THIS DEED OF DEDICATION, made and dated this 14th day of

November, 1957, by HOLIDAY DEVELOPMENT CO., a Delaware Corporation authorized to
do business in the State of Virginia, as the owners and proprietors, and TOWN and
COUNTRY ESTATES, LTD. of Vashington, D. C. of the hereinafter described real estate.
'+n1ER RAS,, HOLIDAY DEVELOPMENT CO. is the owner in fee simple
of the hereinafter described property, and TOWN and COUNTRY ESTATES, LTD. has an
agreement with HOLIDAY DEVELOPMENT CO. dated October 1.5, 10,56, and recorded in the
-Clerk's Office of the Circuit Court of Frederick County, Virginia, in Deed Book
243, at page 5111, providing for TMM and COUNTRY ESTATES, LTD. to consent to all
encumbrances upon the land of HOLIDAY DEVELOPMENT CO.; and
jMFMS. HOLIDAY D, i PMENT CO. desires not to subdivide
its property as hereinafter described in accordance with the applicable Virginia
Subdivision Statutes and the Ordinances of the County of Frederick, Virginia, in
such cases Trade and provided, and to dedicate all streets thereon to the use of the
v lot owners and the public and the County of Frederick.
NOW, THEREFORE, THIS DEED OF DEDICATION WITNESSETH: In con -
sideration of the premises and of the benefits to accrue to them by reason of this ��� ^ jQ

Dedication, the owners and proprietors, with their free consent, in accordance with �l
_'their desires _'ard pursuant to the agreement with TOi�IN and COUNTRY ESTATES, LTD. and.
with its consent, and pursuant to the aforesaid Statutes and Ordinances, we do
hereby dedicate all streets and lots in all the plats of sections of the subdivision
of HOLIDAY =ELOPMENT CO. known as "WIDE ACRES" attached hereto, and do hereby
request the proper officials designated by the County of Frederick and the Board
of Supervisors of said County to approve said plat so that the same may be recorde
in the office of the Clerk of the Circuit Court of Frederick County, Virginia.
The chain of title and the description of the property being
subdivided is as follows:
A portion of that certain larger tract or parcel of land
containing 1,230 Acres, more or less, known as the Judge John Handley Tract which
was conveyed to HOLIDAY DEAL OP1= CO. by Deed dated October 1.,, 1956, from JAY-
SlA1, DEVELOPMENT COMPANY and recorded in the Clerk' s Office of the Circuit Court of
Frederick County, Virginia, in Deed Book 243, at page 509, and as shown on the
attached 4.7 plats, surveyed by B. Calvin Burns, C.L.S., and dated from March 18,
1957 to October 8, 1957.
The lots hereinabove mentioned on said plats as comprising
certain sections in the aforesaid Subdivision of "WIDE ACRES' shall be conveyed
subject to the restrictions listed below. These restrictions are made covenants

real running with the land and shall be binding upon all subsequent owners for ths.'`
use and benefit of the owners of said lots and may be enforced by any of the owners

and proprietors ofsaid Lots in the entire Subdivision. Each Deed from the under-
signed owners and proprietors shall contain an incorporation therein of these
restrictions either by reference to this instrument or by being set forth in said
Deeds, or both

(1) Said lots
shall be used for
residential
purposes only,
and no dwelling cn said lots shall be 'Lss 'Chan 'lwelty (G G) feel'
by Twenty (20 )
feet in
size,
or of
a comparable square footage, and no building
shall be erected
on said
lots except
for residential
purposes only and
for a family car garage.
(2) Any building constructed of
wood must have at least two
coats of paint.
(3) If a family car garage is built, it must conform in gen-
eral appearance to the dwelling house.
(4) Only household pets such as dogs and cats may be kept on
said premises.
(5) No house trailers may be kept on said property for human'
babitation.
(6) No building may be constructed within Tventy.Five (25)
feet of the front line of the lots, or within Six(6) feet of the lot lines on the
sides of the lots. In case of single ownership of more than one lot, these restrict-
ions shall apply to the adjoining lots as a whole.
(7) No lot shall be subdivided into one or more smaller par
eels or pai?t thereof joined to another lot.

(8) No rights of ways or easements shall be granted or creat-
ed upon or across said lots except for public utilities.
(9) The foregoing covenants may be amended from time to time
by �rritten instmiment executed by the owners of a majority of the lots in the
a.forosaid., subdivis-ion and recorded among the land records of Frederick County,
Virginia.
