Staff Review: The Subdivision Ordinance requires that land divisions in the RP (Residential Performance) Zoning District, without an approved Master Development Plan (MDP), be presented to the Board of Supervisors for final approval (Per 144-12-B). The MDP requirement may be waived, and has been waived for this project, when a development proposal does not include provisions for proposed roads and/or regional stormwater management facilities. The project contains land zoned RP, and does not have an approved MDP; therefore, Board review and action is necessary. Dave Holliday Construction, Inc. owns approximately 1.1749 acres of land, located in the Shawnee Magisterial District along Vine Lane (Rt. 850). This property is located in the UDA and SWSA as indicated in the 2000 Comprehensive Policy Plan of Frederick County. Virginia This proposal is to create three (3) new lots containing a minimum of 15,000 square feet each. These proposed lots are allowed in the RP Zoning District, under Chapter 165-65B of the Frederick County Zoning Ordinance, and are categorized as a "Single -Family Detached Traditional" housing type. This housing type is allowed in the RP Zoning District. Public water and sewer will be utilized by the proposed lots. STAFF RECOMMENDATION FOR 12/03/03 PLANNING COMMISSION MEETING: The proposed subdivision appears to satisfy the requirements of the zoning ordinance and the subdivision ordinance. A recommendation to be forwarded to the Board of Supervisors would be appropriate. PLANNING COMMISSION SUMMARY & ACTION OF 12/03/03 MEETING: A Commission member asked for an explanation of the comment by the Public Works Department regarding the location of one of the lots adjacent to the storm water detention pond. The applicant's project manager responded that the comment requires verification that the storm water management facility will not flood onto the adjacent lot or pose any problems with future residential structures; he said this verification is typically required at the time a grading permit or building permit is applied Subdivision Application # 12-03 December 23, 2003 Page 3 for. He said the lots being created are completely consistent with what was initially placed on Vine Lane.
