I am enclosing a copy of the deed of the
predecessor in title on the Bartlett Realty Company, Inc.
property.
As you can see from the same, Bartlett Realty
Company, Inc. has the right of ingress and egress over the
approximately 60 ft. wide strip which leads Westward from
Victory Lane. In order to avoid Bartlett Realty Company,
Inc., it would be necessary to move the road completely
South of its existing right of way.

I contacted Fred M. Tobin, attorney for Bartlett
Realty Company, Inc., to see if that company would agree to the
voluntary conveyance of the land needed for the turn radius for
the Industrial Access Road which intersects with Victory Lane
(Route 728) in Frederick County.
Mr. Tobin indicated to me that Bartlett Realty
Company, Inc. would not entertain a voluntary conveyance
because its chief operating officer, Robert Bartlett, had a run
in with the Department of Transportation of the Commonwealth of
Virginia some years ago and is still angry at the State of
Virginia.
It would appear, therefore, that we have reached an
impasse, and the State will have to use eminent domain if it
insists on requiring the design of the entrance of the road as
presently contemplated.
