THIS DEED OF EASEMENT, made and dated this day
of June, 1976, by and between JOHN RALPH MARKER and CAROLYN
LEE MARKER, his wife, and ADA B. MARKER RUBLE and JAMES BOWEN
RUBLE, her husband, parties of the first part, hereinafter called
the Grantors, and STONEBROOK FARMS, a Virginia partnership,
party of the second part, hereinafter called the Grantee.
WITNESSETH: That for and in consideration of the covenant
and conveyance hereinafter set forth and of the sum of One
Dollar ($1.00), cash in hand paid, and other good and valuable
consideration, the receipt of which is hereby acknowledged,. the
Grantors do hereby grant an appurtenant easement unto the Grantee
for drainage of surface waters from Grantee's land over the land
o.f'the Grantors, and to be twenty (20) feet in width; the said
drainage easement is more specifically set forth on the plat and
survey drawn by Thomas C. Glass, C.L.S., dated May 12, 1976,
attached hereto and by this reference made a part hereof as if
set out in full. Grantors reserve to themselves, their heirs
and successors in title, as owners of the servient estate, the
right, exercisable in their sole discretion upon the recordation
of a plat amending the location of the drainage easement conveyed
herein, to change the location thereof within the servient estate
in such manner as Grantors find appropriate to the use and
development of their land, provided, however, that such relocatio
of the drainage easement shall in no manner adversely affect the
rights of the Grantee acquired hereunder.
The dominant estate is that certain tract of land conveyed
to Stonebrook Farms by deed dated December 30, 1972, from Harold
L. Cooper, et ux, of record in the Office of the Clerk of the
Circuit Court of Frederick County, Virginia, in Deed Book 402,

or parcel of land which was conveyed by Fred A. Robinson, et ux,
to Ralph Marker by deed dated October 23, 1950, of record in the
aforesaid Clerk's Office in Deed Book 216, at Page 408, and
which, by intestate succession, vested in Ada B. Marker Ruble,
widow of the said Ralph Marker, and John Ralph Marker, the only
surviving child of Ralph Marker, there having been only one other
child who died intestate.
FURTHER WITNESSETH: That as part of the valuable consider-
ation for the foregoing conveyance, Grantee hereby grants to
Grantors a perpetual easement over and across a twenty (20) foot
strip adjacent to the Northwest boundary of Lot 106, Stonebrook
Farms, Section Six, including the right of passage through the
gate located in the fence, for passage through said gate from
the fields of the Grantors separated by a fence at said location
for maintaining said fence and for drainage of surface waters.
FURTHER WITNESSETH: That as part of the valuable consider-
ation for the easement hereinabove conveyed, Grantee covenants
that in the future development of the balance of Stonebrook Farms,
no less than two (2) roads will be dedicated to public use
extending to the boundary of Stonebrook adjacent to the lands of
Grantors and at least one (1) of those roads will be developed
and built up to State specifications at Grantee's expense at the
Western end of Stonebrook. Grantee reserves, however, for
itself and its successors in title as owners of the presently
undeveloped portion of Stonebrook, the right, exercisable in its
sole discretion, upon the recordation of a plat fixing or,amending
the location of the said roads, to change the location thereof
within the servient estate in such manner as Grantee finds
appropriate to the use and development of its land, provided,

subdivision which you submitted for further review and comments which are
as follows:
1. 1t appears you are 6btaining the miniumm 200' vertical sight
distance_;et the intersection of Greenfield Road and Forrest
Ridge Road end the three crest verticals in Section Six.
2. Additional Cif-2 underdrains will be required at approximate
Stations 9+75 and 4+75.
3. Since the traffic 3sFexpected to be in excess of 750 vehicles
per day, the depth of stone will be determined by Chit tests
conducted by the 8i.ghway .Department at your expense. These tests
require appr.oxiwgtely two weeks. Therefore, it is suggested that
you request these.tests at least two weeks prior to placing of
base stone after the.rough grading has been completed.
4. The rock ditch in deep fill sections should be no steeper the;
2:1 slopes.
5. Sod or turf must be established in.all ditch lines unless other-
wise protected from erosion.

ditches -had been used that 'you are not getting the proper depth
of ditch when placing the stone. We have.noted on the roadway
typical section that a minimum depth of 12"-is to be obtained in
the depth of ditch as well as the depth of stone.
The shallower depths is. causing erosion of the slopes along the
rock line and which will have to be repaired before accepting
the streets into the system. Also in order to obtain the needed
volume in rock ditches, it should be designed with a minimum
bottom width of one foot. A disadvantage with rock ditches in
subdivisions with growing number of complants is accumulation of
silt and grawth of weeds and vegetation which is difficult to
maintain.

5. Drainage easements are required from the boundary lines to a
well defined stream or water course. These easements must be
recorded on or with the plats.
You may submit revised drawings showing the changes for a field
review of the plans and easement locations.
