Giguere to Mr. Byron Coburn and Mr. Robert Childress dated July 9, 2001. Your office forwarded this information to Mr. Kris Tierney, Assistant County Administrator on August 24, 2001 and requested a comment reflecting Frederick County's position regarding this issue. Frederick County approved a Master Development Plan for the "Shenandoah" development on May 2, 2001. Sheet 11 of this approved plan provides General Notes for various improvements associated with the "Shenandoah" development. Transportation Improvements General Note 3(a) requires the developer to provide a specific access point onto Hudson Hollow Road (Route 636), and General Note 3(c) requires the developer to pave Hudson Hollow Road from the "Shenandoah" development to the north to tie into the existing paved section prior to the issuance of the 750`h building permit. The transportation improvement commitments, as well as all other development improvement commitments, were discussed during the master development plan public process. Several citizens along Hudson Hollow Road were involved in this process and understand the transportation improvements to reflect the notes as described above. Therefore, any modification to the transportation improvements for Hudson Hollow Road will require the developer to resubmit the master development plan for approval by the Board of Supervisors through an additional public process. Frederick County would also request an opinion from the VDOT Resident Engineer regarding the ability to pave -in -place along this section of Hudson Hollow Road prior to the consideration of modifications to this master development plan. VIA FEDERAL EXPRESS Again, on behalf of Dogwood Development, the developer of the "Shenandoah" mixed use project in Clarke, Frederick and Warren Counties, I would like to thank you for taking time to meet with Ray Smith, President of Dogwood, and the Dogwood consultants and me on June 19, 2001, to discuss the necessary transportation improvements that Dogwood and VDOT have agreed on for Shenandoah. As background, I think it is important to again re -state for the record the following key facts: A. Shenandoah is a mixed use development whose major components will be an active adult community with few children and a reduced traffic impact. Shenandoah was previously known as Wheatlands. Ray Smith's revised development plan for this property, now known as Shenandoah, has been approved by the Board of Supervisors of Frederick County. The Frederick County approval will allow for the potential development of 2130 "active adults homes; a continuing care retirement community and some limited retail. Childress July 9, 2001 Page 2 we have reduced projected traffic volumes by approximately forty percent (40%), e.g. Wheatlands had projected traffic at build out in excess of 30,000 vpd, while Shenandoah has projected traffic of just slightly less than 18,000 vpd; B. While the property owned by Dogwood Development includes land in Clarke County, no land development has been approved in Clarke County. Dogwood recognizes that when it submits for zoning approval in Clarke County that VDOT may be suggesting other traffic improvements over and above those agreed to at our June 19, 2001 meeting and also listed in this letter_ Dogwood also recognizes that any Clarke County rezoning will likely result in VDOT requesting the dedication of right of way, at no cost to VDOT, along the Clarke County property frontage on Route 340/522; C_ While no development has been approved for Clarke County, both VDOT and Frederick County have coordinated with Clarke County to confirm Clarke County has no objection to VDOT issuing an entrance permit to allow the Shenandoah project's main southern entrance ("Lake Frederick Drive") to access Route 340/522 through a small portion of Clarke County; D. The total buildout of Shenandoah will not exceed 2,130 in Frederick County. Our development plans are to build approximately 250 units per year, which means this is a ten or more year project, depending on the economy. Although zoning has been approved, we have not yet received any building permits and do not anticipate beginning development until the fall of this year with the first houses occupied in late 2002 or early in the year 2003_ Listed below is our written understanding of the agreements reached at our June 19, 2001 meeting. It is our understanding that this letter, once accepted by VDOT, supercedes VDOT's letter of the same subject dated May 25, 2001 and signed by Mr. Childress. The May 25, 2001 letter, because of some language confusion, is hereby rescinded as evidenced by VDOT's authorized representatives' signatures below. For the purpose of this letter, the Shenandoah Phase I improvements are considered by the Department to be those associated with the Lake Frederick Drive entrance and associated construction along Route 340/522 adjacent to Shenandoah's southern most property frontage. VDOT has agreed that it will immediately issue a Land Use Permit for this work at Shenandoah, subject to the completion of the following conditions: 1. Shenandoah's site plan entitled "Shenandoah-U.S. Route 340/522 Improvements & Lake Frederick Drive" are approved by VDOT. 2. Normal permit fees are paid, and Surety Bonds posted. Shenandoah recognizes and agrees that the permit will also require the reimbursement of VDOT costs associated with a field inspector. 3, A right-of-way dedication to VDOT will be made by Shenandoah across the entire Phase I of the Property frontage to accommodate an ultimate 6 lane urban designed roadway, This dedication will allow one additional though lane and all required turn lanes. The right-of- way dedication limits shall meet VDOT standards. In preparing our designs for the Phase I improvements, it was agreed that Dogwood's engineers would follow the standards listed below. (a) All Phase I improvements may be a rural design with a ten foot (10') shoulder, ditch section, etc. in accordance with VDOT's current geometric design standards. However, once beyond the limits of the side ditch, the remaining right-of-way dedication area will be graded to within 6"± of the final 3-lane width (per half section) urban ultimate design (only one (1) new through lane and required turn lanes at the Shenandoah entrance on Route 522/340)_ (b) All utilities at the Lake Frederick entrance areas and/or within the right-of- way dedication areas of Phase I will be relocated to accommodate the ultimate 3-lane urban section (3 lanes per half section) — one new through lane and turn lanes at the entrance). (c) All work would be completed under a Land Use Permit after the site plan approval referenced in paragraph 1, above. (d) Any roadway improvements in the area of the intersection of Lake Frederick Drive to Route 340/522 will include the removal/upgrading/modifications of the median crossover. As I think you know, we have received preliminary plan agreement with VDOT (Edinburgh residency) on our proposed Route 277 improvements, It is our understanding that VDOT will approve a final plan providing those agreed to improvements are included. Our final plan will be submitted when we reach that phase of development, which will be in the next three or four years. We will properly permit and bond those proposed Route 277 improvements when we file a site plan for the Shenandoah development with frontage on Route 277. Finally, with regard to Route 636, and subject to VDOT approval, we will agree to pave the existing gravel section from the Shenandoah project boundary to the existing paved section of Route 636 to the north. Once VDOT has issued a Land Use Permit for all the Phase I improvements, Dogwood is also willing, if desired by VDOT, to meet with Frederick County representatives to determine if, instead of paving the existing gravel portion of Route 636 to the north, that VDOT's, the public's and Frederick County's interests would be better served by having Dogwood escrow with VDOT or Frederick County, the estimated costs of paving and allow VDOT and Frederick County to maintain Route 636 in its present condition and for emergency access only until such time as Route 635 can be made a VDOT project and properly, widened to remove vertical and horizontal alignment problems. As we discussed, the proposed memo of agreement provides that unique partnership between the commonwealth, the county, and the developer. Transferring Lake Frederick to the private sector negates the intent of the agreement. In your letter you expressed concern that an agreement between the Virginia Department of Game and Inland Fisheries (VDGIF) and the developer of Shenandoah may not gain the approval of the Board of Directors of VDGIF. Accordingly, you have requested that the Frederick County Board of Supervisors rescind their approval of the Master Development Plan. You further requested that any permits issued by the County be suspended. The Board of Supervisors granted approval of the Shenandoah Master Development Plan on October 25, 2000. This approval was conditioned upon the applicant addressing four points of concern raised by the Board. These four conditions, one of which involved the VDGIF agreement, were presented to the Board on March 28, 2001. It was during the March 28, 2001 meeting that the Board approved the conditions as presented. Staff continues to work with the developer to achieve the intent of, and compliance with, the Zoning and Subdivision Ordinances. Furthermore, the developer has been advised that this office will not approve subdivision plats for this project until a number of issues are resolved, one of which involves the agreement with VDGIF. Therefore, the Frederick County Board of Supervisors does not need to rescind their action of March 28, 2001, nor reconsider this issue at a subsequent meeting. Sincerely, EvnA. One of these items was to have an executed agreement with the Department of Game and Inland Fisheries. Although there was no executed agreement furnished, the applicant presented evidence that there was some hope that the agreement you forwarded to the Board would be accepted and signed by the Department. The Board of Supervisors gave approval of the master plan on that basis . When the proposed agreement was presented to the Board of Directors of the Department last week it was neither accepted nor executed. A public hearing was scheduled on the matter for July 19, 2001. The Board of Directors (in executive session) appears to have given instructions to their representative that will drastically alter the substance of any agreement that may finally be approved by that Board Since the Board of Supervisors clearly wanted an executed agreement prior to Master Plan approval it is apparent that the "approval" action of March 28 must be revoked. I request that you initiate the appropriate action to get this before the Board of Supervisors at the next meeting. Ruddy, Planner II Subject: Recreational Access Funds for Lake Frederick Date: July 3, 1997 Staff has recently received a correspondence from the Department of Game and Inland Fisheries. The Department of Game and Inland Fisheries is looking for a resolution of support from Frederick County for their application for Recreational Access funds. These funds will be used for road improvements to serve the public boat landing and fishing pier at Lake Frederick. This application is some what unique in that access to Lake Frederick is through both Frederick and Clarke Counties. A similar request has been forwarded to Clarke County. Recreational Access funds are made available by the Virginia Department of Transportation through a stand alone fund. A specific amount of Recreational Access funding, approximately $250,000 per year, is allocated to each residency in the state. The residency then allocates the money to eligible projects within their jurisdiction. The maximum amount of money that may be allocated to a project is approximately $65,000. VDOT has determined that this access road qualifies for these recreational access funds. It is important to note that the monies in this fund are separate from those used for secondary road improvements and for industrial access funds. Therefore, a successful application will not impact the amount of money available in these funds. 107 North Kent Street • Winchester, Virginia 22601-5000 Recreational Access Funds Memo Page 2 July 3, 1997 Jim Doran, Director of Parks and Recreation, is aware of the application and recommends that the County go ahead with this resolution of support. He believes that a successful application would not have a negative impact on future applications that may be made by the Parks and Recreation Department during the next fiscal year. Furthermore, the preliminary cost estimate for the project provided by the Department of Game and Inland Fisheries, $19,000, is relatively small and the improvements to the road would greatly benefit the County and its residents. The resolution of support as requested by the Department of Game and Inland Fisheries follows. The Department of Game and Inland Fisheries is looking for a resolution of support from Frederick County for their application for Recreational Access funds. These funds will be used for road improvements to serve the public boat landing and fishing pier at Lake Frederick. This application is some what unique in that access to Lake Frederick is through both Frederick and Clarke Counties. A similar request has been forwarded to Clarke County. Recreational Access funds are made available by the Virginia Department of Transportation through a stand alone fund. A specific amount of Recreational Access funding, approximately $250,000 per year, is allocated to each residency in the state. The residency then allocates the money to eligible projects within their jurisdiction. The maximum amount of money that may be allocated to a project is approximately $65,000. VDOT has determined that this access road qualifies for these recreational access funds. It is important to note that the monies in this fund are separate from those used for secondary road improvements and for industrial access funds. Therefore, a successful application will not impact the amount of money available in these funds. I have met with Ray Smith of the Dogwood Development group and have reviewed the plans for Sllcnlndoall with him and comparcd there to Whcatlands, the previous plan. III my opinion as all ecologist, the Shenandoah plan is far superior. it 1) leaves more of the existing forest undisturbed, 2) avoids the steep hill slopes, 3) clusters building sites (leaving larger contiguous forest tracts), 3) and provides suhstalttial detention areas which should have a positive impact oil the water quality in Lake Frederick. Most intriguing to me are the plan. fur post -build -out recovery of the developed areas—i.e., planting with native plants, encouraging owners to establish backyard habitats, establishing, an interpretivee nature cunicr, and, more generally, to create: a collhlulnity that is part of the ecosystem not apart from it. Of course, mentioning such amenities (toes not necessarily mean they will happen. But I feel the: principals involved are dedicated to maintaining or improving on, in measurable ways, the 100a1 c•c010gy of the area. At its October 61h meeting, the Commission established a Double Tollgate Area Plan Committee with five members: Carol Flues, Jane Ghramm, Tom Gilpin, Dave Jelinek, and Dan Mackay -Smith. Ms. Ghramm will chair the committee. The first meeting of the committee will be at 4:00 pm, on Thursday, October 261h, at the Board of Supervisors Meeting Room, Circuit Courthouse, Berryville. You are encouraged to attend or call Chuck Johnston, County Planning Administrator, at 955-5132 if you have questions. The County Comprehensive Plan calls for the adoption of land use plans for areas around the intersections primary highways. Currently there are 26 acres of commercially zoned land at the Double Tollgate intersection. Plans for development in Frederick County include a 4,000-person retirement community around Lake Frederick State Park. Plans for development in Warren County include a five -mile long strip of industrial development along Route 522 from I-66 to the Dollar General Distribution Center. The vehicle and truck traffic generated by these projections will significantly increase the volume of traffic at the Double Tollgate intersection. These and other factors may warrant additional commercially zoned property around the intersection and significant improvements to Route 522, Stonewall Jackson Highway, and the intersection itself. The Double Tollgate Area Plan will address these and other related issues. The Committee hopes to complete its work in the next six months and a recommend a Plan to the Planning Commission. All Committee meetings are open to the public and public involvement is encouraged. After receiving the Plan from the Committee, the Planning Commission will hold public hearings and make a recommendation to the Board of Supervisors. First, I wish to note that my response contains input from Mr. Kris Tierney, director of planning and development, Frederick County, and Mr. Wellington Jones, engineer -director, Frederick County Sanitation Authority. I also wish to note that the contents of this letter contain my views on the questions you raised, which may or may not be the views shared by other members of the board of supervisors. I can only speak for myself as my voting record on such issues will reflect. Regarding your questions about the water issues I am compelled to rely on the experience and expertise of Mr. Jones to assure that Frederick County has an abundant supply of water to meet the needs of our residents now and into the distant future. I do not claim to be an expert on the subject of water, but you can be sure I will, continue to ask questions on how the sanitation authority. intends to guarantee that the county needs will be met. As you may be aware, Mr. Bauman, I have on many occasions made my views known that the sanitation authority should include the use of reservoirs in it's efforts to provide an adequate water supply to the county. Many of our bigger cities in the United States depend on reservoirs as back-up systems to their water supplies. As the Supervisor for the Gainesboro District I would certainly welcome such a reservoir be built in the western part of Frederick County. Not only will we have a much needed back-up supply of water to be utilized in drought seasons, but we could provide the residents in this part of the county with a recreational facility where boating, fishing and swimming could be enjoyed. At the present time there are no recreational facilities in the western part of Frederick County. Moreover, in my conversation with Mr. Jones about the use of reservoirs, he indicated that the Department of Environmental Quality is reluctant to issue new permits for this purpose. The reason being as Mr. Jones claims that such reservoirs presents a negative impact on the environment. He further claims that certain species of birds will become extinct. (Well, it is my personal belief 350 Redland Road - Cross Junction. Virginia 22625 NIr. William B. Bauman August 28, 2000 Page 2 that if we continue to have back-to-back droughts, the people of Frederick County will become extinct.) In any case, I intend to pursue the use of reservoirs as long as I am in office; therefore, the jury is still out on this issue. In further response to your questions on water issues I have enclosed a copy of Mr. Jones' comments to me concerning your letter. Again, I wish to reiterate that I rely on the expertise of Mr. Jones and place my confidence in him and his staff to provide water and sewer to both the residents and businesses in Frederick County. Even though I may not agree with all aspects of the sanitation authority endeavors (i.e. the proliferation of production wells and the dependency on. ground water supplies), I do believe that Mr. Jones and his staff are fully committed and dedicated to serve the people of Fredrick County. However, I only wish that the study on ground water tables in Frederick County which US Geological Survey is scheduled to conduct was available to the sanitation authority at this time. Having that information available as the department planning and development embarks into the development of the Northeastern Land Use Plan and other such ventures would undoubtedly increase my faith in the sanitation authority's ability to project water needs for these ambitious undertakings. Unfortunately, this study will not be available for another three years. It is also my understanding that last such survey was conducted in 1978; therefore, I do not place much faith if these figures on the groundwater tables are going to be used for available water for current projections. Regarding your questions on the amendments to the Frederick County Code, Chapter 165 that was passed by the majority of the supervisors at the August 9th meeting, my "nay" vote on this measure speaks for itself, however, I do not want the residents of Frederick County to think that I do not have confidence in Mr. Tierney and his staff to serve our residents. Nothing can be further from the truth. We may not always agree but my voice will always be heard when it reflects the will of the people. I have enclosed a copy of Mr. Tierney's comments regarding the questions raised in your letter. In closing, I wish to set the record straight about the board of supervisors' voting record on the subject code amendments. Upon the motion made by supervisor Robert M. To his four statement, I submit the following: 1) Redundancy is important and is a major component of our plan. Using two sources about 14 miles apart, on opposite sides of our service area, is optimum. Many sources were evaluated in developing our plan. The sources selected had excellent yield, quality and location when compared with our needs. This results in a cost-effective method of providing water services to over one-half of the population of the County. 2) Frey Quarry is one of four that are in the plan. The other quarries are Stephens City, Middletown, and Strasburg. These quarries will be used as both a source of supply and a reservoir. The same can be accomplished by damming a stream. By using a quarry, citizens do not have to be relocated because of flooding their land. Other quarries have been considered to include Stuart Peary at Round Hill and in Clarke County. These were found to have low yields under the current quarrying operations. 3) Springs are being considered and may be incorporated into our plan. Recent negotiations for the McDonald Farm Springs were reported in the local newspaper. The use of this source, as well as any other source, was vehemently opposed by Ms. Vicky West's group, "Save the Water." Hackwood Springs are also being considered, but rights are owned by the City of Winchester. 4) Concerns of citizens who believe the Authority's operations will "suck neighborhood wells dry," and "drain the aquifer" should not be described as justified. Justified means to demonstrate or prove to be just, right, or valid. The facts prove these concerns to be unjustified. The Authority has pumped water from the Stephens City quarries for six years. The quarries operated for almost 80 years pumping water at two to three times our rate of withdrawal. This is in addition to the water pumped from other quarries mentioned by Mr. Bauman, some of which have also operated for almost 100 years. Has all this pumping drained the aquifer? No, otherwise the pumping would cease and the existing homes with wells near the quarry would be vacant. Mr. Bauman does understand the abundant water resources available in this County. However, I do not see any value in his request to publish a list of resources with reasons why they are not suitable or WATER AT YOUR SERVICE Supervisor Reyes August 23, 2000 Page 2 available. I submit it is more beneficial to identify the available sources that economically meet the projected demands of the County. Those sources were presented at the Board's last meeting. The presentation summarized the water supply plan that has evolved over many years. You might recommend Mr. Bauman read Qptimization of Use and Management of Water Resources. This is a comprehensive water study planning document by O'Brien & Gere Engineers, Inc., published December 1999. There are other reports that have evaluated some of the sources Mr. Bauman suggests and many others. This wealth of information has been used to formulate the Authority's plan. Engineer -Director /ths Information for response to last paragraph of 8/10/2000 letter from William Bauman to Supervisor Reyes Kris Tierney 8/18/200 Mr. Bauman wrote "If the 15% slope has been working to these past umpteen years, what new scientific data supports a relaxing to 25%? Did the Planning Commission look into how the county got the Code requirements so many years ago? What Does VDOT use for maximum permissible inclines?" First; it is important to realize that the County code, prior to the recent amendment, permitted disturbance of up to 25% of slopes in excess of 15%. There was no limit to the degree ofslope that could be developed, merely a limit on the amount (25% of those slopes in excess of 15%) In other words, the code acknowledges that slopes in excess of 15% can safely be developed it merely attempts to limit the amount of development which occurs on "steep slopes" A preliminary examination indicates that the 15% standard has existed since at least 1987. As to exactly when, how or why 15% was selected or enacted would be difficult to determine. Regarding the recent amendment, there has in fact been considerable discussion for a number of years at the Planning Commission level regarding the use of 15% slope as the standard for "steep" within our Ordinance. It has been the general consensus of the membership that a 15% slope (one foot of rise over nearly 7 feet of distance) was not a very realistic definition of a "steep". The net result of this low threshold was to unduly restrict the developable area within the County's Urban Development Area. The standard artificially reduced the ability of any given site to support the level of development which would otherwise be permitted. This ultimately wastes land and contributes to sprawl. A slope of 25% (one foot of rise over 4 feet of distance) was felt to be a much more realistic measure for the purposes of the Ordinance. As to what standard is utilized by VDOT, they routinely permit slopes well in excess of 25%. In fact many roadside slopes are in excess of a 50%. rem COUNTY of FREDERICK Sidney A. I am thinking of Lake Holiday, Lake Frederick, Emerald Lake and Regency Lake to name four. I would bet there we several more in the County that should be evaluated to supply peak demands. By having those reservoirs scattered throughout the county there would be a low risk that they all would be dry, or low, during a drought or in the event of a water main break. It is called redundancy. 2) In the same document, why is the Frey Quarries the only one listed? As your picture showed, the Frey Quarry is not now full of water. The water source projections are based on how many millions of gallons of water per day (mgd) Frey Quarries pumps to keep the quarry dry enough to mine. Well, fine, how many mgd does the quarry in Gore pump? And how about the one off Route 50, there in Round Hill? How about other quarries in the county? Each one should be listed with an evaluation of their potential to supply water to the county instead of pumping it into Back Creek or Opequon Creek, etc.. If Frey Quarries is willing to do it, why not ask the others? If the county bought the water, that would be plain profit for the quarry, they have to pump the water anyway. 3) In the same document, why aren't any of the springs listed? I am thinking of MacDonald Farm Springs, Hackwood Estate Springs, Green Springs, Chalybeate Springs and Rock Enon Springs to name five. I understand that the first 2 have had a water flow of over 500,000 gallons per day for the last 100 years. Utilizing existing springs poses no risk to the aquifer; unlike taking water from a well. There are springs are all over the county and thus would provide some redundancy. 4) With the justified citizen concern regarding the county bringing the Bartonsville wells on line and sucking the neighborhood private wells dry, lets look to any other sources before we drain the aquifer. Some of the existing lakes (reservoirs), quarries, and springs may not be available for various reasons, but that list of resources should be published with the reasons why they are not suitable or available. I do hope you can be persuasive and have the Frederick County Sanitation Authority fund a comprehensive Water Supply Planning document rather than the "once over lightly" approach shown last night As I listened to the citizen comments regarding `Proposed Amendments to the Frederick County Code, Chapter 165, Zoning Amending Article VIII, R5 (Residential Recreation Community) District" it seemed to me that over 90% of the citizens were against the amendments. If the 15 degree slope has been working to these past umpteen years, what new scientific data supports a relaxing to 250/*? Did the Planning Commission look into how the county got the Code requirements so many years ago? What does VDOT use for maximum permissible inclines? They do not want the hillside to slide down on their road. Isn't it nice that the SHENANDOAH developer is willing to plant I new trees on every lot. He clear cuts 62% to 63% of the land and then plants 2 new trees per lot, and some shrubs. Whoopee! In the meantime, Lake Frederick gets a load of silt from the water runoff during construction like you would not believe. The Board voted 3 `yes" and 3 "no" per my count. You voted "no", good. Earlier in the evening there was another 3 to 3 vote and the measure did not pass. How come on this vote, a 3 to 3 ballot passes? Where is the consistency? Does the Chairman have 1 '/2 votes? Clifford & Associates. The plan reflects current density limits and zoning, but anticipates modifying parts of the R5, Small Lot and Subdivision Ordinances, and revising certain MDP notes. Two thirds of the plan is cast as an Active Adult Community (AAC), which is age restricted and does not generate school age children. It is a heavily amenitized resort style community that caters to the empty nester, the fastest growing population segment over the next 20 years. Another third of the site is a primary home community in a resort style setting. Modifications are needed to create a resort character and a single entrance serving both communities and the VDGIF facility. They also come out of efforts to save existing trees, which have resulted in achieving 50% open space, a dramatic increase in the area of oak forest preserved by the plan. RESORT CHARACTER: ACTIVE ADULT COMMUNITY Lotting, landscaping. clearing This community utilizes small lots and slender private rights of way to reduce clearing of its forested lakeside setting, contributing to achieving 50 % open space on the entire property. The project is applying for community certification for the Audubon Signature Program with Audubon International and as a Community Wildlife Habitat with the National Wildlife Federation. Homes are situated principally on the flatter ground. All streets in the community are planted with 2-1/2" caliper trees spaced 22'-33' apart. Front yard landscape design varies by neighborhood. Within neighborhoods, landscape palettes have consistent characteristics. Rear yard landscape designs are available but optional, allowing for resident expression. The small lots are substantially cleared to accommodate large single - level -living floor plans and lot -to -lot grade changes. Modifications sought are: 1. Achieving 50% open space, saving 25% of the overall site's tree cover, and incorporating project -wide resort style landscaping with street trees and planting strategies endorsed by Audubon International and the National Wildlife Federation are put forward as an equivalent alternative to the R5 requirements of saving 75% of slopes over 15% and 75% of woodlands (Section 165-31.b), and the landscape requirements of Section 165- 65.2. 2. The small lots (45'-65' wide, 105'-110' deep) conform to Small Lot dimensional, buffer, and open space requirements. However, the long dimensions of large -footprint, high -plate, one -story -living homes with dramatic volume interior spaces and such upper -level uses as guest facilities and home offices, need a 35' maximum height rather than the 20' allowed by 165-65.F.3. (They would present substantially and predominantly one-story elevations to the street.) 3. Front porches, stoops and steps project up to 8' into the front yards to create a friendly streetscape, exceeding the 3' dimension of 165-23. F.3. This projection is coordinated with utility easements. As quite a number of the homes have walkout -grade siting, we need a deck projection of 12' into the (minimum 15') rear yard area at rear yards fronting on open space, similar to the projection described in 165-23.F.5. This would additionally avoid filling beyond the property line where walkouts alone do not meet falling grade. 2 4. In support of cluster concepts and minimizing site disturbance, the following modifications are requested for multifamily or plex buildings: • For two story buildings, minimum building separations and maximum building height to be the same as for townhouses (165.65.K(5)&(6). • For three story buildings, minimum building separations to be 40' side and 50' front and rear; maximum building height 45' (165.65.L(6)&(8)(a). Private rights of way (sections attached) Both to minimize clearing and to create a resort environment, variation from certain street, utility easement, and walks are integral to the plan. Private, gated streets are an essential feature of this type of community. The buyers travel a lot and security is a big issue for them. Between gatehouses, streets do not carry through traffic, drivers are mature and unhurried, and trip generation is a third of primary housing (ITE Handbook, Retirement Community trip generation rate: 3.4 ADTs). It is typical for local streets (10' lanes, 20 mph) in these leisure communities to carry vehicular, walk and bicycle traffic. On these streets the absence of sidewalks also contributes to a greener, resort (as opposed to urban) streetscape. Neighborhood collector (12' lanes, 25 mph) paving is widened by 12 feet for walk and bicycle traffic in six foot striped -off lanes between the vehicle lanes and curb, again without sidewalks. The Loop road between gatehouses (12' lanes, 30 mph) is paralleled by an eight foot meandering hiker -biker trail. This road functions as a neighborhood parkway for local traffic, with a green buffer on the outside and all but two neighborhoods entered from it toward the lake and view. No homes front or back onto it. The projected traffic suggests these collectors function as minor collectors which do not require an 'efficiency buffer' to protect neighborhoods from outside or high-speed traffic and noise. Each of these roads coordinates the placement of street trees and utilities in a slender corridor to minimize the area of site disturbance (sections attached). Modifications sought are: 1. Lots and multifamily homes served private streets, which is not anticipated in 165-77.1 or 144.24.C. & C.2.b. 2. Classification of the collectors as minor, with no efficiency buffer (165-37.G)(144.17.K). 3. Pedestrian and bicycle ways as shown on the attached sections in lieu of the requirements of 144.18 and 165-29.14. 4. Use of mountable -type curbs in lieu of CG-6, for compatibility with a resort character. 3 Recreation facilities This type of community provides major social amenities at a single location with indoor and outdoor swimming, lawn games, dining, dance and theater facilities, rooms for exercise, cards, games, arts and business interests. Lake access amenities for fishing and boating are located at the recreation area and north of village A in the North Section. The equivalency of standard recreational units (165.77. F and 165-64) will be discussed with Parks and Recreation. RESORT CHARACTER: PRIMARY HOME COMMUNITY In the west, villages on each knoll comprise a primary home community served by a parkway following the stream valley to its south and preserving it as a greenway 'front door' to development along the lake. The parkway is paralleled by a meandering eight foot trail joining the villages to a recreation center at the dam and a light boat launch between villages D and E. Owing to the circuitous character of Rt 636 to the north and low trip generation along Rt 636, the prospect of substantial through traffic between arterials using this collector does not appear great. The plan views its functional classification as a neighborhood collector. Single family lot sizes in these villages target 80' by 125' and 100' by 150'. Except in townhouse parking lots, streets in this Section are public streets with street trees. Local streets have sidewalks on both sides except for dead end culs. To avoid the urban connotation of four-way intersections, local streets in village E have been alternated on either side of the collector. Recreation activity is concentrated largely at the dam, with swimming, tennis, and a fishing and tie-up dock at the water. Modifications sought are: 1. In support of cluster concepts and minimizing site disturbance, the following modifications are requested for townhouses: • Waiver of individual lot size requirements (as for condominiums)(1 65.65. K(a). • Reduction of 50' rear yard requirement to 20' adjoining VDGIF property line below dam (165.65.K(4)(c). 2. Relief from the 'efficiency buffer' requirement for the parkway collector is based on the local nature of most of its traffic, on its resort parkway quality with street trees and trail, on its preserved forest environment for most of its length through the property, and on its purely neighborhood character (carrying least traffic to buffer, furthest from Rt 522) where it traverses homes on both sides in Village E: all conditions not anticipated in 165-37.G). 4. Relief from the 300' street separation requirement of 144.17. D.3, based on the low traffic volumes of the purely local intersecting streets in Village E. The equivalency of standard recreational units (165.77.F) will be discussed with Parks and Recreation. ENTRY REORGANIZATION Both communities and the VDGIF facility have their front doors converging along the Rt 522 frontage. The plan shows a single parkway from Rt 522 to a roundabout from which they are all entered. These are the primary entrances for the two communities, and would be built initially. The geometric requirements of this entrance, the stacking requirements for the AAC gatehouse, and the steepness of the terrain and road dipping below the dam together fix the location of this roundabout, and the size of the site for a village center. Design of the public and private elements of the village center, its green and main street, have resulted in relocation of the wastewater treatment facility, camouflaged in a building along the stream below the dam. All village center activities are located at this point adjacent to the primary entrance to both communities. They are presently planned as a 40,000 sf grocery store, a 9000 sf drug store, 40,000 sf of shops with an upper level of office space, a six screen movie theater, fire house, library, church and post office sites, a naturalist's building with demonstration gardens and biome tours, and a regional office center. As a result, the only commercial use remaining at the Rt 277 entrance is a recreational vehicle storage facility, screened from the Rt. 277, the AAC entrance, and adjoining homes. Because of the small number of homes with children, no school site is included. The modification sought is relief from provision of a school site, based in part on low population, in part on this off -center location in the County.
