Stimpson, Jr., Margaret B. Stimpson, individually and as wife of Harry F. Stimpson, Jr., and Harry F. Stimpson, III, and Doris Conway Blackwell Stimpson, his wife, parties of the first part, hereinafter called Stimpsons, and Allen Properties, Inc., a Virginia corporation, party of the second part, hereinafter called Allen. WHEREAS, the parties hereto are owners of contiguous land (Stimpsons' land being the same land acquired by deed dated July 16, 1973, recorded in Deed Book 413, at Page 303, and Allen's land being the same -land acquired by deed dated June 25, 1976, recorded in Deed Book 464, at Page 292) ; and WHEREAS, each party has currently dedicated adjacent thirty (30) foot strips of land for public street purposes extending from the South side of Route 277 Southwardly to the Sout: line of said tracts a distance of approximately 920.53 feet; and WHEREAS, the parties desire to express their rights and obligations, each to the other, with regard to the cost of improvement of said public street in this document. NOW, THEREFORE, THIS AGREEMENT WITNESSETH: That for andl in consideration of the joint dedication aforesaid and of the mutual promises contained herein and other good and valuable consideration, the parties agree: 1. That the development of a small portion of said street adjacent to the Route 277 frontage by Stimpsons now contemplated in connection with the commercial development of the Stimpsons' frontage adjacent thereto, said development being for the use and convenience of both parties, shall be solely at Stimpsons' expense. Both parties shall have the right to approve the plans and grade of the developed frontage. 2. At such time in the future as either party shall decide to further develop all (but not less than all) of the U said street, the reasonable cost thereof shall be borne fifty percent (500) by Stimpsons and fifty percent (500) by Allen. Design specifications shall be approved by both parties and shall be such as to promote economy of cost and suitability of purpose regarding the land adjacent on both sides. 3. At such time in the future as either party shall decide to further develop less than all,of the said street, then that party shall bear the total expense, but both parties shall have the right to approve the plans for such development. 4. This agreement shall be binding upon and inure to the benefit of, the* parties, and their heirs, assigns and success in interest in the land described herein.
