Frederick County currently maintains the Letter of Credit amount at $10,000.00. During the site visit, we noted that the following items must be completed or obtained prior to release of the guarantee: 1. Written confirmation from Public Works that the storm water management system and soil stabilization is adequate and in accordance with the approved subdivision plan. (I will personally deliver this written request.) 2. Completion of the sidewalk along Tasker Road and any other uncompleted sidewalk segments. 3. The landscape plan is to be completed. This includes plantings for each individual lot and the plantings required in the buffer along Tasker Road. 4. All open space areas are to be adequately graded, stabilized and loose rocks and debris removed, which will leave said areas in a maintainable condition for the Autumn Glen Homeowner's Association. S. The sweets to be accepted into the State system. 6. The recreation center to be completed according to the approved plan. In the near future, I will request input from the Homeowner's Association of Autumn Glen as to any perceived deficiencies which remain incomplete in this development prior to release of the construction guarantee. Specifically, you state that the developer, Mr. Don Arnold, has not completed several site development items, as well as installing other items incorrectly or insufficiently. These items include, but are not limited to, sidewalk installation, site grading, plantings and other items related to the recreation center. You indicate that the County reduced the construction guarantee down to $10,000, which is correct. However, two additional construction guarantees are being held by Frederick County which secure this development. For Section II, the guarantee amount is $10,000 and for Sections III and IV, the amount is $26,914. This brings the total construction guarantee amount securing the Autumn Glen subdivision to $46,914. The developers of each individual Section are currently, and will continue to be, held responsible for improvements in the entire subdivision. Frederick County reserves the right to enforce the terms of the construction guarantees at any time. In this instance, Frederick County will allow 60 days for the developer to install the sidewalk along Tasker Road and correct other deficiencies in accordance with the approved subdivision design plan. If necessary, all three Letters of Credit guaranteeing this subdivision will be enforced if it is determined to be necessary. I am writing to you to enlist your assistance in persuading Mr. Arnold and his company to meet the reasonable demands made therein. I am also writing to express my client's displeasure regarding the County's inattention to the legitimate concerns of the Home Owners Association. With full knowledge of the legitimate concerns of the Association, you sent Mr. Arnold a letter on April 4, 2003 advising him that the County would enforce the terms of the Letter of Credit (then $175,000) to complete the Recreation Center and related site work. The thirty -day deadline came and went. Notwithstanding the failure to address a number of deficiencies and omissions from the approved plan, the County released Mr. Arnold from all but $10,000 on the Letter of Credit. As we have previously discussed, if Mr. Arnold fails to remedy these deficiencies and omissions, it will likely cost more than $10,000 to have them corrected and completed. My client would like to know what action the County intends to take to make good on the excess bill in light of its grossly negligent action in reducing the Letter of Credit with knowledge of continuing deficiencies and omissions. My client would also like to know the proper procedure to call for the money pledged in the Letter of Credit if it contracts to have the work completed after April 30, 2004. You are required to conform the development with the plans filed and approved by the Frederick County Department of Planning and Development. You are further required to comply with all of the applicable provisions of the Code of Virginia and the Code of Frederick County, Virginia. To date, you have failed to complete the development in accordance with these mandatory guidelines. The purpose of this letter is to seek remediation of the problem without the need for litigation. There are at least four major failings between the development as built and the development as planned. The Home Owners Association expects that you will remedy each and every failing on or before April 30, 2004. This should provide ample opportunity to correct the failings after the winter weather breaks. These areas of non-compliance are as follows: 1. The approved site plan calls for the installation of four foot sidewalks along Tasker Road and the unfinished portion of Lynn Drive. No effort has been made to date to construct these sidewalks. They must be completed in accordance with the plans and specifications for the development. 2. The approved plan calls for certain landscaping components. You are wholly non- compliant with the plan. First, the plan calls for lawn areas to be covered with four inches of topsoil, fertilized, limed, seeded and mulched with straw. This was never done. Second, the vegatation approved includes the planting of Japanese Yews of three -feet in height. Those planted are barely one -foot in height. Furthermore, many of the shrubs planted are boxwoods not Mr. Don Arnold Autumn Woods, LLC February 11, 2004 page 2 yews. The deciduous trees are supposed to be Red Oak. The trees planted are Maples. Some of the evergreen shrubs that were planted have since died due to neglect prior to the transfer of the development to the Home Owners Association. 3. You conveyed the development to the Home Owners Association with a severe weed control problem and failed to clear construction debris from common areas. The Code of Frederick County specifically requires that common open spaces shall be free of debris and weeds and shall be graded, stabilized and completely improved for its intended use prior to its dedication to the property owners association. § 144-28 B. 4. The plans call for a screened porch on the recreation center. Though it appears that the Department of Planning and Development cannot make you perform the rest of the promises you made regarding the recreation center, it can require you to screen the porch since it specifically appears on the site plan. Please be advised that the Home Owners Association intends on having these failings corrected immediately. If you fail to correct these matters as requested by April 30, 2004, the Association will correct them and proceed against you and the letter of credit to cover the expense. In that event, the Association will proceed with other remedies for alleged material misrepresentations made by you in the marketing and development of Autumn Glen. Provide all association books and records held by or controlled by you, including, without limitation, minute books and rules and regulations and all amendments thereto which may have been promulgated; 2. Provide a statement of receipts and expenditures from the date of the recording of the association documents to the end of the regular accounting period immediately succeeding the first election of the board of directors by the home owners, not to exceed sixty days after the date of the election, such statement being prepared in an accurate and complete manner, utilizing the accrual method of accounting; 3. Failure to comply with this request will result in suit being instituted against you under the terms of the Virginia Property Owners' Association Act and general law to recover the sums owed together with interest and attorneys fees, and obtain compliance with the statute. We need the county's assistance in getting Mr Don Arnold of AMB builders to complete and turn over the community center and common grounds of the Autumn Glen development to the Autumn Glen Home Owners Association. AMB has been working on this 1900 square foot building for 19 months and will not complete the construction. The only reason we, the association, can see for not completing the building is spite. Several of our members have had to go to the Frederick County Building Inspection Dept to get Mr Arnold to correct poor workmanship on their homes. We feel that this is his way of getting back at us. The fact that the members took over the association, in accordance with the by - laws, from Mr Arnold, certainly didn't endear us to Mr Arnold. The reason we took the association from him was his poor service and his lack of complying with the by - laws. We also found that he had not paid the state non profit corporation fee for the association since 1999. Therefore, the association did not exist, but he was collecting dues for the association. We paid the back dues, plus a penalty, and are now in complete control of the association. I have the complete file on this and would be happy to send you copies if it would be of any assistance. Hs latest act was to back a truck up to the community center and unload a bulldozer like they were going to work on the landscaping on March 21. Then on March 25 he had the bulldozer picked up without doing any work on the center or the grounds. Just a way to irritate us. Enclosed is a copy of Paul J Neal Jr's letter to Mr Edwin Yost, Don Arnold's attorney, dated March 3, 2003 asking Mr Yost to bring this matter to a close. There are several things that we can see from the outside of the building that need to be completed or repaired and they are: 1. Frederick County landscape plan page 8A states there will be a screen porch attached to with tables on the porch. Mr Arnold's last superintendent told me the porch was not to be screened in. 2. The siding around the porch does not match anything and the last super said that this was going to be replaced. 3. There is not a cap on the top rail around the porch and the bare wood is showing. This must be covered. 4. The post wrap is cracked and must be replaced. 5.There is a large space under each of the back doors. 6. The common area should be graded, rocks removed and seeded or sodded. 7. The trees and shrubs should be planted and consist of: (a) Eight northern oak (size 2") trees (b) Sixty five Japanese Yew ( size 3 ft ht) (c) See landscaping plan page 8A for location and spacing 8. Landscape plan page 8A details the parking lot (a) There shall be a lined 14 space parking lot (b) There shall be a driveway from Bayberry Ct to the parking lot (c) There shall be a sidewalk along the driveway 9. There are several dead limbs in a very large tree on the common area that must be removed 10. An accurate survey of the common area shall be provided and permanent survey markers put in place at all corners of all adjacent lots 11. Replace the dead evergreens on the common area near Tasker road 12. Landscape plan page 2 states that there will be a 4 foot sidewalk going along Tasker Rd from Lynn Dr to Spanish Rd This has never been started and must be completed 13. Landscape plan page 2 states there will be a 4 foot sidewalk on both sides of Lynn Dr. It currently stops about 200 yards from Tasker Rd on the east side of Lynn Dr. This must be completed. 14. We need trees and shrubbery surrounding the top edge of the draining ditch behind the community center. The association has never been able to obtain a copy of the plans for the inside of the community center. Reading these plans is the only way we can determine if we are getting what we paid for. Could you check your files to see if you have a copy and if so mail it to me. We would be happy to reimburse the county for same. It is our understanding that the county holds a bond on Mr Arnold for $250,000. I feel that the county should give Mr Arnold a certain period of time, perhaps 45 days, to complete and tum over to the community center and all common grounds. If he does not comply, then the county should pull the bond and use this money to hire an outside contractor to complete the job. In the past Mr Arnold has failed to get rid of the standing water where mosquitoes breed and cut the weeds around the construction sites that irritates allergies. We passed this information on to the county last year but never got a final report on what was to be done. Would you pass this information on to the correct party so someone gets on this problem before the mosquitoes and weeds become a problem again. Our comments follow and are shown in red on the plan sheets. Plan Sheet 1 of 12 1. The professional engineer seal should be signed on final plan sets upon approval by VDOT. Plan Sheet 4 of 12 2. On the existing and proposed sanitary sewer line between existing MH #2 & #3, the planned CG-9B Lt. of Station 12+65+- (Spanish Oak Road) would have MH #3 in its area, how would this be constructed? Also the proposed sanitary sewer between MH #2 & #3 would be passing through 3 CG-9B entrances along with curb & gutter and sidewalk nearly the entire distance between the man holes. Even though this sanitary sewer section is in place, it appears prudent to consider relocation to avoid the potential conflicts in the event future maintenance would be required to provide service. As a reminder, VDOT does not recommend water and sanitary sewer within right-of-way proposed for VDOT roadways. WE KEEP VIRGINIA MOVING Mr. Kurt Pennington November 19, 2001 Page #2 3. All drainage easements, which are provided to the Commonwealth of Virginia for use by VDOT, should be a minimum of 25' between drainage structures and along drainage swales to natural discharges. The minimum 20' width should be provided between structure #1 (proposed) and existing #1. The proposed 10' width easement between structures 13 & 14 is acceptable if a 20' wide easement is provided along the back lines of lots 14A, 1413, 15, 15A and 16, beginning at Spanish Oak Road right-of-way and ending at structure #14. Should structure #10 MH be relocated to back of sidewalk? Prevent conflict with CG-12. 4. An additional CG-12 should be placed on the opposite side of Spanish Oak Road intersection of Sarvis Court on low volume side of intersection. Standard VDOT stop signs should be placed at appropriate locations. Plan Sheet 5 of 12 5. Minimum width between faces of curbs on any street with short distance to cul-de-sac should be 30'. 6. The pavement structure for Spanish Oak Drive should be: 1 1/2 " SM-12.5A 3" BM-25.0 • 8" Type I 21-B See attached guidelines. The storm sewer computations should be provided with signed professional seal affixed. The original stormwater calculations dated 7/22/98 assumed a post -developed "C" value of 0.50 not 0.45 as used in your calculations. Assume a 100-year post - developed storm routing for drainage structures 1,4,5,9 and 14. Ensure that all finished floor elevations have a minimum one -foot freeboard above the 100-year storm elevation. 2) Provide as -built drawings of lots 5A, 5B, 6A and 6B in Section I, and the stormwater pond outlet structure. Ensure that the initial grading operations will not impact these four (4) lots with drainage or erosion control problems. 3) Since 11.56 acres are draining from off -site through Section 2, indicate on the plans that this stormwater runoff shall be routed through Section 2 in the proposed storm sewer system as a first step in the grading operations. 4) Please revise the plan to include sediment traps for erosion run-off control during construction. The existing stormwater pond could be converted to a sediment basin. However, it will be necessary to submit a revised detail, maintenance plan, final clean-up and design. As stated in minimum standard six, a sediment trap can only be sized to handle less than three (3) acres of drainage area. 5) The proposed silt -fence detail shall include wire support. We recommend placing diversion berms along the area located downstream of the site in lieu of the proposed silt fence. 107 North Kent Street 9 Winchester, Virginia 22601-5000 Autumn Glen, Section Two Letter Page 2 November 13, 2001 6) Due to increasing maintenance problems containing mud on the job site, provide a double length construction entrance with wash racks. The construction entrance shall be maintained daily. Also, place a note on the plans for the contractor to provide barriers to ensure that all construction traffic exits through the construction entrance. Provide a barricade at the entrance to Lynn Drive in Section I to ensure that all construction traffic will exit directly onto Tasker Road. 7) Designate a topsoil stockpile with perimeter control on the plans. 8) The culvert inlet protection shall be a rock check dam option. 9) Place a note on the plan which indicates that a land disturbance permit shall be obtained prior to initiating any site grading operations.
