Dear Mr. Hutchinson:
Thank you for your letter regarding the Shenandoah Valley Battlefields Foundation's
current efforts to enhance the Star Fort Park. I understand that the Shenandoah Valley
Battlefields Foundation (SVBF) intends to purchase 10.17 acres in Frederick County (tax
map parcel 54 (A) 1). You intend to acquire the property because it played a significant
role in the Second and Third Battles of Winchester and is in the study area as identified
by the Civil War Sites Advisory Commission and in the 2035 Comprehensive Plan,
Frederick County Virginia, adopted by the Board of Supervisors on January 25, 2017 (the
"Plan"). The property will be added to Star Fort Park which is open to the public during
daylight hours seven days a week.
I further understand that you acquired the property using funds from the American
Battlefield Protection Program (ABPP). A requirement of this grant programs is that you
eventually donate a perpetual conservation easement over the property to the Virginia
Board of Historic Resources.
I am writing to confirm that the Frederick County Department of Planning and
Development finds that perpetual conservation of the property is consistent with the
current comprehensive plan and zoning ordinance.
The property is currently in both the General Business Zoning District (132) where
"parks" are a permitted use and the Residential Performance Zoning District (RP) where
public or private parks are a permitted use.
The Long Range Land Use Map designates the property as business and partially
residential within the County's Urban Area. It is also identified by map in the plan as a
part of the Star Fort Park, one of the County's most important historic resources.
Various County policies support the perpetual preservation of this valuable resource as an
integral component of the future land use of the County.

A preserved Star Fort Park will enhance the mix and integration of uses in the Urban
Development Area by enhancing a park which is open to the public.
The Plan also states, "The Urban Area should be carefully planned to take advantage of
unique natural features and settings, protect and preserve natural and historic resources
and features ... and enhance the natural, scenic, and cultural value of the urban areas of
the County".
When protected under conservation easement, this property will help preserve one of the
County's most prized cultural resources, the Star Fort Park.

Final Master Development Plan #018-87 of Stonewall Industrial Park, Zoned
M-1, 137.04 Acres, for industrial uses in the Stonewall District.
Action - Approved
Mr. Watkins said that the plan met all preliminary master plan
requirements and also appeared to meet all M-1 zoning requirements. He
said that 26 proposed development sites are shown, generally along the
extended McGhee Road and are from two to ten acres in size.
Mr. Ronald Mislowsky, Engineer with G. W. Clifford & Associates, was
present to represent the applicant.
Upon motion made by Mr. DeHaven and seconded by Mr. Wilson,
BE IT RESOLVED, That the Frederick'County Planning Commission does hereby
unanimously approve Final Master Development Plan #018-87 of Stonewall
Industrial Park for industrial uses, roads, and utilities. This property
is located in the Stonewall Industrial Park, northwest of Tyson Drive and
northeast of McGhee Road in the Stonewall District.
PUBLIC MEETINGS
Preliminary Master Development Plan #024-87 of Star Fort Estates, Zoned RP,
2.88 Acres, for patio homes in the Stonewall District.
Action - Approved
Mr. Watkins said that this project is to be served by the Frederick
County Sanitation Authority. He said that .the staff is concerned with
drainage through the site and with the applicant's plan for storm water
management.
Mr. Lawton Saunders, a partner with Harris and Saunders, was present
to represent this application.
Chairman Brumback called for anyone wishing to speak. The following
persons came forward to speak in opposition to this proposal:
Mr. Chris Spanos, resident on Locust Street, was concerned about
increased traffic at the Braddock Street entrance. He said that tractor/
trailers are parked along that street and it is difficult for emergency
vehicles to get through now. Mr. Spanos was also concerned about increased
traffic at the Pennsylvania Avenue entrance, due to the nursing home
located there. He added that the proposed project area acts as a drainage
way when it rains.
Mr. Jerry Newlin, tenant at 136 Locust Street for five years, said
that the drainage ditch is a part of Red Bud Run. Mr. Newlin said that
before he dug a swale in Red Bud Run and put in an eight foot high berm
along the drainage ditch, approximately 1/4 acre of his yard laid in two to

two and one half feet of runoff water from Pennsylvania Avenue, Locust
Street, and from the City of Winchester, by way of Braddock Street. Mr.
Newlin said that during the 1985 flood, the water came to within two feet
of the eight foot high berm. He said that there is approximately three
feet of water in the drainage ditch now, due to rains within the last
couple of days.
Mr. Bruce Davies, resident at 1005 N. Braddock Street, said that
during the wet weather season, his yard has a minimum of one half foot of
water in it. Mr. Davies felt that the runoff from this proposed
development would increase the runoff problem in this area.
Mrs. See, resident at 1008 Pennsylvania Avenue for 27 1/2 years,
said that the creek borders her property and although they have had water
only once in their basement, the runoff has washed away their driveway.
Mrs. See said that after it rains, the water laying in Mr. Newlin's yard
resembles a swimming pool. Mrs. See said that when they had their property
surveyed for sale, the surveyors said that her property was two and one
half feet in the flood plain.
Mrs. Doris Sheulen, property owner of 134 Locust Street, said that
they receive a great deal of water in their back yards. Mrs. Sheulen was
concerned about the type of housing proposed and how it would affect
property values.
Mrs. Madonna Sponaugle, resident at 1005 Pennsylvania Avenue, said
that Red Bud Run comes into her back lot and there is a culvert there. She
said that during the 1960s flooding, the water came through there so hard
that it washed railroad ties into her backyard and it moved rocks that were
five to six feet high and three to four feet wide. Mrs. Sponaugle said
that she also had two feet of water in her basement. She added that their
yard floods with every rain.
Mr. Dennis Hinkle, resident on Locust Street for the past 20 years,
said that what his neighbors have stated is true. Mr. Hinkle said that the
whole area needs sidewalks, culverts, and proper drainage.
Mr. David Coffman, resident at 1004 Pennsylvania Avenue, said that
this area is a clean, safe neighborhood and he wanted it to stay that way.
The Commissioners felt that the plan submitted was not nearly
detailed enough, as it did not show topography or drainageways. There was
also concern that the property was located in a natural storm water
retention area or perhaps, a flood plain. Also, the applicant did not have
a stormwater runoff plan at the present time.
Upon motion made by Mr. DeHaven and seconded by Mr. McDonald,
BE IT RESOLVED, That the Frederick County Planning Commission does hereby
unanimously deny Preliminary Master Development Plan # 024-87 of Star Fort
Estates for 23 single-family zero lot line patio lots. This property is
located at the north extension of North Braddock Street, beginning at the
county line, in the Stonewall Magisterial District.

On July 12, 1988, the City of Winchester Planning Commission, Planning
Director, and City Engineer toured the proposed development site for Star
Fort Estates as well as the adjacent city neighborhood along Pennsylvania
Avenue, Locust Avenue, and North Braddock Street.
Below are comments and concerns raised by the City based upon the following
understanding as denoted on a preliminary master development plan dated
March 30, 1988, revised May 5, 1988:
a) The site is to be developed with a maximum of 16 single-family
detached residences on lots averaging 4000 square feet in area
making use of a zero -lot line provision.
b) A cul-de-sac street would extend westerly from a proposed extension
of North Braddock Street. The street would be centered within the
site and terminate approximately 200 feet from the westerly edge of
the site.
c) With the exception of five lots on the south side of the new street,
all remaining land abutting the city would be ccomon open space for
perpetuity.
Comments and concerns from the Commission include the following:
a) The grading plan and actual grading of the site should be done such
that no increase in runoff or potential flooding of existing
properties in the City occurs. Portions of the site are currently
higher than abutting properties in the City. The drainage
improvements shown on the plan should be carefully reviewed.
b) A single or double row of evergreen screening should be provided in
the common area between the bulb of the cul-de-sac and lots 159
through 161 on the north side of Locust Avenue to assure screening
of car headlights.
c) A common area maintenance program should be provided to assure
perpetual upkeep of the common areas.

RE: Drainage easement - Harris & Saunders Development: North Braddock
Street, extended
As I mentioned to you on the telephone Thursday, June 9th, the City of
Winchester needs a 10' drainage easement along the south property line
of the Harris & Saunders tract of land which lies along the City -County
line at the northern most end of North Braddock Street. This easement
needs to be 10' wide and extend approximately 260 feet fron the stream
to the manhole located in the Braddock Street right-of-way, extended.
A copy of the plan for this drainage facility has been sent to Greenway
Engineering for proper location on the plan.
According to our plans this pipe was installed in 1975 with a 10'
easement. Research in the City Clerks office has failed to produce
this recorded easement. The City will need from the developer an
easement for this pipe to verify and update our records.

On July 12, 1988, the City of Winchester Planning Commission, Planning
Director, and City Engineer toured the proposed development site for Star
Fort Estates as well as the adjacent city neighborhood along Pennsylvania
Avenue, Locust Avenue, and North Braddock Street.
Below are comments and concerns raised by the City based upon the following
understanding as denoted on a preliminary master development plan dated
March 30, 1988, revised May 5, 1988:
a) The site is to be developed with a maximum of 16 single-family
detached residences on lots averaging 4000 square feet in area
making use of a zero -lot line provision.
b) A cul-de-sac street would extend westerly from a proposed extension
of North Braddock Street. The street would be centered within the
site and terminate approximately 200 feet from the westerly edge of
the site.
c) With the exception of five lots on the south side of the new street,
all remaining land abutting the city would be common open space for
perpetuity.
Comments and concerns from the Ccm ission include the following:
a) The grading plan and actual grading of the site should be done such
that no increase in runoff or potential flooding of existing
properties in the City occurs. Portions of the site are currently
higher than abutting properties in the City. The drainage
improvements shown on the plan should be carefully reviewed.
b) A single or double row of evergreen screening should be provided in
the common area between the bulb of the cul-de-sac and lots 159
through 161 on the north side of Locust Avenue to assure screening
of car headlights.
c) A common area maintenance program should be provided to assure
perpetual upkeep of the common areas.

Dear Mr. Watkins:
In reference to our previous conversations regarding the subject development, I
have enclosed a xerox copy of the drainage study of the area incorporating
Route 764 (Lee Avenue) performed by our agency in 1980.
In summary, Lee Avenue currently has a triple line of 24" culverts to handle the
upstream drainage. Recognizing the current restrictions of the existing structures
beneath the B & 0 Railroad (upstream) and Route 11 (downstream), the pipe
culverts could be upgraded with a single 7' x 4' box culvert or equivalent
opening. Presently, the upgrading of the drainage facility is not in the
County's Six -Year. Construction Plan.
It is my understanding the approval of the preliminary site plans for the Star.
Fort Development has been tabled by the Frederick County Board of Supervisors
pending the review of drainage by the Virginia Department of Transportation.
As Mr. Bushman apprised the Board during its meeting of August 24, 1988, VDOT's
review of preliminary site plans is generally limited to the layout of subdivision
streets and roadway connections. Details such as design geometries, drainage,
pavement design and et cetera are reviewed during the final plan assembly.
Our comments regarding drainage at this time would consist of adhereing to
Frederick County policies and not increasing the amount of pre -development runoff
which would adversely affect the downstream drainage facilities. More precise
comments will be reserved until review of the developer's drainage calculations
and proposed structures.

It is noted that you have received a copy of Mr. J. C. Heatwole's
memorandum dated April 9, 1980 concerning a long standing drainage
problem along Routes 11 and 764 near Weber's Nursery in Frederick
County.
You will note that Mr. Heatwole feels the main problem now appears to
be the inadequate structure under Route 764 which overflows along
Route 764 and floods the nursery and adjacent property.
In further review, you will note that Mr. Heatwole recommends certain
improvements, namely replacing the existing structure with a 7' x 4'
precast culvert and lowering the channel approximately 1.5' between
Route 764 and Route 11 with a short section upstream of Route 764.
If your maintenance replacement budget can accommodate the proposed
work on Route 764, we should try and work it into the 1980-81 budget.
At some future time should we find that the 5 x 5 box culvert under
Route 11 is not adequate to carry the water, we may have to add an
additional line of pipe beside the existing box to increase the
capacity.
Should you have any further thoughts or comments on this matter, please
feel free to advance your ideas.

Dear Stan:
With reference to your Batter dated January 23, 1980, and our letter to ym dated
February 15, 1980, the drainais at ths intersection of Routes 11 and 764 has aW"A
been reviewed by our District's Hydraulic Engineer.
The railroad has now replaced the inadequate structure under their main line with
a 91611 x 810" stool arch and completely removed the structure under the spur Crack.
This should now eliminate a larZe portion of the backup on stouts 11.
Approximately 1200 feet upstream, the same water has to pass thru a 3' x 4' stone
culvert under the railroad (Conrail) which acts as a detention dam. So long as this
structure render the railroad is not improved (which is very doubtful, unless it
completely fails), we feud that the S' z S' box under Saute 11 will pass most flows
without flooding the greenhouse if the water will go to the structure.
The greatest cad now appears to be the enlarging of the culverts under Route 764,
this is the point mere the Crater leaves the channal and follows Route 764 to Route 11.
We belle" a large part of this is due to the water backup in the channel on the CMckor
Oil property and was related to the inadequate opening at the railroad.
The size of the structure that could be placed under ,out:o 764 is limited by the
streeama channel and road elsttation. Cpening in a drainage structure higher that the
surrounding grauad would terra no purpose, if placed lower than the natural channel
it would fill to the streams channel by sedimentation. If a berm were placed on the
east side of the stream to force the water into the culvert it wo..ld cruse flooding
of the homes west of the stream. There is a partial berm now protecting the green-
house that was apparently placed there by Hr. :eeber, any damage or flooding to this
upstream properties could be his responsibility. Funds are not now available to
make improvements to these culverts, this would have to be included in the six year
plan.

On July 12, 1988, the City of Winchester Planning Commission, Planning
Director, and City Engineer toured the proposed development site for Star
Fort Estates as well as the adjacent city neighborhood along Pennsylvania
Avenue, Locust Avenue, and North Braddock Street.
Below are comments and concerns raised by the City based upon the following
understanding as denoted on a preliminary master development plan dated
March 30, 1988, revised May 5, 1988:
a) The site is to be developed with a maximum of 16 single-family
detached residences on lots averaging 4000 square feet in area
making use of a zero -lot line provision.
b) A cul-de-sac street would extend westerly from a proposed extension
of North Braddock Street. The street would be centered within the
site and terminate approximately 200 feet from the westerly edge of
the site.
c) With the exception of five lots on the south side of the new street,
all remaining land abutting the city would be common open space for
perpetuity.
Comments and concerns from the Commission include the following:
a) The grading plan and actual grading of the site should be done such
that no increase in runoff or potential flooding of existing
properties in the City occurs. Portions of the site are currently
higher than abutting properties in the City. The drainage
improvements shown on the plan should be carefully reviewed.
b) A single or double row of evergreen screening should be provided in
the common area between the bulb of the cul-de-sac and lots 159
through 161 on the north side of Locust Avenue to assure screening
of car headlights.
c) A common area maintenance program should be provided to assure
perpetual upkeep of the common areas.

Dear Mr. Newlin:
Thank you for your letter of August 26, 1988, regarding
your concerns about the proposed Star Fort Estates in Frederick
County. At Governor Baliles' request, our Department of
Conservation and Historic Resources has reviewed your letter
and investigated the matter. The Department's staff contacted
the Frederick County Planner's office concerning land use in
the area draining to Red Bud Run, which borders the north
Winchester city limits.
Mr. Barry Cockerill of the county planning staff confirms
the zoning of the development as Residential Performance (RP);
however, Cockerill said the proposed development is not located
in the 100-year flood plain. The Director of Planning was
unavailable for comment. According to Mr. Cockerill, the
county will not allow any construction in the 100-year flood
plain. Because the state currently has no stormwater
management law that specifically deals with local flooding
issues, your concern for increased water flow should be
addressed to the county as a stormwater management problem.

We are in the height of a serious problem in the Stonewall P'Iagisterial
District here in Frederick County and the borderlines north of the cit?
of Winchester, Virginia.
I along with my neighbors are in the process of a battle with two
local land developers namely Harris & Saunders Co,, and proposed STAR
r ORT ESTATEES4
The estates in cuestion are planned for sixteen patio style 'roses in
an area that is in the 100 years flood plan span zoned RP. finis land
is a ponding basin in many ways but if developed could cause substantial
flooding to the Lee Avenue areas and U.S. Route I1 TTorth 1 mile north of
th3 Winchester City Limits.
The former owner of the property Mr. Frank Bayliss a Winchester native
sold the property last year in 1987 for the some of $80,000 dollars to
Harris I Saunders Co. the uotal amount of land in question 2.88 acres
located north adjacent to the city limits in Fr,::derick County with only
one access to the property by way of Forth Braddock Street Extended.
The rains of P' y 1988 were just one in many in which the la-%d -.4a:3
at a flooding stage -v.ith Red Bud Run , a supposedly state maintained run
wl,ieh flows from U.S. l.to 522 North through this property to and under
U.S. Rt. 11 North , after these rains water usually comes into several
bacn properties on Locust Street and floods Lee Avenue areas and oor:.etimes
U.S. Rt. 11 7orth at Webers Nursery sometimes so great property owners
ha-;e had to have the local fire companies pump their basements.
The developers in :question, if allowed to disturb -the property and
parts of Red Bud Run will increase a flow of water and access drainage
that could vertualy destroy Lee Avenue homes along with U.S. Rt. 11.
We also have now the problem of overall increase of severe traffic
flow and also the closest fire company, namely Clearbrvok is seven miles
away and would have to use the access of city maintained streets to
enter Star Fort L944689.
We have had support so far with the Frederick County Planning Comission
and the Board of Supervisors but ask your help in trying to resolve
this matter along we ask that the state hater Control Board along with
Enviromental Protection Agencies be notified about this matter.
Our housing levelopments were here as a grandfather 31ause and now
pie need your help �_=long with the Board or Oupervisor_s, our next meeting
on this matte-, "ill be September 7th with planning comi.ssion and on
September 14th wi ch the supervisors.
This matter cannot go unattended, lie ask for your help.

Wo would also like to mention twat within 300 -yards of this
property we have a fully licensed nursing institution with the
Commonwealth of Virginia end that development would mean a more
possitive chance of severe flooding in the future, also a planned
ponding basin would mean that the intensity factor would create
mass problems with stagnation and danger of young childrens welfare
now that we have already several apartment complex -es corstructed in
this neighboring areas,
In conversing with the neighboring parties involved, we feel that
the .state of Virginia in some way ask the r'redarick County Planning

asked to table all matters concerning this development until all
proper authorities have inspected this property and means of

Subject: County Master Development Plans
Dear Steve:
Your letters of March 25, 1988 are acknowledged. Please be
advised that requests for water and sewer for Plan #022-87, Z & S
Partnership, and Plan #023-87, Kernstown Heights, have been tabled by
the Utilities Committee. The committee has no timetable for
considering the requests. Wastewater Treatment Plant capacity issues
continue to be of great concern to the City, and until these issues are
resolved, I would anticipate County extension requests will remain on
the table.
The developers of Plan #024-87, Star Fort Estates, have not
formally requested water and sewer service from the City. Therefore,
extensions have not been considered. I would anticipate that the City
would table a formal request.,!
Please advise if further information is required.
