This letter is to confirm the Frederick County Board of Supervisors' action at
their meeting of February 11, 1987:
Approval of the Revised Subdivision Plat of Wakeland Manor, Section F and F1, for
the subdivision of 42 lots. This property is located on the north side of Route
642, just east of the Route 647 and 642 intersection in the Shawnee Magisterial
District.

Wakeland Manor, Sections F and F1
42 Lots, Zoned RP (Residential Performance)
LOCATION: Northside of Route 642, just east of the Route 647 and 642 intersection
MAGISTERIAL DISTRICT: Shawnee
ADJACENT LAND USE AND ZONING: Residential, vacant, and agricultural land use and
RP (Residential Performance) Zoning.
PROPOSED USE AND IMPROVEMENTS: Revised subdivision of 42 single-family lots with
street, drainage, and sewer/water improvements.
REVIEW EVALUATIONS:
Highway Department - Recommendations as per attached letter of October 16,
1986.
Sanitation Authority - Plans are acceptable to Sanitation Authority.
Stephens City Fire Company - Shall comply with Chapter 10 of the Frederick
County Code.
Planning and Zoning - No objection. This section is being developed under
the former R-3 Residential Zoning Requirements. All subdivision and zoning
standards have been met. The applicant has revised the approved Section F to
include 10 additional lots along Brandylion and Laurel at Route 642.
Additionally, the applicant has divided the original Section F into two
sections: F, containing eight lots, and F1, containing 41 lots.
STAFF RECOMMENDATIONS: Approval of Revised Wakeland Manor Subdivision, Sections F
and F1, a total of 42 lots.
PLANNING COMMISSION RECOMMENDATIONS: Unanimous approval.

As requested, a review of the above referenced subdivision has been made. Our
comments and recommendations are as follows s
1. It will be required that drainage easements be provided to a legal water
course from all proposed drainage pipes and ditches within a subdivision
that is to be taken into the Secondary System.
2. One problem which is noted on Sheet 2 of 5 may be where the drainage
from the 420X29" pipe under Brandon Drive crosses the existing private
entrance. A pipe may be required under the entrance as well as the
drainage easement across the property to a well defined drainage hollow.
3. Standard CD-2, Combination Underdrain, should be provided at approximately
Station 2+25 (Brandon Drive) and Station 5+50 (Craig Drive).
4. Please be sure the developer understands the minimum requirements for
private entrances. In the past we have had problems with the developer
constructing private entrances not in accordance with the minimum require-
ments.
S. All proposed mailboxes must be placed back of the ditch line to conform
with our policy to prevent hindering of maintenance operations when the
streets are added to the Secondary System. please review this with the
developer to be sure it is understood.
6. A standard VDH&T stop sign will be required at the intersection of Laurel
Drive and Wakeland Drive.
7. Pavement design will be determined by CBR Tests conducted by the Virginia
Department of Highways & Transportation at the developer's expense and
will be required when the rough grading has been completed.
8. A permit must be applied for and approved before the connection of Laurel
Drive at Wakeland Drive prior to doing any work on the State's right-of-way.
Enclosed you wil find a copy of the minimum requirements and data for subdivision
streets prior to acceptance into the Secondary System. This is the responsibility

THIS DEED OF DEDICATION made and dated this J=-day
of1987, by and between Ralph M. Wakeman and
Mae C. Wakeman, his wife, parties of the first part, and the
County of Frederick, Virginia, party of the second part.
WHEREAS, the parties of the first part are the owners
and proprietors of a certain parcel of land being a portion of
the same property conveyed to the parties of the first part by
deed dated March 11, 1952, and recorded in the Office of the
Clerk of the Circuit Court of Frederick County, Virginia, in
Deed Book 222, at Page 565; and
WHEREAS, the parties of the first part intend and
desire to subdivide in part the said land in accordance with
the applicable Ordinances of the County of Frederick and to
dedicate the roadways in said subdivision known as Laurel
Drive, Brandylion Drive, Craig Drive and Tyler Court as shown
on the plat of Section F-1 attached hereto and comprising Lots
76-109, inclusive.
NOW, THEREFORE, THIS DEED OF DEDICATION WITNESSETH:
In consideration of the premises, the undersigned
owners and proprietors, parties of the first part, with their
free consent, in accordance with their desire, pursuant to the
applicable Virginia Subdivision Statute, do hereby:
1. Subdivide the hereinafter land; and
2. Grant and dedicate to the County of Frederick and
to the public the roadways shown in said subdivision known as
Laurel Drive, Brandylion Drive, Craig Drive and Tyler Court,
all as shown on the plat of Section F-1 attached hereto.
The lots shown on the plat attached hereto are hereby
made subject to the restrictions listed below and each deed
from the undersigned owners and proprietors shall incorporate
these restrictions by reference to this instrument. Whether
incorporated or not, these restrictions are made covenants
real, running with the land, and shall be binding upon all the
subsequent owners and enforceable by the owners and proprietors
and all subsequent owners of all lots in the subdivision known
as "Wakeland Manor," Section F-1, comprising lots 76-109,
inclusive.
1. LAND USE AND BUILDING TYPE. No lot shall be
subdivided and no lot shall be used except for residential
purposes. No building shall be erected, altered, placed, or
permitted to remain on any lot other than one (1) detached
single-family dwelling not to exceed two and one-half (2 1/2)
stories in height and a private, attached garage for not more
than three (3) automobiles. One detached utility building,
maximum size of ten feet by ten feet (101 x 101). will be
permitted on each lot.
2. DWELLING COST. No dwelling shall be constructed
or erected on any lot at a cost of less than Thirty Thousand
Dollars ($30,000.00), excluding cost of land, based upon cost
levels prevailing on the date these covenants are recorded, it
being the intention and purpose of this covenant to assure that
all dwellings shall be of a quality of workmanship and
materials substantially the same or better than that which can
be produced on the date these covenants are recorded at the
minimum cost stated herein for the minimum permitted dwelling
size.
3. SIZE AND CONSTRUCTION.
(a) Ramblers - 1,240 square feet as determined by
outside dimensions of structure with brick veneer front, but
every third house of all houses built by Buyer may be 1,140
square feet as determined by outside dimensions of structure
with brick veneer front.
(b) Split-levels and split -foyers - 1,050 square feet
as determined by outside dimensions of structure with brick
veneer front, except upper level may be of siding in lieu of
brick veneer.

(c) Two-story - 790 square feet as determined by
outside dimensions of structure with brick veneer front on
first story only and front of second story may be of siding in
lieu of brick veneer.
(d) One and one-half story - 900 square feet as
determined by outside dimensions of structure with brick veneer
front.
Regardless of the style, size and construction of a residence,
there shall not be any exposed block or parged foundations on
either the front, sides or rear of the residences.
4. BUILDING LOCATION. No building shall be located
on any lot nearer to the front lot line or nearer to the side
street line than the minimum building setback lines shown on
the recorded plat of Section F-1. In any event, no building
shall be located on any lot nearer than thirty-five (35) feet
to the front lot line, or nearer than thirty-five (35) feet to
any side street line. No building shall be located nearer than
ten (10) feet to a side/interior lot line. No dwelling shall
be located on any lot nearer than twenty-five (25) feet to the
rear lot lines. For the purposes of this covenant, eaves,
steps and open porches shall not be considered as a part of the
building, provided, however, that this shall not be construed
to permit any portion of a building on a lot to encroach upon
another lot.
5. NUISANCES. No noxious or offensive activity shall
be carried on upon any lot, nor shall anything be done thereon
which may be or may become any annoyance or nuisance to the
neighborhood. Each and every lot shall be kept mown and free
from weeds and debris at all times to comply with County
ordinances.
6. MOTOR VEHICLES. No motor vehicle which does not
bear a current license and a current inspection sticker, and no

inoperative motor vehicle, shall be permitted to be parked or
maintained upon any lot or adjacent thereto.
7. WATER AND SEWER. No individual sewage disposal
system and no individual water supply system shall be permitted
on any lot.
8. TEMPORARY STRUCTURES. No structure of a temporary
character, trailer, basement, tent, shack, garage, barn or
other outbuilding shall be used on any lot at any time as a
residence either temporarily or permanently except that storage
trailers may be placed on the property during construction.
9. SIGNS. No sign of any kind shall be displayed to
the public view on any lot except one (1) professional sign of
not more than one (1) square foot, one (1) sign of not more
than five (5) square feet, advertising the property for sale or
rent, or signs used by a builder to advertise the property
during the construction and sale period.
10. LIVESTOCK and POULTRY. No animals, livestock or
poultry of any kind shall be raised, bred, or kept on any lot,
except that dogs, cats or other household pets may be kept,
provided that they are not kept, bred, or maintained for any
commercial purpose.
11. GARBAGE AND REFUSE DISPOSAL. No 1 t shall be
used or maintained as a dumping ground for rubbish. Trash,
garbage or other waste shall be in sanitary containers. All
incinerators or other equipment for the storage or disposal of
such material shall be kept in a clean, sanitary condition.
12. SIGHT DISTANCE AT INTERSECTIONS. On any corner
lot there shall be no planting, structure, fences, shrubbery or
other obstruction to vision more than three (3) feet above the
II curb level, within twenty-five (25) feet of the intersection of
any two street lines.

13. FENCES. No fences (rear yard or otherwise) shall
be erected or maintained on Lots 104, 105, 106, 107, 108 and
109. As to the remaining lots, only the rear yards thereof can
be fenced, and corner lots cannot be fenced on or along either
street front.
14. ENFORCEMENT. Enforcement shall be proceedings at
law or equity against any person or persons violating or
attempting to violate any covenant either to restrain violation
or to recover damages.
15. SEVERABILITY. Invalidation of any one of these
covenants by judgment or court order shall in no wise affect
any of the other provisions which shall remain in full force
and effect.
16. RESERVATION FOR EASEMENTS. Easements for the
installation and maintenance of utilities and drainage
facilities are reserved where shown on a recorded plat or
reserved in deed of conveyance.
17. BUILDING STREETS. No lot can be used for the
purpose of building streets to adjoining property for ingress
or egress without written consent of the original owner of the
subdivision, namely Ralph M. Wakeman and Mae C. Wakeman trading
as Wakeland Manor, Stephens City, Virginia.
The land herein being subdivided, the boundaries and
streets thereof being dedicated, and the easements conveyed or
reserved are all shown on the attached plat and survey of H.
Bruce Edens, C.L.S., dated January 23, 1987. which plat and
survey are expressly incorporated herein by reference and made
a part hereof.
The parties of the first part do hereby request that
the proper officials designated by the County of Frederick,

Virginia, approve of said plat so that it may be recorded in
the Clerk's Office of the Circuit Court of Frederick County,
Virginia.
The Dedication and Subdivision of the land as shown on
the attached plat is with the free consent and in accordance
with the desire of the undersigned parties of the first part,
being the owners of the land being subdivided, and is in
conformity with the provisions of "The Virginia Land
Subdivision Act" as are applicable, together with the
applicable ordinances and regulations of the governing body of
the County of Frederick, Virginia.

comments and recommendations are as follows:
1. It will be required that drainage easements be provided to a legal water
course from all proposed drainage pipes and ditches within a subdivision
that is to be taken into the Secondary System.
2. One problem which is noted on Sheet 2 of 5 may be where the draiange
from the 42" X29" pipe under Brandon Drive crosses the existing private
entrance. A pipe may be required under the entrance as well as the
drainage easement across the property to a well defined drainage hollow.
3. Standard CD-2, Combination Underdrain, should be provided at approximately
Station 2+25 (Brandon Drive) and Station 5+50 (Craig Drive).
4. Please be sure the developer understands the minimum requirements for
private entrances. In the past we have had problems with the developer
constructing private entrances not in accordance with the minimum require-
ments.
5. All proposed mailboxes must be placed back of the ditch line to conform
with our policy to prevent hindering of maintenance operations when the
streets are added to the Secondary System. Please review this with the
developer to be sure it is understood.
6. A standard VDH&T stop sign will be required at the intersection of Laurel
Drive and Wakeland Drive.
7. Pavement design will be determined by CBR Tests conducted by the Virginia
Department of Highways & Transportation at the developer's expense and
will be required when the rough grading has been completed.
8. A permit must be applied for and approved before the connection of Laurel
Drive at Wakeland Drive prior to doing any work on the State's right-of-way.
Enclosed you wil find a copy of the minimum requirements and data for subdivision
streets prior to acceptance into the Secondary System. This is the responsibility
