As discussed, due to the narrow frontage of the lots 24'xl5" or 17"xl3" C.M.P. culverts may be used. I have enclosed a copy of our standard PE-1 specification for your use. Please ensure the side ditch is cut to the proper elevation prior to installation of the culverts. Also as discussed, neither the rights -of -way of Start Fort Drive or North Braddock Street Extended have been completed to the point where a detailed punch list is practicable. Too many general items, i.e. shoulder and ditch construction, pavement placement, seeding and various drainage related items, remain to be completed. RESTRICTIVE COVENANTS AND CONDITIONS All of the lots (Lots 1 through 16) in said subdivision shall be subject to the following restrictive covenants and conditions which shall be considered covenants real and running with the land and shall be binding upon, and enforceable by, the Grantors and all subsequent owners of said lots: 1. All lots shall be used for single family residential purposes only. 2. No signs or advertising of any nature shall be placed, erected or maintained upon a lot, except for signs advertising the sale or rental of said lot, such signs to be no larger than six (6) square feet. 3. In granting or denying such approval, the Board of Directors may consider the effect upon the view or outlook from surrounding lots and any other factors which will, in the opinion of the Board, reasonably affect the desirability or suitability of the homes in the subdivision. 5. No fencing shall be allowed on any lot except that fencing may be placed by the Grantors herein or placed with the written consent of the Grantors herein. 6. No baby carriages, bicycles or other articles of personal property shall be deposited, placed or permitted to remain upon any lot except in an enclosed area in the rear of the residence thereon. The Association, or its agents, may impound all such articles and make a reasonable charge for their return. 12. No lot shall be used or maintained as a dumping ground for garbage or rubbish. Trash, garbage or other waste shall be kept in sanitary containers. No trash, garbage or refuse, or container for same, shall be placed or stored in the front of any residence except temporarily on the date of garbage pickup. Each lot shall be kept mowed and maintained in a neat and orderly condition at all times. 13. No rooftop antenna shall be erected or permitted on any structure in the subdivision. 14. No exterior clothes line or hanging device shall be allowed upon any lot, except for an umbrella type device with diameter not exceeding seven (7) feet which shall be located in the rear of any residence. No clothing or other washing shall be dried outside a residence except during the hours from 8:00 a.m. to 6:00 p.m. 15. If a residence is destroyed, no structure other than a residence of the same dimensions and similar architecture shall be constructed in the place of the original structure, and such shall be subject to the approval of the Board of Directors as provided hereinabove. 17. Each and every owner of any lot in this subdivision, by accepting a Deed therefor, shall automatically become a member of the Homeowners Association described hereinbelow and subject to all of the obligations and responsibilities, and entitled to all of the rights and privileges, set forth in the Articles of Association set forth hereinbelow. 18. The invalidation of any one of the foregoing conditions or restrictive covenants by judgment or Court Order shall in no way affect any of the other conditions or restrictive covenants which shall remain in full force and effect. DECLARATION OF SUBDIVISION A. The platting of Star Fort Estates subdivision, as shown upon the plats prepared by H. Bruce Edens, C.L.S., dated January 9, 1990, which is attached hereto and incorporated herein in full by this reference is with the free consent and in accordance with the desire of the Grantors herein. The Common Areas of the said subdivision, (hereinafter called the Common Areas) shall include all of those areas marked on the plat as either "Common Area", "Drainage Easement" or "Detention Storage -Area Easement". Ownership of the Common Areas shall be in the owners of the lots in the subdivision, and the Deed conveying each lot shall convey to the Grantee therein a proportionate, undivided interest in and to the Common Areas. Ownership of a lot within the subdivision shall entitle such owner to the full use and enjoyment of all of the Common Areas subject to restrictions set forth or provided for in the Articles of Association of the Homeowners Association set forth hereinafter. MEMBERSHIP: Every person or entity who is a record owner of a fee or undivided fee interest in any lot shown upon the plat of the Subdivision shall be a member of the Association (hereinafter called "Member"), and each such owner, by the acceptance of a Deed conveying to such owner such lot or such interest therein, is deemed to covenant and agree to all of the terms of these Articles of Association; provided, however, the foregoing is not intended to include persons or entities who hold an interest merely as security for the performance of an obligation. Membership in the Association shall be appurtenant to and may not be separated from ownership of any such lot. Ownership of such lot or interest therein shall be the sole and continuing qualification for membership. 5. VOTING RIGHTS: The total number of votes in the Association shall equal the total number of lots in the Subdivision. Such expenses shall include, without limitation, the payment of real estate taxes assessed against the Common Areas, insurance, repair and replacement of facilities, legal and accounting expense and such other expenses reasonably necessary to the operation of the Association. The responsibility for payment of such annual assessment with respect to each lot of the Subdivision shall be borne by the owner or owners of record of such lot as of January 1 of the year of such assessment. The Association shall notify each Member in writing at least thirty (30) days prior to the date such payment is due. In the event that the Association, or any successor organization, established to maintain The Common areas, shall at any time after establishment of the development, fail to maintain The Common areas in reasonable order and condition in accordance with the site plan, the Board of Supervisors may serve written notice upon such organization or upon the residents of the development setting forth the manner in which the organization has failed to maintain The Areas in reasonable condition, and said notice shall include a demand that such deficiencies of maintenance be remedied within thirty (30) days thereof, and shall .state the date and place of a hearing thereon which shall be held within fourteen (14) days of the notice. RCP Culvert Area Star Fort Estates Subdivision Winchester, Virginia Triad Project No. SC-1350(A) Dear Mike, Based on our recent conversations, we understand that a VDOT representative has requested that a professional engineer address the installation and functionability of the four 42" diameter RCP culverts that were installed earlier this year. In addition, we understand that VDOT has requested that the uneven ends of the pipes be corrected. A letter, dated February 6, 1991, was prepared by our office which addressed the unstable subgrade conditions encountered during excavation for pipe installation. This letter was based on our site visit on January 31, 1991. In summary, our recommendations included (1) excavating a sump pit and pumping groundwater from the excavation, (2) removing all loose, saturated material from the excavation, (3) placing a 6-inch mud mat of lean fill concrete, (4) placing a minimum of 12" of compacted 21-A or crusher run stone for pipe bedding and backfill up to the spring line of the pipe, and (5) placing on -site fill in a controlled manner above the stone to the roadway subgrade. Based on our recent site visit on June 19, 1991, we observed the following: 1) A 6" to .7" mud mat consisting of lean fill concrete was located approximately 5" to 6" below the bottom of the pipes at the downstream outlet area. A 12" to 13" layer of crushed stone existed above the mud mat in this area. The thickness of the mud mat and crushed stone could not be determined at the upstream outlet area due to the ponded water. a 2) On -site clay -rock backfill was present between and above the pipes. The top portion of the roadway subgrade consisted of weathered shale material. Triad Engineering, Inc. Based on our field .observations, it appears that the pipes were installed on a stable subgrade consisting of a mud *mat and crushed stone bedding. The pipes are currently functioning properly with the exception of minor seepage through the bedding stone at its interface with the mud mat. We do not believe that this minor seepage is detrimental to the future structural integrity of the pipes. Minor maintenance work, however, may be required in the future to prevent sloughing of the stone and soils around the ends of the pipes. In regard to the uneven pipes, they can be corrected by cutting the longer pipes off such that all pipes will be flush with each other. The findings and conclusions presented in this letter have been developed in accordance with generally accepted geotechnical engineering practices. No other warranty, either expressed or implied, is made. Subsurface conditions may vary from those locations observed at the time of our site visit. The culvert sections proposed will at best be under inlet control conditions. More realistically, they will be under outlet control. Howeder,y it must be determined what the headwater surface elevation will be, and how that will cause waters to back up on to the adjacent properties. This should be compared to the water surface elevation that would occur in the existing channel conditions for the 10 year and 100 year design storm. If they can verify that this proposed drainage system and road bed will not cause the water surface elevation to increase from existing conditions, then the drainage issue of concern will be satisfied. There are several other issues in my letter of 4/28/89 that have not been addressed. Of primary concern, other than the drainage discussed above, are the recommendations for a geotechnical report prior to the construction of homes, and the frontage improvements of North Braddock Street for the full property frontage. The proposed 4 - 42" culverts are to be designed and checked for inlet/outlet control. The proposed design is based on a closed conduit system which does not apply to this condition. 3. How is the 100 year storm being controlled? How far into the adjacent properties does the 100 year ponding limit encroach? Is there adequate over land relief for the 100 year storm? 4. Show ditch computations for the ditch in between lots 11 and 12. 5. Generally, the length and the class of rip -rap is based on the water velocity at outlet. Please verify the proposed length and class of rip -rap based on this. 6. Show computations confirming adequacy of the proposed detention/storage area. 7. The typical ditch section, on sheet 2 of 2, shows the proposed 8" sanitary sewer; a) indicate size of pipe b) show minimum cover to finish grade. 8. We recommend showing the proposed ditch profile with Star Fort Drive Profile. 9. We recommend a minimum 1% slope along ditch section streets to insure adequate drainage. 10. An analysis of the result of 100 year run-off to the 4 culverts, it appears the culverts will pass the flow with a head of approximately 3.4 feet above the pipe invert. This will give us a water back-up to an elevation of 719.9 which should not adversely affect the adjacent houses. I Therefore feel that the plans can be approved from an engineering standpoint. The owner has indicated that he will take full responsibility of the conditions of the existing fill material on site. A final subdivision plat showing the approximate dedications and easements needs to be submitted and recorded by the owner. It was my understanding during our last meeting that Mr. Saunders is going to dedicate the right-of-way for the extension of N. Braddock Street to the Northeastern property line for the future road extension. Materials ,used and method of construction shall apply to current observed VDO►P Road and Bridge Specification applicable during construction of this development. 2. If mailboxes are to be placed along the roadway fronting lots, a minimum four W ) feet shall be between the edge of pavement and the front of mailbox as shown on the attached sketch. 3. Our review and coanents are general in nature; should conditions in the field exists such that additional measures are warranted such measures shall be completed to the satisfaction of the Department prior to inclusion in the Secondary System. 4. Attached is a copy of the mininsun requirements and data for subdivision streets and private entrances prior to acceptance into the Secondary. - System. This is the developer's responsibility. 5. All drainage is to be carried within the right-of-way in ditch lines along . streets to a pipe or drainage easement. 6. A preconstruction conference be held by the engineer and/or developer with -the attendance of the contractor, various County agencies and VDOT prior to initiation of work. Box 601 Winchester, Va. 22601 Re: Star Fort Preliminary Subdivision Plan HSO - 72106-1-0002 Dear Mr. Watkins, MAY 1989 RECEIVED DENT, OF, PLANNING AND DEV.ELOPMENf, I have made a brief review of the subject preliminary plans and offer the following comments: 1. I am unable to evaluate the site drainage and/or grading since no drainage calculations, drainage area map, or existing and proposed contours have been included. Please have the applicant provide site topo to include all existing and proposed contours for all areas impacted, and drainage calculations. 2. We made a site visit of the project and noted the following concerns: a) How is the proposed storm water management going to impact the up stream properties. b) Is the down stream channel adequate to carry the storm flows (100 year event) without impacting lots 5,11, and 12, and the up stream properties including lots 159,160 and 161 of the Chrisman Subdivision and the City of Winchester lot. During the field visit, it appeared that these lots are lower than the fill that has been placed on the Star Fort Site. The developer should confirm for himself and the County that these are viable building lots. c) It is apparent that fill has been placed on the site on the eastern side of the drainage swale. I have some concern in what the fill consists of, particularly after seem the fill on the adjacent property. House footings in this area may need to be below this fill for proper bearing support. Geotechnical information such as compaction reports, and soil analysis should be presented. The stability of the road subgrade is also of concern in this fill area. In Hams,Sn,anga&Assoaates,Inc. The storm water management design should also include how the 100 year relief or emergency spilling will be addressed, or will the proposed culverts carry the flow with adequate allowance for clogging. 4. Improvements to North Braddock Street should be proposed for the full frontage of this property. It will not be necessary to provide a temporary cul-de-sac or turn -around since the intersection of Star fort Drive is so close to the terminus of Braddock. Road end delineators should be indicated. 5. Proposed measures for erosion and sedimentation control such as silt fencing, construction entrance, sedimentation traps, and berming should be indicated on the construction plans if not overly crowded or on a separate erosion and sedimentation plan for projects where there is a lot of line work on the drawings and showing on the plans would make them difficult to read. 6. The proposed spacing between the sewer and water lines should be indicated. Although it appears to be 10 feet, it should be stated for clarity to the contractors. 7. I would recommend that sewer and water service connections to service the lots be indicated to the property line with sewer clean -outs and water stub off. These are observations that I made during my limited review. Additional comments may be warranted after I have had the opportunity to review the information provided.
