THIS DEED OF DEDICATION, made and dated this 19th day of
July, 1994, by and between JASBO, INC., a Virginia Corporation,
and FRED L. GLAIZE, III, of the first part, hereinafter called
the DECLARANT, and COUNTY OF FREDERICK, VIRGINIA, of the second
part, hereinafter called COUNTY.
WHEREAS, the DECLARANT is the owner in fee simple of the
real estate shown on that certain Final Subdivision Plat drawn
by Douglas C. Legge, C.L.S., dated April 12, 1994, known as
Senseny Glen Subdivision, Section II, which Final Plat is
attached hereto and incorporated herein by reference as if set
out in full. This is a portion of the same real estate
previously conveyed to the DECLARANT by that certain deed of
Exchange dated August 6, 1990, which deed is of record in the
Clerk's Office of the Circuit Court of Frederick County,*
Virginia, in Deed Book 748, at Page 1627; and,
WHEREAS, said real estate, as shown on the aforesaid
attached Final Subdivision Plat, Section II, has been subdivided
into thirty-nine (39) lots for the construction of single family
homes thereon, to -wit: Lots 43, 96, 97, 98, 99, 100, 101, 102,
103, 104, 105, 106, 107, 108, 109, 110, 111, 112, 113, 114, 115,
116, 128, 146, 147, 148, 149, 150, 151, 152, 153, 154, 155 156,
157, 158, 159, 160, and 161; and the hereinabove Final Plat
shows accurately the metes and bounds of the subdivided land,
together with the dimensions of each lot thereof and also shows
certain surrounding lands in said Subdivision to be used as open
space, sanitary sewer easements, utility, ingress -egress, and
drainage easements, all of which shall constitute a portion of
that development known as Senseny Glen Subdivision, Section II
and which areas that are marked as common areas to be owned
and/or maintained by the Senseny Glen Home Owners Association

upon the terms and conditions set forth hereinafter; and,
WHEREAS, the Subdivision of Senseny Glen, Section II as shown on
the aforesaid attached Final Subdivision Plat, is with the free
consent and in accordance with the desires of the undersigned
DECLARANT, and the DECLARANT further desires to subdivide the
aforesaid real estate in accordance with the provisions of "The
Virginia Land Subdivision Act" as are applicable and in force
and effect as of the date of execution of this Deed of
Dedication.
NOW THEREFORE, THIS DEED OF DEDICATION WITNESSETH: That
for and in consideration of the premises and the benefits which
will accrue by reason of this Dedication, the DECLARANT does
hereby subdivide all of that certain tract or parcel of land
designated as Senseny Glen Subdivision, Section II, lying and
being situate in the County of Frederick, Virginia, and being
more particularly described by that certain Final Subdivision
Plat of Senseny Glen Subdivision, Section II by Douglas C.
Legge, C.L.S., dated April 12, 1994, containing
thirty-nine (39) lots for the construction of single family
homes thereon, to -wit: Lots 43, 96, 97, 98, 99, 100, 101, 102,
103, 104, 105, 106, 107, 108, 109, 110, 111, 112, 113, 114, 115,
116, 128, 146, 147, 148, 149, 150, 151, 152, 153, 154, 155 156,
157, 158, 159, 160, and 161; which Final Subdivision Plat is
attached hereto and incorporated herein as if set out in full.
This is a portion of the same real estate previously conveyed to
the DECLARANT by deed of Exchange dated August 6, 1990, said
deed is of record in the aforesaid Clerk's Office in Deed Book
748, at Page 1627.
FOR AND IN CONSIDERATION AS AFORESAID, the DECLARANT does
further dedicate all of the streets in Senseny Glen Subdivision,

Section II, to the County of Frederick, Virginia, for public
use, which streets dedicated hereby are more particularly
described by the hereinabove referenced Final Subdivision Plat

All of the lots shown on the plat attached hereto shall be
subject to the following restrictions, covenants and conditions,
which shall constitute covenants real running with the land, and
shall be binding upon all parties having any right, title and
interest in and to the aforesaid lots or any part thereof, their
heirs, successors and assigns, and shall inure to the benefit of
each owner thereof.
ARTICLE I
DEFINITIONS
The Declarant adopts and makes applicable to Senseny Glen
Subdivision, Section II, the Definitions paragraph contained in
Article I, of that certain Deed of Dedication made and dated
June 14, 1993, which Deed of Dedication is recorded in Deed Book
798, at Page 1520, in the Office of the Clerk of the Circuit
Court of Frederick County, Virginia, said Deed of Dedication
relating to Section I of the Senseny Glen Subdivision.
ARTICLE II
MEMBERSHIP
The Declarant adopts and makes applicable to Senseny Glen
Subdivision, Section II, the Membership paragraph contained in
Article II, of that certain Deed of Dedication made and dated
June 14, 1993, which Deed of Dedication is recorded in Deed Book
798, at Page 1520, in the Office of the Clerk of the Circuit
Court of Frederick County, Virginia, said Deed of Dedication
relating to Section I of the Senseny Glen Subdivision.

VOTING RIGHTS
The Declarant adopts and makes applicable to Senseny Glen
Subdivision, Section II, the Voting Rights paragraph contained
in Article III, of that certain Deed of Dedication made and
dated June 14, 1993, which Deed of Dedication is recorded in
Deed Book 798, at Page 1520, in the Office of the Clerk of the
Circuit Court of Frederick County, Virginia, said Deed of
Dedication relating to Section I of the Senseny Glen
Subdivision.
ARTICLE IV
PROPERTY RIGHTS IN COMMON PROPERTIES
The Declarant adopts and makes applicable to Senseny Glen
Subdivision, Section II, the Property Rights in Common
Properties paragraph contained in Article IV, of that certain
Deed of Dedication made and dated June 14, 1993, which Deed of
Dedication is recorded in Deed Book 798, at Page 1520, in the
Office of the Clerk of the Circuit Court of Frederick County,
Virginia, said Deed of Dedication relating to Section I of the
Senseny Glen Subdivision.
ARTICLE V
COVENANTS FOR MAINTENANCE ASSESSMENT FOR THE ASSOCIATION
The Declarant adopts and makes applicable to Senseny Glen
Subdivision, Section II, the Covenants For Maintenance
Assessment for the Association paragraph contained in Article V,
of that certain Deed of Dedication made and dated June 14, 1993,
which Deed of Dedication is recorded in Deed Book 798, at Page
1520, in the Office of the Clerk of the Circuit Court of
Frederick County, Virginia, said Deed of Dedication relating to
Section I of the Senseny Glen Subdivision.

ARTICLE VI
USE, RESTRICTIONS AND COVENANTS
The Declarant adopts and makes applicable to Senseny Glen
Subdivision, Section II, the Use, Restrictions and Covenants
paragraph contained in Article VI, of that certain Deed of
Dedication made and dated June 14, 1993, which Deed of
Dedication is recorded in Deed Book 798, at Page 1520, in the
Office of the Clerk of the Circuit Court of Frederick County,
Virginia, as amended by instruments dated October 8, 1993 and
February 18, 1994, recorded in the aforesaid Clerk's Office in
Deed Book 806, at Page 834, and in Deed Book 814, at Page 1440,
respectively, said Deed of Dedication and amendments relating to
Section I of the Senseny Glen Subdivision.
ARTICLE VII
EASEMENTS
The Declarant adopts and makes applicable to Senseny Glen
Subdivision, Section II, the Easement paragraph contained in
Article VII, of that certain Deed of Dedication made and dated
June 14, 1993, which Deed of Dedication is recorded in Deed Book
798, at Page 1520, in the Office of the Clerk of the Circuit
Court of Frederick County, Virginia, said Deed of Dedication
relating to Section I of the Senseny Glen Subdivision.
ARTICLE VIII
GENERAL RESERVATION
The Declarant adopts and makes applicable to Senseny Glen
Subdivision, Section II, the General Reservation paragraph
contained in Article VIII, of that certain Deed of Dedication
made and dated June 14, 1993, which Deed of Dedication is
recorded in Deed Book 798, at Page 1520, in the Office of the
Clerk of the Circuit Court of Frederick County, Virginia, said
Deed of Dedication relating to Section I of the Senseny Glen
Subdivision.

ARTICLE IX
GENERAL PROVISIONS
The Declarant adopts and makes applicable to Senseny Glen
Subdivision, Section II, the General Provisions paragraph
contained in Article IX, of that certain Deed of Dedication made
and dated June 14, 1993, which Deed of Dedication is recorded in
Deed Book 798, at Page 1520, in the Office of the Clerk of the
Circuit Court of Frederick County, Virginia, said Deed of
Dedication relating to Section I of the Senseny Glen
Subdivision.
ARTICLE X
As an additional Article to the Senseny Glen Subdivision,
the Declarant expressly adopts the following with regard to
Section II, of the Senseny Glen Subdivision:
1. The Declarant, their successors and assigns, reserves
unto themselves the right to use any and all of the utility
easements as noted on the plat attached hereto, for the benefit
of any adjacent land that the Declarant owns, has any interest
in, or any land that Declarant acquires in the future that is
adjacent to the land described herein.
The Subdivision of the land as shown on the plats of
Senseny Glen Subdivision, Section II presently recorded, or to
be recorded, is with the free consent and in accordance with the
desire of the undersigned DECLARANT, and is in conformity with
the provisions of "The Virginia Land Subdivision Act" as are
applicable, together with the applicable ordinances and
regulations of the governing body of the County of Frederick,
Virginia, or other agency having jurisdiction thereof.
The designated "Common Areas" are not dedicated hereby for
use by the general public but are dedicated to the common use
and enjoyment of the homeowners in Senseny Glen Subdivision,
Section II.
