Dear Michael:
We are issuing final certificates of occupancy for seven, possibly eight, units in
Tudor Square. It is our understanding that the letter of credit issued by
Dominion Bank is intended to cover the costs of final paving for the parking lot
and for Tudor Drive, as well as the cost of drainage facilities and soil
stabilization associated with the soil erosion and sedimentation plan. Further,
it is our understanding that paving of the above areas in Section One will be
completed by the end of September.
Before additional certificates of occupancy are granted, we will need to be
assured that all other site plan requirements, including recreational facilities,
drainage facilities, screening, and soil stabilization are being met.

PROPOSED USE AND IMPROVEMENTS: Townhouses and apartments.
REVIEW EVALUATIONS:
Highway Department - A permit must be applied for and approved before any
work is done on the State's right-of-way.
Sanitation Authority - Sewer and water capacity presently exists to support
the proposed development. Final plans must revise the layout of water lines
and appurtenance in order for hydrant spacing to conform with the County Code
and to provide for future looped water main through the Frederick Mall Land
Trust tract on the north side of the development. I have provided the
engineer with technical comments.
Inspections Department - Proposed construction to be in compliance with the
Virginia Uniform Statewide Building Code and other applicable standards for
the proposed use.
Round Hill Fire Company - Need additional hydrant in front of apartments
8-11. Hydrants must be on a loop system so a fire flow can be maintained.
Any refuse containers on the site must be accessible. Fire lanes must be
constructed between townhouses, Sections 8-14 and 15-20, and between
apartments, 24-27 and 28-31. Appropriate curb cut access must be constructed
in accordance with Chapter 10, Article IX, Section 2-3-2, of the Code.
Planning and Zoning - No objections. Final Master Development Plan is in
conformance with the approved Preliminary Plan and meets the intent of the
Residential Performance Zoning District requirements.
The proposed use for townhouses and apartments is acceptable. All
environmental requirements appear to be met. The amount of disturbance for
steep slopes and woodlands is within the framework of the ordinance and will
be further detailed during the site plan review process to insure that the
percentage of environmental areas being disturbed is correct.
The ordinance requires 30% open space, which would amount to 2.89 acres, and
3.5 recreational facility units are required for this townhouse/apartment
development. All townhouse and apartment lot areas, parking, yard areas,
setbacks, and building spacing are in compliance with the Residential
Pa ge 2
FMDP Tudor Square
Performance use regulations. This proposal utilizes three bonus provisions
to reduce the required 30% open space to 2.42 acres by utilizing additional
recreational facilities above the required 3.46 recreational units, by
providing a network of pedestrian walkways throughout the site and by
providing a 60% north —south axis solar orientation. Specific details for
environmental disturbance, recreational facility layout and design, highway,
sanitation, and fire comments will be addressed during the site plan approval
process. This Master Development Plan meets the conceptual land use design
requirements of the Residential Performance Zoning District for the uses
proposed. The next required approval would be review of the site plan by the
staff and approval of the townhouse subdivision by the Planning Commission
and Board of Supervisors.
