SUBJECT: Approval of Water Supply System pursuant to
Sections 15.1-341 and 56.2-265.3 of the Code
of Virginia for 1950 and as amended
1. Stonewall Development Company owns approximately 46
acres of land (see'plat attached) bounded on the West
by U. S. Highway 11, on the South by Virginia Secondary
Route 668, on the East by the B & 0 Railroad, and on
the North by other property owners.
2. This land has been zoned for industrial purposes.
3. That an industrial access highway has been approved by
the Virginia Department of Highways.
4. That one tract of 11 ages has been sold to Hemingway
Transport, Inc., which is proceeding to construct and
develop said lot as a trucking terminal consolidating
the terminal in Hagerstown, Maryland and another terminal
in Winchester, Virginia.
5. Stonewall Utilities Company has been created for the
purpose of constructing, developing and maintaining a
central water and sewer system for the industrial park,
and 2.094 acres of land have been conveyed to Stonewall
Utilities Company by Stonewall Development Company for
the purposes of constructing a sewage disposal plant,
settling pond and collection basis for surface draininge.
6. That the Board of Supervisors of Frederick County is
required to approve the establishment of a central water
system and sewer system before the State Corporation
Commission will entertain a public hearing to determine
the area to be allotted Stonewall Utilities Company and
the rates, rules and regulations for the operation of
the water and sewer service.
You are respectfully requested to approve
the establishment of these systems subject, of course, to
all governmental agencies' rules and regulations such as
the State Health Department and the Water Control Board
as well as the rules and regulations that may be established
now or in the future by the Board of Supervisors and the
rules and regulations of the State Corporation Commission.
Upon approval by the Board of Supervisors
of Frederick County, Stonewall Utilities Company will
immediately petition the State Corporation Commission for
the establishment of the rates, rules and regulations and
authority to commence operations; whereupon Stonewall
Utilities Company and Stonewall Development Company will
then accept one of the bids already made for the construc-
tion of the system and execute a contract to commence the
construction.
