SUBJECT: Public Meeting — Request to waive the public street requirements in
the Lake Frederick Development (Shenandoah)
DATE: July 10, 2014
Staff has received a request from Lawson and Silek, P.L.C., on behalf of Lansdowne
Development Group to waive the public street requirements within the Lake Frederick
(Shenandoah) Development. The applicant is requesting that the public streets be
waived to allow the development to be constructed with a complete network of private
streets with gated access.
The Lake Frederick Development is located on the western side of Route 522 South
(Front Royal Pike), south of Route 277 (Fairfax Pike) and east of Route 636 (Hudson
Hollow Road). Existing primary access to this site is located on Route 522 South via Lake
Frederick Drive. This development consists of 926.27 acres of land zoned R5 (Residential
Recreational Community) District and is approved for a total of 2,130 residential dwelling
units. The details of the private road design are attached.
Staff is seeking a recommendation from the Planning Commission to the Board of
Supervisors on this request to eliminate the public street requirement to allow the Lake
Frederick Development to be developed with a complete network of private streets.

Dear Patrick:
The Final Master Development Plan for "Shenandoah" was administratively approved on December 5,
2007. This project includes the development of a 926-acre age -restricted community, resulting in 2,130
residential units within Frederick County.
The Master Development Plan revisions reflect the Oxbridge modifications of the minor interior road
system. No lots have been created in the revision.
Attached is a copy of the approved Final Master Development Plan. Please contact me should you have

have had problems with the roll-top curb and do not allow it currently. I have not had a

RE: Shenandoah Master Development Plan
Dear Eric,
I've attached several documents, as requested, relating to the Shenandoah MDP as
follows: Planning review comments from Bernard Suchicital dated December 8, 2006,
Fire and Rescue comments, FCSA comments, Building Inspections comments, and
Public Works comments. Review of the MDP subsequent to the December 8, 2006
letter from Planning Staff was completed in meetings between myself and Mr.
Suchicital. As such, no formal response letter was submitted from my office to yours.
To expedite your review of the Master Plan in Mr. Suchicital's absence, I have
provided below the comments contained within the December 8, 2006 letter from the
Planning Department as well as a response for each.
1. On Sheets 1 of 11, correct the vicinity map.
The vicinity map has been corrected with the parcel lines and aerial
photography rotated into the same datum.
2. On Sheet 2 of 11, complete the adjoiners' info table. Item 17 is missing
zoning designation.
The adjoiner table has been updated to include zoning for adjacent
properties.
3. On Sheet 2 of 11, match the residential shading in the legend to what is
shown on the map.
The legend has been revised to reflect the same shading for each land
bay as depicted on the plan.
4. On Sheet 2 of 11, there are several blocks within the MDP that do not
correlate with the legend that are identified as MIA and SFA. These
locations are marked on the MDP.
The labels depicting multi -family attached (MFA) and single-family
attached (SFA) have been revised to correspond with the intended
housing type as identified by the legend.
5. On Sheets 2 of 11, include a symbol for the trails shown on the MDP in the
legend.
The trail has been indicated on the plan using the symbol depicted
within the legend.
6. On Sheet 3 of 11, the hiker/biker trail cross-section indicates a ten foot wide
trail, while the Type 1 road indicates an eight foot trail. Provide the correct
trail width.
The cross section for the Type 1 road has been revised to indicate a 10

Hl + l 7. On Sheet 3 of 11, include a note on the MDP that will explain that the Lake
trail will be constructed with a pervious surface to avoid any detrimental
impacts to the Lake. This will help avoid any confusion when review future
plans.
I have added a note to the MDP which states that the Lake Trail shall
be constructed as mutually agreed with VDGIF. This note is
necessary as VDGIF will dictate the type of trail, including surface
material, that will be allowed in order to protect Lake Frederick. I
discussed this note with Mr. Suchicital and he had indicated that this
would be acceptable.

Please ensure that all comments are addressed when revising the MDP. Once all comments have
been addressed and review agency comments received, you will need to submit a complete MDP
application, a signed and notarized Special Limited Power of Attorney Form, and all review
agency comments to this department. Once this information is received, staff will schedule the
MDP to be presented to the Planning Commission. I have attached a marked copy of the plans to
assist with the revisions. Once this department receives all agency approval comments, we will
then schedule this MDP through the normal approval process. Remaining review comments are
required from the following agencies: Frederick County Fire Marshal, Frederick County
Department of Building Inspections, Frederick County Department of G.I.S, Frederick County
Sanitation Authority, and the Virginia Department of Transportation. Please do not hesitate to

SUBJECT: Revisions to the Shenandoah (a.k.a. Wheatlands) Master Development Plan
DATE: October 27, 2005
The developer of the Shenandoah development has recently expressed interest in revising their
previously -approved master development plan. A significant review process issue is determining
if the revisions require Board of Supervisors review, or if the project might be revised via an
administrative review process handled solely by staff. The zoning ordinance enables minor
master development plan revisions to be handled at the staff level; staff is seeking the Board's
direction, if revisions as described below may be handled administratively at the staff level. Staff
requests that the Board members contact the Planning Staff by November 4`h to offer their
thoughts. If Board concerns are not received, staff will proceed with administrative review and
approval of the revisions.
Existing MDP Approval
The existing master development plan (MDP) for Shenandoah was administratively approved on
May 2, 2001. This MDP approval enabled a development with 2,130 age -restricted residential
units on a 926-acre project area. The housing mix included: single-family detached, single-
family attached, duplex, and apartments. A community center, as well as a village center (retail),
would also be constructed. The project would be developed in six phases, with each phase
having a balance of the various housing types. The community center would be built as part of
Phase 1; the village center (retail) would be built beginning in Phase 3.
Proposal to revise the MDP
The proposed revisions would not exceed the approved total residential units of 2,130, nor would
it exceed the previously -adopted residential units by housing types. The key difference would be
the number of development phases, and the front-end loading of apartments; the total number of
apartments is consistent with the approved MDP. The community center and village center
would be constructed as part of Phase 1. The road systems are generally consistent with the
approved MDP.
Any revisions to the MDP must meet all required ordinance requirements, and satisfactorily
address agency review comments. The significance of involving the Board in the review process

for this project is primarily to educate the Board on the project, and to illustrate how the project is
planned to develop. Since the project was last reviewed by the Board in 2000, staff felt the Board
may be interested in the MDP review. As always, if any individual Board members are
interested in discussing the details of the project, but do not feel a formal Board of Supervisors
meeting is warranted, staff is certainly available to meet individually, as requested.

Dear Ms. Krempa;
This memorandum is to document our understanding of the 6/8/07 conversation concerning the
number and location of trees permitted by code for the above referenced lots.
The Oxbridge Group, the developer, has requested that through their landscape subcontractor,
each owner select the location for 5 trees to be planted on each lot. Due to the size of the
referenced lots, it is impossible for 5 trees of the size suggested be place on these lots.
In our conversation today, you indicated that due to the size of our lots and the fact that the lots
border on "common land", by code some of these trees could be placed in the common area
bordering the referenced lots. It is left to the owner to pick the location of the trees placed in the
"common areas" as long as they are placed to the rear or side of their properties.

This is a public meeting item regarding revisions to the Shenandoah Master Development Plan
(MDP #06-00); no action is required. Since it has been approximately six (6) years since the Board
of Supervisors has reviewed the Shenandoah project, staff felt it appropriate to update the Board and
community on the status of this project.
On May 1, 2001, the County administratively approved the Shenandoah MDP, an age -restricted
community for 2,130 mixed -use residential units, two acres for a fire and rescue site, and a
village/retail center on 926.266 acres. The applicant is currently requesting minor revisions to the
MDP that may be handled administratively. The overall allowed residential unit total has not
increased; the applicant is only proposing to shift the phase lines, modify the housing -type totals, and
realign a few internal neighborhood streets.
Since the initial MDP approval, the applicant has built a new water treatment plant, extended water
lines to the property, and had a total of 90 residential building permits issued to date.

H _l Shenandoah project. The Oxbridge Group, from Rockville, MD, will be the

CORPORATE: We are looking at the duplex lots laid out in Phase One and Two. These are all
Chantilly shown on the Subdivision Design Plans with lot widths required to support 35
foot townhome widths, and 70 foot total building widths. Oxbridge would like to

(March 16, 2007). This will be presented as a waiver request of the the sidewalk ordinance Section 144-18B. If
you could also supply an overall one -page color summary sheet for distribution to the PC and Board, identifying
land use, trails, recreation units, and phases. In addition, please make corrections to the Environmental Features
table, Recreation table, and provide details for the lake trail and walkway/nature trails. Will it be possible to pave
the walkway trails? Also, please provide us with an updated Fire Marshall and Building Inspections comments.

I've attached an agency comment from John Whitacre for the Sanitation Authority regarding the revised
Shenandoah MDP. A courtesy copy was provided to Parks and Recreation last week as well.
Also, please find attached a copy of the revised Shenandoah MDP. Per discussions with Eric, I have added a
note to page 3 that reads: The private road system shall be designed, reviewed, and construction certified by a professional
engineer licensed in the State of Virginia prior to bond release.
As all relevant agencies have now provided comments for an administrative approval of the revised MDP, I
hope that we can move forward with the approval process. If these changes are satisfactory, I would be happy
to provide the additional copies you need to present the MDP to the Planning Commission and Board of
Supervisors as an information item.

3. On Sheet 2 of 11, match the residential shading in the legend to what is shown on the
map.
4. On Sheet 2 of 11, there are several blocks within the MDP that do not correlate with the
legend that are identified as MFA and SFA. These locations are marked on the MDP.
5. On Sheets 2 of 11, include a symbol for the trails shown on the MDP in the legend.
A6. On Sheet 3 of 11, the hiker/biker trail cross-section indicates a ten foot wide trail, while
the Type 1 road indicates an eight foot trail. Provide the correct trail width.
7. On Sheet 3 of 11, include a note on the MDP that will explain that the Lake trail will be
constructed with a pervious surface to avoid any detrimental impacts to the Lake. This
will help to avoid any confusion when reviewing future plans.
