Bordwin 572 Massie Drive Winchester, Virginia 22601 Dear Mr. and Mrs. Bordwin: Since Senseny Heights Subdivision, Blocks C and D, was recorded in 1977, the western section of Massie Drive on which your house is located has remained a private road. That road has never been accepted by the Virginia Department of Highways and Transportation into the State Secondary Road System. The refusal of VDH&T to accept this road has been due to alterations that were made to the shoulders and ditch lines along that road when individual driveways were placed to the homes. Until such time as the drainage is corrected, the Virginia Department of Highways and Transportation will not accept that road into the State System. As long as the western end of Massie Drive remains a private road, there will be no state maintenance whatsoever done on that road. Repairs that are needed on that road will have to be financed by individual property owners and will be in no way the responsibility of the State or the County. The Highway Department has informed me that in their opinion, the only way to solve the drainage problem as it now exists would be to remove the existing culverts along the driveways and regrade the existing drainage ditches to the culvert under Williamson Road. The purpose of this letter is to inquire as to whether you would be willing to participate in the cost of this work. If this office can not be satisfied that all property owners are willing to participate in the cost, there will be no way for the work to be completed and therefore, no way for this section of Massie Drive to be included into the State Road System. It is our opinion that the only way to correct the drainage in this subdivision along this street would be to remove all the culvert pipes that have been placed, rework the shoulder, and pull a new ditchline that would provide positive drainage to a culvert pipe under Williamson Road. April 19, 1979 Dear Sir: 1514 Senseny Road Winchester, Virginia 22601 The Virginia Department of Highways has refused to accept Massie Drive into the highway system from Stafford Drive to its intersection with Williamson Road because, among other things, you have not put a culvert in the drainage ditch for your driveway. The Virginia Department of Highways requires you to put in a 20 foot long culvert with a diameter of 12 inches. This must be done before May 15, 1979 in order that they can inspect it and if acceptable, recommend to the Board of Supervisors that the road be taken into the system. If not acceptable, the roadway will receive no maintenance from the Virginia Department of Highways. When you have completed this requirement, please notify me and I will refer the matter on to the Virginia Department of Highways. This requirement is necessary for all the persons who have built houses on this road and have not _put in the culverts. Peters and wife and myself as their attorney with you and Mr. Dick Madagan and Robert Fussell of the Board of Supervisors, I discussed the matter further with Mr. and I-)rs. Peters at my office and had certain grades run on the property to determine if the Northern end of Massie Drive could be served by Mr. Peters' water and sewer lines. We found they can be served and, therefore the request of the County to permit the County Sanitation Authority to serve the following lots, to -wit: Block A,, Lots 1,2,3,4.5 and 6; Block C. Lots 1.2.3 and 4; Block D, Lots 9,10,11 and Block B, Lots 8, 9, 10, 11 and 12 meets with the approval of Mr. Peters provided no pumping station is located in his sub- division. In disaussing this matter with Mr. Don Krueger the County Engineer, I have learned that the Sanitation Authority plans to sewer these lots with a gravity system which meets Mr. Peters' approval. Lot 13 in Block B is the'lot upon which Mv. Peters' home is located, and he has extended laterals for water and sewer from the present system in the subdivision on Williamson Road and so this lot would be excepted from the Santtation Authority service. Mr. Peters` building permit for two apartment houses on the East side of Williamson Road and just North of the commercial lot on the corner of Williamson Road and Senseny Road, as I understand, will be granted as originally submitted by him to be constructed in the section zoned for ,apartments. FREDERICK COUNTY BOARD OF SUPERVISORS in Chancery No. 5288 Book 54, pp 387-389, Circuit Court of Frederick County, Virginia "On the 25th day of February, 1976, came the parties to this cause by their counsel, and the counsel for the Defendant informed the Court that after a thorough examination of the facts and the law of the case, the Defendant is of the opinion that the refusal of the Board of Supervisors of Frederick County, Virginia, to grant the application of the Complainants for rezoning on August 13, 1975, was unreasonable, arbitrary and capricious for the reasons that (1) it ignored the recommendation of the Frederick County Planning Commission to the Frederick County Board of Supervisors dated July 3, 1975, that the..Complainants' request be granted; (2) violated the statements of intent set forth in Articles IV and VI of the Frederick County Zoning Ordinance of November 1, 1973;. (3) disregarded the pattern of development under which Complainants had developed their land since 1961; (4) disregarded the pattern of development of the surrounding residential and business areas including the developments of churches, schools, fire companies and central water and sewer services serving the requested zoning area; and (5) failed to show a rational basis for singling out Complainants' property for R-1 zoning since said property is in no way distinguishable from surrounding subdivisions, all of which are zoned R-2 or R-3.
