The condition of the above obligation is such that: Ralph M. Wakeman and Mae C. Wakeman are now subdividing certain land in Frederick County, Virginia.,` known as Wakeland Manor Subdivision, and there are in said Subdivision certain streets known as Craig Drive, Lane Street, and Wakeland Drive, Section D, as shown on that certain plat and survey of J. R. Nicely, C. L. S. and by this reference made a part hereof as if set out in full. By an Ordinance duly adopted on January 10, 1966 by the Board of Supervisors of Frederick County, Virginia, it is provided that streets in subdivisions must be paved, graded and otherwise improved to meet the specifications of the Virginia Department of Highways. Further, the Water and Sewer Ordinance of Frederick County, Virginia requires a guarantee of the developer of the maintenance of the water and sewer facilities for a period of one (1) year after they have been completed. It was further provided in said Ordinances that a bond Z:" may be posted with the County of Frederick for an amount of the value of the improvements to be made on such streets and the maintenance of the water and sewer facilities for said period of one (1) year, said bond permitting the early approval and re- cordation of plat and dedication of streets in said subdivision. It is agreed that the said sum of Fourteen Thousand Dollars ($14,000.00) is sufficient to indemnify the County of Frederick for the balance of said street improvements and the maintenance of the water and sewer facilities for said period in Wakeland Manor Subdivision, Section D. NOW, THERFORE, if Ralph M. Wakeman and Mae C. Wakeman shall tender a certificate from the Resident Engineer for this District of the Department of Highways, State of Virginia, to the Treasurer of Frederick County, Virginia within one ( 1 ) year from the date hereof that said improvements have been completed and have met the requirements of the Virginia Department of Highways for subdivisions for counties in the State of Virginia, then this bond shall be void; otherwise, to remain in the full force and virtue. This includes the location of air relief valves, which I indicated may have relocated on the side of the street. The streets are over fifty percent complete at this time. I was responsible for all construction stake -out on the job and was on the site a number of times during construction.
