Frederick County administratively approved the above -referenced, Master Development Plan
(MDP #02-21) for Stephenson Village II on July 5, 2022. This MDP is approved for the
development of 386-acres (1,232 units total) as a residential planned community.
All requirements of the Frederick County Zoning and Subdivision Ordinance have been
addressed in the plan. I am providing you with three (3) of the approved final Master
Development Plan. Please ensure that these plans are distributed accordingly. Please

Dear Mr. Mohn,
Please take this letter a response to the May 20`h, 2022, letter addressed to Tyler Klein. Additionally, I
have attached correspondence from County Attorney Roderick Williams intended as a response to Mr.
Lawson's letter dated May IV', 2022, on the same topic.
Your response to the comment from Mr. Klein's April 18t", 2022, correspondence, copied below for
your convenience. fails to adequately address the comment, and prohibits approval of the MDP in its
current form.
Amended Comment from P&D (4/18/22
As required by proffer, construction of the balance of the tivo-lane section of Snowden Bridge
Boulevard may be completed in segments, from Old Charlestown Road to the limits of
development, corresponding with association of subdivision section(s). Construction in Land Bay
IV (age -restricted section) may not commence until the balance of the hwo-lane half -section is
constructed, from Old Charlestown Road to the limits of development for Stephens Village II
(now Milburn Road). Please add this note to this effect on Sheet / of the MDP.
Please provide a note on the MDP in accordance with the comment and take into consideration third and
subsequent plan review submissions incur an additional $500 review fee. If you have any questions
about this correspondence; please do not hesitate to contact me.

Thank you for your letter of May 19. You note that Brookfield is working in areas of the
community which can be accessed from both portions of Snowden Bridge Boulevard that have
been installed and that Brookfield will continue with that work and development plan. So to
avoid any ambiguity, the County offers this letter to affirm that construction of the two-lane half -
section of Snowden Bridge Boulevard must proceed from Old Charlestown Road toward the
limits of development for Land Bay IV (age -restricted section), in order to enable development
of that land bay/section.

Dear Mr. Klein:
We are in receipt of the Department of Planning & Development's comments regarding the second
submission of the subject MDP, dated April 14, 2022, and offer the following response:
Amended Comment from P&D (4/18/22):
As required by proffer, construction of the balance of the two-lane section of Snowden Bridge
Boulevard may be completed in segments, from Old Charlestown Road to the limits of the
development, corresponding with association of subdivision section(s). Construction in Land Bay IV
(age -restricted section) may not commence until the balance of the two-lane half -section is
constructed, from Old Charlestown Road to the limits of development for Stephens Village II (now
Milburn Road). Please add this note to this effect on Sheet 4 of the MDP.
Response: As noted previously, Snowden Bridge Boulevard will be constructed as required by the
proffer statement approved with the Stephenson Village rezoning (#06-03). A summary of the proffer
statement is provided on Sheet 14 of the MDP. This summary sufficiently outlines the requirements
applicable to construction of Snowden Bridge Boulevard for the purposes of the MDP.

Dear Gentlemen:
This is a follow up to our meeting of May 10th. As I understand it, the County's position
is that the Proffers require Snowden Bridge Boulevard to be built in segments and in conjunction
with development of the various sections. As you know, Brookfield intends to update its Master
Development Plan to allow for the development of sections which will be accessed by Snowden
Bridge Boulevard. It is anticipated that now that Brookfield is working in areas of the
community which can be accessed from both portions of Snowden Bridge Boulevard that have
been installed, Brookfield will continue with that work and development plan. Further still, this
is to confirm that Brookfield will design, bond and complete a two lane portion of Snowden
Bridge Boulevard. Construction of the road section will occur as segments of the community are
developed and brought online. As part of that development process, Brookfield looks forward to
commencing a portion of the age -restricted section because there appears to be a strong demand
for that product. Actual construction work in the development as well as along Snowden Bridge
Boulevard will continue to occur as it has throughout the development of this community.

I understand the County has no issue with proceeding in this manner and that
development will be allowed to progress with certain improvements in place such as base -coated
roads and finish work such as with final top coat being installed after all construction has been
completed within certain sections accessed within the community.
Thank you for your continued assistance and cooperation. We look forward to the
growth of the Snowden Bridge community. In order to move that along, we also look forward to
a quick turnaround of the enclosed Master Development Plan and subsequent subdivision plans.

Thank you for providing Planning & Development with the opportunity to review the master
development plan (MDP) for the development referred to as Snowden Bridge 11. Please
adequately address each of the comments listed below:
Preliminary Review Comments:
1. Cover Sheet. On Sheet 1 add the application reference number, MDP #02-22.
2. Overall Notes and Legend. Under "Project Information" specify previous approvals,
including rezoning (REZ) application 406-03.
3. Overall Environmental Sheet. On Sheet 5, update the "Aggregate Table" and
"Legend" to reflect the change to the Subdivision and Zoning Ordinances to amend the
definition of "steep slopes" to 35%. This amendment was adopted by the Board of
Supervisors on January 26, 2022.
Development Aggregate Tabulation Sheet. The following revisions should be made
on Sheet 6:
• Remove "Rezoning Proffer `Exhibit F,"' this is duplicative from Sheet 4.
• Specify the approximate monetary valuation of proposed recreational
amenities included in Table # 6 — "Recreation Unit Tabulation."
Land -Use Plan and Sheet Index_ The following revisions should be made to Sheet 8
(and subsequent sheets where required):
Pedestrian Trail Detail: Add the following note: "Wood chip, grass, and other non -
hard surface materials may not be used for trails being counted towards fulfilling
recreation amenities."

agencies: Frederick County Fire Marshal, Frederick County Department of Building
Inspections, Frederick County Department of Public Works (County Engineer),
Frederick County Department of G.I.S., Frederick County Parks & Recreation,
Frederick County Public Schools (FCPS), Frederick Water, and the Virginia
Department of Transportation (VDOT).
Additional review comments may be Provided on subseguent submissions.
After you have revised the MDP, please resubmit (electronic submission preferred) so that:
Staff may verify the information contained on the plan addresses the above comments. Once
all Planning & Development comments are addressed you will need to submit five (5) full size
hard copies, all request review agency comment letters, and a digital (.pdf) of the Master
Development Plan is also required. Once this information is received, the MDP will be deemed
"administratively approvable" and signed by the Director of Planning and County
