Prior to approval of this SDP, a survey description of the perimeter tree save area for Section 4 must be completed. Response: The "Tree Save Boundaries Plan" for the entire development was previously provided on March 30, 2004 with the final submittal for Autumn Glen, Section I11. I have included a copy of this plan for your reference. Comment 2: On Sheet 3 of 12, it appears that the tree save that you are using as your screening for your residential separation buffer does not cover the entire buffer area. Response: Per my conversation with Patrick Davenport on May 28's we have provided a 6' berm with landscaping on the west side of the development where the clearing for existing overhead power lines is located. And a row of white pines has been added in the buffer area, along the southern boundary, where the existing vegetation does not provide a minimum of 50' of screening. If you will recall you and I had a meeting on January 13, 2004 where we were discussing the landscaping requirement for "Section Three" and I was told that if the development could comply with: 1) Woodland disturbances as required on an approved MDP or 2) An approved woodlands waiver then no landscaping would be required because that development would be "grandfathered". (The approved MDP and the woodlands waiver predate the adoption of the "Landscape Ordinance". On April 2, 2004 the Section Three Subdivision Design Plans was approved based on the development's ability to comply whit the approved "Woodland Waiver" (approved on 04/10/02). I am now being told that Section Four, of this same development, must, in addition to the approved "Woodland Waiver", provide "ornamental shrub and tree" landscaping (Please see comment #4 in "Second Subdivision Design Plan Review" letter dated April 27, 2004). 1 spoke with Patrick on May 28, 2004 about this matter and I was told that he would check into this and let me know something by the first week in June. Having not heard anything to date, I asked Evan Wyatt, who spoke to Patrick today on an unrelated matter, to ask about Autumn Glen and he was told that no decision has been made yet. I am, along with our client, confused about why we are being asked to provide landscaping.
