As I said since the temporary entrance road into the development is not in the State Secondary Road System, we have no objections to installation of the entrance. However, we do suggest the entrance be installed to our current standard PE-1 specifications at approximate Station 1+50, This should provide a safe distance between your entrance and Route 277. I have enclosed a copy of our standard PE-1 specification with the required dimensions and culvert size noted in red. We had received complaints that the pond located on the subject property had been drained and that sediment, dead fish and other debris had been washed down on the downstream property within the Village at Sherando subdivision. At the time of our meeting, you informed us that you were the executor of the estate that owns the subject property and that upon advice of your realtor, you had E.R. Neff Excavating, Inc. breach the berm of the pond and drain it. This action represents several violations of the county ordinance. The following is a summary of these violations: 1. Frederick County Zoning Ordinance 165-31 indicates that no disturbance of ponds or wetlands is allowed (see attachment 1). We informed your realtor who has called several times this week that you will need to obtain approval from the U. S Army Corps of Engineers to fill in the wetlands area. Also, if it is determined that you can fill in the pond, you will need to obtain a Land Disturbance Permit from this office prior to any site work. 2. You are in violation of Chapter 79 of the Frederick County Ordinance in regards to erosion and sediment control (see attachment 2). By draining the pond in such a manner, you have deposited mud and sediment on adjacent property. You need to clean up the downstream area immediately and prevent further erosion and sediment transport. We informed you that a large rock check dam needs to be placed immediately at the opening of the dam breach (see attachment 3) as a 107 North Kent Street • Winchester, Virginia 22601-5000 Boyd Letter April 29,1998 Page 2 temporary measure. You indicated to us that Greenway Engineering would design an outlet structure for the pond as a long term sediment control measure. The design shall be submitted to our office for review prior to construction. The structure will then need to be installed immediately. You need to have the area cleaned up downstream within 15 days upon receipt of this letter. The rock check dam also needs to be installed immediately. During this period, the outlet structure needs to be designed and progress made to implement these measures. If these items are not addressed during this timeframe, Frederick County will proceed with court action as stipulated in the ordinance. Also, we will take steps necessary to clean up the area. You will be back charged for all costs associated with this cleaning including our costs for coordinating these efforts. We hope these measures are not necessary, however, this pond represents an erosion hazard and a violation of the County Code. If you have any questions, do not hesitate to contact me. ARTICLE I DEFINITIONS Section 1. "Association" shall mean and refer to The Village at Sherando Homeowners Association, Inc., a Non Stock Virginia Corporation, its successors and assigns. Section 2. "Common Area" shall mean all real property (including the improvements thereto) owned by the Association for the common use and enjoyment of the owners. The Common Area to be owned by the Association at the time of the conveyance of the first lot is hereinabove described as common open space, roadways, and parking areas, and such additions thereto as may hereafter be brought within the jurisdiction of the Association. Section 5. "Lot" shall mean and refer to any of the Lots designated upon the plat of The Village at Sherando, with the exception of the Common Area. Section 6. "Declarant" shall mean and refer to J. E. J. P. Corporation, a Virginia Corporation, its successors and assigns if such successors or assigns should acquire more than one undeveloped Lot from the Declarant for the purpose of development. ARTICLE II MEMBERSHIP Every person or entity who is a record owner of a fee or undivided fee interest in any Lot which is subject by covenants of record to assessments by the Association, including contract sellers, shall be a member of the Association. The foregoing is not intended to include persons or entities who hold an interest merely as security for the performance of an obligation. One membership per Lot. Membership shall be appurtenant to and may not be separated from ownership of any Lot which is subject to assessment by the Association. Ownership of such Lot shall be the sole qualification for membership. ARTICLE III VOTING RIGHTS Each Member of the Association shall have one vote for each Lot owned in which said Member shall hold the interest required for membership in Article II. When more than one person holds such interest in any Lot, all such persons shall be Members. The vote for such Lot shall be exercised as they among themselves -4- n L7 O THOMAS A. LOUTHAN, P.C. ARTICLE IV BOARD OF DIRECTORS The affairs of the Association shall be managed by a Board of three (3) directors, who must be members of the Association. The initial Board of Directors shall be appointed by the Association and serve until the first annual meeting following conveyance of the 94th Lot in the Properties; thereafter, the Board of Directors shall be elected by the Membership as determined in the By -Laws of the Association. ARTICLE V PROPERTY RIGHTS IN COMMON PROPERTIES Section 1. Members' Easements of Enjoyment: Every Member shall have a right and easement of enjoyment in and to the Common Area, specifically including but not limited to the rights of ingress and egress across the aforesaid Common Area and such easement shall be appurtenant to and shall pass with the title to every assessed Lot, subject to the following provisions: (a) The rights of the Association, in accordance with its Articles and By -Laws, to borrow money for the purpose of improving the aforesaid Common Area and in aid thereof to mortgage said property and the rights of such mortgagee in said Properties shall be subordinate to the rights of the Lotowners hereunder. (b) The rights of the Association to suspend the voting rights and the right to the use of the Common Area by a Member for any period during which any assessment against his Lot remains unpaid; and for a period not to exceed thirty (30) days for any infraction of its published rules and regulations. (c) The rights of the Association to dedicate or transfer all or part of the Common Area to any public agency, authority, or utility for such purposes and subject to such conditions as may be agreed to by the Members. No such dedication or transfer shall be effective unless an instrument signed by Members entitled to cast two-thirds (2/3) of the votes has been recorded agreeing to such dedication or transfer, and unless written notice of the proposed action is sent to every Member not less than twenty-five (25) days nor more than fifty (50) days in -5- 762FG1746 advance. Section 2. Delegation of Use: Any Member may delegate, in accordance with the By -Laws, his right of enjoyment to the Common Area to the members of his family, his tenants, or contract purchasers who reside on the property. ARTICLE VI COVENANT FOR MAINTENANCE ASSESSMENTS Section 1. Creation of the Lien and Personal Obligation of Assessments. The Declarant, for each Lot owned within the Properties, hereby covenants, and each Owner of any Lot by acceptance of a deed therefor, whether or not it shall be so expressed in such deed or other conveyance, is deemed to covenant and agree to pay to the Association: (1) annual assessments or charges, and (2) special assessments for capital improvements, such assessments to be established and collected as hereinafter provided. The annual and special assessments, together with such interest thereon and costs of collection thereof as hereinafter provided, shall be a charge on the land and shall be a continuing lien upon the property against which each such assessment is made. Each such assessment, together with such interest, costs, and reasonable attorney's fees, shall also be the personal obligation of the person who was the Owner of such property at the time when the assessment fee was due. The personal obligation for delinquent assessments shall not pass to his successors in title unless expressly assumed by them. Section 2. Purpose of Assessment. The assessment levied by the Association shall be used exclusively to promote the recreation, health, safety, and welfare of the residents in the Properties and for the improvement and maintenance of the Common TH7OM-�I I Areas. Until January 1 of the year immediately following the conveyance of the first lot to an Owner, the maximum annual assessment shall be One Hundred Dollars ($100.00) per Lot, payable annually, for the cost of maintenance and improvements for the Common Area owned by the Association. (a) From and after January 1 of the year immediately following the conveyance of the first Lot to an Owner, the maximum annual assessment may be increased each year not more than 10% above the maximum assessment for the previous year without a vote of the membership. (b) From and after January 1 of the year immediately following the conveyance of the first Lot to an Owner, the maximum annual assessment may be increased above 10% by a vote of two-thirds (2/3) of each class of members who are voting in person or by proxy, at a meeting duly called for this purpose. (c) The Board of Directors may fix the annual assessment at an amount not in excess of the maximum. Section 4. Special Assessments for Capital Improvements. In addition to the annual assessments authorized above, the Association may levy, in any assessment year, a special assessment applicable to that year only for the purpose of defraying, in whole or in part, the cost of any construction, reconstruction, repair or replacement of a capital improvement upon the Common Area, including fixtures and personal property related thereto, provided that any such assessment shall have the assent of two- thirds (2/3) of the votes of each class of members who are voting in person or by proxy at a meeting duly called for this purpose. Section 5. Notice and Ouorum for Any Action Authorized Under Section 3 and 4. WINCHESTER.- SK762PG 1 748 be sent to all members not less than thirty (30) days nor more than sixty (60) days in advance of the meeting. At the first such meeting called, the presence of members or of proxies entitled to cast sixty percent (60%) of all the votes of each class of membership shall constitute a quorum. If the required quorum is not present, another meeting may be called subject to the same notice requirement, and the required quorum at the subsequent meeting shall be one-half (1/2) of the required quorum at the preceding meeting. No such subsequent meeting shall be held more than sixty (60) days following the preceding meeting. Section 6. Uniform Rate of Assessment. Both annual and special assessments must be fixed at a uniform rate for all Lots and may be collected on a monthly basis. Section 7. Date of Commencement of Annual Assessments: Due Date. The annual assessment provided for herein shall commence as to all Lots on the first day of the month following the conveyance of the Common Area. The first annual assessments shall be adjusted according to the number of months remaining in the calendar year. The Board of Directors shall fix the amount of the annual assessment against each Lot at least thirty (30) days in advance of each annual assessment period. Written notice of the annual assessment shall be sent to every Owner subject thereto. The due dates shall be established by the Board of Directors. The Association shall, upon demand, and for reasonable charge, furnish a certificate signed by an officer of the association setting forth whether the assessments on a specified Lot have been paid. A properly executed certificate of the Association as to the status of assessments on a Lot is binding upon the Association as of the date of its issuance. Section 8. Effect of Nonpayment of Assessments: Remedies of the Association. Any assessment not paid within thirty (30) days after the due date shall bear interest from the date at the rate WE 0 of twelve percent (12%) per annum. The Association may bring an action at law against the Owner personally obligated to pay the same, or foreclose the lien against the property, and interest, costs, and reasonable attorney's fees on any such action shall be added to the amount of such assessment. No owner may waive or otherwise escape liability for the assessments provided for herein by non-use of the Common Area or abandonment of his Lot. Section 9. Subordination of the Lien to Mortgages. The lien of the assessments provided for herein shall be subordinate to the lien of any first mortgage. Sale or transfer of any Lot shall not affect the assessment lien. However, the sale or transfer of any Lot pursuant to mortgage foreclosure or any proceeding in lieu thereof, shall extinguish the lien of such assessments as to payments which became due prior to such sale or transfer. No sale or transfer shall relieve such Lot from liability for any assessment thereafter becoming due or from the lien thereof. Section 10. Exempt Property. The following property subject to this Declaration shall be exempt from the assessments created herein; (a) the "Common Area"; (b) all properties dedicated to and accepted by a local public authority; and (c) all properties owned by a charitable or nonprofit organization exempt from taxation by the laws of the State of Virginia. However, no residence occupied as a dwelling shall be exempt from these assessments. Section 11. Failure to Maintain Common Areas. In the event that the Association, or its successors, shall fail to maintain the "Common Area" in reasonable order and condition, the County of Frederick may take such action as authorized by the Frederick County Zoning Ordinance. WINCHESTER.- 22601 762P'G1750 ARTICLE VII ARCHITECTURAL CONTROL No building, fence, wall or other structure shall be commenced, erected or maintained.upon the Properties, nor shall any exterior addition to or change or alteration therein be made until the plans and specifications showing the nature, kind, shape, height, materials, and location of the same shall have been submitted to and approved in writing as to harmony of external design and location in relation to surrounding structures and topography by the Board of Directors of the Association, or by an architectural committee composed of three (3) or more representatives appointed by the Board. In the event said Board, or its designated committee, fails to approve or disapprove such design and location within thirty (30) days after said plans and specifications have been submitted to it, approval will not be required and this Article will be deemed to have been fully complied with. ARTICLE VIII USE, RESTRICTIONS, AND COVENANTS This subdivision shall be subject to the following restrictions which are constituted covenants real to run with the land: 1. All lots shall be used for single family residential purposes only. No garage nor carport shall be permitted on any Lot. No townhouse may be modified to provide for a garage therein after such townhouse has been erected. 2. No profession or home occupation shall be conducted in or on any part of a Lot; provided, however, that Declarant reserves the right to use one or more of said Lots for business purposes in connection with the development, sales, and operation of said townhouse subdivision. No boats, mobile homes, motor homes, campers, buses, trailers of any type, tractors, trucks or other motor vehicles (other than automobiles, motorcycles, pickup trucks, and 3/4 ton [or less] vans) shall be permitted on any Lot except during the course of construction. No motor vehicle or material portion thereof which does not have a current license and current Virginia inspection sticker shall be permitted on any Lot. No vehicles shall be parked in an area other than the Parking Area designated on the attached plat. 7. No animals of any kind (including livestock, poultry or birds) shall be permitted on any Lot, except that dogs, cats, and other usual household pets may be kept, provided they are not kept, bred or maintained for commercial or charitable purposes or in unusual numbers; and further provided that no dogs shall be permitted to run at large without restraint in said Subdivision. No dog may be tied and left unattended outdoors. 8. No fence or hedge shall be constructed or erected on any Lot in said Subdivision, except that fences shall be permitted in the rear of each Lot; no rear fence shall be constructed unless the plan of construction, including quality of workmanship, design, colors and materials, shall have been approved in writing by The Village at Sherando Homeowners Association, Inc. as being in harmony with the whole subdivision, especially the adjoining townhouse unit. 9. In the event an owner of any Lot in The Village at Sherando shall fail to maintain the premises and the improvements situated thereon in a manner satisfactory to the Board of Directors, The Village at Sherando Homeowners Association, Inc., after approval by two-thirds (2/3) vote of the Board of Directors, shall have the right, through its agents and employees, to enter upon said parcel and to repair, maintain, and restore the Lot and the exterior of the buildings and any other improvements erected thereon. The cost of such exterior maintenance shall be added to and become part of the assessment to which such Lot is subject. 12. The cost of reasonable repair and maintenance of a party wall shall be shared by the Owners who make use of the wall in proportion to such use. If a party wall is destroyed or damaged by fire or other casualty, any Owner who has used the wall may restore it, and if the other Owners thereafter make use of the wall, they shall contribute to the cost of restoration thereof in proportion to such use without prejudice, however to the right of any such Owners to call for a larger contribution from the others under any rule of law regarding liability for negligent or willful acts or omissions. The right of any Owner to contribution from any such Owner under this Article shall be appurtenant to the land and shall pass to such Owner's successors in title. In the event of any dispute arising concerning a party wall, or under the provisions of this Article, each party shall choose one arbitrator, and such arbitrators shall choose one additional arbitrator, and the decision shall be by a majority of all arbitrators. 13. No Lot shall be used or maintained as a dumping ground for rubbish. Trash, garbage or other waste shall be in sanitary containers. The plans has been revised to incorporate the one-half acre lot (34) from Fredericktowne states Section 2, which is now a part of the townhouse development. During the rezoning of this land, the proffers originally specified 90 townhouse units, and the construction of Golladay Road among other items. When Fredericktowne Estates was resubdivided to allow for the Golladay Road right- of-way, lot 34 was left out of place. The Evans Company purchased the lot and the County agreed that with the addition of one half acre to the parcel, four additional townhouse units would be allowed. The proffers were revised to 94 townhouse units, and were accepted. The revised master plan now reflects the addition of Lot 34, the respective increase in areas under the ct summary, and the 94 units. We plan to have this revised plan approved wi Village at Sherando subdivision on 17 October 1990. The revised master pla would then go to the Board the next week for approval. The approved proffers for the Snyder Rezoning indicate 90 units. I am enclosing a letter to Bob Watkins from the Evans Company which addresses the addition of Lot 35 and the 4 additional townhouse units. Lot 35 was already zoned RP and not part of the proffers for the Snyder Tract Rezoning. Lot 35 is just over one half of an acre. At a maximum density of 8 units per acre, the agreement with the County was that the addition of Lot 35 would allow 4 additional units. The revised Master Plan shows the up to date number. A. ACCESS ISSUES 1. We have no comments of the access issues except it appears that the designated construction entrance shown on the plans will be the main access into the project from Route 277 until the future Golladay connection is built. At the time the future connection is planned, consideration will have to be given to the possibility of providing turn lanes at the intersection of Route 277 and proposed Golladay Road based on the proposed and future traffic projections for this project and the surrounding properties. B. DRAINAGE 1. The grading plan is adequate for rough site grading, utilities and public improvements. We performed a detailed review of the stormwater computations which include the flood routing of the 2, 10 and 100 year storms for the upstream 475 acre drainage area to Wright's Run to verify the adequacy of the proposed box culverts under Golladay Road using TR-55. Our calculations show that the culvert flow is governed by the outlet control and not the inlet control as indicated in the design computation. We came up with a 100 year headwater elevation of 713.53 at Golladay Road which is a difference of 0.5 feet from the design calculation elevation of 713.02 feet. With the accuracy limitations existing with run-off calculations, this is not a substantial difference in the answer between the two methods used, however, it does make enough difference that there could be concern in critical areas. The main problem is the impact of the 100 year flood elevation on lots 33 and 32. We see a 2' to 5' increase in the surface water elevation behind the culverts which will render almost 90% of lot 33 unbuildable if adequate precautions are not taken into consideration. There is the need to know the present status of lots 33 thru 29. It is not clear if there are existing buildings on these lots which will adversely be affected by the 100 year flood elevation. This will result in the need for an alternative design of the drainage culvert. If the lots are vacant substantial grading will be required to make them buildable. The lot owner/builders will need to be made aware of the flood elevations and flood plain limits so they do not build within it. For this reason we recommend the following if the lots are not already built on. - The flood plain limit and building floor elevations on lots 32 and 33 will have to be indicated on the plan. - We suggest that the flood plain limit should be shown of the plats of lots 33 thru 29. 3. The Master Development Plan (reference: Evans/Snyder) does not call for a provision of storm water management for this project. It is our opinion based on current studies that storm water management is needed within the County and it should be considered somewhere within the total planned development. We would like to see that the future plans within this Master Plan Development utilize storm water management which will also accommodate this particular phase of the development. C. EROSION AND SEDIMENTATION CONTROL ENGINEERS ARCHITECTS We have no comments on the erosion and SCIENTISTS sedimentation control plan except that the inlet protection as required will need to be labelled on the plan. Early grading permits can be granted on this plan as well as the on -site utilities. However, before the Golladay crossing is permitted the drainage issues must be resolved. McAllister. The type of construction is 94 townhouse residences. The project will also involve installation of roads, sewer, water and utilities. The total developed area is 12 acres. This area includes the Townhouse Development Site and Golladay Road. Existing Site Conditions Prior to construction, the site was characterized by rolling terrain, predominately open with some undergrowth, all typical of undeveloped areas in the Upper Shenandoah Valley. The site is in the Wiekert-Berks-Blairton Soil Association. This area is characterized by gently sloping, moderately deep, somewhat poorly draining soils that have medium to fine textured subsoil; formed in material weathered from shale. Adjacent Areas Most of the areas surrounding the development are residential in nature. Fredericktowne Estates forms the northern boundary of the entire development. Jefferson Village lies to the west. VA Route 277 will be the access to the south. Land to the north and west is existing residential. The land to the east and south is undeveloped and zoned agricultural. The site is a samll part of the 475 acre drainage area of Wrights Run, which lies just north of the site. Soils For purposes of design run off conditions, antecedent moisture condition II (normal consideration for the mid -Atlantic region) is assumed. The soil is considered to have a moderate rate of water transmission, therefore, SCS Soil Class "C" is adopted. Soils are, for the most part, of the Berks (1C) or Blairton (3B) Series. Handbook. Any area denuded in which work is not proceeding for a period of 30 days or more will be stabilized by a temporary seeding in accordance with State guidelines and procedures. All areas to be seeded will receive seed application by hydroseed methods immediately upon obtaining grades. The seed mixture is specified in the General Notes (sheet 1 of the plans). Storm Water Management Consideration Site Plans have been attached. This development employs curb and gutter streets, enclose storm sewer and grassline ditches to carry drainage away. The site drains in two parts. The northern part, approximately 10 acres, drains off to the north and Wrights Run. Development will increase flow from this end of the site by 8 cfs during the ten year storm. Almost all this flow is carried by the storm channel on the east side of Golladay Road. The remainder sheet flows off to the east, then to Wrights Run in existing swales. We have performed flood routing of the two, ten, and 100 year storms for the site and the upstream 475 Ac. drainage area. The resulting hydrographs are enclosed. As it turns out, due to the development of a storm drain system, the peak flow from the developemnt will be passed prior to the passage of the peak from the 475 acre area. The peak flows from each of storm events analyzed actually decrease due to the staggered hydrograph peaks. The southern quarter of the site drains to an existing pond. There is some storage available in the existing ponds to detain flows from the site. We have evaluated the channel down stream of the ponds, and it is adequate to carry the small increase in flows caused by the proposed improvements. Those calculations are attached. A small part (1.5Ac) of the Townhouse Development will drain across Golladay Road to the west. The existing swale is adequate to carry this additional flow. Maintenance All soil erosion control structures shall be checked weekly by the contractor during this construction period and after construction is completed until grass cover is established. Sediment retained by these structures shall be continuously removed and placed in an area of the site specified, damage to soil erosion control structures shall immediately be repaired when identified by the contractor. McAllister. The type of construction is 94 townhouse residences. The project will also involve installation of roads, sewer, water and utilities. The total developed area is 12 acres. This area includes the Townhouse Development Site and Golladay Road. Existing Site Conditions Prior to construction, the site was characterized by rolling terrain, predominately open with some undergrowth, all typical of undeveloped areas in the Upper Shenandoah Valley. The site is in the Wiekert-Berks-Blairton Soil Association. This area is characterized by gently sloping, moderately deep, somewhat poorly draining soils that have medium to fine textured subsoil; formed in material weathered from shale. Adjacent Areas Most of the areas surrounding the development are residential in nature. Fredericktowne Estates forms the northern boundary of the entire development. Jefferson Village lies to the west. VA Route 277 will be the access to the south. Land to the north and west is existing residential. The land to the east and south is undeveloped and zoned agricultural. The site is a samll part of the 475 acre drainage area of Wrights Run, which lies just north of the site. Soils For purposes of design run off conditions, antecedent moisture condition H (normal consideration for the mid -Atlantic region) is assumed. The soil is considered to have a moderate rate of water transmission, therefore, SCS Soil Class "C" is adopted. Soils are, for the most part, of the Berks (1C) or Blairton (3B) Series. A copy of the respective soil map is enclosed. Any area denuded in which work is not proceeding for a period of 30 days or more will be stabilized by a temporary seeding in accordance with State guidelines and procedures. All areas to be seeded will receive seed application by hydroseed methods immediately upon obtaining grades. The seed mixture is specified in the General Notes (sheet 1 of the plans). Storm Water Management Consideration Site Plans have been attached. This development employs curb and gutter streets, enclose storm sewer and grassline ditches to carry drainage away. The site drains in two parts. The northern part, approximately 10 acres, drains off to the north and Wrights Run. Development will increase flow from this end of the site by 8 cfs during the ten year storm. Almost all this flow is carried by the storm channel on the east side of Golladay Road. The remainder sheet flows off to the east, then to Wrights Run in existing swales. We have performed flood routing of the two, ten, and 100 year storms for the site and the upstream 475 Ac. drainage area. The resulting hydrographs are enclosed. As it turns out, due to the development of a storm drain system, the peak flow from the developemnt will be passed prior to the passage of the peak from the 475 acre area. The peak flows from each of storm events analyzed actually decrease due to the staggered hydrograph peaks. The southern quarter of the site drains to an existing pond. There is some storage available in the existing ponds to detain flows from the site. We have evaluated the channel down stream of the ponds, and it is adequate to carry the small increase in flows caused by the proposed improvements. Those calculations are attached. A small part (1.5Ac) of the Townhouse Development will drain across Golladay Road to the west. The existing swale is adequate to carry this additional flow. This increase, and and the effect of the entire Single Family Phase will be addressed when plans are prepared. The calculations showing this channel to be adequate are attached. Maintenance All soil erosion control structures shall be checked weekly by the contractor during this construction period and after construction is completed until grass cover is established. Sediment retained by these structures shall be continuously removed and placed in an area of the site specified, damage to soil erosion control structures shall immediately be repaired when identified by the contractor.
