Tobin, attorney for Bartlett Realty Company, Inc., to see if that company would agree to the voluntary conveyance of the land needed for the turn radius for the Industrial Access Road which intersects with Victory Lane (Route 728) in Frederick County. Mr. Tobin indicated to me that Bartlett Realty Company, Inc. would not entertain a voluntary conveyance because its chief operating officer, Robert Bartlett, had a run in with the Department of Transportation of the Commonwealth of Virginia some years ago and is still angry at the State of Virginia. It would appear, therefore, that we have reached an impasse, and the State will have to use eminent domain if it insists on requiring the design of the entrance of the road as presently contemplated.
