal pro- gramming document used to commit federal funds to projects for the next three years. The program includes all projects identified in the Commonwealth's 14 MPO area Transportation Improvement Programs ("I`IPs), as well as all roadway and transit projects outside MPO areas that will receive federal funding. The MPOs are required to carry out separate public involvement processes for their TIPs. VDOT and DRPT conduct public involvement processes for those roadway and transit projects out- side MPO areas. The Six -Year Improvement Program (SYIP) is a state document, updated annually, that earmarks funds for transportation projects proposed for construction, development or study in the next six fiscal years. All pro- jects in the SUP that are eligible for federal funding are included in the STIP. The public involvement process for the STIP and SYIP occur concurrently and include the following: Public information meetings are held annually in each VDOT co n- struction district to give interested citizens an opportunity to com- ment on what transportation improvements should be programmed next. The public input received at these meetings will be used in the development of a tentative SYIP. A public hearing is held by the CTB in the spring each year for co m ment on the tentative SYIP. The tentative program undergoes a 45- day review period, where copies of the program will be available for public review online at VDOT's web site, on DRPT's web site, or at local VDOT offices and public libraries. Public Involvement Guide Page 7 County Secondary Six -Year Plan State law requires the development and publication of separate programs for the secondary system of state highways in each county, known as Sec- ondary Sig -Year Plan. Secondary roads are state maintained roads generally numbered 600 and above. The process of developing Secondary Sig -Year Plans is a partnership be- tween VDOT and local governments. The process begins when the VDOT resident engineers recommend projects to their respective counties for inclusion in the county Secondary Sig -Year Plan. These secondary pro- jects can come from current VDOT improvement programs, citizen re- quests, requests by the county, and needs identified by VDOT. The board of supervisors establishes project priorities and VDOT residency staff pre- pares a draft Secondary Sig -Year Plan. Public hearings are generally conducted between October and December to collect citizens' comments on secondary road needs and the draft program. Following the public hearings, the board of supervisors formally establishes project priorities by adopting a resolution approving the project list and budget for the upcoming fiscal year. Once the Secondary Sig -Year Plan is completed for each county and administrative detem-iinations are made re- garding the type of fimding applicable to each project, the program be- comes a component of the Statewide Transportation Improvement Plan. Transportation Enhancement Program The Transportation Enhancement Program is a federal program adminis- tered by VDOT that provides fiords to communities for projects that strengthen the cultural, aesthetic, or environmental value of the transporta- tion system. Transportation enhancement projects are selected through a competitive process, and the funds are provided through reimbursement, not grants. Any local government, state agency, group or individual may initiate a transportation enhancement project. Prior to submission, all pro- jects require formal endorsement by a local jurisdiction or public agency and an advertised public hearing. The public is encouraged to provide comments during public hearing workshops and to VDOT as part of the transportation enhancement application package. Selected transportation enhancement projects are incorporated into the Statewide Transportation Improvement Program. VDOT and DRPT Don't Do It Alone Transportation plans and programs are the results of a collaborative effort between many players and partners. Roadway, transit and bicycle and pedestrian needs are balanced with funding constraints and political and citizen influence. Working together, citizens, politicians and transportation officials can create solutions to the issues facing the transportation system. VDOT and DRPT alerts citizens to these meetings by: • Announcing public meetings in local newspapers 30 days in advance and again a week before the meeting • Using kiosks, mass mailings, or television and radio ads • Sending press releases to the media, which often generate news stories Citizens who wish to view the technical or policy information used to create the plans and programs before they are discussed at the meetings can contact VDOT or DRPT. Meetings may be formal, informal or a combination of the two. Formal - VDOT and DRPT speakers present material and the public makes comments for the official meeting record. Informal - One-on-one interaction among citizens and agency staff; citizen comments are gathered. Regardless of the format of the meeting, public comment is always welcomed. At the meetings, information will be provided to participants about making fol- low-up comments. You don't have to attend the meeting to make comments. Written and telephone comments are accepted at any time and in the following ways: • Writing to VDOT at State Transportation Planner, 1401 E. Broad St., Rich- mond, VA 23219 or DRPT at Planning Director, P.O. Copies of the draft document are available for public review and co m- ment at a number of sources, including public libraries and VDOT district and residency offices. The procedures for commenting are outlined in the draft document. After considering the feedback from the review and comment pe- riod, VDOT creates a final plan document. A public notice is issued following the methods previously outlined informing citizens how they can obtain copies of the final plan. Public Involvement Process Adoption Procedure VDOT periodically updates its public involvement procedures to ensure that the most effective process is in place. When the process is updated, the re- vised procedures must be open for a public comment period of at least 45 days before they are adopted. Comments for the statewide process will be solicited from local governments, MPOs, state agencies, transit providers both public and private, interested professional and citizen groups, planning district commissions, transportation district commissions, federal agencies, and others. By commenting on the proposed changes, citizens can influence the procedures VDOT and DRPT follow when seeking citizen participation in the planning and programming processes. Citizens are informed of the up- date through the same methods used to announce public meetings. The subdivision ordinance § 144-24C(2)b specifies that: "When such lots [townhouses/ do not abut public streets, they shall abut private roads, parking lots or access easements. The length and extent of the private roads, driveways and parking aisles providing access to lots shall be minimized, and public streets shall be provided in larger subdivisions when substantial distances are involved. Individual lots shall not be more than 500 feet from a state -maintained road, as measured from the public street along the access route. This revised master development plan is approved for 214 townhouses and 397 single-family detached urban housing types; a total of 611 dwelling units on 285 acres of land in the Shawnee Magisterial District. This revision allows for a redistribution of housing types, but without an increase in overall density from what has been previously approved. The construction of the portion of Warrior Drive which crosses through this property is required with this development. Recreational units, including a pool facility, picnic tables, basketball court, tennis court, gazebo, tot lot and community center, shall be provided. The plan also provides street tree landscaping, preservation of riparian buffers, sidewalks, parking facilities, and 33 acres of open space. Nothing contained herein shall affect or eliminate any reversion of title to any then adjoining property owners of any portion of the 100 foot wide reserved and dedicated right-of-way if such is abandoned by Frederick County and/or the Virginia Department of Transportation. 9. Nothing contained herein shall create or impose upon the Owner/Developer or the property, any requirements to make, construction or contribute to any "off -site" improvement(s) located outside of the physical boundaries of the property. 10. Upon written agreement with the County, in lieu of the construction of Warrior Drive north of the intersection with Vincent Drive and Talamore Drive, the Owner/Developer would construct two lanes of Warrior Drive from the intersection with VA #756 (Macedonia Church Road) to the intersection with Tasker Road. The criteria below are per the "Cost Sharing Agreement" between Centex Homes and Frederick County. 1. The Interim road will be considered a RuraYCollector with a design speed of 45 mph. The Interim construction plans will build a 2 lane divided road with 16 ft. wide raised curb median and 13 ft. wide lanes plus 3 ft. of additional pavement in each direction. A 3 ft. wide gravel shoulder will be provided on the outer edge of the pavement. The Ultimate pavement width will be graded out as a grass shoulder and the road side ditches will be constructed in their ultimate locations. The location of the road side ditches is allowed within the 80 ft. Road Buffer outside of the right-of-way where necessary due to grading conditions. A storm drainage easement will be established where the drainage ditch is outside of the right-of-way. 2. The Ultimate road will be widened from the Interim design described above and designed to be an UrbaA cMector road section. The Ultimate road design is a 4 lane divided road with a curb -to -curb width of 27 ft. 3. The right-of-way will be 100 ft. wide, except where additional right-of-way may be required at the intersections for right turn lanes. 4. The road will not be super -elevated (the smallest centerline radius = 800 ft.) 5. Turn Lanes: a. Left turn lanes = 200 ft. long with 150 ft. tapers (Ultimate design, to be built with Interim construction). b. Right turn lanes = 150 ft. long with 100 ft. tapers (Ultimate design). For Interim plan, only 100 ft. long right turn lane tapers will be provided. 6. Intersections will have 50 ft. face -of -curb fillet radii. 7. This correspondence is intended to summarize our understanding regarding this matter, and specifically the following matters: Centex Homes shall contract for the engineering design of Warrior Drive from the intersection with Tasker Road, north through the Wakeland Manor project site. Plans shall be submitted to the County and the Virginia Department of Transportation, (VDOT) for review and approval. 2. The County shall be responsible for obtaining all off site right of way, easements or other items required for construction of Warrior Drive south of the Wakeland Manor project. 3. Warrior Drive shall be designed for an ultimate cross section of a four lane divided roadway, with a sixteen foot wide, raised landscape median, gravel shoulders and open ditch drainage section, in accordance with VDOT Standards and specifications. 4. The engineering drawings shall show construction to include only two lanes, one on either side of the center median, an additional three feet of roadway paving on each lane (to facilitate future traffic control when the road is expanded), and appropriate turning lanes and tapers at proposed intersections. The preliminary cost estimate will serve as a basis to determine Wakeland Manor's share of the total road project. Wakeland Manor's share shall be based on an equivalent two lane road section through the Wakeland Manor project only, and shall not include any off site related costs. 7. The Wakeland Manor share cost of the project shall then be the basis to establish a fixed cost per unit contribution towards the funding of the road project. This figure shall be determined by dividing the total estimated cost by 579, which is the estimated total number of units in the Wakeland Manor project to be developed by Centex Homes. 8. Within sixty days after the recordation of phase 5 of the project, Centex Homes shall place a security with the County, in the form of cash, bond or letter of credit, for all units recorded to date in phases 2, 3, 4 and 5. 9. As phases beyond phase 5 are recorded, Centex Homes shall increase the security amount based upon the fixed per unit contribution amount. 10. When the engineering plans for Warrior Drive have been approved by VDOT, and all County, State and Federal Permits have been secured, and when a construction contract has been awarded for the work, and a notice to proceed issued, within sixty days of such date, Centex Homes shall simultaneously transfer funds to the County equal to those secured to date, and the County shall release to Centex Homes all securities posted to date if the security posted to date was in the form of a bond(s) or letter of credit(s). 11. For all phases recorded subsequent to the start of construction of Warrior Drive, Centex Homes shall transfer funds to the County within sixty days of recordation of such phases. 12. At such time when the total number of lots recorded exceeds 434 lots, (approximately 75% of the total lots of Wakeland Manor) and the construction of Warrior Drive has been completed, accepted by VDOT and open to traffic, within sixty days of such date, Centex Homes shall fund the balance of its share of Warrior Drive. At such time when the total number of lots recorded exceeds 434 lots, and if the construction of Warrior Drive has not commenced, within sixty days of such date, Centex Homes shall have the option to fund the balance of its share of Warrior Drive with no further obligation to construct Warrior Drive on or off the project site. 14. In the event that when the total number of lots recorded exceeds 260 lots, and Warrior Drive construction has not commenced, Centex Homes shall have the option to construct Warrior Drive per the approved plans. The County would be required to post a security for its share of the project within sixty days of notification by Centex Homes of its intent to construct Warrior Drive. Centex Homes could then draw against the security on a monthly basis, the amount determined by the percentage completion of the construction. Most significant is the County's expectation that this agreement to construct Warrior Drive should be made apart of the MDP, thereby assigning responsibilities for Warrior Drive construction, per agreement, to the owner of the Wakeland Manor MDP. By placing these responsibilities/agreements on the MDP, any future owner of the project assumes the responsibilities. 2. Securing a time line for completion of the engineering design and approval stages of the road project. 3. Establishing a procedures so that once the construction contract is issued, all committed funds are transferred to the County. The County is not in a position to 'front' the funds to construct Warrior Drive. As a result of our discussion, it is the County's understanding that Centex Homes is interested in partnering with the County in the construction of this segment of Warrior Drive as it traverses the Wakeland Manor project. In an effort to address the Warrior Drive road improvement aspect of the Wakeland Manor Master Development Plan, I would envision that Centex (as applicant of the Wakeland Manor project) issue a letter of agreement regarding the construction of Warrior Drive. At a minimum, it is envisioned that such a statement should address Centex's responsibility for the following issues: Establishing a monetary guarantee that would provide for the construction of Warrior Drive. It is envisioned that such a guarantee would be linked to the approval of individual building lots, per previous conversations. This guarantee would enable Centex to proceed with the development of the Wakeland Manor project, prior to the construction of Warrior Drive. 2. Securing road design approval from the Virginia Department of Transportation. Provisions for funding the construction of a two-lane, divided section of Warrior Drive as it traverses the Wakeland Manor project, and a date for the transfer of funds. The date by which the funds would be transferred should occur no later than the commencement of Phase 9, or Fall 2004, whichever occurs first. 4. Provisions for landscaping and maintenance of the median. Finalizing an agreement regarding the construction of Warrior Drive is necessary in order to proceed with the proposed revisions to the Wakeland Manor master development plan. Please clarify the total site acreage involved in the MDP revision. Notes on sheet 1 of 5 state a site area of 244.18 acres.
