attached.
It is now appropriate for you to submit the final plats for this subdivision. In addition to
the information provided on the approved design plans, the plat must include the approval
signatures of the Frederick County Sanitation Authority and the Virginia Department of
Transportation. Additionally, a deed of dedication and an appropriate guarantee will be
required prior to final plat approval.

Dear Candice:
I appreciate your willingness to meet with Greenway Engineering and Brookfield Homes last week to
review the preliminary site layout for the multiplex lots in Section 10; as well as the proposed residential
unit floor plans and elevations for the 24-foot wide multiplex product and the 20-foot wide multiplex
product for this section of Snowden Bridge.
Brookfield Homes has requested information that the above referenced multiplex units are acceptable to
Frederick County; therefore, the following information is intended to assist in what was discussed during
our meeting:
> The residential unit floor plans and elevations for the 24-foot wide product and the 20-foot wide
product can be developed as multiplex units within Snowden Bridge.
➢ The preliminary site layout deviates slightly from the approved Master Development Plan;
therefore, a revised Master Development Plan will need to be submitted for administrative approval
prior to Site Development Plan approval.
➢ The Site Development Plan will need to comply with all design and dimensional requirements
specified in the Zoning Ordinance for multiplex residential lots.
I have attached copies residential unit floor plans that we discussed and would ask that you sign below
confirming the accuracy of the information in this letter.

Dear Mr. Kepler:
Planning Staff has reviewed the above -referenced subdivision design plan to detennine if
administrative approval can be granted. At this time, administrative approval cannot be granted. This
plan is denied until the issues in this letter, as well as all issues of the other review agencies, have been
adequately addressed. Please review Staffs comments listed below and then prepare a revised plan
which adequately addresses each concern.
Review Comments
1. On sheet (s) 4 & 12 update the adjoiner information for 44-A-292.
2. On sheet 4 update the key map to show the trail network, the future -roads, and the future land
uses as indicated.
3. On sheet 12 ]able the open space.
4. On sheet 12 lot size is incorrect for housing type and parking space count m not correct.
5. Address the following on the landscaping plan:
a. Remove plant types that are not being proposed with this plan.
b. All street tree plantings need to be 2 '/2 inch caliper. Scrubs are not the right height.
c. Notes (1) all planting shall conform with §165-203.01B of the Frederick County
Zoning Ordinance (Plant selection, planting procedure, and maintenance), and (2)
any plant substitutions must be approved in writing by the Frederick County
Planning Department.
6. A photometric plan and light detail is required with this submission.

Design Plans submitted to us on March 19, 2015. We offer the following comments:
1. It is noted that Ellison Way, Splender Garden Way, Prickly Pear Place, and Jutterbug
Way will be private lanes. As our buses don't travel down private lanes, students who
live on these streets will need to walk to a public street to meet the bus at a location to be
designated by our Transportation Department.

Project shall comply with The Virginia Uniform Statewide Building Code (USBC). Dwellings
(R-5) shall comply with The International Residential 2012 Codes. Other Codes that apply are
the 2009 International Energy.
Dwellings (townhouses) shall be separated as required for per Section R 302.2. Allowable
stories and habitable attic area shall comply with the definition of Habitable Attics as defined by
USBC Chapter 2.
Engineer Design required on all foundations and/or slabs with greater than 8" fill or 24" clean
sand/gravel.
Retaining walls exceeding 2' unbalanced fill requires a building permit and possible engineers
design.
Grade shall be sloped away from foundations a min 6" in 10'.

You are correct regarding the access note. For some reason my Cadd file did not show the "Public Park Access Zone"
note that we had included on the last MDP. I am attaching new copies which include the previous notes. We will show
the park access on the future design plans for the area that will adjoin the park.

In response to our meeting on Sept. 4t', I have attached copies of the plan revisions for the Snowden Bridge Master
Development Plan. I have made the minor revisions, that we had discussed, to the private streets in the multiplex area
adjacent to the future public park and north of Northumberland Drive, eliminated the private access drive at the end of
Rooftop Court, and reconfigured Poinsettia Lane to access both Northumberland Drive and Gristmill Court. Please look
over these changes and let me know if you have any comments or concerns. If everything is OK I will forward to you
revised plan sets for administrative approval. Please let me know how many sets you will require.

Adjustments at Instrument Nos. 070005227 and 110007386, located in Stonewall Magisterial
District, Frederick County, Virginia and recorded in the Office of the Clerk of the Circuit Court
of Frederick County, Virginia (the "Property"); and
WHEREAS, it is the desire and intent of Brookfield to subdivide the Property into lots
and parcels, and to dedicate, grant. and convey for public use, the streets and thoroughfares in
accordance with this Deed and the plat dated July 28, 2016, entitled "Final Subdivision Plat
Snowden Bridge Section 10" and prepared by Greenway Engineering, Inc., certified land
surveyors, (the "Plat") which is attached hereto as and incorporated herein by reference as
"Exhibit A"; and
WHEREAS, it is the desire and intent of Brookfield to grant and convey unto the County,
and unto the Authority, the easements in the locations as shown on the Plat and as hereinafter
provided; and
WHEREAS, it is the desire and intent of Brookfield to grant and convey unto Snowden
Bridge Association and Ramie Corner Association, the easements in the locations as shown on
the Plat and as hereinafter provided; and
WHEREAS, it is the desire and intent of Brookfield to create and establish easements for
ingress and egress over and across the Property, said easements being more particularly bounded
and described on the Plat and as hereinafter provided; and
WHEREAS, it is the desire and intent of Brookfield to convey a portion of the Property
unto Snowden Bridge Association and Ramie Coiner Association; and
WHEREAS, the Property is, or will be, subject to the terms and conditions of the
Declaration for Snowden Bridge, a declaration for a property owners association formed
pursuant to the Virginia nonstock corporation act and recorded in the aforesaid Clerk's Office as

Instrument No. 070018836, and the Declaration for Ramie Comer, a declaration for a property
owners association formed pursuant to the Virginia nonstock corporation act and recorded in the
aforesaid Clerk's Office as Instrument No. 120006743 (collectively the "Declaration").
SUBDIVISION
NOW THEREFORE WITNESSETH, in consideration of the premises and the sum of
One Dollar ($1.00), cash in hand paid, receipt of which is hereby acknowledged, Brookfield
hereby subdivides that portion of the Property containing 9.2926 acres into lots and parcels to be
known as Lots 1 through 48, inclusive, and Open Space Parcels 1 through 5, inclusive, Section
10, Snowden Bridge in accordance with the Plat which is expressly incorporated herein and
made a part of this Deed as well as four (4) private drives shown and depicted on the Plat as
"Ellison Way," "Jitterbug Way," "Prickly Pear Place" and "Splendor Garden Way" in
accordance with the Plat which is expressly incorporated herein and made a part of this Deed.
VACATION OF LOT LINES
THIS DEED FURTHER WITNESSETH, that Brookfield does hereby vacate those lot
lines of Tax Map No. 44-A-293 as shown on the Plat.
EMERGENCY INGRESS AND EGRESS EASEMENTS
THIS DEED FURTHER WITNESSETH, that in consideration of the premises and the
sum .of One Dollar ($1.00), cash in hand paid, receipt of which is hereby acknowledged,
Brookfield grants and conveys unto the County, its successors and assigns, an easement for
ingress and egress, for construction and maintenance of utilities, for County and other emergency

vehicles, and for the purpose of performing any governmental functions which the County, may
find necessary or desirable to perform, including, but not limited to, police and fire protection,
over and across all public and private easements. Notwithstanding the foregoing, in the event
any of such public and private easements are hereafter adjusted, relocated, reconfigured, or
otherwise altered, these easements shall automatically be adjusted so that no portion of the
Property which ceases to be a public or private easement shall be subject to these easements.
STORM DRAINAGE EASEMENTS
THIS DEED FURTHER WITNESSETH, that in consideration of the premises and the
sum of One Dollar ($1.00), cash in hand paid, receipt of which is hereby acknowledged,
Brookfield grants and conveys unto the County, its successors and assigns, a twenty foot (20')
storm drainage easement and several variable width storm drainage easements, identified on the
Plat as "20' Storm Drainage Easement," `'Storm Drain Easement" and "Storm Drainage
Easement" which shall run with the land and be perpetual easements for the purposes of
constructing, operating, maintaining, adding to, altering or replacing present or future stormwater
management facilities, storm drainage lines, storm sewer lines, or other drainage structures,
including building connection lines, plus all necessary inlet structures, manholes, and
appurtenances for the collection of stormwater and its transmission through and across said
Property of Brookfield, said easements being more particularly bounded and described on the
Plat.
The foregoing easements are subject to the following conditions where applicable:

1. All storm sewers, manholes, inlet structures, and appurtenant facilities which dre
installed in the easements shall be and remain the property of the County, its successors and
assigns.
2. The County and its agents shall have full and free use of said easements for the
purposes named, and shall have all rights and privileges reasonably necessary to the exercise of
the easements including the right of access to and from the easements and right to use adjoining
land where necessary; provided, however, that this right to use adjoining land shall be exercised
only during periods of actual construction or maintenance, and further, this right shad] not be
construed to allow the County to erect any building or structure of a permanent nature on such
adjoining land,
3. The County shall have the right to trim, cut, and remove trees, shrubbery,. fences,
structures, or other obstructions or facilities in or near the easements being conveyed, deemed by
it to interfere with the proper and efficient construction, operation, and maintenance of said
easements; provided, however, that the County, at its own expense, shall restore, as nearly as
possible, the premises to their original condition. Such restoration shall include the backfilling
of trenches, the replacement of fences and shrubbery, the reseeding or resodding of Iawns or
pasture areas, and the replacement of structures and other facilities located outside the
easements, but shall not include the replacement of structures, trees and shrubs, or other facilities
located within the easements.
4. The County shall have.the right to demolish all paving, curbing, and/or guttering
in the easements being conveyed,. deemed by it to interfere with the proper and efficient
construction, installation, operation, and maintenance of said stormwater drainage lines and
appurtenant facilities; provided, however, that the County, at its own expense, shall restore all

non -interfering paving, curbing, and/or guttering which are disturbed in any manner by r&
construction, operation, and maintenance of said stormwater drainage lines and appurtenant
facilities.
5. Brookfield reserves the right to construct and maintain roadways over said
easements to the extent not prohibited or restricted by ordinance and to make any use of the
easements herein granted which may not be inconsistent with the rights herein conveyed, or
interfere with the use of said easements by the. County for the purposes named; provided,
however, that Brookfield shall not erect any building or other structure, excepting a fence, on the
easements without obtaining the prior written approval of the County.
6. Brookfield covenants that it is seized of and has the right to convey said storm
drainage easements, rights and privileges, that the County shall have quiet and peaceable
possession, use and enjoyment of the storm drainage easements, rights and privileges, and that
Brookfield shall execute such further assurances thereof as may be required.
7. Brookfield agrees that the agreements and covenants stated in this Deed are not
covenants personal to Brookfield but are covenants running with the land which are and shall be
binding upon Brookfield, its heirs, personal representatives, successors and assigns.
8. The individual lot owners and/or Snowden Bridge Association shall be
responsible for maintenance of storm drainage easements conveyed herein in accordance with
the terms and conditions of the Declaration. Each lot owner's responsibility to perform such
maintenance obligations shall run with the land.

SANITARY SEWER AND WATER LINE EASEMENTS

THIS DEED FURTHER WYMESSETH, that in. consideration of the premises and the
sum of One Dollar ($1.00), cash in hand paid, receipt of which is hereby acknowledged,
Brookfield does hereby grant and convey unto the Authority, its successors and assigns several
water and sanitary sewer easements (the "FCSA Easements") for the purpose of .installing,
constructing, operating, maintaining, repairing, adding to or altering and replacing one or more
present or future water mains and sanitary sewer lines, including, without limitation, fire
hydrants, valves, vaults, meters, building service connections and connection lines, sanitary
lateral lines, manholes and other appurtenant facilities (collectively, the "Facilities"), for the
transmission and distribution of water and the collection of sanitary sewer and its transmission .
through, upon and across the portion of the Property bounded and described as "FCSA
Easement' (the "Easement Area") on the Plat, attached hereto and made a part hereof, subject to
the following conditions:
1. All Facilities which are installed in the Easement Area shall be and remain the
property of the Authority, its successors and assigns.
2. The Authority and its agents shall have full and free use of said the FCSA
Easements for the purposes named, and shall have all rights and privileges reasonably necessary
to the exercise of the FCSA Easements, including the right of access to and from the Easement
Area, and the right to use adjoining land when necessary; provided, however, that this right to
use adjoining land shall be exercised only during periods of actual construction or maintenance,
and then only to the minimum extent necessary for such construction and maintenance; and
further, this right shall not be construed to allow the Authority to erect any building or structure
of a permanent nature on such adjoining land.

3. The Authority shall have the right to trim, cut and remove trees, shrubbery,
fences, structures or other obstructions in or reasonably near the Easement Area, including those
existing at the time of execution of this Deed, deemed by it to interfere with the proper and
efficient construction, operation and maintenance of the Facilities; provided, however, that the
Authority, at its own expense, shall restore, as nearly as possible, to their original condition all
land or premises included within or adjoining the Easement Area which are disturbed in any
manner by. the construction, operation and maintenance of the Facilities. Such restoration shall
include (i) the backfilling of trenches, (ii) repaving of asphalt, concrete, composite, and other
impervious areas, (iii) the reseeding or resodding of lawns or pasture areas, and (iv) the
replacement of trees, flowers, shrubbery, vegetable plants, porous/permeable paving, pavers,
structures, and other obstructions located outside the Easement Area, but shall not include the
replacement of trees, flowers, vegetable plants, porous/permeable paving, pavers, structures, or
other obstructions located within the Easement Area.
4. Brookfield reserves the right to construct and maintain roadways over the
Easement Area and to make any use of the Easement Area which may not be inconsistent with
the FCSA Easements rights herein conveyed, or interfere with the use of the FCSA Easements by
the Authority for the purposes named; provided, however, that Brookfield shall not erect any
building or other structure, or install any underground facilities or utilities, or change existing
ground elevation or impound any water on or within the Easement Area without obtaining the
prior written approval of the Authority. In the event a use of the Easement Area by Brookfield is
approved by the Authority, but requires the relocation of any of the Facilities or the adjustment
of the depth of any of the Facilities, all costs required to accomplish such relocation or
adjustment shall be paid by Brookfield. Brookfield agrees that no vegetation other than (i) grass,

(ii) shrubbery, and (iii) flowers and vegetable plants with root systems that extend no more than
12 inches below the surface at maturity, may be planted in the Easement Area; provided,
however, that such flowers, shrubbery and vegetable plants are planted at Brookfield's risk and
the Authority shall have no obligation to replant such flowers, shrubbery and vegetable plants
nor to compensate Brookfield for such vegetation in the event such vegetation is damaged or
destroyed during the exercise of the Authority's rights under the FCSA Easements.
5. At such time as any portion of land within the Easement Area is accepted by the
Commonwealth of Virginia or any appropriate agency thereof for maintenance into the state
highway system, all easement rights acquired by the Authority by this instrument in such portion
of land shall cease and terminate, provided that the Commonwealth of Virginia or any
appropriate agency thereof concurrently grants to the Authority all necessary permits or
easements for the continued operation, maintenance, inspection, repair and replacement of its
water mains, and appurtenant facilities in said location.
6. Brookfield covenants that it is seized of and has the right to convey said FCSA
Easements, rights and privileges, that the Authority shall have quiet and peaceable possession,
use and enjoyment of the FCSA Easements, rights and privileges, and that Brookfield shall
execute such further assurances thereof as may be required.
7. In the event the Authority notifies Brookfield (or its successors or assigns, as
applicable) of a violation of the terms of these the FCSA Easements and Brookfield (or its
successors or assigns, as applicable) does not cure such violation within thirty (30) days of such
notice, the Authority may take such action as necessary to cure such violation, including ingress
and egress over any portion of Brookfield's (or its successors' or assigns', as applicable)
property deemed necessary by the Authority to access the Easement Area or to enforce the

Authority's rights hereunder. All costs and expenses incurred by the Authority in exercising or
enforcing its rights hereunder shall be paid or, at the Authority's election, reimbursed, by
Brookfield (or its successors or assigns, as applicable), within thirty (30) days from the date
Brookfield (or its successors or assigns, as applicable) receives a bill or invoice .from the
Authority for such costs and expenses. If such costs and expenses are not paid within the thirty
(30) day period referenced in the preceding sentence, all such costs and expenses shall
immediately commence bearing interest at the rate of twelve percent (12%) per annum. The
Authority shall have the right to enforce the terms of these FCSA Easements by any remedy
available at law or in equity.
8. If the Authority is adjudicated the prevailing part in any judicial proceeding
between the parties regarding enforcement of these FCSA Easements, the Authority shall be
awarded its costs and expenses, including reasonable attorney's fees.
9. Brookfield agrees that the agreements and covenants stated in this Deed are not
covenants personal to Brookfield but are covenants running with the land which are and shall be
binding upon Brookfield, its heirs, personal representatives, successors and assigns.
RETAINING WALL MAINTENANCE EASEMENT
THIS DEED FURTHER WITNESSETH, that in consideration of the premises. and the
sum of One Dollar ($1.00) cash in hand paid, receipt of which is hereby acknowledged,
Brookfield grants and conveys unto Ramie Corner Association a retaining wall maintenance .
easement over Lots 1 through 16, inclusive, and over those certain areas and in the locations
shown on the Plat for the purposes of installing, providing access to and maintaining a retaining
wall, identified as "Retaining Wall Maintenance Easement," in accordance with the terms and

conditions of the Declaration. This easement is supplemental to, and not in lieu of or otherwise
restrictive of easements for utilities, as set forth in the Declaration.
The foregoing retaining wall maintenance easement shall be subject to the following
conditions:
1. Ramie Corner Association shall be responsible for any and all maintenance of the
retaining wall and shall conduct periodic inspections of the retaining wall. Should Ramie Comer
Association fail to perform maintenance and/or conduct inspections of the retaining wall,
Brookfield, and/or its successors or assigns, is hereby granted the right to perform any
maintenance or inspections of the retaining wall it deems, necessary. All costs and expenses
incurred by Brookfield, and/or its successors or assigns, .in exercising or enforcing its rights
hereunder shall be paid or, at Brookfield's, and/or its successors or assigns', election, reimbursed
by Ramie Comer Association (or its successors or assigns, as applicable), within thirty (30) days
from the date Ramie Comer Association (or its successors or assigns, as applicable) receives a
bill or invoice from Brookfield, and/or its successors or assigns, for such costs and expenses. If
such costs and expenses are not paid within the thirty (30) day period referenced in the preceding
sentence, all such costs and expenses, including, but not limited to, Brookfield's, and/or its
successors and assigns', attorneys' fees and costs, shall immediately commence bearing interest
at the rate of twelve percent (12%) per annum: Brookfield, and/or its successors or assigns, shall
have the right to -enforce the terms of the retaining wall maintenance easement by any remedy
available at law or in equity. Ramie Comer Association is responsible for and shall indemnify
Brookfield, and/or its successor and assigns, for all of its losses, costs and damages, including,
but not limited to, attorneys' fees and costs.

Corner Association is unable .to reasonably exercise the right of ingress and egress over the
retaining wall maintenance easement, Grantee shall have the right of ingress and egress over the
Property adjacent to the retaining wall maintenance easement in order to access the retaining
wall maintenance easement; provided, however, that this right to use such adjoining land shall be
exercised only during periods of actual construction or maintenance, and further, this right shall
not be construed to allow Ramie Corner Association to erect any building, structure or facilities
on such adjoining land.
3. Ramie Corner Association shall have the right to trim, cut and/or remove trees,
shrubbery, fences or other obstructions on or near the retaining wall maintenance easement being
conveyed deemed by Ramie Comer Association to interfere with the efficient construction or
maintenance of the retaining wall; provided, however, that Ramie Corner Association, at its own
expense, shall restore all land or premises which are disturbed in any manner by the construction
or maintenance of the retaining wall. Such restoration shall be to Brookfield's, and/or its
successors and assigns', reasonable satisfaction and shall include the backfilling of trenches, the
replacement of fences and shrubbery, the reseeding or resodd ng of lawns or pasture areas and
the replacement of structures or other facilities as appropriate located within the retaining wall
maintenance easement.
4. Brookfield, and/or its successors and assigns, shall have the right to use the
retaining wall maintenance easement in any manner which is not inconsistent with the rights

granted to Ramie Corner Association herein. Brookfield, and/or its successors and assigns, shall
at all times have the right to cross over and upon said retaining_wall maintenance easement and

PRIVATE DRIVE INGRESS/EGRESS EASEMENTS
THIS DEED FURTHER WITNESSETH, that in consideration of the premises and the
sum of One Dollar (51.00), cash in hand paid, receipt of which is hereby acknowledged,
Brookfield creates and establishes for ingress and egress and for the construction and .
maintenance of utilities in the locations as shown on the Plat, easements designated thereon as

"Private Access Easement," for the use and benefit of the lot(s) served thereby. Each parcel

subject to an easement for ingress and egress, as well as the easement itself, may hereinafter

amended and modified from time to time. The easements may be. modified by the Board of
Directors of Ramie Comer Association, from time to time, provided that in no event shall any
lot's access be eliminated or materially impaired. In the event the parties hereafter enter into any
boundary line adjustments or similar documents affecting any Private Drive, the easement shall.
only affect the Private Drive, as so adjusted, and shall not affect any individual residential lot..
The foregoing Private Drives granted to Ramie Corner Association are subject to.the
following rights and conditions:

WETLAND NIITIGATION BUFFER EASEMENT
THIS DEED FURTHER WITNESSETH, that in consideration of the premises and the
sum of One Dollar ($1.00) cash in hand paid, receipt of which is hereby acknowledged,
Brookfield grants and conveys unto Snowden Bridge Association a wetlands buffer easement
(the "Wetlands Buffer") over those certain. areas and in those locations shown on the Plat,
identified as "Wetland Mitigation Buffer" in compliance with Wetlands Permit No. 2006-7.418
granted to Brookfield by the Department of the Army, Corps of Engineers. on September 7, 2007
(the "Wetlands Permit"). The Wetlands Buffer must remain undisturbed and must be
maintained, monitored and inspected until September 2017 as required by the Wetlands Permits.
The foregoing Wetlands Buffer granted to Snowden Bridge Association is subject to the
following rights and conditions:

and assigns.
The foregoing conveyance of the Open Space Parcels to Ramie Corner Association is
subject to the following rights and conditions:

Open .Space Parcels and shall conduct periodic inspections of the Open Space Parcels. Should

This Deed is made in accordance with the statutes made and provided in such cases; with
the approval of the proper authorities of Frederick County, Virginia, as shown by the signatures
affixed to the Plat, as applicable, and is with the free consent and in accordance with the desire of
Brookfield, the owner and proprietor of the Property.
Snowden Bridge Association and Ramie Comer Association shall execute this Deed for
the purpose of accepting responsibility for all maintenance and other obligations assigned to or
assumed by Snowden Bridge Association and/or Ramie Corner Association under this Deed.

THIS SUPPLEMENTARY DECLARATION ("Supplementary Declaration") is made
this 18 day of August, 2016 by and among BROOKFIELD STEPHENSON VILLAGE, L.L.C.,.a
Virginia limited liability company ("Declarant'); SNOWDEN BRIDGE COMMUNITY
ASSOCIATION, a Virginia non -stock corporation ("Master Association") and RAIIIE
CORNER COMMUNITY ASSOCIATION, a Virginia non -stock corporation
("Subassociation").
RECITALS:
A. Declarant is the owner of that certain parcel of real property located in Frederick
County, Virginia legally described as Lots 1 through 48, inclusive, Section 10, SNOWDEN
BRIDGE, as duly dedicated, platted and recorded by that certain "Deed of Dedication,
Subdivision, Easement and Conveyance" recorded as Instrument No. 1(0M0$J65a among
the land records of Frederick County, Virginia (the "Deed"), and as depicted on the subdivision
plat attached thereto dated March 11, 2016 and titled "Final Subdivision Plat Snowden Bridge
Section 10" (the "Plat').
B. Declarant is also the holder of certain.private access easements for ingress and
egress and for the construction and maintenance of utilities, all as more particularly described in
the Deed, and designated on the Plat as "Private Access Easement' and further designated on the
Plat as "Ellison Way," "Jitterbug Way," "Prickly Pear Place" and "Splendor Garden Way"
(collectively "Private Drives").
C. Master Association is the holder of certain common and shared utility easements,
all as stated in the Deed and on the Plat.
D. Subassociation is the holder of a certain retaining wall maintenance easement all
as stated in the Deed and on the Plat.
E. Subassociation is the owner of that certain parcel of real property located in
Frederick County, Virginia legally described as Open Space Parcels 1 through 5, inclusive,
Section 10, SNOWDEN BRIDGE, as duly dedicated, platted and recorded by the Deed and as
depicted on the Plat.
F. Lots I through 48, inclusive, and Open Space Parcels 1 through 5, inclusive, shall
be collectively referred to herein as the "Property."
G. Declarant is the Declarant of that certain Declaration for Snowden Bridge (the
"Master Declaration") recorded as Instrument Number 070018836 among the aforementioned

H. Declarant is the Declarant of that certain Declaration for Rainie Corner and
Supplementary Declaration for Snowden Bridge (the "Sub -Declaration") recorded as Instrument
Number 120006743 among the aforementioned land records, as it may be amended from time to
time.
I. In accordance with Article 4 of the Master Declaration, Declarant reserved the
right to subject real property described in Exhibit B•attached to the Master Declaration to the
terms and provisions thereof by means of a Supplementary Declaration recorded among the
aforementioned land records.
J. In accordance with Article 4 of the Sub -Declaration, Declarant reserved the right
to subject real property described in Exhibit B attached to the Sub -Declaration to the terms and
provisions thereof by means of a Supplementary Declaration recorded among the
aforementioned land records.
K. The Master Declaration and the Sub -Declaration each provide that every Owner
(as defined therein) shall be a member of the Master Association and the Subassociation, as
applicable, and shall pay Assessments or charges as are properly fixed and established by the
Master Association and the Subassociation, as applicable, (e.g. for the purpose of maintaining
and improving the Common Area and the Recreational Facilities in Snowden Bridge), and
Declarant desires to subject the Property to the covenants, restrictions, reservations, easements,
servitudes, liens and charges, of the Master Declaration and the Sub -Declaration. Declarant
intends that the Owners of Lots within the Property.shall be members of the Master Association,
in addition to being members of the. Subassociation.
L. It is the desire of Declarant to subject the Property to the terms of the Master
Declaration and Sub -Declaration by the recordation of this Supplementary Declaration. The
covenants, conditions and restrictions of the Sub -Declaration shall be subordinate to the Master
Declaration and any amendments thereto, and in the event that there is any conflict between the
Sub -Declaration and the Master Declaration, the provisions of the Master Declaration shall
control.
NOW, THEREFORE, in consideration of the premises, the sum of Ten Dollars
($10.00), and other good and valuable consideration, the receipt and sufficiency of which are
hereby acknowledged, Declarant hereby declares that the Property shall be held, sold and
conveyed subject to the following restrictions, covenants, conditions and easements, which are
for the purpose of protecting the value and desirability of, and which shall run with, the Property
or any part thereof, and shall inure to the benefit of each Owner thereof. The Recitals are
incorporated herein by reference and made a part hereof.
1.01. Declarant, with the joinder of the Master Association and the Subassociation,
hereby declares that the Property shall be held, sold and conveyed subject to the provisions,
easements, restrictions, covenants and conditions set forth in the Master Declaration and Sub -
Declaration, which are for the purpose of protecting the value and desirability of, including, but
not limited to, those provisions relating to Special Declarant Rights, and which shall run with,
the Property or any part thereof, and shall inure to the benefit of each Owner thereof.
1.02. All capitalized items in this Supplementary Declaration shall have the meanings
set forth in the Master Declaration and then the Sub -Declaration, as applicable.
1.03. The Subassociation Common Area of the Property shall include Open Space
Parcels 1 through 5, inclusive, as the same are depicted on the Plat.
ARTICLE II
ASSOCIATION MAINTENANCE
2.01. The Master Association shall be responsible for the maintenance of the storm
drainage easements, the wetland mitigation area and the common shared utility easements
conveyed in the Deed and as more particularly shown on the Plat.
2.02. The Subassociation shall be responsible for the maintenance of the retaining wall
maintenance easement, the maintenance, management and Upkeep of the Common Area
designated as Open Space Parcels 1 through 5, inclusive, and the Private Drives conveyed in the
Deed and as more particularly shown on the Plat.
ARTICLE III
EASEMENTS
3.01. Declarant, the Master Association, the Subassociation, their directors, officers,
agents and employees, all policemen, firemen, ambulance personnel and all similar persons are
hereby granted the easements, including the right to enter upon the Property (and any portion
thereof) as provided by the Master Declaration, the Sub -Declaration and this Supplementary
Declaration, and the Articles of Incorporation and Bylaws of the Master. Association and
Subassociation, as applicable, including in the event of emergencies and in the performance of
proper governmental functions. The exercise of such easements shall be subject to the rights and
limitations set forth in the Master Declaration, the Sub -Declaration, the Supplementary
Declaration and the Articles of Incorporation and Bylaws of the. Master Association and
Subassociation, as applicable.

ARTICLE IV
INITIAL AS FOR MASTER DECLARATION

4.01. Declarant, pursuant to Article 4, Section 4.1 and Article 6, Section 6.l(d)(4) of the
Master Declaration does hereby decrease the initial assessment applicable to any and all unsold
Lots set forth therein to Five Hundred Dollars and 00/100 ($500.00).
ARTICLE V
GENERAL PROVISIONS
5.01. Enforcement The Master Association, Subassociation and any Owner shall have
the right to enforce all restrictions, conditions, covenants, reservations, liens and charges now or
hereafter imposed by the provisions of this Supplementary Declaration, as they provide for
enforcement under the Master Declaration and Sub -Declaration, as applicable.
5.02. Severability. Invalidation of any one of these covenants or restrictions by
judgment or court order shall in no way affect any other provisions, which shall remain in full
force and effect.
5.03. . Amendment. The covenants and restrictions of this Supplementary Declaration
shall run with and bind the Property, and may be amended as provided for under the Master
Declaration or Sub -Declaration, as applicable.
5.04. Annexation. If Declarant should develop additional lands within the area
subject to the Master Declaration or the Sub -Declaration, such additional lands may be annexed
to the Property by Declarant as provided for annexation under the Master Declaration or Sub -
Declaration, as applicable.
