• Any signs to be installed will be in accordance with attachments.
• I suggest any utilities and/or storm sewer placed within the proposed right-of-way be
backfilled completely with C.R. Type 21-B Stone. This will greatly reduce the possibility of
any pavement settlement.
• Upon completion of construction for this proposed project the owner/developer will be
required to enter into a signalization agreement at the intersection of Fortress Drive with
Route 522. Percentage of participation in financing will be established when VDOT
determines the warrants exist to justify signal installation. The Autumn Wind Apartment
project on the opposite side c-Lr&.c crossover will also be enjoined in the signal agreement.
Every effort should be made to provide as safe a geometric condition as possible in the field
construction of this intersection and crossover. Close coordination between owner/designer, the
contractor and VDOT Inspection Personnel should be maintained at all times.

the referenced project. The plans appear satisfactory and are approved. Please advise the
developer accordingly.
I offer the following comments:
• A preconstruction conference be held by the engineer and/or developer with the attendance of
the contractor, various County agencies and VDOT prior to initiation of work.
• Materials used and method of construction shall apply to current observed VDOT Road &
Bridge Specifications applicable during construction of this development.
• Our review and comments are general in nature. Should conditions in the field exist such
that additional measures are warranted, such measures shall be completed to the satisfaction
of the Department prior to inclusion into the Secondary Road System.
• All drainage is to be carried within the right-of-way in ditch lines or gutters along the street
to a pipe or drainage easement.
• The contractor shall notify VDOT when work is to begin or cease for any undetermined
length of time. VDOT will also require 48 hours notice for inspections.
• The appropriate land use permits shall be obtained before any work is performed on the
State's right-of-way. The permit is issued by this office and will require a minimum
processing fee, surety bond coverage, and the salary & expenses of a State assigned
Inspector.

• Private entrances will be installed in accordance with our Standard PE-1
Specifications. This is the developer's responsibility. The entrances shall be installed
in conjunction with the drainage ditch and other right-of-way improvements.
• All utilities placed within the Route 832 right-of-way shall be backfilled completely with
C.R. Type 21-A Stone. This will greatly reduce the possibility of any pavement
settlement.
• The Department of Transportation will not be held responsible for any maintenance or
liability of the detention basin.
• We will require three (3) additional sets of plans for our files.

This is in reference to the. firstt .submittal letter dated September 9,- 1997 and, subsequent
correspondence regarding the subject project; �;We have, receiv,ed,-.comments from .our District
Office and are 'sharing all. VDOT comments with your' office. The comments are shown iri,red
on the plan sheets and as follows:
a) The proposed crossover should be constructed to the best possible percent of
grade; in the general realm of desirable 5%.
b) The southbound left turn lane can be sloped down from the south bound edge of
pavement. However, the algebraic difference between turn lane and main line
pavements should not exceed 7%. Example: existing SBL = +2%, turn lane
should not exceed -5%.
c) The northbound left turn lane can be sloped at 4 %.
d) In the worst scenario, VDOT would allow raising the NBL profile grade a
sufficient amount to achieve the desired 5% grade.

a) The VDOT traffic count conducted in the year 1996 revealed 17,000 vehicles
utilized this reach of Route 522 facilities. Anticipated traffic volumes for future
Fortress Drive are needed to review the intersection configuration and to address
intersection signalization.
b) We have been provided with traffic study data dated October, 1997. If this is the
current information, we will forward to our District Traffic Engineer to complete
the signal consideration.

a)* - � `We are concerned about the limited space between our Route. 522 Primary
Highway and the proposed commercial entrance] to the Chevron; .Station left of
I. proposed Fortress Drive. In particuia"r, the ability.of the. entrance to. receive long
wheel base'vehicles without blocking Route 522 or proposed'Fortress Drive.
b) The space between flare radii along proposed Fortress Drive falls short of the
required minimum.
c) We recommend extension of the build plan at the proposed entrance permit plan
stage to provide additional stacking space for left turning into the Chevron
Station.

4. Intersection sight distance should be provided in both directions from proposed Fortress
Drive to Route 522.
5. Cross sections should be provided at 25' intervals along Route 522, a distance of 200' in
each direction from the Fortress Drive intersection.
b. The pipe culverts at these locations should be considered for extension due to turn lane
widening.
7. The existing drain ditch in the median north of the crossover should be relocated and
reconfigured to new lane requirements.
8. The commercial entrance direct from Route 522 into the Chevron Station should be
moved as far north as possible. The northern radius could be reduced to sidewalk width
to help that move.
9. The typical sections shown for Route 522 appear to be generic with crown as would be
shown on tangent roadway. The condition of Route 522 is a 30 curve to the left on NBL
and a 3.13458' curve to the left on SBL.
The typical section for this road area should indicate the rate of slope is a + % to the right. It
should not show crown at centerline. The cross sections requested in Item 5 should establish
slope rates.
The proposed speed limit of 45 m.p.h. should be shown on the plan sheet.
Finally, a note of interest concerning access to Route 522 at this crossover: Another developer
on the west side of the roadway is proposing access through the crossover. It may be a good
situation for coordination of effort and design approach.
If design changes are implemented to address these comments, please meet or exceed the design
standard.
When you have addressed all the above comments, please submit five copies of the revised plan
for review.
If there are any questions, do not hesitate to call.

The Virginia Department of Transportation has no objection to the referenced plat.
Before development, this office will require a complete (detailed) site plan for review.
For consideration of access, the site should be designed such that access would be along
the northeast side of the site. This would be in conformance with earlier comments
offered by VDOT which have indicated the preferred access for (strip) commercial
development adjacent to Route 522. This should be via a service road on northeast side
of the respective lots. Also, in relation to VDOT, the potential need for a taper and a
right turn lane in the area of curves numbered four and five should be considered.

SUBDIVISION SPECIFICS: Subdivision of a 7.5713 acre portion of the larger parcel into
21 lots for single family dwellings, the minimum lot size consisting of 15,000 square feet.
REVIEW AGENCY COMMENTS:
DEPARTMENT OF TRANSPORTATION: See attached letter dated July 25, 1995.
SANITATION AUTHORITY: Approval after third review.
FIRE MARSHAL: 1) Driveways to residences should be located away from fire
hydrants. 2) Post temporary street address signs on each lot as construction begins.
3) Burning of land in order to clear debris requires a permit from Fire Marshal's
Office. NOTE: Virginia Department of Forestry Laws go into effect March 1, 1995.
4) Burning of construction debris on site is prohibited in Frederick County. 5)

CITY OF WINCHESTER: The length of the cul-de-sac seems excessively
long (1700'+), if provisions of Subdivision Ordinance Section 144-17G apply.
Should future street connection to the land on the east, designated as "future
development" be provided near the north end of Lauck Drive?
PARKS AND RECREATION: No comment.
COUNTY ENGINEER: The revised site plan dated June 1, 1995 has adequately
addressed the stormwater management issues for the proposed 21 lot subdivision.
We understand that the existing detention pond will be abandoned in favor of a
regional facility when the additional phases of the project are developed.
PLANNING AND ZONING: The proposed subdivision is in conformance with the
approved master plan. All of the proposed lots are 15,000 square feet or larger in
size and are to be constructed using the open ditch design. The comment from the
City of Winchester is not valid since the street is an already existing state maintained
road and the existing street allows access to the adjoining property. It appears that
all other ordinance requirements have been addressed.

FINAL PLAT CHECKLIST
The subdivider shall be required to submit a deed of dedication, a
copy of all covenants and restrictions, an estimate of all public
improvements, all required guaranties for improvements and all
final plats to the Subdivision Administrator. All final plats
shall be drawn -to a scale acceptable to the Subdivision

THIS ANODED DEED OF DEDICATION, Made and dated as of
the 12th day of August 1996, by and between SELDON, INC., a
Virginia Corporation, RICHARD G. HARDISON, INC., a Virginia
Corporation; and RICHARD & BYRON, INC., a Virginia
Corporation, parties of the first part, hereinafter called
the Declarants, and THE COUNTY OF FREDERICK VIRGINIA, party
of the second part; and STEPHEN G. BUTLER and CARLIN L.
SMITH, EXECUTOR OF THE ESTATE OF LESTER A. ELLIOTT,
DECEASED, Trustee and Beneficiary, respectively, parties of
the third part,
WHEREAS, the Declarants have previously executed and
recorded that certain Deed of Dedication dated February 21,
1996 of record in the Office of the Clerk of the Circuit
Court of Frederick County, Virginia, in Deed Book 853, at
Page 650, with plat attached thereto drawn by Marsh & Legge,
Surveyors, P.L.S., dated June 12, 1995, known as Star Fort,
Section I, described in the Final Master Development Plan of
Star Fort, Section I, as filed in the Office of the
Frederick County Department of Planning and Development;
and,
WHEREAS, said Deed of Dedication reserved to the
Declarants the right to amend said Deed of Dedication;
and,
WHEREAS, Declarants are the owners of record of all of
the lots in Star Fort, Section I; and,

WHEREAS, Declarants desire to amend Exhibit A,
Paragraph 3, Total Finished Space, Restrictive Covenant, and
Paragraph 12, Off -Street Parking;
NOW, THEREFORE,
WITNESSETH:
That for and in consideration of the premises and other
benefits which will accrue, Declarants hereby amend the
aforesaid Exhibit A attached to the Deed of Dedication in
the following respects:
(1) Paragraph (3) of Exhibit A shall read as follows:
113. TOTAL FINISHED SPACE: No dwelling is to be erected or
maintained on any of said Lots to contain less than the
following total finished living space (outside foundation
dimensions), exclusive of open porches, carports, garages,
and basements of the following types of dwellings:
(a) Rambler and ranch dwellings shall have 1200
finished square feet;
(b) Split-level dwellings shall have a total of
1640 finished square feet above and below
grade;
(c) Split foyer dwellings shall have 1340
finished square feet on its upper level, or a
minimum of 1000 square feet on the upper level and
a minimum of 500 square feet on the lower level.
(d) A one and one-half stories dwelling shall have
a total of 1600 finished square feet;

(e) Two stories dwelling shall have a total of 1640
finished square feet.
(f) A storage building shall be allowed so long as the
same is equal or better in quality of materials of
the dwelling house erected on the Lot and the same
shall not exceed 140 sq. ft., nor shall the same
be greater in height than 8 ft. with a 5/12 roof
pitch. Any storage building shall be compatible
with the architecture of the dwelling house
erected on the Lot.
(g) All structures must have a minimum roof pitch of
5/12.
(2) Paragraph 12 of Exhibit A shall read as follows:
After a residence is built on any of the said lots, the Lot
Owner shall provide in connection therewith, a driveway of
at least twelve feet (12') by thirty-five feet (351). The
driveway must be paved or hard surfaced by asphalt or other
approved material by the Architectural Review Committee set
forth hereinafter. All or a portion of the paving
requirement may be waived in writing by the Developer.
(3) Except for the amendments set forth above,
Declarants do hereby ratify and confirm all the remaining
terms, covenants and conditions of said Deed of Dedication
dated February 21, 1996 of record in the aforesaid Clerk's
Office in Deed Book 853, at Page 650.

APPLICABLE TO STAR FORT, SECTION is
LAND USE: No Lot shall be used except for '
single family residential purposes. No
beauty shops or similar home occupations, nor
home occupations of any type, shall be
allowed on any of said Lots. No yard sales
or similar commercial enterprises may be
conducted on said Lots.
BUILDING TYPE: No building or structure of any
kind whatsoever shall be erected, altered,
placed, or permitted to remain on any Lot,
other than a permanent single family dwelling
and a storage building as hereafter limited
in dimensions. All garages shall be attached
to the dwelling. No mobile homes are
permitted on any of said Lots. No
recreational type camper or recreational
vehicle shall be parked on any of said Lots
unless such recreational camper trailer or
recreational vehicle is stored so as not to
be seen from any road at any angle of sight.

4. BUILDING FOUNDATION: All parging of
foundation walls above ground level shall be
painted so as to conceal the color of the
parge. The color of the paint shall be
compatible with the color of the dwelling.
5, TEMPORARY STRUCTURES: No structures of a
temporary nature, including but not limited
to, trailers, mobile homes, campers,
basements, tents, shacks, garages, barns, or
other outbuildings, shall be used on any Lot
at any time as a residence, either temporary
or permanent.
6. FENCES: No fences shall be located in front
or on the sides of the house. Fencing in the
rear of the house may not exceed forty-eight
(48) inches in height and the material and
design shall be wooden board or rail, and in
no event shall chain link fences or wire
fences be used. All fences constructed shall
be kept and maintained in good repair,
including painting and staining, if the same
is required. Provided, however, that this
restriction shall not preclude the owner from

7. SWIMMING POOLS: No above ground swimming
pools shall be constructed on any Lot.
8. SIGNS: No sign of any kind shall be displayed
on any Lot except a single sign not larger
than five (5) square feet advertising the Lot
for sale which shall be removed as soon as
the object is achieved.
9. CLOTHES LINES AND SATELLITE DISHES: No clothes
lines or drying yards shall be located on any
Lot. No satellite dish or like device for the
reception of TV signal, microwave signal,
etc. in excess of eighteen (18") inches in
diameter shall be allowed on the premises,
provided, however, that one (1) tv antenna or
satellite dish, not in excess of eighteen
(180) inches in diameter, may be allowed so
long as the same is attached to the side or
the rear of the house located on the Lot.
lo. GARBAGE AND REFUSE DISPOSAL: No Lot shall be
used or maintained as a dumping ground for
rubbish. Trash, garbage, or other waste
shall not be kept except in sanitary
containers with tops, said containers to have
a capacity of not more than forty (40)
gallons and shall not exceed two (2) in
amber.
11. ANIMALS: No animal, livestock or poultry of
any kind shall be raised, bred or kept on any
lot, except that two (2) cats and one (1) dog
per household are allowed. All dogs and cats
shall be reatricted to the Lot(s) of their
owner and shall not be allowed to roam the
Star Fort Subdivision, Section I.
12. OFF-STREET PARKING: After a residence is
built on any of the said Lots, the Lot owner
shall provide in connection therewith, off-
stree a of at least twelve feet

13. TRUCKS: No lot shall be used for the parking
of trucks of a load capacity of more than 3/4
ton or tractor/trailers, and no such trucks
or tractor/trailers small be parked on any
street in this subdivision. No Lot shall be
used for manufacturing purposes or for the
sale, parking, or storage of new or second-
hand automobiles or other motor vehicles. No
abandoned motor vehicles will be permitted on
any Lots or parking area. (For this purpose,
an abandoned motor vehicle is defined as one
which bears no or an expired license plate
and has not been operated within six (6)
months on a public street or highway.)
14. SIGHT DISTANCES AT INTERSECTIONS: There shall
be no planting, structure, fences, shrubbery,
or other obstruction to vision planted or
maintained on any corner Lot which rises more
th'n three (3) feet above ground level within
tei (10) feet of the intersection of any two
street lines.
15. 1011SANCES: No noxious or offensive activity
tall be permitted on any Lot, nor shall

aecome an annoyance or nuisance to the
neighborhood. Each Lot shall be kept mown
and free from weeds and debris at all times,
and shall be kept cleared in accordance with
State laws and local ordinances.
16. UTILITIES: All utilities, including all
telephone, electric, television, gas, TV
cable, etc., shall be located underground.
17. DRIVEWAYS AND CULVERTS: If the construction
of a driveway on any Lot prohibits the
drainage in front of that Lot, then a pipe or
culvert of sufficient size (and not less than
twelve (12) inches in diameter) shall be
installed by the purchaser of said Lot at his
expense. The final determination regarding
this requirement will be made by the Virginia
Department of Transportation representative
who cervices the property and NO ENTRANCE,
TEMPORARY OR PERMANENT, SHALL BE MADE WITHOUT
FIRST OBTAINING A PERMIT FOR SUCH ENTRANCE MON
THE VIRGINIA DEPARTMENT OF TRANSPORTATION.

18, BUILDINGS: No building of any sort shall be
place or constructed on any Lot hereby
dedicated unless or Until plans and
descriptions of the Pima shall have been
submitted in duplicate to and approved by the
Architectural Review Committee. In addition,
the Architectural Review Committee shall
approve all exterior colors for roofing,
doors, windows, shutters and exterior
coverings of the house, as part of the review
and approval process. Once approval of
colors has been made, no change in color
scheme shall take place for a period of five
(5) years after completion of construction.
(a) Buildings may be of either
traditional or contemporary design
but must be situated, designed,
constructed and finished so as not
to detract from the natural beauty
of the surroundings so as to be
compatible with the existing
buildings. The power to determine
compliance with this standard
shall rest solely with the
discretion of the Architectural
Review Committee who have no
liability whatsoever for the
approval or disapproval of any
such plans.
(b) The initial Architectural Review
Committee shall consist of three
(3) members appointed by the
Declarants to serve thrcugh
December 31, 1999. The Declarants
shall be solely empowered to fill,
by further appointment, any term
which shall become vacant priuc to
December 31, 1999.
(c) Those persons owning Lots hereby
dedicated in Star Fort, Section I
in the year 2001 and subsequent
years, may elect successor members
to continue the existence of the
Architectural Review Committee.
Successor members shall be elected
for terms of one (1) year. Each
Lot shall be entitled to cast one
(1) vote for each Lot owned for

not affect the binding effect of the
covenants and conditions upon any Lot.
20. ENFORCEMENT: The Declarants herein, and any
and every person hereafter having any right,
title, or interest in any Lot, shall have the
right to prevent or stop violation or
attempted violation of any of these
restrictions by injunction or other lawful
procedure, and to recover any damages
resulting from such violation. Together with
his or her costs and reasonable attorney's
fees expended therein, if there is no other

caused by violation of any restriction.
Declarants' right of enforcement shall
survive the closing and delivery of the deed

any other manner, shall in no way affect any
of the other provisions, which shall remain
in full force and effect.

THIS DEED made and dated this 25th
day of October, 1993,
by and between C. MONTY HARRIS and LAWTON M. SAUNDERS, PARTNERS
T/A HARRIS & SAUNDERS, A VIRGINIA PARTNERSHIP, parties of the
first part, hereinafter called the Grantors, and MARY H. MILLS,
Widow and not remarried, party of the second part, hereinafter
called the Grantee.
WITNESSETH: That for and iin consideration of the sum of Ten
Dollars ($10.00), cash in hand paid, and other good'and valuable
consideration, the receipt of all of which is hereby
acknowledged, the Grantors do hereby grant, sell, bargain and
convey with General Warranty and English Covenants of Title, in
fee simple absolute, unto the Grantee, the following described
tract or parcel of land, together with all rights, rights of

Court of Frederick County, Virginia, in Deed Book 747
at Page 152 et sea., as amended July 1, 1993, and
recorded in said Clerk's Office in Deed Book 800 at
Page 005, et gea., and being further more recently
described as shown on that certain plat of L. Allen
Ebert, Land Surveyor, dated October 13, 1993, which
said plat is attached hereto and by this reference
hereby made a part hereof as if set forth in full; and
being a portion of the same property conveyed to C.
Monty Harris and Lawton M. Saunders, Partners T/A
Harris & Saunders, a Virginia Partnership, by Deed
dated September 23, 1987 from Francis M. Bayliss,
Widower, and by Quitclaim Deed from Frederick A.
Crisman, Jr., Widower, et als, dated September 11,
1987, said Deeds being of record in the aforesaid
