REVIEW AGENCY COMMENTS: Planning and Zoning: Public Meeting Requirement The Subdivision Ordinance requires that land divisions in the B2 (Business General) Zoning District, without an approved master development plan, be presented to the Board of Supervisors for final approval (§ 144-12-B). This project contains land zoned B2 (Business General) District and the MDP requirement was waived by the Director of Planning & Development pursuant to Section 165-123.C.; therefore, Planning Commission and Board review and action is necessary. Subdivision #07-00, Baker and Glass, Partners (t/a TOMS) Page 2 June 8, 2000 Staff Review This application, which proposes a three -lot commercial subdivision, has been reviewed by the Frederick County Sanitation Authority, the Department of Public Works, and the Virginia Department of Transportation. None of the agencies have an objection to the proposed subdivision and have indicated their approval of the final subdivision plats. The 19-acre parcel that is proposed to be subdivided has frontage on both Route 11 South (Valley Pike) and Route 839. Route 839 is a frontage road directly south of the Route 37/Route 11 Interchange. Primary access to the three parcels within this subdivision would be provided via Route 839. In addition, the potential may exist in the future for lot 3 to have modified access to Route 11 such as a right -in, right -out movement. Presently, the minimum entrance spacing requirement of 200 feet would prevent locating an entrance directly onto Route 11 for lot 3. This property adjoins land to the northwest that is zoned M1 (Light Industrial) District and land to the southwest that is zoned B3 (Industrial Transition) District. At both locations, an "A" category zoning district buffer shall be provided and indicated on the subdivision plat prior to final approval. Notation should also be included on the final plat stating that all utilities serving the subdivision shall be installed underground. With these additions in mind, the subdivision as submitted, generally, satisfies the requirements of the Subdivision Ordinance. On March 6, 2000, Samuel & JoAnn Whitacre submitted an application for a master development plan for a project entitled, "Rt. 37 Mini -Warehouse" and paid the required fee of $2,083.20 with Check # 1454 (Receipt #001738 is attached) . After staff review, it was determined that the request was a minor subdivision (consisting of only three lots) and a master development plan was not required. The fee for this minor subdivision is $250.00 plus $35.00 per lot, which would total $355.00. We will need to refund the over- payment, in the amount of $1,728.20. The following comments reflect the combined concerns of the Residency Office and the Staunton District Traffic Engineer. Based on the findings of our review, no reason could be found not to continue with site plan development for this location. Please proceed accordingly with consideration of the following comments: • The frontage road number is F-839. • All access should be via Route F-839. The first entrance should be established approximately 300' north of the intersection of Route F-839 with Route 11 (Valley Pike). • A copy of the typical section used to construct the existing F-839 is attached for information only. Also the surface has recently been overlain with surface bituminous asphalt in varying depth of from 1" to 3" from Route 11 to approximately 300' north of Route 11 according to VDOT maintenance records provided by Mr. Bill Stover, Area Maintenance Superintendent. • Actual proposed typical section for Route F-839 at build out for this site plan should be in compliance with VDOT Standards for Rural Local Road System (GS-4) (copy attached) with a DHV 400 to 200. If existing right-of-way and limited access is inadequate for a full right turn lane as above, the maximum achievable should be provided. • A left turn lane and taper for NBL Route 11 as called for in Appendix C of your traffic analysis should be satisfactory, 100'x12' turn lane with 200' taper. • The appropriate reconstruction of the Route 11 pavement, shoulders and ditching to provide transitions for left turn lane application should be part of the site plan. • All phasing of site development should be illustrated and addressed to the extend possible in terms of scheduling and construction on plans being submitted for VDOT approval. Please address all VDOT concerns on the site plan being prepared for review and provide this office with two sets of the plan for review.
