THIS DEED OF DEDICATION, DEDICATION OF WATER AND SEWER
EASEMENTS, CONVEYANCE AND QUIT CLAIM, AND DEED OF EASEMENT OF
TRAIL, made and dated this 11"' day of June, 2007, by and between MANNING & ROSS
DEVELOPERS, LLC, a Virginia limited liability company, party of the first part, (Grantor for
indexing purposes); TAYLOR-GRACE, L.L.C. (successor in interest by merger to QR
Development, L.L.C.), a Virginia limited liability company, party of the second part, (Grantor
for indexing purposes); and LYNNEHAVEN, L.C., a Virginia limited liability company, party
of the third part, (Grantor for indexing purposes), collectively called the "Declarant", and
FREDERICK COUNTY,. VIRGINIA, party of the fourth part, (Grantee for indexing
purposes), and the FREDERICK COUNTY SANITATION AUTHORITY, party of the fifth
part (Grantee for indexing purposes), and S.F.C., L.L.C., a Virginia limited liability company,
party of the sixth part (Grantor for indexing purposes), and ARTHUR I. TSIAMIS, Trustee,
party of the seventh part (Grantor for indexing purposes).
WHEREAS, QR Development, L.L.C., a Virginia limited liability company, was merged
into Taylor -Grace, L.L.C. by Certificate of Merger issued by the Virginia State Corporation
Commission on May 29, 2007 and title to all real estate owned by QR Development, L.L.C. was
vested thereby in Taylor -Grace, L.L.C., the successor in interest by merger to QR Development,
L.L.C.; and,
WHEREAS, the Declarant, Taylor -Grace, L.L.C., is the owner in fee simple of real
estate (Frederick County Tax Map Nos. 55-A-206 and 55-A-208) shown on the plat drawn by
Ernest S. Holzworth, L.S., dated June 5, 2007, attached hereto and by this reference made a part
hereof as if set out in full, and being a portion of the same property conveyed to QR
Development, L.L.C. by Deed dated the 29t' day of March, 2005 from Lynnehaven, L.C., of
record in the Clerk's Office of the Circuit Court of Frederick County, Virginia, as Instrument No.

record in the aforesaid Clerk's Office as Instrument No. 04-0005596; and,

WHEREAS, said property is subject to a Credit Line Deed of Trust to secure the party of
the sixth part a certain indebtedness, which Deed of Trust is dated the 8th day of June, 2007, of
record in the aforesaid Clerk's Office as Instrument No. 07-0009323, with additional Assignment
of Interests, Contracts, Plans and Profits of even date, of record as Instrument No. 07-0009324,
and the Assignment of Rents of even date of record in the aforesaid Clerk's Office as Instrument
No. 07-0009325 (the "Credit Line Deed of Trust"); and,
WHEREAS, Lynnehaven, L.C., is the owner of a 10-acre tract of land at the intersection
of Channing Drive and Farmington Boulevard, zoned `B-2" under the Frederick County Zoning
Ordinance and further being a portion of Frederick County Tax Map No. 55-A-206 and being the
remaining portion of the same land conveyed to Lynnehaven, L.C.,- by Deed of record in the
aforesaid Clerk's Office in Deed Book 843 at Page 415; and,
WHEREAS, Manning & Ross Developers, L.L.C., is the owner of a certain tract of land
designated 65-((A))-39 on the aforesaid plat of survey drawn by Ernest S. Holzworth, L.S., dated
June 5, 2007, and being a portion of the same land conveyed to Manning & Ross Developers,
LLC by Deed dated November 28, 2001, of record in the aforesaid Clerk's Office as Instrument
No. 01-0016381; and,
WHEREAS, said real estate on the aforesaid attached plat drawn by Ernest S.
Holzworth, L.S., dated June 5, 2007, has been subdivided or is contemplated to be subdivided
into a subdivision made by Taylor -Grace, L.L.C. and known as Lynnehaven Subdivision and the
real estate of Manning & Ross Developers, L.L.C. has been or is contemplated to be, subdivided
into a subdivision known as Sovereign Village Subdivision; and, the real estate of Lynnehaven,
L.C., is a commercial tract of land to be further developed as allowed under Frederick County
Zoning Ordinance; and,
WHEREAS, the Declarants desire to dedicate to the County of Frederick the public

L.S., dated June 5, 2007 attached hereto and by this reference made a part hereof as if set out in

full, and to further dedicate to the Frederick County Sanitation Authority the easements for
public water and the easements for public sanitary sewer, and to dedicate the storm drainage
easements to serve the aforesaid Channing Drive, to adjust the boundaries of the real estate
adjoining Charming Drive and to dedicate the 10-foot wide trail easement, all of which are
shown on the aforesaid attached plat drawn by Ernest S. Holzworth, L.S., dated June 5, 2007.
NOW THEREFORE, this Deed of Dedication witnesseth:
DEDICATION OF CHANNING DRIVE
That for and in consideration of the premises and the benefits that will accrue by reason
of this Dedication, the Declarants, Taylor -Grace, L.L.C., Manning & Ross Developers, L.L.C.
and Lynnehaven, L.C., do hereby dedicate and convey to the County of Frederick, Virginia, that
certain tract or parcel of land, lying and being situate in Red Bud Magisterial District, Frederick
County, Virginia, containing 3.4164 acres in the aggregate as shown on the plat of survey drawn
by Ernest S. Holzworth, L.S., dated June 5, 2007, and by this reference made a part hereof as if
set out in full. Said Dedication being for a public roadway known as Channing Drive, together
with the storm drainage easements to serve the said roadway shown on the aforesaid attached
plats.
DEDICATION OF WATER AND SEWER EASEMENTS
The Declarants, Taylor -Grace, L.L.C., Manning & Ross Developers, L.L.C., and
Lynnehaven, L.C., hereby dedicate easements to the Frederick County Sanitation Authority for
water mains and sanitary sewer mains as designated on the aforesaid attached plat. The said
easement being for the construction and maintenance of the water and sewer mains and said
rights -of -way are granted for the purpose of enabling the Frederick County Sanitation Authority
to install, lay, maintain the water mains and sewer mains underground as hereinabove described.
The Declarants and their successors in title to the land over which the said easements or rights-

use said easements or rights -of -way, provided such use does not interfere with the construction,
laying and maintaining of said water mains and sanitary sewer mains.
The Frederick County Sanitation Authority, it's officers, agents, servants and employees
shall have the right to go on, over and upon said rights -of -way for the purpose of laying the
water mains and sanitary sewer mains under ground, and for the purpose of repairing said water
mains and sanitary sewer mains and no use of said rights -of -way by the Declarants shall interfere
with the use and enjoyment of said rights -of -way by the Frederick County Sanitation Authority.
Upon completion of construction the said water mains and sanitary sewer mains, the Frederick
County Sanitation Authority shall restore the disturbed area to its original condition. The
Declarants agree to execute such additional documents, from time to time, as requested by the
Frederick County Sanitation Authority to carry out the intent of the dedication of the water main
and sanitary sewer main easements hereby created.
CONVEYANCE AND QUIT CLAIM
For and in consideration of the above premises, the adequacy of the same is hereby
acknowledged, Taylor -Grace, L.L.C., and Lynnehaven, L.C. hereby grant, convey and Quit
Claim unto Manning & Ross Developers, L.L.C. those certain parcels of land containing 0.1023
acre and 0.0059 acres, shown on the plat of survey drawn by Ernest S. Holzworth, L.S. dated
June 5, 2007, and which tracts are on the eastern boundary of Channing Drive (Part 3) and by
this reference are made a part hereof as if set out in full.
DEDICATION OF TRAIL IN SOVEREIGN VILLAGE
Further, in conformity with the Master Development Plan of Sovereign Village
Subdivision, Manning & Ross Developers, L.L.C. hereby dedicate that certain 10-foot-wide trail
easement unto Sovereign Village Homeowner's Association, Inc., as shown on Sheets 8 through
10, inclusive, on the plat of Ernest S. Holzworth, L.S., dated June 5, 2007, and by reference

RELEASE OF LIEN ON CHANNING DRIVE AND
WATER AND SEWER EASEMENTS
The party of the sixth part and party of the seventh part join in the execution of this Deed
of Dedication to release the aforesaid lands containing 0.1023 acres and 0.0059 acres owned by
Taylor -Grace, L.L.C. included in the boundary adjustment as aforesaid and 2.7181 acres in the
Dedication of Channing Drive and the water and sewer easements from the lien of the Credit
Line Deed of Trust dated the 8th day of June, 2007, of record in the aforesaid Clerk's Office as
Instrument No. 07-0009323, and by this reference made a part hereof as if set out in full, and
which release shall not affect the lien on the remaining land described in the aforesaid Deed of
Trust.

EASEMENTS, CONVEYANCE AND QUIT CLAIM, AND DEED OF EASEMENT OF
TRAIL, made and dated this 11'' day of June, 2007, by and between MANNING & ROSS
DEVELOPERS, LLC, a Virginia limited liability company, party of the first part, (Grantor for
indexing purposes); TAYLOR-GRACE, L.L.C. (successor in interest by merger to QR
Development, L.L.C.), a Virginia limited liability company, party of the second part, (Grantor
for indexing purposes); and LYNNEHAVEN, L.C., a Virginia limited liability company, party
of the third part, (Grantor for indexing purposes), collectively called the "Declarant", and
FREDERICK COUNTY,. VIRGINIA, party of the fourth part, (Grantee for indexing
purposes), and the FREDERICK COUNTY SANITATION AUTHORITY, party of the fifth
part (Grantee for indexing purposes), and S.F.C., L.L.C., a Virginia limited liability company,
party of the sixth part (Grantor for indexing purposes), and ARTHUR I. TSIAMIS, Trustee,
party of the seventh part (Grantor for indexing purposes).
WHEREAS, QR Development, L.L.C., a Virginia limited liability company, was merged
into Taylor -Grace, L.L.C. by Certificate of Merger issued by the Virginia State Corporation
Commission on May 29, 2007 and title to all real estate owned by QR Development, L.L.C. was
vested thereby in Taylor -Grace, L.L.C., the successor in interest by merger to QR Development,
L.L.C.; and,
WHEREAS, the Declarant, Taylor -Grace, L.L.C., is the owner in fee simple of real
estate (Frederick County Tax Map Nos. 55-A-206 and 55-A-208) shown on the plat drawn by
Ernest S. Holzworth, L.S., dated June 5, 2007, attached hereto and by this reference made a part
hereof as if set out in full, and being a portion of the same property conveyed to QR
Development, L.L.C. by Deed dated the 29t' day of March, 2005 from Lynnehaven, L.C., of
record in the Clerk's Office of the Circuit Court of Frederick County, Virginia, as Instrument No.
05-0007270 and by Deed dated March 26, 2004 from Helen R. Bean, et al., Co -Trustees, of
record in the aforesaid Clerk's Office as Instrument No. 04-0005596; and,

WHEREAS, said property is subject to a Credit Line Deed of Trust to secure the party of
the sixth part a certain indebtedness, which Deed of Trust is dated the 8t' day of June, 2007, of
record in the aforesaid Clerk's Office as Instrument No. 07-0009323, with additional Assignment
of Interests, Contracts, Plans and Profits of even date, of record as Instrument No. 07-0009324,
and the Assignment of Rents of even date of record in the aforesaid Clerk's Office as Instrument
No. 07-0009325 (the "Credit Line Deed of Trust"); and,
WHEREAS, Lynnehaven, L.C., is the owner of a 10-acre tract of land at the intersection
of Channing Drive and Farmington Boulevard, zoned `B-2" under the Frederick County Zoning
Ordinance and further being a portion of Frederick County Tax Map No. 55-A-206 and being the
remaining portion of the same land conveyed to Lynnehaven, L.C., by Deed of record in the
aforesaid Clerk's Office in Deed Book 843 at Page 415; and,
WHEREAS, Manning & Ross Developers, L.L.C., is the owner of a certain tract of land
designated 65-((A))-39 on the aforesaid plat of survey drawn by Ernest S. Holzworth, L.S., dated
June 5, 2007, and being a portion of the same land conveyed to Manning & Ross Developers,
LLC by Deed dated November 28, 2001, of record in the aforesaid Clerk's Office as Instrument
No. 01-0016381; and,
WHEREAS, said real estate on the aforesaid attached plat drawn by Ernest S.
Holzworth, L.S., dated June 5, 2007, has been subdivided or is contemplated to be subdivided
into a subdivision made by Taylor -Grace, L.L.C. and known as Lynnehaven Subdivision and the
real estate of Manning & Ross Developers, L.L.C. has been or is contemplated to be, subdivided
into a subdivision known as Sovereign Village Subdivision; and, the real estate of Lynnehaven,
L.C., is a commercial tract of land to be further developed as allowed under Frederick County
Zoning Ordinance; and,
WHEREAS, the Declarants desire to dedicate to the County of Frederick the public
roadway known as Channing Drive (Part 3) as shown on the plat drawn by Ernest S. Holzworth,
L.S., dated June 5, 2007 attached hereto and by this reference made a part hereof as if set out in

full, and to further dedicate to the Frederick County Sanitation Authority the easements for
public water and the easements for public sanitary sewer, and to dedicate the storm drainage
easements to serve the aforesaid Charming Drive, to adjust the boundaries of the real estate
adjoining Channing Drive and to dedicate the 10-foot wide trail easement, all of which are
shown on the aforesaid attached plat drawn by Ernest S. Holzworth, L.S., dated June 5, 2007.
NOW THEREFORE, this Deed of Dedication witnesseth:
DEDICATION OF CHANNING DRIVE
That for and in consideration of the premises and the benefits that will accrue by reason
of this Dedication, the Declarants, Taylor -Grace, L.L.C., Manning & Ross Developers, L.L.C.
and Lynnehaven, L.C., do hereby dedicate and convey to the County of Frederick, Virginia, that
certain tract or parcel of land, lying and being situate in Red Bud Magisterial District, Frederick
County, Virginia, containing 3.4164 acres in the aggregate as shown on the plat of survey drawn
by Ernest S. Holzworth, L.S., dated June 5, 2007, and by this reference made a part hereof as if
set out in full. Said Dedication being for a public roadway known as Channing Drive, together
with the storm drainage easements to serve the said roadway shown on the aforesaid attached
plats.
DEDICATION OF WATER AND SEWER EASEMENTS
The Declarants, Taylor -Grace, L.L.C., Manning & Ross Developers, L.L.C., and
Lynnehaven, L.C., hereby dedicate easements to the Frederick County Sanitation Authority for
water mains and sanitary sewer mains as designated on the aforesaid attached plat. The said
easement being for the construction and maintenance of the water and sewer mains and said
rights -of -way are granted for the purpose of enabling the Frederick County Sanitation Authority
to install, lay, maintain the water mains and sewer mains underground as hereinabove described.
The Declarants and their successors in title to the land over which the said easements or rights -
of -way are granted, shall have the right at all times to cross over and upon said rights -of -way and

use said easements or rights -of -way, provided such use does not interfere with the construction,
laying and maintaining of said water mains and sanitary sewer mains.
The Frederick County Sanitation Authority, it's officers, agents, servants and employees
shall have the right to go on, over and upon said rights -of -way for the purpose of laying the
water mains and sanitary sewer mains under ground, and for the purpose of repairing said water
mains and sanitary sewer mains and no use of said rights -of -way by the Declarants shall interfere
with the use and enjoyment of said rights -of -way by the Frederick County Sanitation Authority.
Upon completion of construction the said water mains and sanitary sewer mains, the Frederick
County Sanitation Authority shall restore the disturbed area to its original condition. The
Declarants agree to execute such additional documents, from time to time, as requested by the
Frederick County Sanitation Authority to carry out the intent of the dedication of the water main
and sanitary sewer main easements hereby created.
CONVEYANCE AND QUIT CLAIM
For and in consideration of the above premises, the adequacy of the same is hereby
acknowledged, Taylor -Grace, L.L.C., and Lynnehaven, L.C. hereby grant, convey and Quit
Claim unto Manning & Ross Developers, L.L.C. those certain parcels of land containing 0.1023
acre and 0.0059 acres, shown on the plat of survey drawn by Ernest .S. Holzworth, L.S. dated
June 5, 2007, and which tracts are on the eastern boundary of Channing Drive (Part 3) and by
this reference are made a part hereof as if set out in full.
DEDICATION OF TRAIL IN SOVEREIGN VILLAGE
Further, in conformity with the Master Development Plan of Sovereign Village
Subdivision, Manning & Ross Developers, L.L.C. hereby dedicate that certain 10-foot-wide trail
easement unto Sovereign Village Homeowner's Association, Inc., as shown on Sheets 8 through
10, inclusive, on the plat of Ernest S. Holzworth, L.S., dated June 5, 2007, and by reference
made a part hereof as if set out in full.

The party of the sixth part and party of the seventh part join in the execution of this Deed
of Dedication to release the aforesaid lands containing 0.1023 acres and 0.0059 acres owned by
Taylor -Grace, L.L.C. included in the boundary adjustment as aforesaid and 2.7181 acres in the
Dedication of Channing Drive and the water and sewer easements from the lien of the Credit
Line Deed of Trust dated the 8th day of June, 2007, of record in the aforesaid Clerk's Office as
Instrument No. 07-0009323, and by this reference made a part hereof as if set out in full, and
which release shall not affect the lien on the remaining land described in the aforesaid Deed of
Trust.

THIS DEED OF DEDICATION, made and dated as of the 11 " day of July, 2006, by and
between QR DEVELOPMENT, L.L.C., a Virginia limited liability company, party of the first part,
hereinafter called "Declarant" (Grantor for indexing purposes), and FREDERICK COUNTY,
VIRGINIA, party of the second part, (Grantee for indexing purposes), and the FREDERICK
COUNTY SANITATION AUTHORITY, party of the third part (Grantee for indexing purposes),
and S.F.C., L.L.C., a Virginia limited liability company, party of the fourth part (Grantor for
indexing purposes), and ARTHUR I. TSIAMIS, Trustee, party of the fifth part (Grantor for

WHEREAS, the Declarant, QR Development, L.L.C., is the owner in fee simple of real
estate shown on the attached plat drawn by Mark D. Smith, L.S., dated January 9, 2006, known as
Lynnehaven, Section Three, Phase I, which property is further described on the Subdivision Plan of
Lynnehaven Subdivision, as filed in the Office of the County of Frederick Department of Planning
and Development. This is a portion of the same real estate conveyed to QR Development, L.L.C.
by Deed dated the 29`' day of March, 2005 from Lynnehaven, L.C., of record in the Clerk's Office
of the Circuit Court of Frederick County, Virginia, as Instrument No. 05-0007270 and by Deed dated
March 26, 2004 from Helen R. Bean, et al., Co -Trustees, of record in the aforesaid Clerk's Office
as Instrument No. 04-0005596; and,
WHEREAS, said property;is subject to a certain Credit Line Deed of Trust to secure S.F.C.,
L.L.C., the party of the fourth part, a certain indebtedness, which Deed of Trust is dated the 5`h day
of May, 2005, of record in the aforesaid Clerk's Office as Instrument No. 05-0009635, with
additional Assignment of Leases, Interests, Contracts, Plans and Profits of even date, of record in
the aforesaid Clerk's Office as Instrument No. 05-0009924, as modified by Modification of Deed
of Trust dated December 14, 2005, of record in the aforesaid Clerk's Office as Instrument

family homes thereon and the attached plat shows accurately the metes and bounds of the subdivided
land, together with the dimensions of each lot thereon and also shows certain surrounding land in
said subdivision to be used as common space, storm water detention easements, landscaping
easements, access and driveway easements, sanitary sewer easements, drainage easements and utility
easements over and across said lots, all of which constitute a portion of that development known as
Lynnehaven and which common open space/driveway/access easements shall be owned and
maintained by the Lynnehaven Homeowners Association, Inc., upon the terms and conditions set
forth hereinafter; and,
WHEREAS, the Declarant now desires to subdivide the same into lots to be known as
Lynnehaven, Section Three, Phase 1. The subdivision of said real estate as it now appears on the
aforesaid attached plat is with the consent and in accordance with the desire of the undersigned
Declarant and the Declarant hereto further desires to subdivide the aforesaid real estate in accordance
with the provisions of the "Virginia Land Subdivision Act" as are applicable and in force and effect
as of the date and execution of the Deed of Dedication and the Frederick County Subdivision
Ordinance.
NOW THEREFORE, THIS DEED OF DEDICATION WITNESSETH:
That for and in consideration of the premises and the benefits that will accrue by reason of
this Dedication, the Declarant, QR Development, L.L.C., does hereby subdivide all of that certain
tract or parcel of land designated as Lynnehaven, Section Three, Phase 1, Lots 100 through 113,
inclusive, and "Outlot E" and "Outlot F," lying and being situate in Red Bud Magisterial District,
Frederick County, Virginia, and being more particularly described by the aforesaid plat of Mark D.

Smith, dated January 9, 2006, attached hereto and made a part hereof and by this reference
incorporated herein as if set out in full, and which plat is drawn in conformity with the Subdivision
Design Plan for Lynnehaven, Section Three, Phase 1, on file in the Office of the County of Frederick
Department of Planning and Development. Derivation of title for the aforesaid land is stated as
before in the Recitals.
That for and in consideration as aforesaid, the Declarant, QR Development, LLC, does
hereby dedicate and convey to the County of Frederick, Virginia, that certain tract or parcel of land
containing 1.5407 acres in the aggregate, as shown on the Plat of Survey drawn by Mark D. Smith,
L.S., dated January 9, 2006, and by this reference made a part hereof as if set out in full, and which
public roadways are known as Woodrow Road and a portion of Renee Lane and a portion of
Lynnehaven Drive, together with the drainage easements to serve said roadways as shown on the
attached plat.
ARTICLE I
GENERAL PROVISIONS
Section 1. Dedication of Street: The DECLARANT does hereby dedicate unto the
County of Frederick, Virginia, as public streets those certain roadways designated as Woodrow
Road, and a portion of Renee Lane and a portion of Lynnehaven Drive as shown on the attached
plats drawn by Mark D. Smith, L.S., dated January 9, 2006.
The Dedication and Subdivision of the land as shown on the attached plat is with the free
consent and in accordance with the desire of the undersigned Declarant of the land being subdivided,
and is in conformity with the provisions of "The Virginia Land Subdivision Act" as are applicable,
together with the applicable ordinances and regulations of the governing body of the County of
Frederick, Virginia.

The County of Frederick, Virginia and the Frederick County Sanitation Authority, by the
signatures of its agents on the attached plat, do accept the dedications to public domain of the land
and easements, respectively, herein described as such.
The designated "Common Areas" are Outlot " E" and Outlot "F" and such Common Areas
are not dedicated hereby for use by the general public but are dedicated to the common use and
enjoyment of the homeowners in Lynnehaven Subdivision as provided hereinabove.
ARTICLE II
ADDITIONAL SECTIONS
Section 1. Additional sections ("Phases") of Lynnehaven Subdivision will be added in
the future and those sections, as they are added, will become part of Lynnehaven Subdivision,
subject to the same provisions as set forth herein and governed by the same property owners
association, provided, however, that Declarant may amend the land use restrictions, setback
requirements, building sizes and any other provisions so long as the same scheme established in
Lynnehaven as being a single family residential lot is maintained.
Section 2. The additions authorized under this Article shall be made by filing of record
a Supplementary Declaration of Covenants and Restrictions with respect to the additional property
which shall extend the scheme of the covenants and the restrictions of the Declaration (amended as
herein permitted) to such property.
Section 3. Such Supplementary Declaration may contain such complementary additions and
modifications of the covenants and restrictions contained in this Declaration as may be necessary
to reflect the different character, if any, of the added properties, and as are not inconsistent with the
scheme of this Declaration. Except as hereinafter permitted, such Supplementary Declaration shall

not revoke, modify or add to the covenants established by this Declaration within the existing
property.
Section 4. The Declarant shall not be and is not bound to make or proceed with the
addition of any of the proposed additional sections of Lynnehaven Subdivision.
ARTICLE III
RELEASE OF LIEN ON PUBLIC STREETS

The party of the fourth part and the party of the fifth part join in the execution of this Deed
of Dedication to release the aforesaid lands included in the Dedication of Woodrow Road, a portion
of Renee Lane and a portion of Lynnehaven Drive as shown on the attached plat drawn by Mark D.
Smith, L.S., dated January 9, 2006, and the water and sewer easements from the lien of the Credit
Line Deed of Trust dated May 5, 2005, of record in the aforesaid Clerk's Office as Instrument No.
05-0009635, with additional Assignment of Leases, Interests, Contracts, Plans and Profits of even
date, of record in the aforesaid Clerk's Office as Instrument No. 05-0009924, as modified by
Modification of Deed of Trust dated December 14, 2005, of record in the aforesaid Clerk's Office
as Instrument No. 06-0001601, with Assignment of Leases, Interests, Contracts, Plans and Profits

In an effort to keep the Board apprized on the Channing Drive development, staff felt it would be
appropriate to provide you with a summary of recent development activities. This 3 76-acre Master
Development Plan approved project accommodates 848 single family residential lots and 22 acres
for commercial uses. A more detailed development progress summary is attached for your review.
Staff is also seeking direction regarding the possible consideration of removing the barricade
requirement currently noted on the approved Master Development Plan. The barricade notes (see
attachments) restrict access to the Fu-Shep property via Canyon Road (Senseny Glen subdivision)
and Morning Glory Drive (Apple Ridge subdivision) until a primary access route via the proposed
Channing Drive and Rossmann Boulevard is available. As noted on the attached illustrative, the
subdivision design plan for Rossmann Boulevard and a portion of Canyon Road has been approved.
Additionally a majority of this road system has also been dedicated to the County and bonded.
Upon completion of this road system, the Fu-Shep property would have primary access via
Rossmann Boulevard.
Staff is interested in learning if the Board believes the existence of Rossmann Boulevard may satisfy
the intent of the barricade notes. Should the Board desire formal consideration of removing the
barricades, please contact staff so that the request might be placed on a future Board agenda.
Staff is available to meet with you individually should you be interested in better understanding the
progress of this development; sometimes meeting and reviewing the actual master development plan
may assist in visualizing the various aspects of this development. Thank you.

Channing Drive
Progress Summary
June 26, 2003
Background
Channing Drive was rezoned to RP on December 8, 1999. A proffer package was included, a
sampling would include: a monetary contribution per lot of $3,558.73 (Giles tract), $3,278.31
(Lynnhaven tract), $4,205.14 (Fu-Shep tract); and, a phasing program to limit the issuance of
building permits; provisions to establish Channing Drive, a major collector road; and a recreation
center. The associated Master Development Plan, enabling 848 single-family residential lots, was
approved December 5, 2001. The Channing Drive project, at the time of rezoning and master
development plan review, consisted of three landowners (Lynnhaven, Giles, and Fu-Shep).
Currently, the development is owned by Q R Development (Lynnhaven tract), Manning and Ross
(Giles tract, aka Soverign Village), and Doctors Futral and Sheppard (Fu-Shep tract).
Current Subdivision Plan Review
As of June 26, 2003, the following development activity has occurred within the Channing Drive
Master Development Plan area:
Subdivision Plats Approved
• Sovereign Village, Phase 1, Sections 1 and 2, and includes a portion of Rossman
Boulevard. All 64 lots have building permits on file (pending or issued).
• Sovereign Village, Phase 2, Section A: 37 lots. Five lots have building permits
(pending or issued).
• Lynnhaven, Section 1, which includes a portion of Channing Drive and 24 lots. Ten
lots have building permits (pending or issued).
Subdivision Plats Pending_ Approval (Subdivision Design Plan Approved)
• Sovereign Village, Phase 1, Section 3: 12 lots
• Sovereign Village, Phase 2, Section B, and includes 12 lots. Includes the completion
of Rossmann Boulevard to Canyon Road to the Fu-Shep property.
The proffers for the Channing Drive rezoning indicate that no more than 316 building
permits would be issued through December 2003. As of June 26, 2003, only 125 lots have
been approved.

Wetlands Study
Staff has learned that the wetlands review and permitting process, as required by the Army Corp of
Engineers, has been completed for the Lynnhaven and Sovereign Village parcels. The joint
DEQ/ACOE permits have been issued for these two projects. This wetlands process is necessary
prior to constructing portions of Charming Drive, the Recreation Center, and some of the local
neighborhood streets identified on the Master Development Plan. The wetlands permitting process
has been pursued jointly by Manning and Ross (developers of Sovereign Village), and Q R
Development (the developer of Lynnhaven). Staff understands that wetlands exist on the Fu-Shep
tract, although staff is not able to confirm if the necessary wetlands study has been initiated.
Additional Property Acquisition
The construction of Channing Drive (the road) was not only deferred to accommodate the wetlands
study, but also the acquisition of two existing residential parcels (Bean and Kerns properties) was
necessary. These two properties, acquired by the developers of Lynnhaven and Sovereign Village,
are located within the planned Channing Drive road right-of-way. The first segment of Charming
Drive (the road), at its intersection with Senseny Road, is currently under construction, and is
targeted for completion within the month.
Channing Drive - Road Phasing
The project has continued to be developed in conformance with the approved Master Development
Plan. As noted above, wetlands and property acquisition requirements prohibited the construction
of Channing Drive (the road) until recently. Development of Lynnhaven will necessitate the
construction of the first segment of Charming Drive (the road), per the approved MDP. Subsequent
development of Lynnhaven will also necessitate construction of additional segments of Charming
Drive (the road). The developers of Lynnhaven and Sovereign Village have advised staff that they
have entered into an agreement that addresses their individual responsibilities to complete
construction of Charming Drive over the next four years; such an agreement would construct the road
in a time frame consistent with the proffered phasing plan.
Recreation Center
The developer of Sovereign Village has stated that the Recreation Center, as proffered, will be
developed on the northwest corner of the intersection of Senseny Road and Rossman Boulevard.
Similar to the wetlands affecting the construction of Charming Drive, the Recreation Center's site
was also identified as requiring a wetlands review. Therefore, the construction of the recreation
center had been deferred until the appropriate wetlands permit is issued. Staff has been advised that
requirements of the wetlands permit have been satisfied, and that the permit is ready for issuance.

The Recreation Center will be developed in Phase III of Sovereign Village, possibly within the next
year•, Phase II of Sovereign Village has received subdivision design plan approval, and is currently
under construction.
Monetary Contributions for Schools, Parks, and Fire and Rescue
In regards to the Giles property (a.k.a. Sovereign Village under construction by Manning and Ross),
a monetary contribution of $3,558.73 would be paid to the County prior to the issuance of each
residential building permit. This accounts for: $2,958.80 for schools; $554.80 for parks; and
$435.13 for fire and rescue. The Lynnhaven property has proffered a monetary contribution of
$3,387.31 which would be paid to the County prior to the issuance of each building permit. This
contribution is intended to offset the additional costs to the County due to an increased demand on
public services.
The County is in receipt ofcontributions totaling $328,058.87, which accounts for 91 residential lots.
Summary
It appears that the proffers and master development plan associated with the overall Channing Drive
project continue to be effective and adhered to. The first segment of Charming Drive (the road) is
nearing completion, the Recreation Center is planned for construction in the next phase of Sovereign
Village, and monetary contributions have been paid consistently, as proffered.
