I would consider this as a vested action since it was previously approved by this department; however, the plat will need to be redone to current platting requirements. Part of this action will need to be the addition of a new street name to replace Surrey Lane since this name has been used and cannot be duplicated. I don't think the replatting should have any impact on the deed, therefore, you will not need to go through that exercise again. Garth, femme sole, and Mary Lou Andrew, femme sole, parties of the second part; Barry C. Smith and Theresa A. Smith, his wife, parties of the third part; George Pogharian and Carol L. Pogharian, his wife, parties of the fourth part; Felipe Villegas and Romona Villegas, his wife, parties of the fifth part; Michael W. Stockhaus and Debra J. Stockhaus, his wife, parties of the sixth part; Thomas M. Dickinson, Jr., Trustee, party of the seventh part; D. B. WHEREAS, the parties of the first, second, third, fourth and fifth parts are the owners of the tracts in Section IX, Timber Ridge Farms Subdivision, Gainesboro Magisterial District, Frederick County, Virginia, the deed of dedication and plats of which are recorded in the Office of the Clerk of the Circuit Court of Frederick County, Virginia, in Deed Book 552 at Page 67; and WHEREAS, the parties of the sixth part are contract purchasers from the party of the first part of Tract 115, i Section IX, Timber Ridge, said contract of sale being dated i November 2, 1985; and WHEREAS, Timber Ridge Farms of Virginia, Inc. executed and recorded a deed of vacation and rededication signed by all of the then owners of tracts in Section IX, Timber Ridge Farms Subdivision, said deed being dated April 11, 1986 and recorded in the aforesaid Clerk's Office in Deed Book 616 at Page 623, whereby the original plat as recorded in the aforesaid Clerk's Office in Deed Book 552 at Page 67 was modified so as to eliminate provisions for the recreational easements as shown on that plat and to show on said plat an easement for ingress and egress; and WHEREAS, since the aforesaid deed of vacation recorded in the aforesaid Clerk's Office in Deed Book 616 at Page 623, Mary Lou Andrew, one of the parties of the second part, acquired an interest in Tract 112, Section IX; the parties of the fourth part acquired title to Tract 116, Section IX; the parties of the fifth part acquired title to Tract Lot 114, Section IX and the parties of the sixth part acquired an interest in Tract 115, Section IX; and WHEREAS, on said plat attached to the aforesaid deed of vacation and rededication recorded in the aforesaid Clerk's Office in Deed Book 616 at Page 623, the easement for ingress and egress was sketched in and the parties now have a plat by a certified land surveyor showing said easement; and WHEREAS, it is the desire of the parties hereto to correct said deed of dedication and the deed of vacation and rededication recorded in the aforesaid Clerk's Office in Deed Book 552 at Page 67 and Deed Book 616 at Page 623, respectively, by attaching said plat made by David Lee Ingram, L.S., dated March 9, 1981, revised June 17, 1982 and revised April 8, 1988, j hereto and by reference making it a part hereof, which plat shows said easement and clearly provides access to Tracts 113, 114 and 115, Section IX. NOW THEREFORE, WITNESSETH: The parties hereto do hereby vacate those provisions of the original plat which relate to the recreational easements as recorded in the aforesaid Clerk's Office in Deed Book 552 at Page 67, and do hereby adopt the modified provisions as shown on the attached plat as to the -2- V easement. The parties hereto do also agree, as evidenced by their execution hereof, to the establishment of a right of way fifty (50) feet wide, extending southeastwardly from the cul-de-sac at the end of Surrey Lane, to provide ingress and egress to and from Tract 113. 114 and 115, Section IX. The parties of the seventh and first parts, as the Trustee and Beneficiary under that certain deed of trust dated December 12, 1987 and recorded in the aforesaid Clerk's Office in Deed Book 669 at Page 433, which said deed of trust created a lien against Tract 114, Section IX owned by the parties of the fifth part, and the parties of the eighth and ninth parts, as the Sole Acting Trustee and Beneficiary under that certain deed of trust dated January 28, 1988 and recorded in the aforesaid Clerk's Office in Deed Book 671 at Page 145, which said deed of trust created a lien against Tract 112. Cundiff, et ux Attached to this petition are three plats showing various changes to the original grant from L. Harold Moss, et ux, in 1971 to George Allen Clark, et ux, of 5.62 acres in Plat #1, then a revision by trade of land from Clark to Good Earth Fruit Farms, Inc., successor in title of Moss and Good Earth Fruit Farms, Inc. to Clark, as shown in Plat #2; and now the revision again of said plats by Plat #3. Good Earth Fruit Farms has now conveyed the surrounded land to Timber Ridge Farms of Virginia, Inc., and it has created a large lot recreational subdivision, and in order to put through a sixty -foot roadway it was necessary to convey part of the Moss lot to Timber Ridge Farms, thus reducing the old Clark lot to 4.55 acres. Request for administrative approval of this new plat is. hereby made in accordance with the provisions of Section 18=4 of the Subdivision Ordinance of Frederick County, Virginia. This lot is improved by a_large dwelling house, septic tank and drain field; the lot fronts on a public road in West Virginia. This property has never been recorded in Virginia, but. since the contract purchaser, George M. Cundiff, is a Virginia licensed Certified Public Accountant, it is necessary to record the lot in Virginia where the house is located so he can remain qualified to practice.
