Adjoining Parcel 43-A-16
Dear Mr Gilpin:
We have received your letter dated March 27, 2002, in which you request a determination of the
buffer requirements of a property you own that adjoins a parcel currently proposed to be developed.
You requested what buffer would be required if the adjoining property, which is being proposed as
a `Rural Preservation Subdivision," is developed. As indicated in the proposed preliminary sketch
plan given to you, the development of this proposed subdivision features a 40-acre "rural
preservation" tract which adjoins Stonewall Industrial Park.
In regards to the relative buffer requirements in the Zoning Ordinance, §165-37D (4) states that:
"Whenever land is to be developed in the B3, Ml, or M2 Zoning District that is adjacent to land
primarily used for residential purposes in the RA (Rural Areas) Zoning District, a Category C Buffer
shall be provided on the land to be developed." The proposed 40-acre "rural preservation parcel
adjacent to the Stonewall Industrial Park is not permitted to be further subdivided per § 165-54D.
In regards to the specific buffer requirements, if a site development plan is submitted on an approved
lot in the industrial park adjacent to the 40-acre preservation parcel prior to that 40-acre parcel
becoming developed, no buffer will be required. If the 40-acre parcel is improved with a dwelling
prior to the submission of a site development plan for the adjoining industrial land, a buffer will be
required on the industrial parcel.
You have the right to appeal this notice of determination within thirty (30) days of the date of this
letter in accordance with Section 15.2-2311 of the Code of Virginia. This decision shall be final and
unappealable, if it is not appealed within thirty (30) days. Should you choose to appeal, the appeal
:rust be filed with the Zoning Administrator and the Board of Zoning Appeals (BZA) in accordance
with Article =, Section 165-155A, of the Frederick County Zoning Ordinance. This provision
requires the submission of an application form, a written statement setting forth the decision being

Dear Mr. Davenport,
I am writing to request your written opinion on a matter that the
Planning Commission will be considering shortly. I represent Lenoir City
Company of Virginia, owner of Stonewall Industrial Park.
The Planning Commission is considering a cul de sac waiver from
Glen W. Russell. The 40-acre reserve which is proposed on Mr. Russell's
plan adjoins Stonewall Industrial Park. Will there be a buffering
requirement on our land as a result of this subdivision now or in the future?
I enclose a copy of our original master plan in 1987 which indicates that no
buffering is required.
I am concerned that if a house or houses were build on the 40-acre
tract (or if the 40-acre tract was further subdivided in the future) that
buffering requirements might be imposed on our property, thus limiting its
development capacity. We have spent hundreds of thousands of dollars to
extend a road and utilities to that section of Stonewall Industrial Park. We
would consider it unfair and unjust if any additional buffering requirements
were imposed.
