concur with your findings.
Action should be initiated by you requesting a vacation
of these lots by the Board of Supervisors and a rezoning
request filed in this office.

In February 956, we.recorded a plat for "Valley Acres"
Sub -Division on R 'ute 652 justWest of Kernstowt. We had a
total of 18 lots facing on a proposed street. paxialleling the
front. However, due to .subsequent septic problems with the
Health Department, we never did develop the secand street,
and consequently could not use the lots. These''-X8 lots,
#2, 4, 6, 8 and even numbers to 36-, have never ,been sold and
cannot be used for housing as there is no develdped street.
I talked to 11r. Jennings of the Commissioner of Revenue
office and he recommended that we vacate these` lots andlet
the land revert to A2 zoning, or the same as the adjoining

Attached you will find a resolution requesting vacation of a portion
of the Valley Acres Subdivision.
As you will note from the attached correspondence, Mr. Wilkins has
encountered septic approval problems on these lots and, until water
and sewer is available, has no hopes for development of these lots.
If you have any questions regarding this matter, please do not
hesitate to contact me.

WHEREAS, Mr. James R. Wilkins, owner and developer of Valley
Acres Subdivision in the Back Creek Maqisterial District recorded in
Deed Book 240, Page 521 dated March 30, 1956, is requesting vacation
of a portion of said plat including Lot Numbers 2, 4, 6, 8, 10, 12,
14, 16, 18, 20, 22, 24, 26, 28, 30, 32, 34, 36 pursuant to Code
Section 15.1-481 (vacation of plat before sale of lot therein), and
WHEREAS, Mr. James R. Wilkins, owner and developer of Valley
Acres Subdivision, is requesting the 52.2 foot right-of-way known as
Wilkins Lane to remain intact, and

Reference is made to my letter dated November 2841 1980 and
December 5, 1980, and your reply of .December 2, 1980 (copies en
closed)
As per your suggestion, I kindly request that Lots#2, 4, 6,
8 and even numbers to 36, making a total of 18 lots, which' front
on no improved street in Valley Acres Sub-Diviston on State Route
652 just West of Kernstown, be vacated and the land be zoned the
same as the adjoining property to the East. However, we do not
wish to vacate the 52-foot right-of-way shown on the plat drawn
by Richard U. Goode in February 1956, as this is our main right-
of-way to this entire tract.
We did not develop these lots because of difficulty with
septic permits with the Health Department. We hope to develop
this when sewer services are available and wish to retain the
right-of-way for that purpose.
Kindly advise us if you need any additional information to
initiate this action?

Reference is made to my letter of I overriber 28, 1960 and your
reply of December 2, 1980 concerning Valley t*acres Sub-L)ivision on
Route 652.
It is kindly requested that Lots 2, 4, 6, 8 and even numbers
to 36 - making a total of 18 lots - which front on no improved
street in Valley acres as per survey by Richard U. Goode, Certi-
fied Surveyor, in February 1956, be vacated and the land re -zoned
in accordance with existing zoning of the land lying East which,
I think, is A-2. However, we do not wish to vacate this if it would
in any way interfere with our proposed street going between these
lots known as ':Jilkins Lane.
'lilkins Lane is approximately 52 feet wide and is the only
right-of-way we have to the acreage East of these lots. Kindly
advise me if this would create a problem for a later development,
as present regulations require 60 feet. `When this was approved,
they only required a 50 foot right-of-way. I assume this right-
of-way would come under the "Grandfather Clause" as far as future
development is concerned. We do not desire to vacate the right-
of-way. Your opinion concerning this matter would be greatly
appreciated, before asking the Board of Supervisors to vacate the
lots.
