I have reviewed your correspondence concerning the bonding for Star Fort, Section II. Based on
my review and Ed Strawsynder's (County Engineer) comments, the County will require a
monetary guarantee (bond, letter of credit) in the amount of $110,000.00. Once I receive this
guarantee, I will be able to approve the final subdivision plats for the same.
I've attached the Letter of Credit format that we require. If you elect to use a letter of credit
form of guarantee, please have your bank place this language on bank letterhead.

that they elect not to renew the instrument for such additional period. During the last thirty (30) days
while -this Letter of Credit is in force and effect after notice of termination has been given, the County
may draw up to the full amount of the sum: when accompanied by a .document stating that

Pursuant to our recent telephone conference-. I. represent-Starfort Developers who
are in the process of developing Starfort Subdivision, a residential subdivision on the
north side of Route 522, approximately one half mile from the City of Winchester line.
Inquiry has been made by my client, Starfort as to the situation existing with
respect to the improvement to the crossover located at the entrance to Starfort Subdivision
Phase IV, which is planned some three to four years hence.
In reviewing the site plan for a development :which lies on the opposite side of the
highway and which is known as Autumn Winds Apartments ("the apartments") it appears
that the improvements to the crossover including a deceleration lane along the southern
boundary of the west bound lane of Route 522 is noted to be performed "by others". I
presume that the "others" of which is referenced on the apartment site plan is my client,
Starfort.
There appears,to be the potential problem that the apartment will create at least, if
not more, the same amount of per day trips than. the Starfort Subdivision. I believe I am
correct in stating that the estimates for the apartments are 700 trips per day. Therefore, it
seems to me that the fair solution to the potential problem is to have the apartment
construct the decel lane along thenorth side of the west bound lane of Route 522 and

contribute fifty (50%) percent toward the improvements of the crossover as well as fifty
(50%) percent for the signalization of the intersection that will be created. Starfort
recognizes its obligation to construct the deceleration lane and the acceleration lane on
the north side of the west bound lane of Route 522 and to contribute up to fifty (50%)
percent of the cost of the crossover including the signalization, even though the
development is some four to five years in the future, however, it should not be solely
responsible for the cost of the crossover and any portion of the decel lane along the south
boundary of the west bound lane.
It is therefore, requested that a meeting be held between VDOT, Starfort and the
Autumn Winds Apartment complex with an eye toward resolving the issues which now
exist at this location before a traffic problem is created.

Future Need for Signal: VDOT will secure actual traffic counts after the business on

warranted based on traffic volumes, or if a signal is determined to be needed for any
other reason, such as accident experience, during that five (5) year period, a signal

Y In an attempt to keep you abreast of the situation at the Starfort Properties on
Route 522, North of Winchester, the following information is submitted.
I made contact with the owners of Autumn Winds Apartments, National Housing
Inc. in Virginia Beach and that entity is not willing to contribute any monies to improving
the crossover at Route 522.
As was indicated at the meeting on February 22, 1999, Starfort has no plans to
have any development which would need the crossover for some four to five years. It is
concerned that a safety problem will occur prior to that time because of the usage of the
same by the tenants in the Autumn Winds Apartment. For that reason, Starfort
Developers has no objection to the crossover being closed until Phase IV is developed
and the Subdivision is placed of record.
In addition to the above, Starfort was under the impression during their
negotiations with the Red Cross that the Red Cross would pay a certain percentage of the
signalization at the intersection of Fort Road and Route 522 should that signalization
become necessary. I would appreciate it if you could let me know VDOT's position with
respect to a contribution by Red Cross in reference to any required signalization or other
VDOT Letter

improvements at the location. Starfort does understand that it will be building the
deceleration lane in connection with the entrance to Fort Road, however, it is
contemplated that perhaps Red Cross should be contributing on some percentage basis to
the signalization as well as the Starfort Developers.
Finally, I would appreciate it if you could give me some information on what
guidelines are used by VDOT to determine the necessity of a signalization at the
intersection.
I look forward to hearing from you in this matter.

This is to inform you that the Department of- Environmental Quality has received an
application for a Virginia Pollutant Discharge Elimination System (VPDES) permit from Arogas,
Inc. The applicant proposes to discharge treated wastewater from a truck stop and restaurant
located at Interstate Route 81 at Exit 323 in Frederick County.
The Department will review the application and may draft a permit for this discharge. If
the Department drafts a permit, a notice will appear in The Winchester Star announcing our
intention to issue the permit and inviting public comment on its content. This public comment
period will run for 30 days from the date the notice first appears in the newspaper. In the
meantime, the public is welcome to review the permit application at our office during normal
business hours.

On Tuesday, February 2, 1999, I performed a site inspection at the subject subdivision. I
met with Gary Brown and Charlie Whitacre of R & G Construction Co. to walk the site. As stated
in a previous memorandum dated December 15, 1998 to John Trenary, Frederick County Building
Official, we would not issue any building permits within the subdivision until the road base was
installed and all drainage ditches within the subdivision where installed and stabilized.
Based on my site inspection, it appears that these items have been addressed. The road
base has been installed to the proper depth as determined by the Virginia Department of
Transportation and all ditches have been installed and stabilized as indicated in the approved
subdivision plan. Therefore, we will allow the issuance of building permits.
The following items will need to be addressed prior to issuance of final occupancy
permits:
The road will need to be paved in accordance with the approved subdivision plan.
A site inspection by VDOT is recommended prior to paving to verify the condition
of the base stone and underlying subgrade.
2. All street signs will need to be installed at the locations indicated on the approved
subdivision plan.
3. The stormwater pond being constructed by Shockey's will need to be completed.
Also, since the site has been completely stripped of vegetation, the site will need to be
stabilized in accordance with the approved erosion and sediment control narrative (Attachment 1).
The stabilization will need to be completed within 14 days from the date of this letter.

The site contractor informed me that the gas line along Lauck Drive will be relocated this
week. Once that is completed, they will finish grading this area to drain along Lauck Drive. They
will need to stabilize this area With rip -rap after the grading is performed to minimize erosion. I
also informed the contractor to re -stabilize an area downstream of culvert number 3 and to place
outlet protection as shown on the plan.
It appears that several areas will need to be regraded in the spring to promote positive
drainage. We will perform periodic inspections to monitor the construction of the single family
homes as well as monitor erosion on -site. We do recommend that you inform all the builders that
they will need to minimize the mud being tracked off their building sites and onto Fortress Drive.
We will hold you responsible for cleaning Lauck Drive in the event that contractors track mud
from the building sites. If necessary, we will use your subdivision bond to insure that the site is
properly maintained during the course of construction.

In a memorandum dated December 15, 1998, the Public Works Department informed you
that building permits could not be issued within the subject subdivision since the road base and
drainage structures had not been installed. At the request of the earthwork contractor for the
subdivision, I performed an follow-up inspection at the subject site on Tuesday, February 2, 1999.
The contractor has installed the base stone for the road even though some subgrade failure has
already occurred. He has also completed the installation and stabilization of all the drainage
ditches as indicted in the previous memorandum. Therefore, we recommend that building permits
be issued for the subject subdivision.
Prior to issuance of final occupancy permits, the road will need to be reinspected to
evaluate the condition of the base stone as well as verify that surface treatment has been place.
The presence of street signs will be determined at that time.

County. The name of the streets are Fortress Drive, Sentinel Drive and Caliber Court Thereby
necessitating three new intersections, Fortress Drive and Lauck Drive, Fortress Drive and Sentinel
Drive, and Fortress Drive and Caliber Court.
I am writing this letter to inform you that the initial sign installation (intersections of
Fortress Drive and Lauck Drive, Fortress Drive and Sentinel Drive, and Fortress Drive and
Caliber Court) is the responsibility of the developer of the property. Once the initial sign
installation has been completed, maintenance of the signs then become the responsibility of
Frederick County, Virginia, i.e., vandalism, theft, etc.

We have received your letters and have reviewed and researched your questions and
concerns.
The crossover in questions, which is to be improved by Star Fort developers will not be
closed. It will be required, prior to any future site plan approvals, that the crossover be
improved as shown on the approved Star Fort Subdivision, U.S. Route 522 Improvement
Plan dated 10/08/97 and approved 06/01/98.
As of this date, VDOT has not received or approved a final site plan for the Red Cross site
and portions of Fortress Drive. We have however conducted an initial review and
returned our comments to the design engineer for revisions. VDOT does expect to enter
into a signalization agreement with the Star Fort developers. Should the developers assign
or transfer all or a percentage of the responsibility to reconstruct the crossover as approved
and/or the traffic signalization agreement to the Red Cross or other commercial sites within
the Star Fort development, VDOT will still require the previously noted Route 522
improvements to proceed and traffic signalization agreement to be executed prior to final
approval of any Star Fort site plans including the Red Cross project.
VDOT will expect to enter into the traffic signalization agreement with the Star Fort
developers for 50% of the costs associated with the design, installation and material
necessary to install the traffic signal at the Route 522/Fortress Drive intersection. Should
the developers enter into any additional agreements for the installation of signals,
crossover upgrades, etc., these agreements should remain the concern of the private parties
and not be part of VDOT's agreement with the Star Fort developers.

Other commercial developments not accessing Route 522 from the Star Fort development
will not affect the Star Fort developers' contribution to the signal agreement and crossover
installation. Each access point from a developable site onto Route 522 will be reviewed
for that development's traffic impact on Route 522 and the need for right-of-way
improvement and signalization necessary to enhance and improve safety at that access
point. Any improvements deemed necessary by VDOT will be required of that developer
' prior to site plan approval.
Attached for your review is a copy of Section 4C Warrants for traffic signal installation from
the Manual on Uniform Traffic Control Devices.

Recently, a building permit application was received for Lot 25 within the subject
subdivision. At this time, the site work has not reached a point where building permits can be
issued. The following is a summary of the items that will need to be addressed prior to issuance of
building permits:
Currently, Fortress Drive has only been rough graded with no road base or
drainage ditches installed. After talking with Steve Melnikoff of the Virginia
Department of Transportation, he agrees that until a proper road base is installed
consisting of eight (8) inches of compacted 21-B road base ( detail from approved
subdivision plan), no building permits should be issued.. Also, all drainage
structures and ditches within the subdivision shall be installed with proper
stabilization as shown on the approved plan.
2. A proper construction entrance and all erosion and sediment control devices shall
be installed as shown on the approved plan.
Once we have been notified by the developer that these items are completed, we will
perform an on -site inspection to ensure everything is installed in accordance with the approved
subdivision plan. At that time, we will inform you of the status of the subdivision.

Upon review of the revised subdivision plan dated March 11,1998, we offer the following
comments:
1. The revised plan adequately addresses all stormwater and erosion and sediment
control concerns.
2. As indicated in our previous comments, the construction of the
stormwater/sediment pond and the drainage ditch will be required as the first step
in site development. Issuance of a land disturbance permit will be required prior to
initiating any grading operations.
We offer no additional comments. Therefore, we recommend approval of the revised
subdivision plan dated march 11, 1998.

project. The plans appear satisfactory and are approved. Please advise the developer
accordingly.
I offer the following comments:
• A preconstruction conference be held by the engineer and/or developer with the attendance of
the contractor, various County agencies and VDOT shall be conducted prior to initiation of
work.
Materials used and method of construction shall apply to current observed VDOT Road &
Bridge Specifications applicable during construction of this development.
• Our review and comments are general in nature. Should conditions in the field exist such
that additional measures are warranted, such measures shall be completed to the satisfaction
of the Department prior to inclusion into the Secondary Road System.
• All drainage is to be carried within the right-of-way in ditch lines or gutters along the street
to a pipe or drainage easement.
• The contractor shall notify VDOT when work is to begin or cease for any undetermined
length of time. VDOT will also require 48 hours notice for inspections.
• The appropriate land use permits shall be obtained before any work is performed on the
State's right-of-way at Routes 522 & 832. The permits are issued by this office and will
require a minimum processing fee, surety bond coverage, and the salary & expenses of a
State assigned Inspector.

• If mailboxes are to be placed along the roadway fronting lots, a minimum of 4' shall be
between the edge of pavement and the front of mailbox.
• Any signs to be installed will be in accordance with attachments.
• I suggest any utilities and/or storm sewer placed within the proposed right-of-way be
backfilled completely with C.R. Type 21-A Stone. This will greatly reduce the possibility of
any pavement settlement.
• We acknowledge certification of culvert invert elevations under Route 832 (Lauck Drive) 30"
RCP, and under NBL Route 522 (North Frederick Pike) 48" RCP to be correct as shown on
the plans.

to install a temporary construction entrance at the referenced location. This
letter is to be considered your permit to do so. The following provisions will be
required:
• Work area protection signage is to be in accordance with the current Work
Area Protection Manual while working on the right-of-way.
• All work on the right-of-way is to be confined to the temporary entrance
location only.
• A minimum 6" depth of VDOT # 1 (2-3 inch stone) course aggregate by 30' in
width will be required. It is to be placed from the edge of pavement and
extended back onto private property far enough to prevent the carrying of
mud onto the roadway.
• Positive drainage is to be maintained within the right-of-way at all times.
• A wash rack will be required.
• A 15"x40' culvert will be required.
• Any disturbed areas of the right-of-way or damages to the pavement
structure adjacent to this entrance will be repaired by you to our satisfaction.
• This permit is being issued for 180 days.

Upon review of the revised subdivision plan dated March 11,1998, we offer the following

1. The revised plan adequately addresses all stormwater and erosion and sediment

Upon review of the subject subdivision plan, we offer the following comments:
Sheet 3 of 8
1) All drainage ditches adjacent to residential lots need to be analyzed and capacities
checked for a post developed 100-year storm event. The analysis needs to
incorporate post -developed conditions of all future sections within Star Fort that
drain through Section II. Also, place proposed minimum floor elevations for all
lots adjacent to these ditches on the subdivision plan.
2) Perimeter silt fence needs to be around the site to contain silt and erosion on -site as
indicated on the plan.
3) The existing stormwater pond along Lauck Drive cannot currently be used as a
sediment basin as indicated within the erosion and sediment control narrative.
There is not sufficient wet -volume storage area within the pond and the outlet
structure would need to be redesigned so that it can operate as a sediment basin.
Indicate how you will control silt on -site within this drainage area.

4) The proposed stormwater pond needs to be designed as a sediment basin in
accordance with standard 3.14 of the Erosion Control Manual. You need to
extend the silt fence along the property boundary to control sediment during
the construction of the pond and stormwater conveyance channel. Also,
determine the outlet velocities for the twin culverts to ensure downstream
erosion will not occur. Provide adequate outlet protection as required.
5) Place additional rock check dams within the conveyance channel as
indicated on the plan.

6) The construction entrance needs to include a wash rack to help control mud
from being tracked off -site.
7) The following lots require individual site plans at the time of application for
building permits: 27,28,29, 30, 32, 33, 34, 35, 36, 37, 38, 39, 40, 41,
42, 43 and 44.
8) Place a note on the subdivision plan indicating that once the construction of
single family dwellings begins, it may be necessary to provide erosion and
sediment control measures for individual lots to contain the erosion and
sediment on -site.
9) The proposed erosion and sediment control schedule needs to be changed to
ensure that all perimeter erosion and sediment control measures including
the stormwater/sediment ponds are in place as a first step in construction.
11) Approval of the subdivision plan from the Virginia Department of
Transportation and the Frederick County Sanitation Authority is required
prior to issuance of a land disturbance permit from this office. However, a
land disturbance permit for the stormwater/sediment ponds, erosion and
sediment control measures associated with the ponds as well as the
stormwater conveyance channel (only) may be issued prior to these
approvals. Once these comments have been addressed, submit two (2)
copies of the subdivision plan for further review.
