DARLINGTON, his wife, here- inafter referred to as OWNERS. WHEREAS, the OWNERS did by instrument dated April 5, 1983, of record in the Clerk's Office of the Circuit Court of Frederic County, Virginia, in Deed Book 558, Page 563, plat a certain subdivision known as "THIRD BATTLE SUBDIVISION", consisting of Four (4) Sections of lots numbered lA through 32B and more particularly described by "Final Plat Third Battle Subdivision", Sections 1, 2, 3 and 4, Stonewall District, Frederick County, Virginia, dated February 16, 1981, prepared by J. R. Nicely, C. L. S. WHEREAS, certain errors were made in the survey of said subdivision and it is necessary to vacate said subdivision in its entirety and dedicate a corrected subdivision to be recorded immediately hereafter. WHEREAS, none of the lots in said subdivision have been sold and the OWNERS who are the only parties having an interest in said lots, now desire to vacate all of said sections and lots, rights of way, easements and restrictions appertaining thereto and created by the OWNERS. NOW, THEREFORE THIS DEED OF VACATION. The following changes have been marked on the plans in red. Plan Sheet 1 of 4 The double line of 43" x 27" pipe arch should be increased to a double line of 49" x 33". All flare radius to be changed to 40' or 35' as noted on the plan. Plan Sheet 2 of 4 The size of pipe arch at station 0 + 25 should be shown as a 35" x 24". Protective covering is to be installed between approximate station 0 + 25 and 6 + 50. Plan Sheet 3 of 4 The pipe arch at station 6 + 25 should be shown at a 28" x 20" size. Protective covering is required between station 2 + 50 and 6 + 25. In locations where entrance culverts larger than 15 inch diameter will be necessary, we have shown the required size for the developers conveniences. If there are any questions, please advise.
