Dear Claus:
Thank you for meeting with me on January 4, 2001 to briefly discuss the proposed revisions to the
Autumn Glen MDP. I have had an opportunity to review this plan submittal, and offer the following
comments. Please:
1) Denote the proposed revisions by placing a bubble around each revision.
2) Clarify the location of the Environmental Features, and the Area Calculations that are referenced
on Sheet 1. The provided note refers to Sheet 6, which has not been submitted for review.
3) Include Page IA as previously included in the approved MDP.
4) Provide a statement explaining why the `Environmental Feature Disturbance' table has been
deleted from the MDP. (Sheet 4 of 5)
5) Provide a statement explaining why the woodlands delineation has changed.
6) Explain why the statement addressing the woodlands disturbance limitation has been removed
from Sheet 4 of 5.

Dear Mr. Davenport
The officers and membership of the Autumn Glen Homeowners
Association (HOA) wish to express our appreciation for the action you and your
associates took on our behalf as expressed in your certified May 4, 2003 letter to
AMB Builders and Mr. Donald Arnold.
We must note with some disappointment that although some superficial
improvements have been made at the community center a great deal remains to be
done before it and the common grounds will be finished. Many details must be
completed in a satisfactory manner to bring the center into compliance with
official plans. We note that as of May 5, the following tasks have not
satisfactorily completed; however, this list of tasks is not by any means to be
considered as complete since we have not yet had an opportunity to inspect the
building carefully. Please bear in mind that since we do not have access to the
center building we cannot comment on the state of the interior of it at this time..
Specific Items Of Concern To Us At The Center And Associated
Common Grounds
1). The parking lot has been graded, but paving and installation of curbs, walks
and plantings remains to be done.
2). Some of the lawn areas have been seeded and covered with straw. However,
the preparation of the seedbed consisted of rough grading with a "rock hound"
and slight raking close to the building. We doubt if the lawn will ever be smooth
enough for machine mowing without rolling at least. In any case grass growth will
probably not be satisfactory since no fertilizer was applied at the time of seeding
the lawn.
3.) Concrete walks, curbs and gutters, and paving of the drive and parking lot
remain to be done.
4.).The screening on the porch has not been installed. Also the tables specified in
the plans are not in place. The white plastic posts around the porch were not
installed in a professional manner.; specifically the installer tried to nail them in
place without pre -drilling them. Consequently the posts all cracked when they
were nailed. This situation must be corrected.
The next three items are of public health concern.
5).The large tree at the left of the "Community Center" has large, overhanging
dead limbs in it that must be removed because of the danger to persons who might
be underneath if one were to fall.
6). The retention pond behind the "Community Center" does not completely drain
after a rain. Last year an examination of the water in the ditch showed it to be
heavily infested with mosquitoes. The matter was presented to county supervisors
through Harrington Smith and an attempt was made to rectify the situation.
However water still collects in the ditch and remains for sufficient time for
significant mosquito populations to develop. These insects are vectors of West
Nile Virus, a serious disease to which the senior population of Autumn Glen is
particularly susceptible. Correction of this situation is imperative.
7).A serious problem exists because of the flowering weeds that abound in and
along the boundaries of the retention pond. Last year a number of residents of
Autumn Glen with serious respiratory problems suffered severely from the effects
of pollen produced by these weeds. This situation must not be allowed to continue
to exist.
8).Construction debris and other worker generated trash is a continuing and
unsightly problem in Autumn Glen that must be cleaned up and removed. One
example will suffice: a large roof truss was discarded in the grass area behind the
community center over two years ago and has remained there ever since.
9).The site plan as revised 1/2/01 clearly shows four foot wide sidewalks that
extend along both sides of Lynn Drive to Tasker Road (642)and then along the
left side of Tasker Road toward Winchester for the full length of the Autumn
Glen property. There is no indication yet of any attempt by the developer to
complete these sidewalks.
10). There are two areas on the road in Bayberry Court where significant amounts
of water fail to drain off the street after a rain. These are clear indications of
improper grading of the street and should be corrected before the streets are
turned over to the county.
11). A dangerous condition was created over two years ago when a trench was cut
along the right side of the pavement of Lynn Drive. This trench (approximately
six inches wide, six inches deep and fifty feet long) was never re -paved or even
filled with gravel. It is a constant danger to pedestrians, cyclists, other persons
and equipment and should have been corrected long ago.
Following are two important issues over which you probably do not have
direct control. However, we would welcome your suggestions on the correct
county officials (or Others) for us to approach for assistance
12). We have not received the $ 7,856.12 that was the AGHOA bank account
balance as of May 30 2002 when the members voted (according to by-law
provisions) to assume control of the association. Mr. Arnold was advised through
his attorney by our legal counsel to turn the funds over to the association but has
failed to do so. We must follow this matter up.
The $7,856.12 is made up of $7180.10 = Apr. 30, 2002 bank balance
$676.02 = May 2002 excess received from dues
$7856.12 = Bank balance May 30, 2002
13). The association has yet to receive $2020.15 owed by the developer for
questionable checks written against the AGHOA checking account for purchases
and services that our audit shows were written for purposes other than AGHOA
business.
Mr. Davenport, let us again thank you for the actions you have already initiated
on behalf of the property owners of Autumn Glen. Now that the thirty day grace
period you gave AMB Builders and Mr. Arnold has passed we are sure you will
recognize the same pattern of delay and non performance by this developer that
has become all too familiar to our residents over the past few years We urge you
and your department to follow through and immediately initiate enforcement and
reclamation of the letter of credit as mentioned in your April first and fourth
letters. The members of the Autumn Glen Homeowners Association feel that they
have been very badly treated, both individually and as a group, and that resolution
of these problems has been delayed for too long and is long overdue.

With regard to the above referenced item, it is my understanding that you advised staff this
permit was for a portable restroom facility to accommodate your employees while working on
this particular lot. Due to the temporary nature of this facility, your permit does not require the
signature of the County Administrator prior to issuance by the Health Department. My signature
is only required for projects involving the construction of a permanent sewage disposal system
requiring a long term pump and haul permit.
