SEEKFORD, single, LEVI L. SEEKFORD and HELEN E. SEEKFORD, his wife, RICHARD H. SEEKFORD and RUTH H. SEEKFORD, his wife, and RALPH M. SEEKFORD and ANITA L. SEEKFORD, his wife, hereinafter referred to as "OWNERS". WHEREAS, the said Owners are the owners, in fee simple, of real property hereinafter described and situate in Opequon Magisterial District, Frederick County, Virginia, and desire to subdivide the same as_ Lots num- bered 1, 2, 3, 4, 5, 6, 7, and a 1, 208 acres tract of a subdivision known as "Southern Hill Subdivision", on the plat and survey of H. Bruce Edens, Certi- fied Land Surveyor, dated April 2, 1979, attached hereto and made a part hereof and to be recorded herewith. NOW, THEREFORE, for and in consideration of the premises the said owners do hereby subdivide all that certain tract or parcel of land lying and being situate in Opequon Magisterial District, Frederick County, Virginia, more particularly described by the aforesaid plat and survey; and being the same property conveyed to said Owners by Deed of Garland M. Headley, et ux dated March 16, 1979, of record in the Clerk's Office of the Circuit Court of Frederick County, Virginia, in Deed Books,47, as Deed No. AU2. The aforesaid lots are subject to certain restrictions, which are to con- stitute covenants to run with the land and shall be binding on all parties and persons claiming under them, and for the benefit of and limitations upon all future owners of said lots, as more particularly set forth as follows: 1. Each lot shown on the aforesaid attached plat shall be used for resi- dential purposes only. No business or occupation of any kind other than a home occupation shall be carried on or permitted upon any of the subject lots. 2. No more than one single family dwelling shall be erected on any lot shown on the attached plat. No single family dwelling shall be erected on said 740 900X MGE . lot of less than 1200 square feet. All square foot measurements shall be ex- clusive of porches, patios, carports, basements, attics and garages. j 1 road. 3. No building shall be located on said lot closer than 50 feet to the 4. The said lot shall not at any time be subdivided, conveyed or sold except as a whole. 5. No billboards or signs of any kind shall be erected, maintained or displayed for any commercial purposes except for temporary signs advertisi the sale or rent of real estate on which such sign is located. 6. No hogs, chickens, or fowls shall be maintained upon said lots at any time. 7. All lots shall be kept clean at all times and free from junk, rubbish, � garbage and other noxious matter.
